the above appeal was considered, and the action indicated below was taken

Application of PETER AND DIANE LUHRS for a Special Exception to the
Zoning Ordinance, Article VII, Section lO0-70(B) for permission to con-
struct addition for a repair station in conjunction with Special Excep-
tion Permit #3161 rendered October 11, 1983, at premises known as 45845
North Road, Southold, NY; County Tax Map District ]000, Section 55~
Block 2, Lot 17.' Zone District: "B-I."
WHEREAS, a public hearing was held and concluded on December 10,
1987 in the Matter of the Application of PETER AND DIANE LUHRS under
Application No. 3689; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north side
of C.R. 48, Southold, with 149.42' frontage and a total lot area
'.of 21,931 sq. ft.
2. The subject premises is located in the "B-l" General
Business Zoning District and is improved with a 35' by 50'
concrete block building havi, ng a frontyard setback at 41 feet
from the southerly property line, 55½ feet from the easterly
property line, 45 feet at the westerly property line, and 42
feet at the northerly property line (at its closest points).
3. By this application, applicants request a Special Excep-
tion for permission to utilize proposed 30' by 60' addition at
the east side for vehicle repairs and garage use. The proposed
addition is shown on the October 9, 1987 Site Plan Map to be
set back 29 feet (at its closest point) from the easterly
property line and 45½± feet from the front property line. The
setback proposed at the northerly yard area is 42 feet.

4. It is noted for the record that a Special Exception
has been previously granted with conditions under Appl. No.
3161 on October ll, 1983 for this public garage/repair station.
5. In making this determination, it shall be understood
that this project shall not violate any building or zoning code
regulations.
6. In considering this application, the Board also finds
and determines: (a) that the use requested will not prevent
the orderly and reasonable use of adjacent properties or of
properties in adjacent use districts; (b) the use will not
adversely affect the safety, welfare, comfort, convenience, or
order of the Town~ (c) the use is in harmony with and promotes
the general purposes and intent of this Zone District. The
Board has also considered subsections Ia] through [1] of the
Zoning Code in making this determination.
Accordingly, on motion by Mr. Grigonis, seconded by
Messrs. Sawicki and Goehringer, it was
RESOLVED, to GRANT a Special Exception for the establish-
ment of an addition for vehicle repairs and garage use as
applied under Appl. No. 3689 in the Matter of PETER and DIANE
LUHRS, SUBJECT TO THE FOLLOWING CONDITIONS:
1. Compliance at all times with the conditions of the
prior determination of this Board under Special Exception
Action #3161 rendered October ll, 1983;
2. No outside storage in the front yard or any side yards;
3. Four-foot high chainlink fence as proposed shall be
maintained in good condition and without a gate at the east
side; '
4. There shall be no egress or ingress onto the County
right-of-way abutting the subject premises on the easterly side;
5. Minimum three-foot high plantings shall be placed and
maintained across the front and easterly yard areas as recom-
mended by the Planning Board under their site-plan review, and
as a minimum those areas depicted on the October 9, 1987 Site
Plan map prepared by Roderick VanTuyl, P.C.;
6. No overhead doors to be placed on the front (street side)
of the building facing C.R. 48.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Douglass and Sawicki. (Member Doyen of Fishers Island was
absent.) This resolution was duly adopted.

Gentlemen:
The subject property is zoned B-i, General Business Dist.,
the proposed use is permitted by Special Exception by the
Board of Appeals, Art. VII, Sec. 100-70 (4).
The entrance and exit driveway located on westerly side of
premises is not permitted up to the property line. Guide lines
under the Special Exception require a driveway to be not less
than 10'-0" from any property line, (Art. VII, Sec. 100-70 B
(4) (a)).
Except for the location of the driveway, the site develope-
ment conforms to the provisions of the Zoning Ordinance, Chapter
100, Town of Southold, NY.

At a regular meeting of our Board, Monday, October 24,
1983, discussion was held regarding the action taken by the
Zoning Board of Appeals October 11, 1983. The Board was in
agreement of the following:
(1) Relocate doors to the rear of the building.
(2) Relocate building for maximum exposure.
(3) Removal of the westerly doors as indicated
on plan.
This application will be held in abeyance pending receipt
of amended plans to reflect relocation of the vehicle entrance/
exit doors. Kindly forward three (3) plans to our office.

In regards to the action taken on my appeal,no.3161 for a special
exception and permission to establish a public garage/repair station,
in a B-] general business district,premise knov~n as 45845 Nort:~ Road,

i would greatly appreciate if the board would review and reconsider
their determination as to the location of the bay doors of tl~e building.
There are seversl reasons why I would like ti~s bay doors locazed on the
West side instead of the North as the board determined. I designed the
building to be appealing,functional and within my financial capacity. To
relocate the b~y doors would totally disrupt the interior and exterior
flow of vehicles. The bay doors on the west side -;ould be for automobiles
and ~he larger door on the north for trucks.Also the survey/ plan shows
the first door would be aproximately 65' feet from the road on the side
facing my adjacent property o~mers bay doors.And lastly,followin~ the
planning board pre-submission conference,not knowing about the changes
of the bay doors,I had architectural drawings dra~ at a considerable
expeBse.
I always had in mind to design the building to be appealing and to be
reflective of the service I want to render.Please reconsider my appeal
to retain the bay doors as they are on my survey/plan.

The public hearing on this application was held on August 31, 1983.
Upon application for PETER LUHRS, by Michael J. Hall, Esq., 218
Front Street, Greenport, NY for a Special Exception to the Zoning Ordi-
nance, Article VII, Section 100-70(B) [4] for permission to establish a=
public garage/repair station in this B-1 General Business District,
premises known as 45845 North Road, Southold, NY; County Tax Map Parcel
No. 1000-55-02-17 (Owner: L.P. Edson).
The board made the following findings and determination:
~- This is an application for a Special Exception pursuant to Article
VII, Section 100-70(B) [4] of the Southold Town Zoning Code to establish
a public garage or repair station containing approximately 1,700 sq. ft.
of building and which will be set back from the County Road approximate-
ly 40 feet, from the west side line approximately 35 feet, from the rear
property line approximately 55 feet. The parcel in question is zoned
"B-1 General Business," contains an area of approximately 22,500 sq. ft.
with 149.42' frontage along County Road 48, and is presently vacant.
Applicant proposes to locate the bays of the garage at the rear of the
proposed building and same will not be visible from the street from
either direction. The ingress, egress, parking and screening shall
be as required by the Southold Town Planning Board in consideration of
its site plan. The setbacks of this proposed structure will meet the
minimum requirements of the zoning code as shown on survey/plan dated
February 6, 1967 with sketched-in amendments.
It is noted for the record that alterations or new construction
other than as shown on the site plan and approved herein shall be
subject to review and approval by the Board of Appeals, Planning
Board, Building Department, and any and all other agencies which may
be involved.
The members of this board have personally visited the site and
are familiar with the property as well as the surrounding neighbor-
hood. Adjoining the subject premises on the west is a parcel of
land contaning 37,700 sq. ft. in area, also zoned "B-1 General
Business" and which was granted use variances on October 15, 1981
and July 29, 1982 in Appeals No. 2890 and No. 3009, respectively,

for a one-family dwelling and manufacturing of small mechanical
parts. Adjoining the subject parcel on the east is a vacant lot
and further east VanDuzer's Gas and Wheeler's Gas and Repair Station,
also zoned "B-t General Business."
In considering this application, the board determines: (1) that ~.]
the use will not prevent the orderly and reasonable use of adjacent
properties in adjacent-use districts; (2) that the use will not
prevent the orderly and reasonable use of permitted or legally estab-
lished uses in the district wherein the proposed use is to be located,
or of permitted or legally established uses in adjacent use districts;
(3) that the safety, health, welfare, comfort, convenience or order
of the town will not be adversely affected by the proposed use and
its location; and (4) that the use will be in harmony with and
promote the general purposes and intent of zoning and the master plan.~.,
On motion by Mr. Grigonis, seconded by Mr. Douglass, it was
RESOLVED, that Appeal No. 3161, application of PETER LUHRS for
a Special Exception to the Zoning Ordinance, pursuant to Article VII,
Section 100-70(B) [4], for a repair station, BE AND HEREBY IS APPROVED
SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the applicant (and/or his successor) shall conform with
the following prior to the operation of this business:
(a) No major repair work is to be done out in the open;
(b) No automobiles, automobile parts, dismantled or damaged
vehicles, and similar articles, shall be stored out in the open. All
vehicles to be serviced must be stored in the rearyard area only
[except when inside] and the rearyard area to be used for storage ~
must be properly screened with a six-foot stockade fence;
(c) There shall be no more than 10 vehicles in this screened
storage area at one time;
(d) The parking areas shall be as designated by the Planning
Board (with a minimum of six parking spaces at 350 sq. ft. each) and
shall be laid out as to avoid the necessity of any vehicle backing out
across any public right-of-way and shall be located not less than 10
feet from any property line;
(e) No sales of gasoline, fuel, or flammable oils are per-
mitted;
(f) No motor vehicle sales are permitted;
(g) Vehicle lifts or pits, dismantled vehicles, other than
such minor servicing such as changing tires, shall be conducted within
the building;
(h) Vehicle entrance/exit doors shall be located at rear of
building.
2. In the event it is found that the subject premises are being
used in a manner other than that permitted by this approval or the
zoning ordinance, or are in violation of these conditions or of the
zoning ordinance, the Board of Appeals may automatically terminate the
relief granted hereunder; and the subject premises would return to
its original status;
3. That this matter be referred to the Suffolk County Planning
