Dear Mr. Lieblein:
The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday, June 24, 1991.
Be it RESOLVED that the Planning Board hereby accepts the
as-built site plan for Ciccolino's Restaurant, located on State
Route 25 in Southold. Any changes in the use of the buildings
from that indicated by the as-built plan, which consists of a
survey of the site amended on May 21, 1990 and received by the
Planning Board on May 3, 1991; accompanied by a floor plan drawn
by William Lieblein, and parking calculations set forth by the
Planning Board on June 21, 1991 may require an amended site plan.

regarding the above.

Dear Mr. Wiggin:
The following action was taken by the Board of Town Trustees during
its regular meeting held on August 1,1991 regarding the above matter:

WHEREAS, PECONIC ASSOCIATES ON BEHALF OF CICCOLINOS RESTAURANT
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated May 19, 1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on August 1, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally,yiewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT PECONIC ASSOCIATES ON BEHALF OF CICCOLINOS RESTAURANT
BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Install floating docks for 6 boats to be used for restaurant patron
docking ONLY as per survey dated May 12, 1990. There shall be no
overnight docking. Located off Route 25, Southold.
This permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months
of the date of this notification. Two inspections are required and
the Trustees are to be notified upon completion of said project.

Permit will be issued upon payment of the following fees for work to

The attached correspondence may be of interest to you in
light of the Planning Board's recent correspondence to the owner
of Ciccolino's Restaurant regarding the lack of site plan
approval. Bill Mullen is concerned about the implication in the
letter of liability on the part of the Town.

Dear Members of the Board:
In regard to the application by Armando Cappa to install
floating docks just south of Ciccilino's Restaurant in Budd's
Pond, Southold, I am expressing my concerns and objection that
lessening the navigable channel in excess of the 20% allowed
by the Army Corp of Engineers in an area of treacherous cur-
rents and high boating traffic in the peak summer season where
access is required for the large boating capacity of Albertson
Marine Marina and Port of Egypt could create an extremely
dangerous situation.
I would also like to mention that through much of this
month (June) boats were occupying these proposed slips and
the proposed float~ are ~resently in service. I b liev~~
~~, ecome a part~ in t~i~ J,iability.
In addition, I would also like to ask the question, that
where there is a proposal for six slips having boats of less
than 30', how will Southold Town enforce expanding it to 10
slips including larger boats. It is evident that five finger
piers can certainly accommodate 10 boats.
I appreciate your attention in regard to this matter.

proposed site plan is to change the use of an existing building
from an auto parts retail store to a delicatessen. The building
is on a 24,028 square foot parcel, located in Southold.
Mr. McDonald: Mr. Chairman, I would like to offer the following
resolution.
RESOLVED that the Southold Town Planning Board, acting
under the State Environmental Quality Review Act, make a
determination of non-significance, and grant a Negative
Declaration.

last thing we did was run a preliminary approval extension which
runs to October 30th, 1991 and if you come into the office and
talk with Valerie or Melissa, they can explain.
Mrs. Dickerson: I have done that. Somehow, I thought I had
to check with everybody.
Mr. Orlowski: No.
Mr. McDonald: The plan is good, you can just pick it up and
move ahead.
Mrs. Dickerson: I don't know if it's got final approval.

As the BUilding Department is adamant that the building
permit was issued appropriately for the previous work, which
was prior to the adoption of the new Zoning Code, it has
become apparent that we cannot proceed further on the
application of the docking facilities until the Planning
Board and the Building Department resolve their differences.
Hopefully this could be done in the near future so that we
could proceed to complete the application prior to the
summer season of 1990.

I recently requested a work session conference with the
Planning Doard to discuss the feasibility of a project
for my client Mr. Cappa. I was informed the procedure
to follow is the submission of a preliminary sketch of
the site plan for your review and subsequent meeting to
discuss the intended project in detail prior to its be-
ing presented to the Board.
~ccordingly, I have enclosed a photocopy of a survey
with the proposed concept depicted in red. To
elaborate, the intention of the proposal is to improve
upon an otherwise undeveloped parcel which has become
overrun with weeds and litter thereby being unsightly
and a visual disturbance to my client.
The nature of the proposal is an open air pavilion built
on piles at the westerly end of the property. This pa-
vilion would be used as a seasonal market place for lo-
cal truck farmers to display and market their products
to the public providing off street parking and conve-
nience to both tourists and local residents. Please
Note, access to the site would be from the "Old Main
Road" thereby eliminating congestion on the presently
traveled State Highway.
Connected to the pavilion would be a boardwalk elevated
on piles above the marsh providing access to the pond at
the east end of the property. The Boardwalk would con-
nect with a gazebo and terminate in a platform at the
pond where fish and waterfowl could be observed. This
aspect of the proposal would act as a nature walk avail-
able to the public.

It is MY opinion, in a developed state, the site could
be properly maintained and would take on a more parklike
appearance as opposed to the present catchall for litter
and debris from the highway.
In conclusion, I am requesting a meeting with you to re-
view in depth this proposal and answer any questions you
may have so a presentation can be made to the Board at
its earliest convenience. Given the nature of the pro-
posal and the site, several state and local agencies
will need to review the proposal so your timely action
on this request will be appreciated.

The survey depicts the site as-built. However, it does not
conform in scale to the 1"=20' scale required of site plans
pursuant to Article XXV of the Zoning Ordinance of the Southold
Town Code. It would be appreciated if the survey were redrawn to
the scale required for site plans.
The as-built plan also should indicate the number and
location of parking spaces, the total square footage of building
area for each use depicted on the survey, and the number of
boats that could be moored at the docks.

Pond, Southold, I am expressing my concerns and objection that
lessening the navigable channel in e~cess of the 20% allowed
by the Army Corp of Engineers in an area of treacherous cur-
rents and high boating traffic in the peak summer season where
access is required for the large boating capacity of Albertson
Marine Marina and Port of Egypt could create an extremely
dangerous situation.
I would also like to mention that through much of this
month (June) boats were occupying these proposed slips and
the proposed floats are presently in service. I believe that
Mr. Cappa may be liable if an accident Occurs, and the Town
may become a party in this liability.
In addition, I would also like to ask the question, that
where there is a proposal for six slips having boats of less
than 30', how will Southold Town enforce expanding it to 10
slips including larger boats. It is evident that five finger
piers can certainly accommodate 10 boats.
I appreciate your attention in regard to this matter.

Reference your letter of June 14, 1989 regarding the need
for Site Plan Approval for the above referenced project.
Please be advised that a Building Permit No. 16279-Z was
issued for this building's modification in July of 1987
(Planning Board office verbally notified of this on June 19,
1989).
It would seem, based on th above, that Site Plan approval
has already been accomplished or is not required. Please
review as expeditiously as possible as the Board of Trustees
Application of April 26, 1989 is still being held pending
action of the Planning Board. As explained to you in our
letter of May 31, 1989, this delay is creating an
unnecessary hardship to the Owner, who was hoping to be able
to use these dock facilities for this summer's tourist season.
If you have any questions, please do not hesitate to contact

The Planning Board's position is that a site'plan should
have been submitted for the conversion of the fishing station
into a restaurant. At present there is no site plan approval
for the restaurant use.
The Board requests the submission of a site plan
application for the restaurant use and the accompanying docks.

Despite earlier understandings, it came to our attention
last week that the Planning Board now feels that they will
require an approved Site Plan for subject work.
Please be advised that this project entails the positioning
of six (6) floats adjacent to an existing bulkhead for six
(6) boats to permit transient docking for boaters to use the
restaurant facilities. There are no upland services such as
parking, electrical, water, sanitary, and so forth required.
As defined in Section 100-250 of the Southold Town Code,
there is no work proposed that will effect the
characteristics of the site in terms of parking, loading,
access, drainage, open space, our utilities that would seem
to necessitate site plan approval. If it is the Planning
Board's decision that a Site Plan is required, we will
comply with same, even though it is both our opinion and
from a legal one that the Code does not require same.
Also we are concerned because of the recent stated back-log
of work in the Planning Department, that the review and
approval of a site plan would cause extraordinary and
unnecessary hardship to the Owner, and would in effect
probably negate the applicant being able to have these
