Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on November
2, 1983, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Frank W. Abrams, Jr.", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to approve said
map subject to the following six conditions deemed necessary to help preserve
the traffic safety and carrying capacity of Middle Road, a county road:
1. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Southold Town Planning
Board.
2. All new driveways on Middle Road shall make an angle of at least 700
and preferably 900 with the county road if the driveway is to serve
as both entrance and exit.
3. Each lot having frontage on Middle Road shall have a turnaround pro-
vision, such as a T-shaped shunt, so that a vehicle leaving a lot
will not have to back out into the traffic stream on the road.
4. All stormwater runoff resulting from the development and improvement
of this subdivision or any of its lots shall be retained on the site
by adequate drainage structures so that it will not flow out into the
right-of-way of Middle Road.
5. Since the commercial development of this parcel can have an adverse
impact upon the county road a coordinated access and parking plan
shall be developed for this site. This plan shall be binding upon
future lot owners to insure proper access to each lot and between lots
so that vehicles will not have to reenter the county road to go from
one lot to the other. In lieu of the parking plan an easement shall
be required so that when the parking areas are designed in the future
each lot will be interconnected.

6. Conditions 1-5, inclusive, shall be filed as covenants and restric-
tions in the office of the County Clerk on or prior to the granting
of approval to this subdivision.
These covenants and restrictions can be modified only at the request
of the then OWner of the premises with the approval of a majority
plus one of the Town Board of the Town of Southold after a public
hearing. Adjoining property owners shall be entitled to notice of
such public hearing but their consent to such modification shall not
be required.

The fOllowing action was taken by the southold Town Planning Board,
Monday, November 7, 1983.
RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled "Frank W. Abrams, Jr." located at
Southold was submitted to the Planning Board on May 13, 1982
and, a filing fee in the amount of $75 was paid February 16, 1983, and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on October 18, 1983 at
7:45 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of "Frank W.
Abrams, Jr." for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated January 3, 1983 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to receipt and consideration of the Suffolk County Planning
Commission's recommendations.

hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Frank W. Abrams, Jr. is a three-lot
subdivision located at Southold.
The 'project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation it is assumed that there is no objection
nor comments by that agency.
The Suffolk County Department of Health Services has no
objection to the designation of lead agency and is in
agreement with the initial determination. This Depart-
ment has received an application and it is complete. It
app€a~that the project can be served by Subsurface Sewage
Disposal System(s) and a Public Water Supply System.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.
