The following action was taken by the Southold Town
Planning Board, Monday, July 14, 1986.
RESOLVED that the Southold Town Planning Board approve the
set-off of 23, 960 square feet from 49,089 square feet located at
a right-of-way from willow Point Road, Southold, survey
dated November 22, 1985.
1. Health Department approval of the water and
sewer pursuant to Article 6.
Upon receipt of this approval, the Chairman will endorse
the surveyw.

Ordinance, Article III, Section 100-31, Bulk Schedule, for approval
of two contiguous parcels, having insufficient area, width and depth.
Location of Property: Along Right-of-Way off the east side of Bay
Home Road (and along the end of Willow Point Road), Southold, NY;
County Tax Map Parcels No. 1000~56-5-39, 40, and 41.
WHEREAS, a public hearing was held and concluded on June 19,
1986 in the Matter of the Application of ELEANOR LEUNARD under Appeal
No. 34L4; and
I
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, at said hearing all those who desired to be heard
were heard, and their testimony was recorded; and
WHEREAS, the board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the board made the fOllowing findings of fact:
1. The premises in question is located along the south
(east) 'side of a private 3D-foot right-of-way extending from
the easterly side of Bay Home Road, and fronting along the south
(westerly end) of Lv.i Ilow Point Road, in the Hamlet of Southold,
and is further identified on the Suffolk County Tax Maps as
District 1000, Section 56, tllock 5, Lots 39 and 40.
2. The subject premises as a whole consists of a total
Jot area of 49,089 sq. ft. and a total frontage along the
private right-of-way of 2l5~ feet.

and September 24, 1968, respectively; (b) separate 1985-86
town tax b111s; (c) real estate appraiser's report dated
June 1M, 1986; (d) sales memorandum concernin9 improved
parcel; (e) Certificate of Occupancy #Z13517 concerning
the vacant lot; (f) Certificate of Occupancy #Z2098
concerning the improved parcel and Certificate of Nonconform-
in~ Premises Pre C.O. #Z13914; (g) D.E.C. Permit #10-86-01/1;
lh) Town Trustees waiver concerning new dwelling construction
dated-Ja~uary 13, 1986; (i) letter from the Village of
Greenport dated December 18, 19M5 indicat1ng that pUblic
water 1S available for the vacant parcel as proposed; (j)
County Tax Map showing lots in the area of a sim11ar size
and character as that proposed herein; (k) memorandum from
Bui1d1ng Inspector dated October 11, 1985 indicating prior
Cetificates of Occupancy were 1ssued based on erroneous
information submitted.
5. Ihe character of the lots in the immediate vicinity
are of a size similar to these lots as proposed and deeded
previously.
In considering this appeal, the board also finds and
determines: (a) that sufficient practical difficulties have
been shown to warrant the granting of this variance; (b) the
circumstances are unique and not shared by all other properties
in the neighborhood; (c) there will be no substantial change
in the character of the neighborhood or detriment to adjoining
properties; (d) the relief requested is not substantial,
(e) the difficulty cannot be obviated by some method feasible
for appellant to pursue other than a varlance; If) that the
variance wi1 I not in turn cause a substantial effect of increased
population density or be adverse to the safety, health, weflare,
comfort, convenience and order of the town; (g) that in
view of the manner in which the difficulty arose and in con-
sideration of all the above factors, the interests of justice
will best be served by allowing the variance, as conditionally
noted below.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Grigonis, it was
RESOLVED, that the relief requested under Appeal
No. 3424 in the Matter of the Application of ELEANOR LtONARD
for approval of two parcels as shown on survey mapped
November 22, 1985, having insufficient area of 25,129 and
23,960 sq. ft., and insufficient lot width of 110t feet
and 130t feet, respectively, BE AND HEREBY IS APPROVED,
PRuVIDED THAI ALL CONSTRUCTION COMPLY WITH THE REQUIREMENTS
OF COLUMN "A" OF THE BULK AND-PARKING SCHEDULE.
Vote of the Hoard: Ayes: Messrs. Goehringer, Grigonis,
Douglass and Sawicki. (Member Doyen was absent.) This resolu-
tion was duly adopted.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all permits:
,
A. If any of the permit conditions are unclear, the permittee ahall contact
the Division of ~egulatory Affairs at the address and telephone noted below.
B. A copy of thia permit or approval and supplementary conditions shall be
available at the project site whenever authorized work is in pro~ress.
C. The permit si~n enclosed with the permit or a copy of letter of approval
shall be protected from the weather and posted in a conspicinus location
at the work site until completion of authorized work.
D. At least 48 hours prior to commencement of the project, the permittee shall
complete and return the top portion of the enclosed receipt form certifying
that he ia fully aware of and understands 011 provisions and conditions of
this permit. Within one week of completion of the permitted work, the
bottom portion of that form shall alao be completed and returned.
E. For projects involving activities to be accomplished over a period er more
than one year, the permittee shall notify the Regional Permit Administrator
in writing at least 48 hours to the commencement of resumption of work each
year.
F. I~ project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by tbe
Regional Permit Administrator prior to undertaking any such oodifications.
The permittee is advised that substantial modification may require sub-
mission of a new application for permit.
G. All necessary precautions shall be taken to preclude contamination of any
wetlands or waterway by suspended solids. sediment, fuels, solvents,
.1ubric8:ts, epoxy coatings, paints, concrete, leachate or any other
environmentally deleterious materials associated with the project work.
B. Any failure to comply precisely with all of the terms and conditions of
tills per.:rl.t, unless authorized in writing, shall be treated as a violation
of the Enviro~tal Conservation Law.

Please be advised that I represent Eleanor Leonard who owns two parcels
of property on Peconic Bay located between Bay Home Road and Willow Point
Road. One parcel is improved with a two story dwelling and is designated
on the Suffolk County Tax Map as District 1000 Section 56 Block 5 Lot 39.
The second parcel is vacant and is designated as District 1000 Section 56
Block 5 Lot 40.
My client took title to both parcels at different times with two separate
Deeds and a copy of a Van Tuyl survey showing both parcels is enclosed
herewith.
I understand from the Village of Greenport Water District that the house
parcel is being serviced with public water and that it is also available
for the vacant parcel.
I am aware that the Suffolk County Health Department refers to the 1980
Tax Maps which would show that there are two separate tax parcels in-
volved and that no Article VI Sub-division Application need be made to
your office.
Please confirm that no Sub-division Application need be made in light
of the fact that there are two separate parcels as reflected on the 1980
Tax Map.
