Gentlemen:
The subject premises is located in a B-1 General Business
District and the proposed use is permitted, (Art. VII, Sec. 100-
70 A (c)).
Building set backs as shown exceeds minimum requirements
for front and rear yard area. Item #2 of your letter dated
June 28, 1984 requiring additional 10 foot set back sets a
more stringent requirement than the 35'-0" minimum for front
yard permitted by statute (Art. VII, Sec. 100-71, Bulk Schedule).
Off-street loading as proposed is within driveway to parking
area in rear. Relocation to north side of fish market would meet
requirements of code (Art. XI, Sec. 100-113 C).
Proposed location of 6 x 12 sign is too close to property
line. Set back scales to approximately 2'-0"; a 5'-0" set back
is required, (Art. VII, Sec. 100-70 C (2) with reference to Art.
VI, Sec. 100-60 C (2) (a)).
Because of the sign and off-street loading area this site
plan can not be certified as meeting all require ents of Zoning.

2. Garage door on side rather than rear. This was
preferred to allow for more sufficient maneuverability in
the fish market work area with the large freezer and other
facilities which would be along the rear wall of the bUilding.{,

' 3. Setback of buildings at 50 feet. Please be aware
that the zoning code allows a setback up to 35 feet from the
front property line (see bulk schedule). Requiring a
more restrictive setback to 75 feet appears to be a legis-
lative action. The proposal for a 50 foot setback is more

The applicants for the above mentioned site plan have indicated
to the Planning Board that they are requesting a variance
on the insufficient area of the lot from the Board of Appeals.
