Dear Mr. Strang:
The Southold Town Planning Board, at a meeting held on Monday, October 7, 2002,
closed the final public hearing and adopted the following resolution:
WHEREAS, the site plan is for a 1,400 sq. ft. warehouse addition and a 4,992 sq. ft.
warehouse replacement; and
WHEREAS, the Lewis Family Partnership is the owner of the property known and
designated as Lewis Marine Supply, located at 230 Corwin Street in Greenport; and
WHEREAS, a formal application for approval of this site was submitted on August 8,
2002; and
WHEREAS, the Southold Town Planning Board, on September 9, 2002, determined
that this action is classified as Type ]E and not subject to review under the State
Environmental Quality Review Act (Article 8), Part 617; and
WHEREAS, the Zoning Board of Appeals granted the setbacks variances as requested
for an addition to the warehouse building, with alternative relief concerning the total
building area at 50% of the total lot area, subject to the condition that there be no further
variances to increase lot coverage greater than 50%, Application No. 5109; and
WHEREAS, this site plan was certified by the Building Department on October 7, 2002;
and
Lewis Marine Supply - Pa.qe Two - October 8, 2002
WHEREAS, the Town Engineer has reviewed the drainage calculations and the
Planning Board has accepted his recommendation for approval; and
WHEREAS, on August 13, 2002, the Architectural Review Committee reviewed and
approved the proposed site plan application; and
WHEREAS, a final public hearing was closed on the Lewis Marine Supply application at
the Town Hall, Southold, New York on October 7, 2002; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore
RESOLVED, that the Southoid Town Planning Board grant final approval on the
surveys, dated January 3, 2002 and last revised September 26, 2002, and authorize the
Chairman to endorse the final surveys subject to a one year review from date of building
permit.
Enclosed please find two copies of the approved site plan; one for your records and one
to be submitted to the Building Department when you apply for your building permit.

Public Hearings
Under the current site Plan application procedure, the process for
reviewing a site plan application is: a public hearing is not scheduled and
held by the Planning Board until after, among other things, the site plan
has received a stamped Health Department approval.
The applicant shall now have the following options:

the site plan application and have the Planning Board vote on the
proposed conditional site plan prior to the applicant receiving

As per your request, I have reviewed the site plan for the above referenced project.
The drainage calculations and proposed drainage system are satisfactory and meet the
minimum requirements of the Town Code.
The Site Plan indicates the installation of new curbing and raised planting areas along
the existing edge of pavement on Corwin Street. This new curbing should be set back
approximately eight (8') feet from the existing edge of pavement to provide an adequate
shoulder. This shoulder area should be paved with asphalt to match the typical section
shown on the plan.

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The subject property is a 67,131 sq. fi. lot located on the comers of
Ninth St. and Corwin St. in Greenport. The lot has two front yar~ fac[ngthe two streets The property is
located in the LI Light Industrial Zone District, and is improved with an office and warehouse buildings as
shown on the site plan prepared January 3, 2002, making reference to information shown on a survey made
by Peconic Surveyors dated November 14, 2001.
BASIS OF APPEAL: Building Department's Notice of Disapproval dated February 12, 2002, denying an
application for a permit to build additions and alterations to existing industrial buildings a commercial
buildings, for the following masons: (1) Article XXIV, Section 100-242A concerning a proposal that creates
a new nonconformance or increase of nonconformance or new nonconformance, relative to setbacks, lot
coverage, and linear building foot~ge greater than 60 fi. facing one street, and (2) Article XIV, Section 100-
143C for the reason that the new construction is setback less than 100 feet from the right-of-way, and the
structure will have 480 fi. of linear frontage; and (3) Section 100-142 concerning rear yard setbacks at 8 fi.
and 11.7 feet, side yard of zero feet instead of 20 feet, and total sides of 25 feet instead of 40 feet; and (4)
Section 100-142 and Bulk Schedule concerning additional lot coverage of 2400 sq. ft., increasing the lot
coverage from the existing 48+- percent to 53 percent.
RELIEF REQUESTED: Applicant requests multiple variances as noted above and more particularly detailed
on site map dated January 3, 2002, and elevation plan SK*I dated May 31. 2002.
REASONS FOR BOARD ACTION: Please also see hearing and record in its entirety.
The property is adjacent to residences on the north side of Corwin St. and dwelling units on the west side of
Ninth Street. The Long Island Railroad (MTA) is located on the south of this property, there is no other land
area available. There is little or no area available to improve circulation on the site or to increase tim safety.
The small amount of open area left is necessary for clearance bctwccn buildings, circulation on the site, and
tim and safety.
The Town records concerning this site indicate many variances which allowed substantial relief from the
codes.

and welfare of the community.

At the conclusion of this meeting, the Board indicated that philosophically they could not be in
favor of increased lot area over that which is allowed by zoning, but that this aspect is a zoning
issue. However, they are sympathetic to the fact that failure to receive the relief requested from
your board could force the existing business to relocate out of the area, thereby having a negative
impact with regard loss of employment and a vacant building. There was also a comment with
regard to the fact that the sought increase in lot coverage is minimal. Another concern is access
for firefighting equipment on the south side of the building, which may be mitigated by the fact
that the entire existing building is sprinklered.

The Planning Board reviewed this matter at its Work Session on June 3,2002 and offers
the following comments:
The Planning Board is concerned that the proposed lot coverage is now up to 51%,
and while the increment is small, the total coverage is now extensive. While we are
aware of the need for this company to continue to grow, and the importance of the jobs
created by the expansion, the fact remains that this company may be approaching the
limits of the site with regard to parking, fire safety, and overall circulation on the site.
The Planning Board notes that there may be as little as 8 ft. clearance in the rear yard,
adjacent to the LIRR tracks. While the building is sprinklered, the building as very long
and may require access by emergency equipment.
The site is tight on parking, and while the proposed parking layout satisfies the
parking requirements of the Code, operationally the Planning Board has asked that
the parking stalls, and the entrance to the site be clearly.marked, and that the parking be
clearly defined t~om the street, which now merges into the subject lots.
Additional landscape elements may also be required, as the Site Plan is further
developed. A formal review of the Site Plan cannot begin until an application and the
correct fees are submitted.
In view of the constraints facing continued expansion of this site, The Planning Board
would recommend that if the proposed variances were granted, that no future floor area
be allowed beyond what is now proposed.
