This letter will confirm that you and Mr. Illgasch met with this Board
at its work session of February 10, 1997.
As indicated in the Board's letter to Mr. Illgasch of September 11,
1995, the Board requests that a site plan application be filed with this
office for all uses at the above mentioned site. The plan should include
any commercial use of the adjacent property owned by Mr. Illgasch.
It should be noted that with spring approaching, there be no commercial
use of the property with out an approved site plan.

Dear Justice Price:
AS you may be aware by virtue of the Notice of Appearance
which we filed in this matter, the undersigned is counsel for the
defendants in the above-referenced matters. These matters involve
alleged Town Code violations and are scheduled for a conference
before Your Honor on January 17, 1997. We have scheduled a meeting
between my clients (and their environmental consultant) and the
Planning Board, which is scheduled to take place on February 10,
1997. It is our intention to make every effort to try to resolve
or narrow the issues involved during that meeting. In light of the
foregoing, it is respectfully requested that the conference
scheduled for January 17, 1997 be adjourned until the next
available date after February 10, 1997, which is convenient for the
court.
I have spoken with Laury Dowd, Esq. regarding our intended
application for an adjournment of the conference. I would like to
make clear that she has ~ consented to the adjournment because
she wants to schedule a trial date. I would like to point out that
our .- clients' . business operations have been' suspended; since
septem!:ler 2.. 1996. As such, it is our belief that there is no
ongoing violati:on of Town Code. "

The following is an analysis of parking at the above site to be used to
support a change in the intensity of use which affects the characteristics
of the site in terms of parking. This calculation is made to support the
Board's request for a site plan, as contained in the Board's resolution of
September 11, 1995.
The analysis is as of the date of the appearance ticket of July 26, 1996.
An as-built site plan for Ciccilino's Restaurant accepted by the
Planning Board on June 21, 1991, shows the following uses:
Ciccilino's Restaurant
Chrispy Chicken Restaurant
Four picnic tables
Bungalow - Two connected buildings; one is unoccupied. The
other is used for office and restaurant storage.
The parking calculations, accepted by the Board, (22 spaces), on this
as-built plan were set at the Boards' discretion, as permitted by code.
On July 26, 1996, the date of the appearance ticket, the following uses
were observed:
- Bar and Restaurant
- Residence
- Boat rental and sales office
- Storage trailer

Total required parking spaces as per code - 53 spaces.
Parking calculations as follows:
Residence = 2 spaces
Boat rental and sales office, 1,053 square feet @ 1 space per 100
square feet = 11 spaces
One rental boat in water = 1 space
Fifteen water craft in dry storage @ one space per 4 water craft in
dry storage = 4 spaces
Bar and restaurant @ 1 space per 100 square feet of floor area, 2,690
square feet = 27 spaces.
Employees (4) = 4 spaces
Boat yard @ 3 spaces
Storage trailer @ 1 space per 1000 square feet of storage area = 1
space
Total required by code = 53

Dear Deputy Commissioner Gioffre:
On May 31, 1996 the Town of Southold received correspondence from
you requesting Town input concerning the above application for an on-
premises liquor license.
The Town Board has discussed this matter and would like to make you
aware of concerns about the operation of this site in the summer of 1995.
At that time the restaurant site was also used as a site for rentals of jet
skis and other watercraft. The Planning Board found this to be a violation
of the zoning. There is concern about the juxtaposition of liquor sales and
watercraft rentals. At this point in the 1996 summer season, the Town
does not know whether the site will continue to be used for both purposes.
Use of the site for both purposes is a violation of the approved site plan
for this property.
Thank you for allowing the Town to comment on the application.

Dear Mr. IIIgasch:
The following took place at the September II, 1995, Planning Board public
meeting:
WHEREAS, the Planning Board is the bOdy charged by law with requiring, reviewing
and approving site plans; and
WHEREAS, Article XXV, Section 250 of the Southold Town Zoning Code grants the
Planning Board the authority to require site plan approval when there is any change
of use or intensity of use which will affect the characteristics of the site in terms of
parking, access, drainage, open space or utilities; and
WHEREAS, the Planning Board had adopted an as-built site plan on June 21, 1991,
which showed two restaurants and two connected buildings with pre C.O.'s for
residential use, one unoccupied and the other used for office and restaurant
storage; and
WHEREAS, Club Wave has initiated the rental of more than fifteen (15) watercraft
such as wave runners, jet skis and banana boat rides in addition to its existing
restaurant and bar business; and
WHEREAS, a large trailer is now located on the site; and

WHEREAS Club Wave has changed the use of the former chicken take-out restaurant
to a water craft sales and rental office in addition to retail sales of marine supplies;
and
WHEREAS, this change in use and intensity of use represents a significant change in
the nature of the previous use, because the water craft rentals and boat sales have
created an additional need for parking; and
WHEREAS Club Wave has recently expanded its operation to an adjacent property
by displaying and selling boats which will also result in the need for additional on-
site parking; and
WHEREAS, residential use has been introduced to one of the buildings. One of the
restaurants, (the chicken take outl, is now being used for watercraft rental's and
sales in addition to retail sales of nautical supplies; be it therefore
RESOLVED, that the Southold Town Planning Board has determined that boat sales,
and rental of wave runners, jet skis and banana boat rides, the expanded operation
to the adjacent property, the additional retail sales and the addition of the large
storage trailer has resulted in a significant change in the nature and intensity of use
from that shown on the as-built site plan that was approved in June of 1991; and
BE IT FURTHER RESOLVED, that these changes trigger the need for a site plan
review to consider the parking, traffic and other impacts which will be caused by the
boat sales and rentals.
A site Plan application is enclosed for your use. If we do not receive the completed
site plan application by October 25, 1995, we will be forced to issue violations.

In response to your question, "Does the Planning Board have any
objection to an on premises liquor license being issued to Bay Watch at
Club Wave restaurant."
This Board passed the attached resolution on September 11, 1995, formally
requesting a site plan from Club Wave after futile effort in trying to
obtain a site plan for the increased intensity of use at the site.
The Board plans to request the Town attorney's approval to have the
Building Inspector revoke the Certificate of Occupancy for this club in
accordance with Town Code 100-253 G.
Accordingly, the Board is not in favor of this request until such time as
either of the following happens:
1. Club Wave submits a revised site plan in response to the
Planning Board's 9-11-95 resolution.
or
2. Club Wave returns the site to compliance with the June 21, 1991,
site plan currently in effect.

I am not looking to s. the ferry. I am asking that . as the elected supervisor
of Southold Town do everything in your power and that Southold Town do everything
in its power to keep the ferry from growing any further. One way to do this is
to deny the zoning change Cross Sound i.s seeking in order to create a parking lot
on residential land east of the ferry. Granting the variance will only encourage
more and more fast speed passenger ferries in and out of Orient Point. We have all
read these new high speed ferries are coming in order to move people to and from
tJ-Je new gambling casino scheduled to open in September. It is extremely doubtful
any other area is going to allow these ferries to start in their towns. Orient is
stuck because it already has an established ferry port. It is up to you to put
teeth into the existing ordinances and laws, and even legislate new aleS to protect
the quality of life for the residents of Orient and East Marien and other areas
al<ng the route.
No passing on the right signs should be put up between Orient Point and the blinker
light going into Greenport Village.
SometJ-Jing must be done to achieve a reasonable balance between one very large
business wi th its headquarters in Connecticut and the residents of Orient and
East Marion who pay taxes to the Town of Southold, Suffolk County and New York State.
All of these governments should be protecting its residents. Southold Town should
fight in court if necessary to protect the rights of its citizens.
'!he time to stand firm is NJW. There have been too many years where the Town has
looked the other way. Southold Town can no longer afford to do that. I would
like to see my tax dollar'S spent to save the future of the North Fork.
I leave you with one last observation: last Friday night, May 31st, while
traYf,ling east to Orient, before we reached the four-lane part of the highway
west of Mattituck on the North Road, we counted 60 cars and 2 trucks traveling
west all grouped together (obviously ferry traffic). That doesn't count those
who took Rt. 25 or crossed Shelter Island. It was apparent that those 60 cars
and 2 trucks didn't stop to eat at our restaurants, nor did they stop at our
motels. I doubt they stopped for gas because there wasn't enough break in the
traffic to account for a gas stop. I believe you will find most of the traffic
is destination traffic and not traffic that is greatly benefiting the businesses
in Southold Town (as the ferry would like us all to believe).
Please take the leadership role that I know you are capable of. It is important
for the future of Southold Town.

This is in reference to your June 9. 1994, memo to the Trustees on the
above violation.
To date, Club Wave has not proceeded with a site plan application.
Further legal proceedings seem to be required to bring the defendant into
compliance with the Town Code Article II 97-20.
The Trustees have given lead agency to the Planning Board, however this
Board does not have a site plan application and cannot proceed with its
review.

Board at its work session. Mr. Illigasch explained his
operation at club Wave and said he would submit an application

On May 23, 1994, the Planning Board received a Lead Agency
Coordination Request from the Board of Town Trustees for a Town
Wetland Permit for the construction of an outdoor bar on a 24'
by 7' slab at the above location.
In order to respond to the Trustees Coordination request an
inspection was made of the property on June 10, 1994. The
inspection revealed two uses on the site; the restaurant, and
the rental of water craft.
In the Board's letter to Mr. Illigasch of June 14, 1994, (copy
forwarded to your department), the Board noted that your
department would review the site to determine if a site plan is
required, and additionally, if a review must be made by the
Appeals Board for the two uses.
The Board would like to know the results of your review.

The Planning Board has received a Lead Agency Coordination
request from the Board of Trustees for your proposed outdoor bar.
The required area for each use in the M-II zone is 80,000
square feet per use. A recent review of your restaurant shows
that in addition to the restaurant a jet ski rental business is
in operation.
As your present lot area is approximately 36,000 square feet,
the second use must be reviewed by the Building Department in
connection with your building permit for the construction of the
outdoor bar.
The Building Department will decide if a site plan is required
for your expanded use and if the Board of Appeals must review
your second use.
A site plan application is enclosed for your possible use.

On May 23, 1994, the Planning Board received a Lead Agency
Coordination Request from the Board of Town Trustees for a Town
Wetland Permit for the construction of an outdoor bar on a 24'
by 7' slab at the above location.
In order to respond to the Trustees Coordination request an
inspection was made of the property on June 10, 1994. The
inspection revealed two uses on the site; the restaurant, and
the rental of water craft.
In the Board's letter to Mr. Illigasch of June 14, 1994, (copy
forwarded to your department), the Board noted that your
department would review the site to determine if a site plan is
required, and additionally, if a review must be made by the
Appeals Board for the two uses.
The Board would like to know the results of your review.

The Planning Board has received a Lead Agency Coordination
request from the Board of Trustees for your proposed outdoor bar.
The required area for each use in the M-II zone is 80,000
square feet per use. A recent review of your restaurant shows
that in addition to the restaurant a jet ski rental business is
in operation.
As your present lot area is approximately 36,000 square feet,
the second use must be reviewed by the Building Department in
connection with your building permit for the construction of the
outdoor bar.
The Building Department will decide if a site plan is required
for your expanded use and if the Board of Appeals must review
your second use.
A site plan application is enclosed for your possible use.

Dear Members of the Board:
In regard to the application by Armando Cappa to install
floating docks just south of Ciccilino's Restaurant in Budd's
Pond, Southold, I am expressing my concerns and objection that
lessening the navigable channel in excess of the 20% allowed
by the Army Corp of Engineers in an area of treacherous cur-
rents and high boating traffic in the peak summer season where
access is required for the large boating capacity of Albertson
Marine Marina and Port of Egypt could create an extremely
dangerous situation.
I would also like to mention that through much of this
month (June) boats were occupying these proposed slips and
the proposed floats are presently in service. I believe that
Mr. Cappa may be liable if an accident occurs, and the Town
may become a party in this liability.
In addition, I would also like to ask the question, that
where there is a proposal for six slips having boats of less
than 30', how will Southold Town enforce expanding it to 10
slips including larger boats. It is evident that five finger
piers can certainly accommodate 10 boats.
