The public hearing on this application was also held on February 25, 1983.
Upon application of EAST END SUPPLY CO., INC., 203 Front Street,
Greenport, NY for a Rehearing (of Appeal No. 3013) for a Variance to the
Zoning Ordinance, Article VIII, Section 100-81, Bulk Schedule, for per-
mission to construct warehouse building in this "C-Light Industrial
Zone" with insufficient front, rear and side yard setbacks. Location
of Property: South Side of Corwin Street, Greenport, NY; County Tax
Map Parcel Nos. 1000-48-02-02 and 03.
This is a rehearing in the matter of Appeal No. 3013 for East
End Supply Co., Inc. pursuant to its request dated February 1, 1983.
This board unanimously agreed to rehear this application for the
reasons stated in the subject rehearing application, and a.~ublic
hearing was held on February 25, 1983.
The premises in question is located at the northerly side of
Corwin Street, Greenport, and is more particularly identified on
the County Tax Map as District 1000, Section 48, Block 02, Lots 2
and 3. The subject parcel is zoned "C-Light Industrial" and contains
an area of approximately 51,000 square feet with 875 feet along Corwin
Street, inclusive of a 25' strip from Seventh Street and a 50' strip
from Eighth Street, which road strips have been officially abandoned
by the Town. Existing on the premises are two dwelling structures
in disrepair, accessory building, and a 32' by 156' one-story stor-
age building located on the easterly portion.
By this appeal, appellant seeks a Variance to the Zoning Ordi-
nance, Article VIII, Section 100-81, Bulk Schedule to construct a
warehouse building with an office of approximately 21,000 square
feet first-floor area on the westerly portion of this property,
eliminating existing dwelling structures and accessory building
thereto. The existing building on the easterly portion of the
premises will be exterior-modernized and is to remain a one-story
structure. The proposed new construction aG the westerly portion
of the premises will be approximately one-half at two-story height
and the other half one-story height.

Facts were submitted at this hearing which were not originally
presented in the prior hearing. The type of construction proposed
is a prefabricated ~tructure and is available only in multiples of
ten feet. Applicant asserts that compliance with this board's prior
decision would result in underutilization of 20% of the lot area.
If the board reconsidered the depth of the building to permit one
additional foot, a prefabricated building 90' in depth could be
utilized, verses an 80' building.
In considering this appeal, the board determines that the
variance request is not substantial in relation to the requirements
of the zoning code; that the circumstances are unique; that by allowing
the variance no substantial detriment to adjoining properties will be
created; that the relief requested will be in harmony with and promote
the general purposes of zoning; and the interest of justice will be
served by allowing the variance, as indicated below.
On motion by Mr. Douglass, seconded by Mr. Sawicki, it was
RESOLVED, that Appeal No. 3080, application of EAST END SUPPLY
CO. INC. for permission to construct warehouse with insufficient
front, rear and side yard setbacks in this "C-Light Industrial" Zoned
District, be and hereby IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS:
1. Al~gnstruction from the rear property line shall be n__qo
closer tha~eet;
2. There shall be a minimum of twenty [20] parking stalls on
the premises;
3~ Ail loading and unloading must be done on the premises only
[with no protrusion of vehicles onto the streets];
4. Screening shall be provided as submitted on applicant's
10/16/81 plan;
5. Ail storage must be contained within the buildings;
6. Acquiescence by the Planning Board of the above conditions;
7. Suffolk County Planning Commission review pursuant to
Sections 1323, et seq. of the Suffolk County Charter.

SYNOPSIS
Proposed Office and Warehouse
EAST END SUPPLY CO., INC.
This proposal involves a parcel.of land located several hundred
feet to the west of The Incorporated Vilage of Greenport,
twd blocks south of Main Road (Rte. 25), subject to the juris-
diction of the Town of $outhold.
The total parcel measures:

Ail in title of East End Supply Co., Inc., including the
extension of Eighth Stret and one-half (25') of Seventh Street
bounded by Corwin Street on the north and MTA on the south.
The entire parcel is zoned "C" Light Industrial District,
in which office buildings, wholesale storage and warehousing
are permitted uses with Special Exception, subject to site
plan approval by the Planning Board. (Appeal #1537 - May
25th, 1972).
A one-story storage building measuring 32' x 156' (5000 sq.
ft.) is located on the easterly portion of the property.
This building and portions of the vacant land pertinent thereto
have always been used commercially since first developed,
to the best of our knowledge. It is the site of the long-
time grain, coal and oil distributing plant.
The westerly portion of the property contains four dwelling
units (one of which is sealed as a protective measure). Pictures
of this site are being presented herewith along with a picture
of the company's present headquarters.
Unusual
to this parcel are the following:
Railroad (MTA) adjoining the entire southerly
boundary. Previous existing siding has been
removed.
2) Shape and dimensions of the property. Long,
narrow and tapered.
3) Vacant parcel to the east (Jernick), presumably
held for commercial purpose.
4) Existing commercial storage warehouse to the
west - (125-127 Main Street Corp.).
5) Easterly portion of property has been used
commercially for many years. (Coal and grain
storage, bulk insulation storage, furniture
storage, marine equipment storage).
6) Residential character of this property is
depressed and undesirable.
It is proposed to construct a permanent warehouse and office
building of approximately 21,000 square feet on the west
portion of this property, eliminating existing buildings.
Simultaneously, the existing building on the easterly portion
will be exterior-modernized, conforming with the new, providing
a total of approximately 26,000. square feet of covered space.

Remainder of the land wil be devoted to off-street parking,
loading areas, screening and landscaping. This facility
will be principal location for East End Supply Co., Inc.
and related subsidiaries. The nature of those activities
is such that exterior advertising and illumination is required
for security reasons only.
East End Supply Co., Inc. has been a domestic New York State
Corporation since 1949 established for the purpose of wholesale
distribution (no retail) of marine hardware, equipment and
related products serving commercial customers nationally
and overseas with its major market in the northeasterly U.S.
Principals and employees (presently 26) are local residents,
being the circumstance from its inception; consequently it
is a substantial stable contributor to the local economy.
Four locations, all in Greenport, owned by the corporation,
comprise the present facility.
Any condition placed on requested variance reducing area
of buildings would raise serious questions of economics of
the plan.
To adhere to the Bulk Schedule would thus be a practical
difficulty and an unnecessary hardship. You, the Board of
Appeals, have the power to vary or modify the application
of the provisions of the Zoning Ordinance when the spirit
is observed, public safety and welfare secured and substantial
justice done.
The applicant submits that the filed plans comply with all
of above considerations.

Gentlemen:
The subject property is located in the
District. Proposed use is permitted in said
Art. VIII, Sec. 100-80 B (2} & (3) of Zoning
'C' Light Industrial
district subject to
Code, Chapter 100.
The minimum requirements for lot area would appear suffi-
cient based on the survey dated May 18, 1982 attached to the
site plan. The building set backs, however, do not meet re-
quirements for front, side, and rear yards under Section 100-
81, Bulk Schedule. Lot coverage for principal buildings is
not given in the Bulk Schedule or in Art. VIII for this District.
Off-street parking requirments are to be determined by the
Planning Board per Art. XI, Sec. 100-112 A, and shall comply
with sub section B,C,D,E, & K of this section.
Off-street loading areas have been provided for and exceed
requirements of Art. XI, Sec. 100-113 A (6) & B. However, two
loading berths are located in the front yard area; this would
not meet requirements under sub section C of this section and
a variance would be necessary.

I am in receipt of your letter dared October 9,
1982. Please be advised as follows:
Your letter of July 12, 1982 states that the two
(2) applications were to be reviewed by the Southold Town
Planning Board. On September 28, 1982 the Southold Town
Planning Board sent a letter to Mr. Lessard with a copy to
your Board and myself. It appears that the Planning Board
has reviewed the submitted site plan and the subject applica-
tions.
At this time the applicant does not intend to sub-
mit a revised site plan to make same comply with the setback
and lot coverage zoning provisions. The applicant hereby
requests that the Zoning Board of Appeals schedule a hearing
on November 15, 1982 for the variance application. The appli-
cant further requests that the special exception hearing be
adjourned until subsequent to the Zoning Board of Appeals'
decision concerning the variance application.

Dear Mr. Lessard:
Our Board made an on site field inspection of the property captioned
above and discussed same at our meeting held September 20, 1982.
The Board noted insufficient rear yard and side yard setbacks. The
Board was in agreement that the percentage of the lot coverage was
too high for the area and stated the area coverage could-be decreased
with a two-story building on the site.
After thorough discussion, the following action was taken:
RESOLVED that the Southold Town Planning Board refer the site plan
of East End Supply Co. to the Building Inspector for certification.

My recc~mendation for the new construction would be that
the property facing Corwin Street should have curbing, if the
builder so desires. Otherwise, .a fence could be erected around
the perimeter and grass seed planted. Either of these would
be in keeping with the homes in this area.

The public hearing on this application was held on November 18, 1982.
Upon application for EAST END SUPPLY CO., INC., by Irving L.
Price, Jr., Esq., as agent, 828 Front Street, Greenport, NY for a
Variance to the Zoning Ordinance, Article VIII, Section 100-81, Bulk
Schedule, for permission to construct warehouse in this "C-Light
Industrial" Zoned Distric~ with insufficient front, rear and side
yards as shown on building plans accompanying the appeal application.
Location of Property: South Side of Corwin Street, Greenport, NY;
County Tax Map Parcels No. 1000-48-2-2 & 3.
The board made the following findings and determination:
The premises in question is located at the northerly side of
Corwin Street in Greenport and is more particularly identified on
the County Tax Map as District 1000, Section 48, Block 02, Lots
2 and 3. The subject parcel contains an area of approximately
51,000 square feet with approximately 875 feet along Corwin Street,
inclusive of a 25' strip from Seventh Street and 50' strip from
Eighth Street, which road strips have been abandoned by the town.
Existing on the premises are two dwelling structures in disrepair,
accessory building, and a 32' by 156' one-story storage building
located on the easterly portion.
By this appeal, appellant seeks permission to construct a
warehouse building with an office of approximately 21,000 square
feet first-floor area on the westerly portion of this property,
eliminating existing dwelling structures and accessory building
thereto. The existing building on the easterly portion will be
exterior-modernized and is to remain a one-story structure. The
proposed new construction at the westerly portion of the premises
will be approximately one-half, two-story, and one-half, one-story
construction.
In considering this appeal, the board determines that the
variance request is not substantial in relation to the requirements
of the zoning code; that the circumstances are unique; that by allow-
ing the variance no substantial detriment to adjoining properties will
be created; that the relief requested will be in harmony with and
promote the general purposes of zoning; and the interest of justice
will be served by allowing the variance, as indicated below.

RESOLVED, that Appeal No. 3013, application of EAST END SUPPLY
CO., INC. for permission to construct warehouse with insufficient
front, rear and side yard setbacks in this "C-Light Industrial"
Zoned District, be and hereby IS APPROVED SUBJECT TO THE FOLLOWING
CONDITIONS:
1. Ail construction from the rear property line shall be
no closer than 13 feet;
2. There shall be a minimum of twenty [20] parking stalls on
the premises;
3. Ail loading and unloading must be done on the premises
only [with no protrusion of vehicles onto the streets];
4-. Screening shall be provided as submitted on the applicant's
10/16/81 plan;
5. Ail storage must be contained within the buildings;
6. Acquiescence by the Planning Board of the above conditions;
7. Suffolk County Planning Commission review pursuant to the
Suffolk County Charter, Sections 1323, et seq.

The public hearings concerning this application were held on January 13,
1983 and February 4, 1983.
Upon application for S~L CAIOLA, by David E. Kapell as agent,
400 Front Street, Greenport, New York for a Special Exception to the
Zoning Ordinance, Article V, Sections 100-50(B) [3] and 100-51, Bulk
Schedule for permission to construct condominium units (multiple
dwelling units) to be located at the South Side of C.R. 48, Southold,
NY; County Tax Map Parcel ID No. 1000-51-05-002. Zoning District: M-1.
The board made the following findings and determination:
This is an application for a Special Exception pursuant to Article
V, Section 100-50(B) [3] of the Southold Town Zoning Code to construct
10 condominium (multiple-dwelling) units on a 2.4-acre parcel located
at the south side of County Road 48, Southold, and more particularly
known as District 1000, Section 51, Block 5, Lot 2. Each condominium
unit will have a total living area of 1370 square feet. The lot area
applied to each dwelling unit will be a minimum of 9,000 square feet.
Applicant proposes five dwelling units in each of two separate struc-
tures and a maximum height of 35' will be adhered. The ingress and
egress and parking areas will be covered with gravel to allow proper
drainage within the site and is subject to approval by the N.Y.S.
Department of Environmental Conservation. All setbacks of these
two structures will meet the minimum requirements of the zoning code
as shown on plan dated 5/12/82 and received 12/14/82.
It is noted for the record that alterations or new proposed
construction other than as shown on the site plan approved herein
shall be subject to review and approval by the Building Department,
Planning Board, Board of Appeals, and any and all other agencies
which may be involved.
The premises in question is zoned M-1 "Multiple-Residence" and
is not at this time improved with construction. The subject premises
fronts along C.R. 48 approximately 241 feet, has an average depth of
542 feet, and fronts along Arshamomaque Pond 193.12 feet (at a tie
line).
It is also noted for the record that the subject premises is

located in an A-4 Flood Zone with a minimum elevation of eight feet
above mean sea level and shall be subject to those regulations
pertinent thereto (Chapter 46 of the Town Code).
Upon personal inspection of the premises in question, the board
finds the topography of the land to be at varying elevations and the
most easterly section of the premises is an area of environmental con-
cern. This board finds it imperative to restrict this area along the
easterly boundary of the "curbing and private road" from any construc-
tion, and that the following conditions be complied with.
On motion by Mr. Douglass, seconded by Mr. Sawicki, it was
RESOLVED, that Appeal No. 2930, application for SAL CAIOLA for
a Special Exception to construct ten condominium units in two separate
buildings, BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDI-
TIONS:
1. Placement of a retaining wall 1½' in virgin soil and 1½' out
of ground in lieu of proposed curb shown on plan dated 5/12/82, which
retaining wall shall run along the easterly side of the parking area
and up through the proposed cul-de-sac.
2. That the retaining wall be constructed of 2" tongue and
groove C.C.A. planking with a double 4' by 6' header, or equivalent.
3. This retaining wall shall be maintained at all times;
4. Ail water shall be retained on site (no runoff).
Location of Property: South Side of C.R. 48, Southold, NY;
County Tax Map Parcel ID No. 1000-51-5-2.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis, Doyen,
