SCTM #1000-51-3-12.2 A review of this file reveals the following items: 1. The applicant originally applied to the Planning Board for permission to Subdivide his land ~ into two lots. (1982) 2. Applicant received this Board's approval with conditions, which were never met. Consequently, that approval is no longer valid. Info, arch of 1987, the applicant returned to the Planning Board; this time to request permission to create four lots; three of which were not in conformance with the required lot widths. The applicant applied to the Zoning Board of Appeals for three variances to reduce the lot width from 150' to 133 to 137 ± feet. Parcel was represented as being 15± acres. 5. Planning Board notified ZBA that subject parce~had been split off a larger parcel without its approval (letters of June 18,1987). 6. ZBA granted variances. 7. The Planning Board subsequently granted sketch approval of the p~ed map subject to condition that the final map show the entire 12.~parcelo 8. On December 9,1~ the applicant submitted a final map which showed that the 12.1 acre piece was originally part of a 28.5 acre parcel that had been split in 1979 without benefit of Planning Board review and approval. o This map was followed by a letter adopted January 18th, wherein a claim was made that the 1979 splitting of Sawicki's property should not be part of the subdivision map. The grandfather list did not show this subdivision. 10. On January 6th, the ~unty Health Department notified the Planning Board that it would not review the porposed subdivision as a minor subdivision because of the fact that there would be 5 lots on 28.5 acres. 11. Five days later, the Health Department approved the minor subdivision map. A calco the Health Dept. requesting an explanation, resulted in a verbal message from John Bredemeyer; the gist of which was that ~_article 6, which requires subdivision approval, was adopted after 1979, therefore the Sawicki property could not be reviewed as a major subdivision Mr. Bredemeyer said another letter from the SCDHS would be forthcoming. This letter has not been received yet. 12. On January 20th, Mr. Raynor's letter was recieved. This letter included a letter from Sawicki's attorney , which pertained to the 1979 sale. Analysis: The Planning Board is within its rights to require that all subdivision applications before it rectify unauthorized split-offs by their inclusion on the subdivision map. The Planning Board should be consistent in its review of subdivision proposals. Consistency will enable it to discourage unauthorized splitting of property. If this practice is not discouraged, the Plann~g Board will continue to find itself undermined by those who chose to flo~t ~ authority. If the practice is prevented, the Planning B~d will be able to effect better subdivision design.
