Dear Mr. Uhl:
~ At a meeting of the Planning Board on October 4th we
enjoyed having Mr. Hewlett and we hope we made sane progress
on the problemr of Orient-By-The-Sea.
Mr. Van Tuyl and Mr. Pric® have briefly 8lscussed the high-
ways in Section 1 and Section 2 and Mr. Price has some question
about whether the State has or will accept the connection and the
surface water, if any, at the ~unetion of Plum Island Lane and
Route 25. He also feels, as you have outlined in your letter to
us, that there may be some problem about the catch basins and
finally, and most important, he feels that the highways in Section
1 do not meet the conditions for dedication as regards access to
the water until such time as highways are constructed to the water.
In discussing this with Mr. Hewlett it would seem to us that
there are three alternatives which are as follows:
1. Give a performance bond for that section of road to the
beach which lies in Bection 2. (This would have to have the
approval of the Town Attorney.)
2. Either this fall or next spring, construct that section
of Soundview Avenue in Section 2 which run• to the Sound and
dedicate that part to the Town.
3. File the map of Se c tion 2 and at that time take out
a performance bond on sane of the highways. (That will also
~ require approval of the Town Attorney.

we would like to have you consider these alternatives and
indicate which look most realistic to you at this time. If you
let us know your decision we would be glad to pursue it further
with Mr. Price and the Town Attorney who in the last analysis have
to pass on all dedications.
In conclusion, let me say that there is nothing fixed about
~ our ideas on the matter and it 1s entirely possible there may be
some other combination or method by which the Town Board can be
assured that access to the water would be guaranteed.
We are sorry this thing has taken ao long but these problems
have a habit of arising.

I hope I did not disturb you last night when I called. I
did ,not lmow abcut hr. Prices' letter until this morning. I am enclosing
a copy of the letter dated September 28th from TIr. Harold Price, Superin-
tendent of Highways, paragraph one of which I do not quite understand.
It was my understandin„ from previous discussions that the
matter o£ a road terminating at the water would be resolved upon the
filing o£ the Plat of Section Two, Crient-ByBThe-Sea, which would provide
for a lot terminatinC at the water. Such preliminary plat was approved by
the Planning 3oard o£ the Town of Southold. on August 22, 1960. Perhaps
I°ir. Price was not apprised of these developments.
Regarding the second paragraph of the enclosed letter, re-
ferring to the road basins overflo•~aing, you trill recall that .ae had unusually
severe rain storms. On one occasion l~. inches o. rain had fallen Lrithin a
period of 24 hours. The drains may have filled during that storm, hotaever,
a few da~rs later I inspected the road drains and found that they were drain-
ing satisfactorily and also that there had been no washouts or road repairs
necessary. Conditions such as these are an overload to any drainage system.
In m~~ opinion the basins as installed are adequate to accomodate the rain
falls, etc. under normal conditions, and the road stood up exceptionally
well for such a storm.

i£ ir. Price could possibly attend ~ the situation can be discussed with
him,
I respectfully request that a review of the matter of dedica-
tior_ of the roads in Section One, Orient-By-The-sea, be made.

a meeting held on May 5, 195$, that your means of access be
approved at Orient-By-the-Sea.
As regards dedication of highways to the Town of Southold,
this is a matter that lies wholly within the province of the Town
Board. IP you have not already done ao I would suggest that you
or your attorney 1nit3ate Lhe proceedings at an early date iP you
have a target date in mind. In any event, the next step is up to
you.
My personal opinion is that if you could find the time it
wou7.d be well to go over the propertq and your proposals with
Mr. Harold Price, the Town Supt, of Highways. He is without a
doubt. the most able man in his Field in our County, if not the
State, and his opinioa would be most helpful. I have spoken to
him and he wi~I be glad to go with you.

I am in receipt of your letter of April 18th, 1958
acid have noted the contents thereof,
4Yith respect to the proposed roads I would advise
you that I am entering into a contract with Mr. Latham to con-
si;ruct the roads on this map irr accordance with the requirements

Nith respect to such roads I wish to advise you,
although under protest, that I am willing to have our corporation
deed one hundred (100) feet of Sound frontage to the Town~~hip
immediately adjoining that portion of the premises that ha.s been
reserved for beacki purposes on this map, It wouldbe understood,
of course, that ai'ter the Town entered into occupancy of these
premises rules and regulations would be enforced with respect to
the maintenance oi' the beach similar to those that we would pro-
pose to enforce on the reserved beach property for this develop-
ment, It is understood, however, that such an offer to the
Township would be conditioned upon the acceptance of these roads
by the Town and that we would receive such acceptance not later
than June 15th of this year.

I believe that you are holding in reserve about
:75 feet of Sound frontage for the use of the
property owners. You will recall in our last
conversation that I told you that in order Eor
the roads in your development to be accepted by

In eases such as this. ~vhere private roads are
anticipated at least for the preaeat, the.Plaaning
Board generally requires a statement to the effect
that there is 100 feet in reserve which would
provide the necessary frontage when and if it is
ever deemed advisable to ,have the Town of Southold
take these roads over.

I have ;your letter of November 4th, 1957 and regret
the delay in replaying to the same. However, it was neces;aary
for me to confer with Mr. Uhl relative to this, and because of
the pressure of matters here at the office and a recent death
in my family it was just impossible for me to get out this reply.
However, I have carefully reviewed this matter with Mr.
Uhl and it is our opinion that the demand of the Town is com-
pletely out of lime with all existing law. What the Town pro-
poses is, in effect, confiscation of property without due process
of law, a violatilon of a very fundamental constitutional right.
After discussion with Mr. Uhl it was our conclusion
that you slnuld be apprised of our position in the matter so that
you might discuss this at length with town counsel and so that
you and the Board may properly be advised. Of course, if this
situation cannot be disposed of amicably, Mr. Uhl will have no
other remedy but to resort to the courts for an adjudication with
respect to his legal rights in the premises,

Mr, Walter Uhl has advised us of his conference with
you relative to the approval of the plan of Orient by the Sea,
Section 1, Orient, New York. In this connection we also have at
hand a copy of your letter dated October 2nd, 1957.
dlr. Uhl desires that we advise you (1) that he is agree-
able to continuing a spur on the extreme westerly end of the entire
parcel of land which is to be the subject of this proposed develop-
ment; and (2) with respect to your request for access to the beach
that we advise qou that he would be willing to dedicate :t fifty
foot strip providing for access to the beach oa the west end of
the proposed development. This, of course, would be subject to
an agreement on the part of the Township that there would be no
further demands for access to the beachand, further, that the same
would not be used for public purposes, The exact terms of such
agreement will be the subject of further negotiation.
In this connection we would advise you that the proposal
to dedicate such a tract of land is against our advice to Mr. Uhl,
as attorneys for Woodhollow Properties, Inc „ since we find no
basis is the law for any municipal body imposing such a condition
on an applicant's request for the approval of a proposed subdivision.
