Route 48, Southold SCTM# 1000-59-4-8 & 9 Dear Mr. Grey, This letter will confirm the site plan agreements reached with you at the Board's work session of January 19, 1999. Board and Batten or a siding similar to the residence or a combination of the two will be placed on the entire side of building F and D as shown on the site plan. In addition, the siding will be placed on the front of buildings A, B, C, D, & F with a fifty (50') return. The mansard shown on the current elevation drawing will not be used. The roof will have a higher pitch than shown in your overlay. The pitch is to be in keeping with the size and mass of buildings A, B, C, D, & F. 3. The five foot landscaping in front of buildings A, B, C, D, and F will not be required. Additional items that you had agreed to in your letter of August 12, 1998, are: · West and south property lines to be planted with a 25' wide vegetative buffer consisting of a staggered double row of evergreens 8' to 10' tall planted 10' on center· A staggered double row of evergreens is the minimum required by Town Code where a Business zone abuts a residential zone· · A mix of evergreen varieties should be used to prevent species related disease from destroying the plantings,such species as Red Cedar, Douglas Fir and Junipers are recommended. · Excavation of the parking and building area to same grade as the forty foot contour at the north west side of the property. · Elevation drawings · Lighting poles and type and wattage of outdoor lighting should meet the code requirements for height and shielding. The proposed location, type and wattage must be shown on the revised site plan. · Move street trees inside property line · Establish a serpentine berm as shown on enclosed sketch and plant with evergreens Single story buildings must be thirty five feet 35' from rear property line Sign sketch, to scale showing materials, lighting and color The Architectural Review Committee recommendations you accepted are: · Windows should be rectangular with shutters · Doors and siding should be the same shade of gray and the standing seam roof a dark green · An irrigation system for plantings A revised site plan and elevation drawing must be submitted showing these changes. As you know, the Planning Board cannot take final action on your site plan application until the final hearing is closed and the moratorium expires on June 8, 1999. PORT OF EGYPT (Garrett Strang recused himself).. ,William Leiblein described a 40' by 260' building, 35' high, to be used for winter boat storage in recks two or three boats high. The front, facing Route 25 and just East of the Sea Shell Restaurant, would be sliding doors. I wrote your Board and the Town Board and others some on this proposal. On reading the minutes I note that raised some of the same issues. comments others A few days after I turned in my comments on the proposal for a new self storage complex I was lnformed that Gray 'had lost' the Southold (Horton's Road) complex and there was a new owner. Further that all but one employee had quit 'owing allegience to Gray'. The other quit also. As my communication in writing to the Planning Board noted I hve had units at Southold Self-Storage since late 1994when a complex legal situation ended, temporarily, in my being put out in the Street. I contend that the actions of various Southold Town employees were major ~ctors in this event. My choice was to use a Riverhead Storage unit but as time went by my only help claimed insufficient time to help me to Riverhead so I ended up at Mr. Gray's (also leaving things all over the nelghborhoold). At that time various small businesses operated with Southold Self-storage as a base. Ny near or immediate neighbor used a generator and built or~mpaired something and loudly told Mr. Gray he did~t~O~nt me as a neighbor - seemingly because I ~ve off bad vibes. A lot has happen4 since then in Jlmbo storage pag. cluding the changes in Feather Hill (from prospering to almost abandoned), I think the home occupation law at least effected occupancy of the Cutchogue industrial complex and I am sure other things I have little knowledge of, The secretary to this Board said that Mr. Gray uses many corporate names partially because your Board urged him to do so due to confust~n over his projects, I think on this matter your Board may have been wrong, Like others who addressed you I believe the time to determine economic viability of significant business and building proposals ~s now, I am not business oriented but I am smart and I would like the Town in all its ~ulses and the Planning Board to start discussing new rules and l~ws which would introduce this element of any significant proposal within the Town, During my time (to date) at first Southold Self-S~oarage which is now Liberty Self-Stor with a Ohio nominal ownership - various problems have arisen (one) Mr. Gray did not permit credit cards whether due to financial problems ore'her ~easons I am unsure, Two) there were various msnagement problems, legal problems, upkeep problems and other problems which Mr. Gray should have been awareof and I hold him responsible for, I recall baying found a place to live being in a financial position where I could not pay both rent and storage and~eo was ready to move my belongings but I was locked out, Southold Self-Storage took one mont~posits usually on lts~ntals. / That money was returned within~lrty days of leaving a clean and empty unit within certain other provisions, Management with or without Gray's personal knowledge would not permit me to 3. In reviewing Southold Self storage someone in the Assessors said that the Bank (what bank?) took a 1.500.000 bath on Feather Nil~. Wh~t ~nd of community encou~ges this by allowing further such actions b~y the .perp' and what pmeciselY if true does this mean for the Town and the country? I would really like to know. I realize this country ls in a general eoon~mio upturn but I QuestiOn what is hap~ening to basic ethics, morality and stander. An earlier speaker mentioned the various ~nclards for successful operation of self-storage businesses. Active pay~ occupancy. Legal conflicts in or out of court. Units requiring repair. Units empty and so on. Of course, the usual mortgage and related expenses, employees, maintenance and so on versus income also is important ~ consider. I described the storage units as places of last resort. As noted many small businesses still keep things in ~hese ~]nits and until the ch~nge of mnagement a variety of people used the olace as a true base. One of the other lost buildings was rented or leased to a mna~er to develop a transport and packing business. That too went into ltigatlon and that manager was also working from a financial deficit. I also~ew the manager and his family prior to that and the son of Joan Terry, Scott, who was manager for the last three years at times ~rklng close to 12 hours a day seven ~ys a week, Joan Terry sharing in book keeping and other ~sponsibillties sd apparently a basic employee of Gray. The p~ce is in transition. It has out of State ownership and it is unclear who will run it or how. I do raise certain other questions Bout this application and the running of Southold Self Storage. These include the dsoosition of abandoned property (some things left are abandoned). The statement in Mr. Gray's application that the new units will not require a public bathroom. The question about what sounds to me a huge heating apacity and ~ether these are to be hsated units with electricity and air conditioning and are they really t~'o read story and other questions. I do not mad blue prints comfort- ably. Are thed~posits interest bearing and separate from other accounts a~ they would be in general real estate. And ~robably more. While these may not at present be part of what ~he law allows you to consider in making a decision these are what miMht be considered and put generally into law in the future. The office at the present complex has a bathroom which is assumed to be publicly available. Other than that it has occasional outdoor water faucets and minimal o ut of mach electricity here and 5. $~mbo st~age m there. ^ toilet accessible ~l~ or mch of the time i~ close to a uece~slty esnecially if other 'rules' are enforced. An example l~ you are not supposed to leave thin~s unattended lu they~rd as onposed to the units if put anything into the yard atall. Often to search organize or what have you it is necessary to violate this rule. If you do not have a bathroom you then have to (theoreticallly) put everything back into the uni* and go somewhere else then ~t~rn and start all over. So I sug2est that this needs some discussion. Further. since the yard or office anager often locks up the office I ~s~e~t toilet facilities outside the office might ~e mndated. The matter of disposing of either abandoned things by the comDlmx owner or manager and by individual tenants might also be a subject you should ~view. A variety of reason for the &posit is to pay the units. At one tl~e a large things are involved and a partial for getting rid of waste and cleaning sale took plsce for abandoned things and ~nants were also allowed to sell but that was declared illegal by the Town. Disposition of repairable or usable material is some- thing I would like to see discussed with charities and others to see how to m,aningfully use unwanted things. A lot of waste may be generated by these units. In regard to the question of planting the ZBA does mandate for instance in relation to tennis courts that evergreen screening plants be installed and maintained. Bankruptcy and these other types of abandonment must be considered. Controlling the times o$ ~raffic. the que§tion of traffic lnterruotion also seem legitimate concerns. I am typing this in the storage unit and other problems m with the new mnagement has arisen. I suggest Mr. Gray's business practices permitted and acouraged by the Town of $outhold should be very carefully considered in the present in regard to the past and the future -as should those of other businesses with equivalent potential and visible problems. I~ summer, the area of the present facility nearest to Town Hall is largely hidden or unnoticeable due to planting. However, the planting is not evergreen so in winter the ~ro- tection is lost. Mandating and allowing space for large everareen planting and demanding it mai~tained forever (which the EBA has done ret~nnis courts) might) ~ight help solve the problem. I am concerned about ~covering the area should either Mr. Gray fall or the business become outdated. Are there alternatives to the massive blacktopping present at the present unit. If the business falls, how can the land be recovered for a different use. There are other t~chnlcal problems I can share with the present units - not b~ving yet seen the new plans I ~on't know if they have beencorrected. Leaking is one of them. According to Town records the North Pork Bank took a 1,500, 000 loss when Feather Hill 'was returned to the bank'. I am told that this my be on paper only but certainly the econo, lc background of Jimbo should be considered. 2. Gray/storage At ~resent due to economic stress, summer occupancy ~nd other things the storage business does seem to be a u~eful adjunct of the local economy butpBrhaDs one which ~ght be best considered in_relation to overall goals. Other problems at the ~resent unit include limited access to a single toilet (the office is often unpersoned). Due to the fact that I stillrent there I hesitate to go into some other matters. The building on Route 48 in Cutcho~e was an eyesore when built. While I hnve grown used to seeing it its necessity is unclea/'. I believe it was built prior to the home occu~ation law which made fewer oeo~le need such a facility. ?he oresent storage ~]nlts have served a variety of purposes not the least of which is a base for the homeless. The Board examined the line of sight, as shown on the drawings, and determined that the east and west two story buildings would look more uniform if the mansard was continued to the rear on the east and west sides so as to give viewers a more uniform look. In addition, as previously discussed the depth of all proposed mansards should be increased by two feet, holding the proposed top elevation and lowering the bottom elevation two feet. The Board also recommends the following: · Use of black vinyl chain link fence. · A mix of evergreen varieties should be used to prevent species related disease from destroying the plantings. Such species as Red Cedar, Douglas Fir and Junipers are recommended. Alberta Spruce is not recommended. Several parking spaces should be eliminated in front of the house and additional landscaping should be placed in this area. Revise parking calculations to reflect this change. · Evergreen plantings should be shown on the site plan on the outside of the chain link fence. Show fire well locations on revised site plan as indicated on the enclosed diagram from the Southold Fire District Elevation drawings are required showing the peaked roof of both one story buildings. New mansards two feet deeper on all buildings including extending the mansard to the rear of the east and west side of the two story east and west buildings. Show revised drainage calculations and retention basins on the site plan as per enclosed Town Engineers recommendations. A highway work permit issued by the Suffolk County Department of Public Works. See letter of March 25, 1998, from Paul Campagnola, Permits Engineer, enclosed. Site Drainage calculations should utilize the Equation V = ARC to establish the required drainage. This is the typical formula used when designing for leaching basins rather than open sumps. The rainfall intensity should remain attwo (2") inches and the runoff coefficient should be one (1) for all buildings and pavement areas. The landscaped areas are minimal and do not appear to impact the overall runoff that could be generated for this site. I would recommend that the design calculations be revised accordingly and the required quantity and size of leaching basins should be provided. 2. The basins as indicated on the odginal plan show a uniform spacing throughout the site. Depending on the total number required, it might be more suitable to consolidate pool locations to allow for a more uniform and even pavement transition between inlet grates. These basins should be connected using corrugated traffic bearing pipe with a minimum diameter of fifteen (15") inches. 3. Ail roof drain leader pipe should be connected directly to the basins by way of underground pipe. Size of pipe and location of pools connected to each building should directly correspond to the volume of water calculated for each watershed area. All pools or groups of pools should be numbered to verify total quantity of drainage provided. The size of each pool should be indicated on the plan to eliminate confusion during construction. The leaching pool detail also indicated a variable depth of 8 to 12 feet in depth and the design indicated that all pools were to be 12 feet deep. 5. The revised contours at the north west corner of the proposed parking lot appear to have been labeled in reverse. This should be reviewed and corrected. Kassner, Site Plan Reviewer Planning Board Office Town of Southold Main Road, Southold, N.Y. 11971 Re~ Proposed Self-Storage Facility for Jim Gray Dear Bob: Based on our review of the submission for the above referenced property on Monday, November 24, 1997, the committee submits the following report · Firstly, the board expresses our concern for constructing this type of facility at such a highly visible location on a major thoroughfare of our community, surrounded as it is by farmland. Given that this project is permissible under the current code, we feel that more should be done to reconcile the buildings to their environment. At a minimum, we recommend the individual buildings all be provide with gable end or hipped roofs, to indicate some sensitivity to the historic, and most of the recent structures in the area. We would hope these buildings would try to resemble, or at least show some sensitivity to local barns or greenhouses. With regards to the landscaping, we are in favor of anything that can be done to shield the project from view from all directions, with more landscape buffer to be provided along the northern edge of the property.. One specific concern is on the Site Plan, which indicates a chain link fence surrounding the property, with a line of evergreens on the inside of the fence. Site Drainage calculations should utilize the Equation V = ARC to establish the required drainage. This is the typical formula used when designing for leaching basins rather than open sumps. The rainfall intensity should remain attwo (2") inches and the runoff coefficient should be one (1) for all buildings and pavement areas. The landscaped areas are minimal and do not appear to impact the overall runoff that could be generated for this site. I would recommend that the design calculations be revised accordingly and the required quantity and size of leaching basins should be provided. 2. The basins as indicated on the original plan show a uniform spacing throughout the site. Depending on the total number required, it might be more suitable to consolidate pool locations to allow for a more uniform and even pavement transition between inlet grates. These basins should be connected using corrugated traffic bearing pipe with a minimum diameter of fifteen (15") inches. 3. All roof drain leader pipe should be connected directly to the basins by way of underground pipe. Size of pipe and location of pools connected to each building should directly correspond to the volume of water calculated for each watershed area. All pools or groups of pools should be numbered to verify total quantity of drainage provided. The size of each pool should be indicated on the plan to eliminate confusion during construction. Originally, 20 pools were called for and only 19 were indicated on the map. The leaching pool detail also indicated a variable depth of 8 to 12 feet in depth and the design indicated that all pools were to be 12 feet deep. 5. The revised contours at the north west corner of the proposed parking lot appear to have been labeled in reverse. This should be reviewed and corrected. The total storaye area of 37,600 square feet would require 38 park/ny spaces , The office would require one space for 100 square feet of office floor area. Ovsianik: Parking for all uses at this site as per Town Code 100-191. The applicant has never filed a site plan application for the existing metal building. Our records indicate that the Building Department permitted the erection of r_his metal building in 1988 without requiring the owner to obtain a Special Exception from rhe Board of Appeals to expand a use that was permitted by Special Exception only. Furthermore, the Buildin~ Department did not require the fiHn~ of a site plan. Accordingly, we have no records with which to answer your questions. We would appreciate your obtain/n~ from the applicant a copy of a site survey showing the location of ail structures and the square footage of same on the site so thai we may calculate the park/n~ requirements and answer your request for suggestions on park/n~, screen/n~ and lands caping. The Board is not in favor of the variance request by the Pudge Corporation for two commercial buildings each having a proposed width of one hundred thirty feet (130')and a setback of approximately fifty (50') feet. The current code change limits building width parallel to the road to sixty feet (60') and requires maximum building setback of 100 feet (100') in this General Business (GB) Zone. The current code was recently changed for the express purpose of preventing the massing of building structures along the road, which is the primary negative feature of strip development, and of this proposed project. The Planning Board had no objection to a prior variance request (the first since adoption of the code), namely Island Ale (Oest House) Brew Pub. In that case, the applicant requested a variance to expand the width of a proposed brewery and pub from 60' to 120' in width. However, the setback of the structure at more than 140' from the road, the building design and the extensive landscaping were significant mitigating factors. The impact of the proposar by Pudge Corporation: a two story windowless storage buildings, each 130' in width and 177 feet in depth, surrounded by a parking lot, bordered by just 25' of landscaping at the perimeter, and set back at half the required distance: will be considerable. The Planning Board strongly recommends against the issuance of this variance; which would have the practicai effect of nullifying the legislative intent of Section 100-103. A. and C. The Board has made its position known to the applicant, and is willing to work with the applicant on an alternative site design in order to achieve his objectives without requiring the variance.
