RE: Minor subdivision of Frank Sawicki,
Southold. SCTM #1000-51-3-12.2
A review of this file reveals the following items:
1. The applicant originally applied to the Planning Board for permission to
Subdivide his land ~ into two lots. (1982)
2. Applicant received this Board's approval with conditions, which were never
met. Consequently, that approval is no longer valid.
Info, arch of 1987, the applicant returned to the Planning Board; this time to
request permission to create four lots; three of which were not in
conformance with the required lot widths.
The applicant applied to the Zoning Board of Appeals for three variances
to reduce the lot width from 150' to 133 to 137 ± feet. Parcel was represented
as being 15± acres.
5. Planning Board notified ZBA that subject parce~had been split off a
larger parcel without its approval (letters of June 18,1987).
6. ZBA granted variances.
7. The Planning Board subsequently granted sketch approval of the p~ed
map subject to condition that the final map show the entire 12.~parcelo
8. On December 9,1~ the applicant submitted a final map which showed that
the 12.1 acre piece was originally part of a 28.5 acre parcel that had
been split in 1979 without benefit of Planning Board review and approval.

This map was followed by a letter adopted January 18th, wherein a claim
was made that the 1979 splitting of Sawicki's property should not be
part of the subdivision map. The grandfather list did not show this subdivision.

On January 6th, the ~unty Health Department notified the Planning Board
that it would not review the porposed subdivision as a minor subdivision
because of the fact that there would be 5 lots on 28.5 acres.
11. Five days later, the Health Department approved the minor subdivision
map. A calco the Health Dept. requesting an explanation, resulted in
a verbal message from John Bredemeyer; the gist of which was that
~_article 6, which requires subdivision approval, was adopted after 1979,
therefore the Sawicki property could not be reviewed as a major subdivision
Mr. Bredemeyer said another letter from the SCDHS would be forthcoming.
This letter has not been received yet.
12. On January 20th, Mr. Raynor's letter was recieved. This letter included
a letter from Sawicki's attorney , which pertained to the 1979 sale.
Analysis:
The Planning Board is within its rights to require that all subdivision
applications before it rectify unauthorized split-offs by their inclusion
on the subdivision map. The Planning Board should be consistent in its review
of subdivision proposals. Consistency will enable it to discourage unauthorized
splitting of property. If this practice is not discouraged, the Plann~g Board
will continue to find itself undermined by those who chose to flo~t ~ authority.
If the practice is prevented, the Planning B~d will be able to effect better
subdivision design. Discouraging this practice will also prevent the creation
of land locked or difficult to develop parcels.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR part 617,
Section 617, Section 617.10 and chapter 44 of the Code of the
Town of Southold, notice is hereby given that Southold Town
Planning Board, as lead agency for the action described below
has determined that the project will not have a significant
effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Frank Sawicki is for 4 lots on
15.061 acres located at Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because there has been no correspondence received from the
Suffolk County Department of Health Services in the alotted
time, it is assumed that there are no comments or
objections from that agency.
Because there has been no correspondence received from the
NY State Department of Environmental Conservation in the
alotted time, it is assumed that there are no co~ents or
objections from that agency.
The project will meet all the requirements of the Code of
the Town of ~outhold Subdivision of Land Regulations.

The Planning Board has reviewed the file for the above
mentioned proposal, and offer the following input for your
consideration:
1. The Planning Board, in 1982, approved a set off
of 3.6 acres of this property with the stipulation that
it be deeded to & merged with the adjoining property
of Caiola to the East. Apparantly this stipulation has
not been complied with and this file should be withdrawn
if the above proposal is to be pursued by the applicants.
2. We have found evidence that the property (12.1 acres)
was part of a larger piece and we have no record that
the subject property and the adjoining lot were subdivided
through the Planning Board.
3. The Board cannot comment on the layout of this minor
subdivision or whether this is the best layout of the
three proposed lots based on the above information, because
it has not finished its own review of the application.

this review.

WHEREAS, a public hearing was held and concluded on June 18,
1987 in the Matter of the Application of FRANK AND EDITH SAWICKI
under Application No. 3640; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and
familiar with the premises in question, its present zoning,
and the surrounding areas~ and
are
WHEREAS, the Board made the following findings of fact:
1. The premises in question is a 15-acre parcel of land
with 406.70 ft. frontage (lot width) along the south side of
Sound View Avenue and 375± ft. frontage along the north side
of C.R. 48 (a/k/a North Road), in the Hamlet of Southold, Town
of Southold. The entire premises is used for agricultural
purposes.
2. The subject premises is

3. By this application, appellants request a variance for

lots will contain a minimum lot area of 80,000 sq. ft.
4. In viewing the immediate area, it has been found that
a majority of the parcels located on the north side of Sound
View Avenue directly opposite the subject premises have lot
widths/frontages of the same length, or less, and therefore
there will be no substantial change in the character of the
immediate area.
5. It is the position of the Board that the relief
requested is the minimal necessary, particularly since the
lots conform to the zoning code in all other respects and
since there is no other method feasible for appellants to
pursue, other than this variance application... _
In considering this appeal, the Board also finds and
determines:
(a) the percentage of relief requested is not substantial,
at 20% of the requirements;
(b) the circumstances of the property are unique;
(c) there will not be a substantial, detrimental change
in the character of the neighborhood;
(d) there is no other method feasible for appellant
to pursue other than a variance;
(e) this project is consistent with the spirit and
intent of zoning;
(f) the grant of this variance will not affect govern-
mental by increased population;
(g) in view of the manner in which the difficulties
arose and in view of all the above factors, the interests
of justice will be served by granting relief, as condi-
tionally noted below.
Accordingly,-on motion by Mr. Grigonis, seconded by
Mr. Goehringer, it was
RESOLVED, to GRANT the relief requested under Appeal
No. 3640 for lot width of proposed Lot #1 of 135.79 feet;
Lot #2 of 137.56 feet, Lot #3 of 133.35 feet, as applied
in the Matter of the Application of FRANK AND EDITH SAWICKI
SUBJECT TO THE FOLLOWING CONDITIONS:
1. There be no future lot-line changes or lot area
adjustments;
2. Future construction shall conform to the require-
ments of Column A-80 of the Bulk Schedule as to setbacks, etc.
