Dear Ms. Schweiger and Murray:
The following action was taken by the Southold Town Planning Board,
Monday, January 7, 1985.
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled Schweiger and Murray located at Southold
was submitted to the Planning Board on April 21, 1983 and, filing
fee of $75 was paid on November 7, 1983,
WHEREAS, appublic hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York on December 17, 1984
at 7:30 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of Schweiger/
Murray for approval of said subdivision plat prepared by Rod Van
Tuyl dated Apr. 18, 1983, June 29,1983, Nov. 15, 1983 and lastamended
Mar. 8, 1984, be approved and the Chairman be authorized to endorse
approval on said subdivision plat.
Please forward three (3) blueprint surveys of this map in order for
the Chairman to endorse approval thereon.

Dear Sirs:
We are writing to request your reconsideration of the
requirements for the driveway to our property on Lighthouse Road
in Southold (District 1000, Section 051.00, Block 02.00, Lot plo
001.000 and 002.00). Your recent decision, on April 19, 1989,
requiring Alternate Road Specifications (Section AI08-42B) for
this driveway causes several problems for us.
The driveway in question represents an accomodation by
Elizabeth Blake Schweiger, the original seller and current
neighbor, for access to our property via right-of-way over her
property. Our property is improved by a single one-family
dwelling. The proposed driveway will be used only by us for this
residence. Both Ms. Schweiger and Ms. Murray have completely
separate driveways to their homes.
The most serious restriction involves a lawful restriction
upon the original sale deed, transacted December 31, 1986 (see
Bargain and Sale Deed, enclosed) which prevents said right-of-way
from being improved with asphaltic, concrete or any other
impervious surface. This restriction, which was in full
accordance with Southold Town guidelines and specifications in
effect at that time, further specifies that the driveway may be
improved to a width of ten feet with a stone base, blend, or
other pervious material. The sale agreement was transacted in
good faith to preserve the integrity of all three properties.
As the proposed driveway serves a subdivision in name but not
in reality, we would be very grateful for your approval of
driveway specifications as recorded in the original deed-of-sale
restriction. We are, at the same time, concerned about
maintaining ready private and town-emergency access to our
property. We intend to keep said driveway scrupulously groomed
through all seasons. The wearing surface would consist of
bluestone blend, fully compacted on a dug-out, sand-mixed base.
In addition, the driveway currently used by Elizabeth Schweiger
for her property represents a second (alternate), unobstructed,
straight-line means of access to our property if necessary.

itself lead agency with regard to the State Environmental
Quality Review Act in the matter of the minor subdivision of

Southold. An initial determination of nonsignificance has
been made.

Dear Ms. Schweiger:
After an on site field inspection and discussion of
same at our regular meeting, Monday, July 25, 1983, our
Board noted the fOllowing:
(1) Lot number one would contain an existing
dwe lling.
(2) Lot number two would contain a beautiful
barn.
(3) Lot number three would contain an existing
dwe 11 ing .
(4) The area of each lot proposed are over one
acre and less than two acres; present zoning
requirements.
(5) It appears to be a reasonable proposal and
would not pose a problem to the area.
It was the concensus of the Board to await a determina-
tion with regard to an area variance from the Zoning Board

The public hearing on this application was held on August 31, 1983.
Upon application of ELIZABETH SCHWIEGER and MARGARET MURRAY, Light
House Road, Southold, NY for a Variance to the Zoning Ordinance, Article
III, Section 100-31, Bulk Schedule, for approval of three proposed lots,
each having insufficient area, width and/or depth, and/or insufficient
setbacks of existing buildings due to location of lot lines, located at
the east side of Light House Road, Southold; County Tax Map Parcels
No. 1000-51-02-001 and 002.
The board made the following findings and determination:
By this appeal, applicants seek permission to re-divide premises
containing 4.754 acres into three separate parcels, to wit: Parcel
1 containing 1.15 acres, Parcel 2 containing 1.55 acres, and Parcel
3 containing 1.69 acres. Parcels 1 and 3 would retain an existing
one-family dwelling, and Parcel 2 would retain a barn structure sub-
stantial in size and structurally sound. The board agrees with the
reasoning of applicants and find the "barn" structure to be of histori-
cal value and under the circumstances could and should be converted
for one-family dwelling use, as proposed on this separate parcel of
land.
In considering this appeal, the board determines: (1) that the
variance request is not substantial; (2) that no adverse deteriment
to adjoining properties will be created; (3) that no adverse effects
will be produced on available governmental facilities of any increased
population; (4) that the circumstances are unique; (5) that the
relief requested will be in harmony with and promote the general
purposes of zoning, and (6) that the interests of justice will be
served by allowing the variance, as indicated below.
On motion by Mr. Goehringer, seconded by Mr. Sawicki, it was
RESOLVED, that Appeal No. 3153, application for ELIZABETH
SCHWIEGER and MARGARET MURRAY, for approval of insufficient area,
width and/or depth of three proposed parcels with existing build-
ings, BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:

In May of 1969, I purchased a house and a large barn on
1,6)8 acres of land on Lighthouse Road. At the time I was told
that the barn was mOre valuable than the house, but after much
thought, I decided to move into the house and develop the barn_later
I realized that a building of its size and beauty needed mOre
land around it, so in 1974, I arranged to buy the adjoining ),116
acres of land with my friend, Margaret L. Murray.
I put a new roof on the barn to Protect it from wind, rain,
and snow, and had architectural designs drawn up so that it could
be converted into a house that would maintain its beautiful
structure and Preserve its historic value.
I thought of the barn, not only as something precious left
Over from the Past, but also as a kind of security fOr myoId age
which is, unfortunately, almost here - or perhaps IS here, dePending
upon the definition of "old." I Prefer to think of "old" in terms
of the barn's age and that is well OVer One hundred years - Civil
War vintage. I am not that YETI
I want the barn to be Preserved. I don't want to see it rot
and decay as so many lovely old buildings have done, because no one
bothers to keeP them up; however, in order to preserve it, I need
to be able to know that it can be rented or sold as a seParate
sin~lp.-~Rmily dwelling.
Unfortunately, both Margaret Murray and I procrastinated
having this land sUbdivided. We're both very concerned about
ecology, environment and the dangers of over populating this fragile
area on this fragile planet. This is why we were never seduced by
the arguments to have the barn converted into a~artments, 0 r any
sort of multiple dwelling.
I've enclosed photographs of the barn in the hope that you
will see its beauty and help us to Preserve it by allowing a variance
