This letter serves to inform your office that the attached Negative Declaration was issued by the
Planning Board for the above-referenced subdivision of the property identified as SCTM# 1000-
52-5-55. This subdivision was approved by the Planning Board on February 8,1982.
When the Planning Board processed this subdivision application, the applicant filed Declaration
of Covenants and Restrictions as required and fulfilled all of the conditions of approval.
Accordingly, the Planning Board signed-off on the subdivision. From our perspective, this is an
approved map. However, for one reason or another, the approved subdivision map was never
filed with the County. It is my understanding that the current property owner, Andrew Cassidy, is
in the process of correcting this matter with the Health Department so that the County will
recognize the lots. I hope the information we have provided will help with your review.

Dear Mrs. Cassidy:
After review of your revised maps, please be advised that under
subdivision regulations they are unacceptable for approval as they
do not reflect the proposal for which a Public Hearing was held,
specifically, your surveyor has changed lot three and four from
their original forrn,~or do they reflect the maps our office referred
to the Suffolk County Planning Commission, Department of Environmental
Conservation and the Suffolk County Department of Health Services.
Please refer to our resolution dated February 8, 1982 which authorizes
the Chairman to endorse approval; such authorization was subject to the
applicant meeting those conditions stated within six (6) months from
date of resolution. Because this has expired, the Planning Board can-
not take further action unless an extension for approval is granted by
the Board. If such is granted, you would be required to supply the
board with three copies of the original subdivision map which was ap-
proved by the board and a copy of the covenants and restrictions filed
with the County Clerk's Office. As an alternative you may withdraw
the present application and resubmit a new application and maps; This
would entail new referrals to state and county agencies, along with a
public hearing on the new proposal.
Kindly advise this office if you wish to withdraw your present applica-
tion or if you would request the board to consider an extension on the
application presently before the board.

Dear Mrs. Cassidy:
The fOllowing action was taken by the'Southold Town Planning Board,
Monday, February 8, 1982:
RESOLVED that the chairman of the Southold Town Planning Board be
authorized to endorse approval on the subdivision map entitled Marie
Cassidy, located at Arshamomaque, subject to meeting the following
conditions within six (6) months from date of resolution:
1. The lot lines of Lots 1, 2, and 3 shall be moved northerly
to provide the maximum lot area possible for Lot 4 to in-
sure ample room for siting of house, well, and sewage dis-
posal facility on the lot so that there will not be any
interference with any residence, well, or sewage disposal
facility on any other property.
2. The question of stormwater disposal within the right-of-
way shall be resolved before approval of this subdivision
is granted to insure that no runoff from the right-of-way
will be discharged into the wetlands.
3. No sanitary disposal facility shall be installed or con-
structed within 100 feet of the upland edge of the tidal

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on January 6,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Marie Cassidy", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map sub-
ject to the following nine conditions deemed necessary to help preserve the
natural and aesthetic attributes of the shoreline of Arshamomaque Pond:
1. The lot lines of Lots 1, 2, and 3 shall be moved northerly to pro-
vide the maximum lot area possible for Lot 4 to insure ample room
for siting of house, well, and sewage disposal facility on the lot
so that there will not be any interference with any residence, well,
or sewage disposal facility on any other property.
2. The question of stormwater disposal within the right-of-way shall
be resolved before approval of this subdivision is granted to in-
sure that no runoff from the right-of-way will be discharged into
the wetlands.
3. No sanitary disposal facility shall be installed or constructed with-
in 100 feet of the upland edge of the tidal wetlands.
4. No stormwater runoff resulting from the development of the subdivi-
sion or any of the lots shall be discharged directly into the tidal
wetlands.
5. Erosion and sediment control measures shall be required during and
immediately after construction on each lot to insure that stormwater
runoff will not carry eroded and other deleterious materials into the
tidal we tlands.

6. A conservation or scenic easement having a minimum width of 50 feet
shall be established along the upland edge of the tidal wetlands to
insure that no development adverse to the present aesthetic and en-
vironmental quality of the shoreline will take place.
7. No lot lines shall be changed in any manner at any future date un-
less authorized by the Southold Town Planning Board.
8. Approval of this subdivision shall be made subject to the subdivi-
sion's meeting the requirements and standards of the Suffolk County
Department of Health Services.
9. The above conditions shall be filed as covenants and restrictions
in the office of the County Clerk on or prior to the granting of ap-
proval to this subdivision.

DESCRIPTION OF ACTION
The minor subdivision of Marie Cassidy is a four-lot subdivision
located in Arshamamaque.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency. Applicant should be aware
that a permit may be required because of proximity
to the wetlands.
The Suffolk county Department of Health Services has
indicated it agreement with the lead agency designation.
Prior to commenting on the sanitary facilities a test well
and a test hole would be necessary.
The project will meet all the requirements of the Code of the
Town of Southold Subdivision of Land Regulations.

2, 1981, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Marie Cassidy", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to return said subdivi-
sion as incomplete for the following reasons:
1. It is questioned whether this subdivision can be developed in its
entirety as presently laid out because most of the turnaround area
of the right-of-way and approximately one-third of the area of Lot
4 consists of tidal wetlands. (See enclosed map.)
2. It is questioned whether Lot 4 is a buildable lot if a 100 foot set-
back from the tidal wetlands is required for sanitary disposal
facilities.
