Your Inquiry Dated June 24, 1988
Relocation of Historic Residential Structure
This letter is in response to your inquiry received Monday
concerning the location of a historical building on a
parcel of land identified on the Suffolk County Tax Maps
as District 1000, Section 25, Block 03, Lot 12,1, fronting
along three streets known as Bay Avenue (or Village Lane),
Fletcher Street, and Vincent Street, in the Hamlet of Orient.
The parcel is presently zoned B-1 General Business; however,
the proposed Master Plan Maps show the premises to be
re-zoned to R-40.
The premises as shown on the February 17, 1988 survey prepared
by John T. Metzger depicts the following nonconformities:
1. Main 2-story frame building: (a) nonconforming front yard
setback (100-71); (b) nonconforming single-family residential
use in a B-1 Zone [100-70]. Additional information will be
necessary in the initial process to determine same.
2. Two-story frame structure: (a) nonconforming single-family
residential use in a B-1 Zone [100-70]. Additional information
will be necessary in the initial process to determine same.

3. Frame shed accessory to the existing residential use (100-70C).
It will be necessary for the property owner to apply for the
appropriate building permits which m.ust include all the uses of
the premises proposed (stating those uses to be used in conjunc-
tion with the subject building/use).
If the historic building is to be used as a principal residential
use, whether it be the present B-1 Zone or the proposed R-40
Zone, any increase in density (over the permitted single principal
use, whether it be business or dwelling use) must be approved by
the Board of Appeals. The Zone Districts B-1 and R-40 would not
permit an increased nonconforming use or increased density without
appropriate Z.B.A. application and reviews. As you know, the
current B-1 provisions also require site-plan approval by the
Planning Board under 100-70 for such use.
Alternatively, if the historic building is to be used as an
accessory building incidental to the nonconforming residential
use of the premises, the building should cODform to those set-
backs for a principal building in this B-1 Zone under the Bulk
Schedule. It does not appear that a "use variance" c6~ld'be applied.
You should note for your records that under Building Permit #16733Z
issued February la, 1988, the application reflects that the
existing use and occupancy of the premises is "one-family dwelling."
The building permit and Certificate of Occupancy #Z16646 dated
February 11, 1988, states "AtcessorYStructure, rear yard, out
of~section af the "BAY HOUSE," and not for a '2-sty fro hse."
which was depicted on the subsequent survey of February 17, 1988.
Before any determinations are made, it is strongly suggested that
the history of prior actions or reviews by the Planning Board
be researched and submitted since there may have been other
site-plan reviews or subdivision prior to 1983 affecting this
land.

Pursuant to our recent conversatlon. I have enclosed tour (4) coples ot
the proposed slte plan tor Mr. Prost's property. The proposed relocatlon ot the
bulldlng belng purchased from PKB propertles (presently located on property
deslgnated as Tax Map No.s 1000-055-05-8. 9 and 10) ls shown. Mr. Frost
Intends to preserve thls hlstorlc structure on hls property and to use It tor a
purpose allowable In a B (Light Buslness) Dlstrlct; perhaps tor an artlsts
workshop.
Addltlonally, as I prevlously advlsed, Mr. Frost has advlsed me that the
rear portlon ot the "Bay House" was not detached and then moved In an easterly
dlrectlon. In tact. what happened was that a portlon ot the orlglnal "Bay
House" connected the two front bulldlngs Into one large bulldlng. At some tlme,
thls mlddle sectlon was apparently demollshed. Mr. Prost has plctures to
substantlate thls tact. The 2 story frame house located behlnd the "Bay House"
ls presently belng used tor storage.
Please revlew thls slte plan wlth the Plannlng Board at your earllest
convenlence, so that we may proceed wlth thls appllcatlon.

Relocation of an historic residential structure onto

The Planning Board has been asked to review a site plan
which involves the following: (read with enclosed map)
1. Relocation of an historic structure from its present
site in Southold (on C.R. 48 across from Wheeler's
Garage) to a business zoned lot in Orient.
2. The lot in Orient has on it a residential type
structure that had been a hotel or boarding house
and that is currently being used as a single-family
residence to the best of my knowledge.
The Planning Board is willing to entertain a site plan for
the Orient property in the interests of preserving the historic
structure. But, the fOllowing question comes to mind:
1. Is this a situation which should be reviewed by the
Zoning BoardJ.?rior to Planning Board review inasmuch
as the propo~ involves establishing two uses, one
either residential or commercial and the other strictly
residential (existing use). Please advise so that I may
respond to the inquiry.

Dear Ms. Scopaz:
Confirming our recent conversation, it is my under-
standing that the Planning Board has no objection to the moving
of the historic building presently located on the Penney-Boger-
Kreitsek parcel (Tax Map No. 1000-055-5-8, 9 & 10) to my clients
parcel in Orient.
The buildign will merely be placed on my client's said
parcel and will not be used until site plan approval is obtained.
All set back requirements will be observed and the building will
be located as depicted on the survey dated February 17, 1988, of
peconic Surveyors. I have spoken with Victor Lessard, who has no
problem with this plan.
My client will obtain all necessary licenses and permits
for the transportation of this structure to its new location.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR part 617"
Section 617, Section 617.10 and chapter 44 of the Code of the
Town of Southold, notice is hereby given that Southold Town
Planning Board, as lead agency for this unlisted action
described below has determined that the project will not have a
significant effect on the environment.
DESCRIPTION OF ACTION
The Site Plan of PKB Associates is for a retail/commercial
building proposal located at Southold. SCTM 11000-55-8,9,10.
The project has been determined not to have a significant
effect on the environment for the fOllowing reasons:
An environmental assessment has been submitted, reviewed
and it was determined that no significant adverse effects
to the environment were likely to occur should the project
be implemented as planned.
Because there has been no correspondence received from the
Department of Health Services in the allotted time, it is
assumed that there are no comments or objections from that
agency.
Because there has been no correspondence received from the
New York State Department of Environmental Conservation in
the allotted time, it is assumed that there are no comments
or objections from that agency.
The Planning Board feels that this proposed use is a proper
use for a business zone. Also, the area is designated in
the proposed Master pla~ as a business ZOne.

your department regarding my intended use of the above
referenced structure and property.
As I informed tlr. tlcLaughlin, my intent is to preserve and
restore the structure in a manner which is in keeping with
both the historical integrity of the building and the
historical character of Orient Village. As you may Know, the
property onto which the structure is proposed to be moved is
adjacent to both' the museum and historic district in Orient.
To assist me in this restoration process, I have contacted
Zachary Studenroth, Preservation Services Coordinator of the
Society for the Preservation of Long Island Antiquities.
The structure is currently situated in a commercial zone on
the North Road. . Unfortunately, the commercial surroundings
greatly detract fropm the innate integrity of the structure.
In addition, the building risks being modified or irreparably
damaged by further conversion to commercial usage.
To reiterate, my intention is to preserve and restore the
structure in a location more suited to the historic nature of
the bUilding.
Regarding the question concerning the. rear portion of "Bay
House", I have enclosed a brochure from the 1950s that has an
aerial photograph of the Bay House compound. As the
photograph shows, the rear portion has not been moved, rather
the middle section was demolished during renovations in the
early 1980s. I have additional photographs, taken at the time
of the renovations, if you require them.

Showing recommended changes.
The Planning Board emphasized the elimination of the paved access
adjacent to the southernmost building. Some other considerations which
are briefly noted below are noted on the map also.
1. Show location of dumpster(s) and screening thereof.
2. Include detailed landscaping plan showing street trees, low
shrubbery to block view of parking areas from road.
3. Designate handicapped parking (required for certification by
Building Department).
4. Relocate parking space as noted on east side of site.
5. Drainage calculations for roof runoff and paving.
You might want to reconsider the location of the building entrances.
In almost every instance, client has to walk around half to three
quarters of the bUilding to get from the parking space to the "front"
door..
Hpon receipt of six copies of the revised site plan and the drainage
calculations, the Planning Board will proceed with its review.
