WHEREAS, Henry Arbeeny is the owner of the property known and designated as SCTM# 1000-59-7-31, located at the northwest corner of County Road 48 and Kenny's Road in Southold; and WHEREAS, this minor subdivision, to be known as Henry Arbeeny Minor Subdivision, is for 4 lots on 7.592 acres; and WHEREAS, a variance for insufficient area of Lot 4 was granted by the Zoning Board of Appeals on September 21, 1989; and WHEREAS, the Southold Town Planning Board, pursuant to the State Environmental Quality Review Act, (Article 8), Part 617, declared itself Lead Agency and issued a Negative Declaration on April 29, 1987; and WHEREAS, a final public hearing was closed on said subdivision application at the Town Hall, Southold, New York on January 18, 1989; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; and be it therefore, RESOLVED, that the Southold Town Planning Board approve and authorize the Chairman to endorse the final survey dated October 31, 1989. You will recall, in our letter to you of November 2, 1988, we requested an explanation of the items included in the bond estimate prepared for the above subdivision. As suggested by your office, we did, thereafter, contact a representative of Sidney B. Bowne & Son in this regard. Their response to our inquiry was unsatisfactory, and they tossed the proverbial ball right back in your lap. If we understood correctly, their estimates are compiled from an extensive and generalized "master list" and not, apparently, from either their own or the Planning Board's previous recommendations, which are specific to the project. Their opinion is that the Planning Board is responsible for reviewing the estimate and eliminating the extraneous or inappropriate items included therein. I can't agree with the above position. Although I believe the Planning Board should exercise control, I also believe it should be able to rely more fully on the expertise and judgment of its engineering consultants. It doesn't take an expert to indiscriminately furnish a list of items from a "master list" We feel very strongly that this bond estimate requires your careful scrutiny and reevaluation, as it is grossly incompatible with the parameters of this project. We respectfully request that, before making a judgment on this matte~, it be referred hack to the Planning Board enabling them to make proper response to this office and to the developer. Dear Mr. Orlowski: The Suffolk County Planning Co,~nission at its regular meeting on July 6, 1988 reviewed the proposed subdivision plat, entitled, "Subdivision Map of Henry Arbeeny" referred to it pursuant to Section A14-24, Article XIV of the Suffolk County Administrative Code. After due study and deliberation it resolved to approve said map subject to the following seven conditions that are deemed necessary to help preserve the traffic safety and carrying capacity of Middle Road, a county road. No lot shall be subdivided or its lot lines changed in any manner at any future date unless authorized by the Town of $outhold Planning Board. Ail driveways on Middle Road shall make an angle of at least 70° and preferably 90° with the county road. Each lot having frontage on Middle Road shall have a turnaround provision, such as a T-shaped shunt, so that a vehicle leaving a lot will not have to back out into the traffic stream on the road. Ail stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow out onto the right-of-way of Middle Road. In order to minimize the number of access points on Middle Road and to insure that there will not be any conflicts between the points of access that are created, consideration shall be given to creating a plan indicating the placement of access for Lots 4 and 5, and the parking areas on these lots. Consideration shall also be given to establishing, through the creation of easements, co~non use of access points and parking by these lots; that is, allowing a vehicle to pass from a parking area on one lot to another parking area on a lot without the vehicle having to reenter the road. Conditions 1-4, inclusive, shall be filed as covenants and restrictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Town Board or Planning Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required. 7o The final map shall bear the following note: A Declaration of Covenants and Restrictions has been filed in the Suffolk County Clerk's office which affects lots in this subdivision. SEVENTH. The standards for the installation of the piping and the hydrants shall be in accordance with the following specifications: (1) polyvinyl chloride pipe (AWWA Spec. C-900) Class 150 or equal with push-on joints/couplings and underground metallic warning tape or (2) cement-lined ductile iron pipe (AWWA spec. C151-76) class 150 or equal. Any pipe and all joints and ? $ )arts of the system must be able to stand pressure of not less hah 150 pounds per square inch. EIGHTH. The VILLAGE will supply without charge to ;NER sufficient water to make essential te~ts and to leave the system on final approval completely sanitary, said supply to be not less than ~pounds per square inch. NINTH. The WORK shall be inspected by the VILLAGE which hereby delegates its Superintendent of Utilities or his designee full power of inspection hereunder. OWNER will grant complete freedom of access to all parts of the premises and the WORK for inspection. The VILLAGE will have an authorized inspec- tor at the site at all proper times so as not to delay the work. No work not passed by the inspector will be accepted by the VILLAGE. No backfilling shall be done until the pipe and the work in the trench has been approved and tested by the inspector. TENTH. OWNER will, and by this agreement does, upon approval of the completed work, which the VILLAGE will indi- cate to the OWNER in writing, dedicate the mains to the VILLAGE, and does hereby grant and convey to the VILLAGE an easement and right of way for the purpose of laying, relaying, repairing, operating and maintaining water mains, both supply and distribu- tion, and appurtenances, including domestic services and fire hydrants in the full length and width of the now or hereafter existing public or private streets in the premises as shown on the attached map. The rights of way and easements shall also extend five feet on either side of the mains to be laid pursuant to this agreement, whether or not such distance shall be within the road- way The mains and appurtenances and the rights of way and ease- ments shall be deeded to the VILLAGE its successors or assigns. and shall forew~r remain the property of the. VILLAGE, its suc- :essors or assigns. The rights of way shall be over the lands erein described and marked Exhibit "E". ELEVENTH. The easements herein granted are not exclusive, and other easements in said streets may'be granted by OWNER to other persons or corporations maintaining public services !throughout the development, provided that no other mains are set within two feet internally of the water main and no poles are set into the ground within two feet either side of a line on the sur- face directly above the mains. If a gas, sewer or other main or service necessarily crosses the water mains, OWNER will advise the VILLAGE in writing of the exact location of the intersection forthwith upon installation and shall supply maps to the VILLAGE showing the exact locations. Said intersections shall not be per- mitted without prior written consent of the VILLAGE. TWELFTH. If OWNER contracts with a third party for the WORK, as the parties contemplate will be the case, the VILLAGE will examine the proposed contract, plans, and specifications, and promptly furnish OWNER and the third party contractor with a writ- ten statement of what part, if any, of the WORK proposed in such contract should be revised to insure approval by the VILLAGE. Upon completion, inspection and approval the VILLAGE will supply water to the development and the owners the lands therein at the rates and pursuant.to the rules and regu- lations of the VILLAGE in force from time to time. FOURTEENTH- A one inch (1") service line shall be installed to each lot, with a curb stop near the property line. This installation is under the direction and supervision of the Greenport Water Department. FIFTEENTH. The VILLAGE requires a cash payment of thousand five hundred and seventy dollars ($2570.00) per dwelling unit to be recorded as a consumer hook-up deposit and placed in a key money reserve account to help gain new production supply, so as to assure OWNER of future adequate supply. It is contemplated by this contract that the OWNER anticipates construction of dwelling units. Upon execution of this agreement, the OWNER shall deposit with the VILLAGE the sum of twenty-five hundred dollars seventy dollars ($2,570.00) times three (3) dwelling units for the total of eight thousand two hundred and fifty dollars ($8,250.00) in bank or certified check. This per dwelling unit amount may be amended from time to time, depending on findings by the VILLAGE'S consulting engineerS, Holzmacher, McLendon and Murrell, P.C. or their successors and upon approval by the villag~ Board of Trustees. In the event that the per dwelling unit cost P& is increased or decreased between the execution of this agreement Lnd the application for water- the OWNER shall pay the VILLAGE, upon application for water, the difference between the per g unit amount specified herein and the per dwelling unit unt required by the VILLAGE at the time of the application of water times the number of dwelling units covered by said applica- tion. Said payment shall be in bank or certified check and shall be paid to the VILLAGE prior to any hook-up for water. In the event that the OWNER does not complete the project, as contemplate, by this agreement or does not make application for the full number of dwelling units allotted or specified herein, the VILLAGE shall keep all funds so deposited by the VILLAGE as the sole exclusive property of the VILLAGE and the OWNERS shall have no claim thereon. SIXTEENTH. The WORK contemplated by this agreement shall be completed within twenty-four (24) months of the date of this agreement. It is hereby mutually agreed and understood that all specifications in reference to materials used for the construction of said system, the WORK to be completed, and/or water to be supplied shall be changed to conform with the then current standards as set by the VILLAGE of Greenport Utility Department, its successor, or its authorized agent at each such interval. SEVENTEENTH. The OWNER agrees that upon completion of the work in accordance with any contract made pursuant hereto, :itle to the mains, hydrants, valves, and fittings so installed ~nd laid shall be deemed dedicated to the VILLAGE, and the OWNER hall in confirmation of such passage of title, execute an instru- ment transferring and assigning to the VILLAGE the title, free and clear of all encumbrances or liens to the mains, hydrants, valves and fittings so laid and installed and if required by the VILLAGE shall procure from all persons having an interest in the land in which said mains lie a proper easement in favor of the VILLAGE for the perpetual maintenance, repair or replacement of said mains and fittings including the right to extend the mains and to connect them with other mains to be laid the VILLAGE. A visual inspection was made of the site from which it was determined that a low point on Kenny Road exists approximately 100 Ft. south of the northern boundry of the site. This is not indicated on the plan. The existing elevations as shown are too infrequent and are therefore insufficient for determining low areas or direction of flow on existing roads. Resubmit and provide additional elevations at 50 Ft. intervals (featurin§ high & low points) for a distance of 200 Ft. past the boundaries of the site on all existing, adjoining roads boardering the site. With this information, possible problem flooding areas can be located and drainage structures situated by the designer. A review of the sewer topographic maps indicate a minor depression to the north of the site, and generally the ground is sloping away from the site. Therefore, stormwater runoff from adjoining areas should not pose any threat to this site. Lot 3 does not meet the minimum zoning requirements (A-80) for lot width at the building setback line, 175 Ft. is required. The plan indicates the required width is achieved approximately 240 Ft. in from the road. At this location, all side yard requirements could be met. The Suffolk County Department of Health Services has no objection to our designation of lead agency. The Department has received an application which is incomplete. It appears that the project can be servced by Subsurface sewage disposal system and a public water supply. The applicant has proposed public water for lots 4,5, and 6 and well water for lots 1,2 and 3. The department has requested that public water be provided for all six parcels in the proposed subdivision. If the applicant does not want to provide public water service to lots 1, 2, and 3, then he has to request a Board of Review determinatin for his proposal.
