Jefferson, New York, hereinafter referred to as the "Declarant."
W I T N E S S E T H :
WHEREAS, the Declarant is the owner in fee simple of the
real property described in Schedule A, annexed hereto and made a
part hereof; and
WHEREAS, an application for approval of the subdivision
known as "Minor Subdivision of RHR Realty Co.", described in
Schedule A has been filed with the Planning Board of the Town of
Southold; and
WHEREAS, the Planning Board of the Town of Southold has
determined that such subdivision would be granted, provided the
applicant covenants to use its property in conformance with the
zoning ordinances of the Town of Southold and further covenants
that there shall be no further subdivision of lots; and that a
75' conservation easement be placed on Lot #4 as shown on said
map; and
WHEREAS, the Declarant deems it advisable for the best
interest of the Town of Southold to impose certain covenants
upon said property.

4. There shall be no cesspools or other pollution
rendering equipment and installations placed
within a two hundred (200) foot radius of the
well located on the southerly portion of

Said covenants shall run with the land and shall be
binding on the heirs, successors and assigns of the Declarant,
subject to the right of the Town of Southold to amend, modify or
repeal said covenants at any time with the permission of
owner of said property.

In 1989, the Planning Board approved a subdivision map entitled "Subdivision of RHR Realty," a
copy of which is enclosed." The map was filed with the County Clerk and included four lots, two of
which (Lots 1 and 2) had access at a point on Chestnut Road and two additional lots, (Lots 3 and 4,)
which had separate access on Chestnut Road. As you will note, Lots 1 and 2 included a fi~y-foot
right of way, which at its northern end, is impacted by wetlands area.
This right-of-way had a notation on the map that it was "to be dedicated to the Town of Southold."
Essentially, there are two lot owners who will use the right-of-way which comes out on a relatively
narrow street in an existing residential area. Under the circumstances, on behalf of the owners of
Lots 1 and 2, we would like to file a map correction, reducing the size of the right-of-way to a
common driveway and also eliminating the offer of dedication.
I would 1;.ke to discuss this matter with the Planning Board and ask you to confirm that this matter
will be on your agenda on Monday, March 25~.

The approved road construction required by the Planning Board in 1989 for the
construction of the above referenced subdivision has been put on hold. The Town
Attorney's Office is currently investigating the possibility of calling the Bond in an effort to
allow for the installation of the required drainage approved by the Planning Board.
At this time, the owner of Lot # 4 (SCTM #: 1000-59-03-16.5), has completed
construction of a 16' wide access driveway from Chestnut Road to his new residence. This
road is considered suitable for site access and meets the minimum requirements for use by
emergency equipment. Therefore, the matter of site access has been addressed and
should no longer present an obstacle with regard to the issuance of the Certificate of
Occupancy.

ON APRIL 6, 2004:
WHEREAS, the Southold Planning Board by resolution dated July 25, 1988, conditionally
approved the final plat entitled "RHR Realty Corp."; and
WHEREAS, said resolution had imposed certain conditions one of which required the posting of
a performance bond in the amount of $68,666.00 in connection with improvements to be
completed in the subject subdivision; and
WHEREAS, RHR Realty Corp. through Robert C. Rapp had posted International Fidelity
Insurance Company Bond No. 000834334-89 in the amount of $68,666.00 dated June 2, 1989;
and
WHEREAS, the Town Board of the Town of Southold accepted the performance bond of RHR
Realty Corp. and Robert C. Rapp in a resolution dated August 29, 1989; and
WHEREAS, RHR Realty Corp. and Robert C. Rapp have failed and neglected to perform the
required site improvements at the "RHR Realty Corp." subdivision; and
WHEREAS, RHR Realty Corp. and Robert C. Rapp are in default concerning said subdivision.

RESOLVED, that the Town Board of the Town of Southold hereby declares RHR Realty
Corp. and Robert C. Rapp in default and calls upon RHR Realty Corp. and Robert C.
Rapp to perform in all respeets~ all road and drainage improvements in connection with
the "RHR Realty Corp." subdivision or reimburse the Town for the costs and damages which
the Town may sustain by reason of failure of default, and for any and all costs associated with
corrective action the Town takes in the interest of protecting the health, safety, and wellbeing of

The Planning Board has been informed that a request has been made for a certificate of
occupancy on one of the lots on the subdivision known as "RHR Realty Co." To the best
of the Board's understanding, there is an active performance bond on file in the Town
Clerk's Office for this subdivision.
The Planning Board recommends to the Town Board that an attempt be made to pull the
bond so that the road may be constructed. If the road is not constructed, the CO may not

I am referencing tax map number 1000-59-03-16.5 which is 1132 Chestnut Road,
Southold. I am inquiring about a performance bond posted with International Fidelity
Insurance Company in the amount of $68,666. The bond number is 000834334-89 which
lists the Town of Southold as the Obligee guaranteeing that the principal (Mr. Rapp) will
construct, install and complete the improvements stipulated in the minor subdivision
plans.
I have contacted the bond company and determined that the bond would be paid
out if the work has not been performed by the principle. I am requesting that the Town of
Southold call this bond so this work can be completed. I have completed my home and
passed all inspections. The issuance ora CO is being withheld until these improvements
have been made. The bond was put into place for situations exactly like this. The Town
of Southold has an obligation to call the performance bond; otherwise your process of
requiring a performance bond has failed. If we still have conflicts with the issuance ora
CO, I anticipate attending the next Town Board meeting to express my concerns in an
open and very public forum. I am available any time to discuss this situation further.

The above referenced subdivision received final approval from the Planning Board in
1989. This project was approved with specific road construction requirements pertaining to
the two lots that would be accessed from Chestnut Road. As you can see from the
documentation enclosed, road construction including a 20' wide asphalt wearing surface,
drainage structures and a fire well were all required by the Planning Board. Bonds were
posted but the work was never begun.
At this time, I would recommend that you do not issue Certificates of Occupancy or
any other building permits until the issue of site access has been addressed. All road &
drainage construction items, including the Fire Well, that were required by the Planning
Board in 1989 must be completed to receive final approval. When this work has been
finished, my office will prepare & submit a final inspection report to the Planning Board for
their approvals.
Please note that any modifications to the requirements of the Road and Drainage
plan on file will require the formal approvals of the Planning Board. This can only be
achieved by making formal application to the Planning Board office and providing all
necessary documentation that indicates any potential changes to the approved plan.

I am enclosing a copy of the Tax Map for the Glasser parcel which is identified as Lot 16.4. The
proposed road would bisect two residential lots where the homes are virtually on the sideline of
the lot. You will note that the two residential lots identified as #2 and #14 on the Tax Map are
small, as is the lot directly across from the proposed exit to Chestnut Road. A car making a lef~
turn from the proposed road out of the Glasser parcel would virtually go into the front yard of
that lot.
The proposed road entrance is also 30 feet from the intersection of Chestnut and Hickory Roads.
It is difficult to believe that the point of ingress and egress from the Glasser lot could be less
favorably located. Would it not make more sense when tax lot 17.3 located along Kenny Road is
developed, to have a road extending to the 17-acre parcel? I have dotted in a proposed road to
tax lot #26.1.
It xvould not be a problem to include an emergency access over the Glasser parcel or the adjoining
tax map lot, #16.5, since this would be of limited use. However, to place a road at this site going
through a residential area of small lots, leading into the relatively narrow Chestnut Road, while
traversing a wetland, not only seems inappropriate, but both a burden on an existing quiet
residential neighborhood and evading wetland regulations.

covenant #3 states as follows:
"No structures, disturbance or excavation shall occur within the 75' conservation
easement along the edge of the wetland located on Lot #4 on said map, as depicted
on said map."
This, as well as the present 100-foot setback requirement, precludes the use of the right-of-way to
service a lot or lots to the south.
I respectfully request that the Board permit a map correction to be made by a map revision showing
a 25-foot common driveway.

will be required:
a) An environmental review fee of $400.00.
b) A Park and Recreation fee of $2,000.00, as
required in Section A106-38 E. of the Town
Code.

As you know, a Declaration of Covenants and Restrictions
was recorded for the subdivision stating that there shall be no
further subdivision of the lots. Therefore, any further
subdivision of the property would require that the Declaration
of Covenants and Restrictions be amended.
If you wish, the Planning Board will allow you to amend the

2. A 75' conservation easement along the edge of the

This letter is to confirm the understanding between the
Village of Greenport and the RHR Realty Co., who is applying for a
minor subdivision.
The Village of Greenport and RHR Realty Co. have reached an
oral agreement in principal for the purchase of the southerly por-
tion of lot 2, consisting of approximately 1.9 acres for purposes
of a well. (Please refer to the map of the Minor Subdivision of
RHR Realty Co prepared by Young and Young and last dated May 10,
1988 for a pictorial explanation.)
In addition to the purchase of the southerly portion of lot 2,
RHR Realty Co. will also grant a fifteen (15) foot easement over
the southerly portion of lot 1 for the purpose of ingress
and egress and maintenance and repair of pipes together with a
'~ ---non-polution easement over lots 2, 3, and 4.
This agreement in principal is predicated upon a successful
testing of the proposed well site.

Pursuant to our meeting of yesterday, enclosed please
find six copies of the new sketch plan for RHR Realty Co.
Please note the following:
1. The sketch plan proposes a dedication of a
fifty foot strip on the easterly boundary of the property
or a roadway;
2. The sketch plan also designates a 1.9 acre
parcel which is to be conveyed to the Greenport Water
Company for a pumping station. In addition to the
1.9 acre parcel, there is provision made for a 15 foot
right-of-way over Lot #1 for access from Kennys Road
and installation of water lines.
The water company is most anxious to enter into a
contract with RHR Realty Co. We are reluctant to do so
without Planning Board approval;
3. We would like an answer from the Planning Board
concerning the type of access that will be required over
the dedicated area so as to provide ingress and egress
to lots 3 and 4.
Your prompt attention to this letter will be greatly
