RESOLVED that the Southold Town Planning Board override the Suffolk County Planning Commission's resolution of denial with regard to the minor subdivision for John and Margaret Kerbs located at County Route 48, Southold. RESOLVED that the Southold Town Planning Board accept and request compliance with Inspector John W. Davis' report No. 531 with regard to the required improvements on the access road within the minor subdivision of John and Margaret Kerbs. RESOLVED that whereas a formal application for the approval of a subdivision plat entitled "John M. and Margaret A.Kerbs" located at Southold was submitted to the Planning Board on April 25, 1986 and the filing fee of $550 was paid on August 19, 1986, and WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York on Monday, August 25, 1986 at 7:30 p.m., and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of John and Margaret Kerbs for approval of said subdivision pla prepared by Rod Van Tuyl and dated as last amended July 31, 1986 be approved and the Chairman be authorized to endorsed approval on said subdivision plat. Kerbs Southeasterly side of Middle Road, C.R. 48, approximately 1,350 feet southwesterly from Richmond Road, Southold, New York. Dear Mr. Orlowski: The Suffolk County Planning Commission at its regular meeting on September 3, 1986, reviewed the proposed subdivision plat, entitled, "Minor Subdivision - John M. & Margaret A. Kerbs", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to disapprove said map for the following reasons: The proposed subdivision will result in the creation of a landlocked parcel; that is, a parcel that will not have frontage on an existing or proposed public road. The creation of such a lot is contrary to good subdivision layout principles and creates problems as far as access by emergency and service equipment is concerned. This lack of access could result in health, safety and welfare problems for the future residents of the landlocked lot, not to mention potential disputes over the use and maintenance of any right-of-way over an adjacent parcel that may be created for the purpose of access. Creation of a landlocked lot also places the Zoning Board of Appeals in the awkward position of having to grant a building permit for the lot under Section 280-a of the Town Law as the future owner of the landlocked lot cannot be held responsible for the landlocked nature of their parcel. Kerbs Creation of a subdivision with substandard lots, that is, lots whose areas are less than the minimum required by the zoning classification of the property, constitutes an overintensification of land use in a groundwater sensitive area in what is meant to be a low density area. Such action could establish a precedence for future subdivision of this kind which would essentially be a circumvention of the Town Board's action taken over the past years to upzone these groundwater sensitive areas. The Commission feels that the Town Planning Board should have the prerogative to review this type of application rather than it being left to the sole discretion of the Zoning Board of Appeals. Davis Date: August 5, 1986 Access to Lot No. 4 - Minor Subdivision for John and Margaret Kerbs at Southold. Comments: The 25 ft. R.O.W. to above lot is more or less level and meets C.R. 48 at about the same elevation. From visual observation there could be a slight minus grade to the south. The approximate location of the R.O.W. was determined by using a scaled distance from the house on Lot No. 2 and measured with Mr. Kerbs. Test hole on plans, adjacent to the R.O.W. shows 4" of dark brown loam, 2'8" of brown loam and ]'6" of light brown clay before reachlng sand and gravel. Recommendations for access road in the 25 ft. R.O.W.: I. Road width 15 ft. (280-A requirement) with 4 ft. shoulders. 2. Remove loam for 12" in the ]5 ft. width and grade to an even profile. 3. Backfill loam excavation w/th a compacted grade of clean fill to a depth that when the following courses are placed the final surface is 4"~ above the existing ground. 4. Place a 6" compacted course of 6ankrun sand, loam and gravel. Gravel content to be 25-30%_ 5. Place a top course of 3/4" stone blend or crushed concrete so that when compacted the depth will be 2". 6. Do not .forsee any d?ainage problems at this time. Although this access is 356 ft. in length it serves only one lot and a road width less than 15 ft. might be considered. Mr. Kerbs does not intend to construct this access road in the immediate future.
