Page 2 SEaR Negative Declaration - McSherry/O'Neill March 27, 1995 Reasons Supporting This Detennination: This proposal is to set off a 5,000 square foot parcel from an existing larger 12,460 square foot parcel. Both parcels have existing houses; thus the proposed action will not result in a more intensive use of the land and is consistent with zoning. An Environmental Assessment Form has been submitted and reviewed, and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The applicant will have to comply with the requirements of the Suffolk County Sanitary Code (SCSC) and all relevant standards of water supply and sewage disposal systems. Design and flow specification, subsurface soil conditions and site plan details will have to be approved by the Suffolk County Department of Health Services (SCDHS). This impact is not considered significant due to the anticipated project compliance with established requirements of the SCSC and the SCDHS and the required relevant permits. In the cellar I noticed l:hat sever"l low poinl:S"of the new heal:ing pipes have 110 drains pro- vided. 1 did not inspect the pipes in the crawl area. Also, the two-story porch repairs haven't been complel:ed. 'rhe other dwelling faces Wiggins Street and is algo to be repaired. The bUilding c()nl:ains a living room, one bedroom, kitchen, laundry-pantry, and a bathroom. I told Mr. Hudson that the second floor is uninhabil:able, and the new piping must have drains Pl"oVided at all low points. There is also an accessory building Which they are to raise and repair. In reviewing the prior history of our records, we note the following: (a) alternative relief was granted by the ZBA in March 1988 approving two substandard lots, each with a single-family dwelling structure and use; (bl an Article 78 determination was made by Justice Orgera in October 1988 deciding that the issues of continuous two-family use of one of the structures was not addressed before the ZBA by the applicant and relief granted by the ZBA was annulled without prejudice to any party.
