The following action was taken by the Southold Town Planning
Board at a regular meeting held April 7, 1980.
RESOLVED that whereas, a formal application for the approval
of a subdivision plat, entitled Minor Subdivision of Clement w.
Booth was submitted to the Planning Board on December 18, 1979,
and an application fee of $20 was paid on December 18, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and Plat at the Town Hall in Southold, New York, on
March 24, 1980 at 8:00 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision plat and
application,
Now, therefore, be it RESOLVED, that the application of
Clement w. Booth for approval of said subdivision plat prepared
by Roderick Van Tuyl, P.C. and dated February 5, 1980 be approved
and that the Chairman.of the Planning Board be authorized to
endorse approval on said' subdivision Plat.

Gentlemen:
On August 4, 1980 I had a discussion with Hr. Fisher
concerning rearranging lot lines of the property owned by
George Koch and Barbara Koch at Mt. Beulah Avenue, Southold,
New York.
Enclosed please find a copy of the survey of the
premises owned by the Koches by Roderick Van Tuyl, P.C. dated
April 21, 1980. Mr. and Mrs. Koch, as tenants by the entirety,
own the property designated on that survey as Koch, the parcel
being south of the property designated as owned by Booth and
north of the parcel designated as vacant. Barbara Koch in-
dividually owns the parcel noted on that survey as vacant.
I am enclosing three copies of a map of the subject
parcels made by Roderick Van Tuyl, P.C. dated April 24, 1980
showing what the resultant parcels should look like. The prop-
erty to the north on that survey showing the garage and house
would continue to be owned by Mr. and Mrs. Koch as tenants by
the entirety (parcel designated as #1 on the map). Hrs. Koch
would own the southerly parcel indicated as #2. Both parcels
would be in full compliance with the bulk schedule of the Southold
Town zoning Ordinance. It is my opinion that there is no sub-
division in that there are two lots initially and that the result
of the rearrangement of the lot lines would continue to be two
lots. However, Mr. Fisher has directed me to submit this pro-
posal to the Planning Board, which I hereby do.
What the applicants are requesting is that the lot
lines be changed to create two lots as shown on the Van Tuyl
map dated April 24, 1980 and that both lots be legal building
lots.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project will
not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Clement W. Booth is a two-lot
residential subdivision of 6.210 acres located at Southold.
The project has been determined not to have a significant effect
on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because it is more than 300 feet from the tidal wetlands
it is not under the jurisdiction of the New York State
Department of Environmental Conservation.
The Suffolk COcUlty Department of Health Services has
indicated that a precursory review of the subdivision
indicates conditions are suitable for individual sewage
systems; however, problems may be encountered with
obtaining potable water due to high nitrate concentrations.
The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land regulations.

This project is unlisted. Other agencies may be involved but
the optional coordinated procedure for designating lead agency and
determining significance will not be followed. The Southold Town
Planning Board wishes lead agency status with regard to the State
Environmental Quality Review Act.

this project will be received at this office until February 4, 1980.
