Hi:
Just a brief letter to mention I have had the drainage
installed by Gary Tabor of Orient, and the trees planted
by Tom Thompson of Cutchogue. I gather this work has been
inspected and approved. Have you been sent letters to this
effect by Sidney Bowne Company, your engineers? I would
like copies of their inspection and approval if possible and
also would like to proceed to have my Irrevocable Letter of
Credit released from NorStar Bank of Riverhead for the
amount requested.
Thank you very much for your consideration.

Dear Sir:
Just a brief letter to mention I spoke to Sidney B. Bowne
& Son's office to clarify a few points in regard to the drainage
and the street trees.
I understand that besides the four leaching basins with
traffic covers referred to in the Bond Estimate, they want an
additional 4 X 4 catch basin with inlet casting to grade.
Therefore I have arranged to do the job accordingly.
Also in regard to the street trees, I believe if they are
planted on Town property, they will be under the electric wires
and quite close to the road. I would therefore respectfully
request that you allow me to plant these back further and inside
the property line of lots ~1 and ~2.
Thank you for your consideration. I will probably have
Gary Tabor of Orient do the drainage work and Tom Thompson of
Cutchogue do the trees, and I have asked them to contact you
if any questions.
Respectfully ~yours,

Enclosed is the letter of credit requested in the amount
requested in reference to my minor subdivision of three lots

need for final map approval, as Rod VanTuyl said he dropped
off all the maps needed to be signed by you in accordance
with your last letter to me.
Please let me know when I can expect the final approval,
so that I can make plans for a building permit in the near
future. Also, I would like to get further details on the
drainage work requested, as to where it is to be installed,
and any other specifics needed to get the work done and
approved by you. Once the drainage is in I guess we can
determine where you want the trees planted.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE

RESOLVED that the Town Board of the Town of Southold hereby approves
the bond amount of $21,000.00 for roads and improvements in the Franklyn
Born Minor Subdivision, located at Southold, all in accordance with the
recommendation of the Southold Town Planning Board and Consulting Engineers

Gentlemen:
I recently picked up the "Bond estimate" relative to the
three lot subdivision on Old North Road and road profile. I
believe the requirements you are suggesting are unreasonable
and excessive. It appears your engineer must have used the
worst scenario to calculate the bond and work. I doubt whether
they took a look physically at the site and especially in a down-
pour to see there is no accumulation of rainwater there due to
excellent drainage as indicated in the test borings. Also they
no doubt took the entire road figures, when I only am involved
in the south side of the road and future users should be
responsible for the north side. Please keep in mind these are
not quarter acre lots but two acre and so there is ample drainage
on each lot for each house since there will be lawns, not concrete.
I'm not trying to be facetious, but trying to exercise the spirit
of a sound mind in this matter. I believe a basin one tenth of
what they are asking would be more than ample, due to soil condi-
tions. I also spoke to Rod Van Tyle who I regard as a very reason-
able and fair minded man, and he too felt this recommendation was
excessive in our brief discussion of the road profile.
There is no question you have a problem on Old North Road
and Youngs Avenue and of course have a real handicap in that topsoi~
erodes and fills your little sump on the corner each time it rains
and acts as a lining preventing fast drainage. However, where thes~
two homes will go has no such problems and because of homes on each
side will not have this problem in the future.
I have waited patiently for a year now to get my map approved
and signed and to begin to build. I respectfully submit and feel
all this should have been dealt with when the preliminary plan was
submitted, and not at the last minute. I had been led to believe
I would have had a signed and approved map months ago and made plan~
accordingly. This was my mistake I guess.
I respectfully request that you please re-consider what the
Smithtown engineers have recommended so as to be more in line with
reasonableness and fairness.
Paqe two
Your estimate recommends 14 trees, but no details as to type
or size required, or where they are to be planted.
Thank you for any consideration you may extend in this matter.

Dear Mr Orlowski:
Received your letter of July 26th, 1988, but I am at a
total loss as to why I would be required to do $2t,000 worth
of work on a town road. Your letter refers to rite of way
in July 18th copy of letter to you from Vincent Mariconda
of engineering firm of Sidney B. Bowne & Son, which I do
not understand since there is no rite of way involved in
this subdivision, only a driveway to the rear parcel. Please
note there is no rite of way invoved only a driveway. The
driveway is for rear lot only and is not a rite of way but is
owned by rear lot.
I would like to set an appointment to discuss this matter.
It has been approximately a year since I applied for this sub-
division into three lots. I had hoped to begin construction
of a new home months ago, and now I am very frustrated by this
new request in your letter of July 26th, 1988.

P.S.
Respectfully yours,
Frank Born
I have lived in Southold for awhile and have never noticed
a drainage problem on the road in front of this minor sub-
division of three lots. However, I noted that on the corner
of Old North Road and Youngs Avenue there is a water problem
where two minor subdivisions have been approved not too long
ago.

Re: Minor Subdivision of
Franklyn Born
Dear Mr. Born:
The following action was taken by the Southold Town

on 6 acres, survey dated August 10, 1987.
RESOLVED that the Southold Town Planning Board declare
themselves lead agency under the State Environmental Quality
Review Act for the minor subdivision of Franklyn Born located
at Southold, SCTM# 1000-107-4-2.1.
If you have any questions, please don't hesitate to

Dear Sirs:
Just a brief letter to express my disappointment in
the time it seems to be taking to look at the sketch plan
I submitted on the six acres I own on Old North Road in
Southold. I was told it would be reviewed the 4th of
September than the llth and than the 18th, and positively
the 25th, and today I'm told it will be next week on
October 2nd.
I would like to build on these parcels and so time is
a big factor. I would very much appreciate your consideration
and co-operation in this regard. I believe what I am
requesting is reasonable and uncomplicated in dividing six
acres into three two acre parcels in compliance with your
zoning code.
