Jason Luhrs and his friend Fred Glasser purchased two 3 acre lots offof Chestnut and
Glasser in Southold maybe 2 years ago. Jason got permit to build his home and it is
finished. (. Fred has not chosen to build yet)
Jason is ready to close on his property and can't get a CO because of problem with
driveway/roadway He was planning to put a 15' gravel road in-
Right of way goes through wetlands???
Boufis(?) checked with Jamie Richter and Jason was told there was a problem which
dates back to previous owners who were brothers (Robert and William Rapp a/k/a RHR
malty) who sub-divided property around 1989 At that time town required asphalt road
with curbing, catch basins and fire wells and a bond was posted. No work was ever done-
According to Jason the town is withholding the CO because they want the work done.
Jason was inquiring - wasn't that what the bond was for???No one seems to be able to
tell him where the bond is or went. He wants to know if either the town of the seller has
the bond.
Accord. to Jason Boufis/Richter/Verity want to know how he ever got the building
permit in the first place..
Jason says he's in a catch-22 situation
Jason can't close on his property, is a 29 y.o persosn and says he hasno money left and
needs his mortgage. He was able to get a mortgage extension until U23.but is paying
hefty interest. Jamie Richeter told Jason to doo the work would cost him about 17k
Property is located at 1132 Chestnut Road
As an aside - Jason claimed Mr. Sawicki had property next door and had no problems
and put in a dirt road= wondering where the equal treatment is/was

DECLARATIONS OF COVENANTS AND RESTRICTIONS
by ROBERT C. RAPP, WILLIAM E. RAPP and C.J. PATRICK HIBSON, d/b/a'
RHR REALTY CO., a New York partnership, having its principal
place of business at 112 Maple Place, Port Jefferson, New York,
hereinafter referred to as the DECLARANT, as the owner of
premises described in Schedule "A" annexed hereto (hereinafter
referred to as the PREMISES) desires to restrict the use and
enjoyment of said PREMISES and has for such purposes determined
to impose on said PREMISES covenants and restrictions and does
hereby declare that said PREMISES shall be held and shall be
conveyed subject to the following covenants and restrictions:
1. DECLARANT has made application to the Suffolk County
Department of Health Services (hereinafter re-
ferred to as the DEPARTMENT) for a permit to construct,
approval of plans or approval of subdivision or
development on the PREMISES.
2. WHEREAS, the test wells sampled for the PREMISES
indicated a ground water supply that had contamination
in excess of the minimum drinking water standard
and/or guidlines of the State of New York and
contained excess of the following : nitrates
WHEREAS, the County of Suffolk Department of Health
Services has agreed to issue a permit only if there be
a record covenant that the necessary water conditioning

equipment be installed so as to meet the quality
standards for drinking water; it is DECLARED and
COVENANTED by DECLARANTS, their heirs or successors~
and assigns forever, that no residence upon the above
described property will be occupied prior to the
installation of the necessary water conditioning equip-
ment so that the water, when conditioned, meets the
said minimum quality standards for drinking water of
the State of New York and evidence of the same is
furnished to the Suffolk County Department of Health
Services for their written approval.
The DECLARANT, its successors and/or assigns shall
set forth these covenants, agreements and declarants
in any and all leases to occupants tenants and/or
lessees of the above described property and shall,
by their terms, subject same to the covenants and
restrictions contained herein. Failure of the
DECLARANT, its successors and/or assigns to so
condition the leases shall not invalidate their auto-
matic subjugation to the covenants and restrictions.
All of the covenants and restrictions contained herein
shall be construed to be in addition to and not in
derogation or limitation upon any provisions of local,
state, and federal laws, ordinances, and/or regulations
in effect at the time of execution of this agreement/
or at the time such laws, ordinances, and/or regulation
may thereafter be revised, amended, or promulgated.

This document is made subject to the provision of
all laws required by law or by their provisions to be
incorporated herein and made a part hereof, as though
fully set forth.
This aforementioned Restrictive Covenants shall be
enforceable by the County of Suffolk, State of New
York, by injunctive relief or by any other remedy in
equity or at ]aw. The failure of said agencies or
the County of Suffolk to enforce the same shall not
be deemed to affect the validity of this covenant nor
to impose any liability whatsoever upon the County of
Suffolk or any officer or employee thereof.
These covenants and restrictions shall run with the
land and shall be binding upon the DECLARANT, its
successors and assigns, and upon all persons or
entities claiming under them, and may be terminated,
revoked or amended by the owner of the premises only
with the written consent of the DEPARTMENT.
If any section, subsection, paragraph, clause, phrase
or provision of these covenants and restrictions shall,
by a Court of competent jurisdiction, be adjudged
illegal, unlawful, invalid, or held to be un-
consitiutional, the same shall not affect the
validity of these covenants as a whole, or any other
part or provision he~eof other than the part so
adjudged to be illegal, unlawful, invalid, or
unconstitutional.

The following items must be submitted in order for the Planning
Board to proceed:
You must submit an affidavit that upon approval the
property involved in the lot line change will be merged
with the adjacent property, and will not become a separate
parcel.
You must submit the metes and bounds description for the
two parcels involved in the proposed lot line change. The
metes and bounds description submitted with the application
materials is not for the parcels involved in the proposed
lot line change.
The maps must be presented at a scale of 1 inch equals 100
feet.
The location of the firewell required for the original
subdivision must be indicated. Its omission is misleading,

The Planning Board has reviewed your letter in regard to
amending the approved map to eliminate the proposed fifty (50)
foot right-of-way and to design lots 3 and 4 as flag lots.
In order to proceed with this amendment to the filed map a lot
line application will be required. I have enclosed the
application materials for your convenience.
Please note that the following items must be shown on the
map for the lot line change:
1. The two lots involved in the lot line change;
2. The wetland area and the wetland setback;
3. The 200 foot radius from the pump station;
A notation that the Declaration of Covenants and
Restrictions recorded for the minor subdivision of
RHR Realty has not been invalidated by the lot line
change. The Liber and Page number of the recorded
document must also be noted on the map.
Upon receipt of a complete lot line change application, the
Planning Board will request that the Town Board reduce the bond
estimate to the amount required for the firewell.
