This subdivision received conditional final approval on May 24, 1993 . All conditions of approval have been met. The original minor subdivision of Too Bee Realty Corp. which was filed in the County Clerk' s office on April 19, 1991 is to be abandoned and replaced with this subdivision. At the meeting the Board thanked you for designing the project in a manner in the best interest of the Town. It was also noted that as discussed at a prior meeting, the Board was awaiting information from you in regard to an easement for drainage and recreation purposes on your adjacent piece of property. Enclosed please find a copy of the map which was endorsed by the Chairman. The mylar maps, which were also endorsed by the Chairman, must be picked up at this office and filed in the office of the County Clerk. During the course of my talk with Mr. Akris he found that you did not have a copy of the filed map, 9086, with Health Department Approval, dated April 19, 1991 . A copy of that map is attached. At this time TooBee is asking for approval of an amended plot plan (see attached overlay and letter).The Southold Planning Board is in favor of the proposal and is asking for Health Department Approval to complete the process. As you can see, the number of units (4) is identical. The change is in the elimination of the cul de sac and road, with access provided by two driveways for the four homes. TooBee has also deeded a small wetland area and fifteen foot access to the town for drainage. We understand from Mr. Akris that you have asked us to retest the well. An amended subdivision map must be submitted. (Eight copies are required. ) This map must meet the requirements for minor subdivisions. It also must include: a. The wetland/overflow area to be dedicated to the Town; b. The common driveways; c. The proposed building envelope for each lot; d. The location of the firewell. There will be no application fee for the proposed amendment. 2. A short environmental assessment form shall be completed for the revised subdivision. A coordinated SEQRA review was conducted for the original four lot subdivision, and a Negative Declaration was granted. The proposed amendment basically eliminates the road. Therefore, a coordinated review is not warranted, and an uncoordinated review will be conducted. • Amendment to Too Bee Realty December 28, 1992 Page 2 4. The Declaration of Covenants and Restrictions that was recorded for the filed Too Bee Realty subdivision will have to be amended. The revised Declaration must be submitted to the Planning Board for review. Once accepted, it must be recorded, and the Liber and Page number of the recorded document must be indicated on the final map before any endorsement of such. 5. Dedication papers for the wetland/overflow area must be submitted. (I have enclosed an example of an Offer of Dedication for your use. ) 6. When the revised maps are submitted, a revised bond estimate will be prepared. It is the Planning Board' s understanding that part of this amendment includes your placing a restriction on the adjacent property (SCTM# 1000-50-6-4) limiting this lot to one buildable lot. Therefore, a draft of the proposed Declaration of Covenants and Restrictions should be presented as an integral part of the amended subdivision application. You also must obtain Health Department approval for the revised maps. In addition to Numbers 1 thru 5 above, one map with Health Department approval must be submitted before the final hearing will be scheduled. Two ( 2) mylars and five ( 5) paper prints of the final maps, all containing a valid stamp of Health Department approval, will be required prior to any endorsement of the final map. No structure or building shall be placed within the conservation easement area. The terms "structure" and "building" shall be interpreted as including swimming pools, patios, storage buildings structures for the housing of domesticated animals, boat or other trailers, recreational vehicles, fences, retaining walls and bulkheads. 2 . There shall be no construction of any kind within the conservation easement. 3 . The conservation easement area shall remain in its natural state. It is not to be cleared of the indigenous vegetation of the area. Nor shall it be mowed and planted to grass. The only exception shall be the allowance of one foot path to the pond, not to exceed four ( 4) feet in width, for each lot. 4 . The conservation easement area shall not be filled with either soil, sand, or other debris, including brush. 5. Any disturbance to the land within the conservation easement shall be redressed by the restorations of said land to its prior natural state. The Planning Board' s decision to include the area adjacent to the pond in the parcel to be offered for dedication, was not based on the extent of wetland vegetation in this area. Rather, the decision was based on the Board' s observation that this area is part of the natural drainage area of the pond, and is therefore an integral part of the pond. Mr. Like would pursue the procedures for abandoning the filed map. In addition, he would review the procedures should his client be unable to abandon the filed map prior to the two year time frame established by Real Property Law. The issue of Health Department approval for the 6 lot proposal was discussed. It was decided that the applicant would pursue Health Department approval. If the need should arise, Mark McDonald would also meet with the Health Department. Upon the applicant' s submission of concept sketches of the clustered layout, Mr. Kiernan would schedule a meeting with representatives of the Planning Board, the Zoning Board of Appeals, and the Board of Town Trustees. A Yield map containing six ( 6) lots. The amount of wetland, pond and upland area must be indicated for each lot. B. A preliminary Sketch map containing six ( 6 ) clustered lots and indicating that the open space area is to be offered to the Town for dedication. All lots are to be on the "Too Bee Realty" side of the parcel, with the exception of a lot which may include the existing foundation. It is not necessary to construct a road to provide access to the interior lots. However, common driveways must be designed for all flag lots, in order to reduce the number of curb cuts on Lighthouse Road. 3 . The Planning Board will forward the Yield Map and the preliminary Sketch Map to the Board of Town Trustees for their review of the wetland delineation. 4. The Planning Board will follow the procedures listed below in accordance with the State Environmental Quality Review Act ( SEQRA) : A. The Planning Board will review the Positive Declaration which was granted on May 23 , 1991. If the new application (six ( 6) clustered lots with the open space to be dedicated to the Town) mitigates the reasons set forth in the Positive Declaration, the Positive Declaration will be rescinded. B. The Planning Board will conduct a coordinated review in accordance with SEQRA for the new application. 5 . It will be necessary for you to apply for area variances for all lots shown on the Yield map which do not meet the minimum requirements for the Residential Low-Density R-80 District. A disapproval from the Building Department will be required prior to your submittal to the Zoning Board of Appeals. If the Planning Board is in favor of the preliminary Sketch Map, it will support your application before the Zoning Board of Appeals. 6 . If the area variance(s) are granted, the Planning Board will proceed with its review of the clustered subdivision in accordance with the Town' s Subdivision Regulations. This will include, but not be limited to, a determination on the sketch plan, a drainage review, and a final public hearing which will be scheduled upon receipt of a complete final application (including Health Department approval) . I trust you will find the above list helpful. Of course, any approvals would be conditioned on the pond and associated areas being offered for dedication to the Town. Although the use of this open space has not been formally discussed by the Town Board, it is the Planning Board' s intent to leave this area in its existing condition.
