Section A 106-36C of the Planning Board's subdivision regulations pro- vides, in part, that "land subject to flooding or land deemed by the Planning Board to be uninhabitable shall not be platted for residential occupancy. . ." Question has arisen as to the board giving any con- sideration in computing area falling below water. As is evident by the map, the proposed lots upland area contain approximately 3/4 acre each. Dear Henry: Following our meet~ng regard~ng the above property, I rev~sed the sketch to show 3 lots instead of 4. All lots are well over one acre in size, w~than upland area of approximately 33,750 sq. ft. on Lots 1 and 2 and 38,000 on Lot 3. All computations are approximate, and would of course be subject to verificat~on by a surveyor. The DEC has verified that they have no jurisdiction. The Board of Health will be satisfied if pools are located 100 feet from the water, and I have ordered a test hole to determine soil composition.
