RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled Schweiger and Murray located at Southold was submitted to the Planning Board on April 21, 1983 and, filing fee of $75 was paid on November 7, 1983, WHEREAS, appublic hearing was held on said subdivision application and plat at the Town Hall, Southold, New York on December 17, 1984 at 7:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of Schweiger/ Murray for approval of said subdivision plat prepared by Rod Van Tuyl dated Apr. 18, 1983, June 29,1983, Nov. 15, 1983 and lastamended Mar. 8, 1984, be approved and the Chairman be authorized to endorse approval on said subdivision plat. Your recent decision, on April 19, 1989, requiring Alternate Road Specifications (Section AI08-42B) for this driveway causes several problems for us. The driveway in question represents an accomodation by Elizabeth Blake Schweiger, the original seller and current neighbor, for access to our property via right-of-way over her property. Our property is improved by a single one-family dwelling. The proposed driveway will be used only by us for this residence. Both Ms. Schweiger and Ms. Murray have completely separate driveways to their homes. The most serious restriction involves a lawful restriction upon the original sale deed, transacted December 31, 1986 (see Bargain and Sale Deed, enclosed) which prevents said right-of-way from being improved with asphaltic, concrete or any other impervious surface. This restriction, which was in full accordance with Southold Town guidelines and specifications in effect at that time, further specifies that the driveway may be improved to a width of ten feet with a stone base, blend, or other pervious material. The sale agreement was transacted in good faith to preserve the integrity of all three properties. As the proposed driveway serves a subdivision in name but not in reality, we would be very grateful for your approval of driveway specifications as recorded in the original deed-of-sale restriction.
