Please let this confirm the following action taken by
the Planning Board, Monday,June 15, 1987.
RESOLVED that the Southold Town Planning Board amend
the conditional resolution of approval of June 1, 1987 for
the site plan propsoal for Carmine and Donna Marie DiSpirito
to delete the condition requesting that a landscape plan
indicting a 10' buffer from the existing houses be submitted.
The amended resolution will now read as follows: "RESOLVED
that the Southold Town Planning Board approve the site plan
for Carmine and Donna Marie DiSpirito for construction of
a two-family dwelling located at Young's Avenue, Southold,
site plan survey dated as amended May 4, 1987, (tax map no.
1000-55-2-p/o 1 ).
When the Chairman has endorsed the site plan, we will-
forward a copy to you.

On a motion made by Mr. Latham, seconded by Mr. Mullen, the
following action was taken:
WHEREAS, Charles W. Bowman, has applied to the Southold
Town Planning Board for a subdivision for 2 lots on 7.02 acres
located at Main Bayview Road, Southold, (application Bowman,e~.~
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: ~~
1. That pursuant to the provision of Article 8 of the
ENvironmental Conservation Law,; Part 617 of Title 6 of the
New York State Codes, Rules and Regulations, and Chapter 44
of the Southold Town Code, the Southold Town Planning Board,
as lead agency, does hereby determine that the action proposed
is Unlisted and is likely to have a significant effect on
the environment.
2. That the Planning Board shall file and circulate such
determination as required by the aforementioned law, rules
and code.
3. That the Planning Board immediately notify the applicant,
Charles W. Bowman, (application Bowman et.al.) of this determination,
and further request said applicant to prepare a Draft Environmental
Impact Statement in accordance with the Scope and contents
required by the Planning Board and Planning Consultant, all
in accordance with said law, rules and code.
4. An initial scoping product and SEQRA fee determination,
pursuant to Chapter 44, Section 20 of the Town Code, will
forwarded as soon as it is determined.

. Carmine and Donna Marie DiSpirit~ - The Board reviewed this
site plan for construction of a two-family house located at
Young's Avenue, Southold. This proposal has received a special
exception from the Board of Appeals and has been certified
by the Building Department. The Planner, Valerie Scopaz recommended
that the Board ask for a more detailed site plan so that the
Board can see if the house is in keeping with the character
of the neighborhood. Ms. Scopaz also noted to the Board that
the house is proposed for the back of the lot so it will be
be in proximity to the back yards of the new houses which
are being build and the existing house. It was felt that
more of a buffer should be requested and Ms. Scopaz asked
that the Board consider a 10' buffer planted next to the adjacent
property, to at least protect the privacy of the existing
residence. This is under the jurisdiction of the Board for site plan.

site plan survey dated as amended last May 4, 1987: subject
to: (tax map no. 1000-55-2-p/o 1)
1. A landscape plan indicating 10' buffering from the
existing houses.

On a motion made by Mr. MUllen, seconded by Mr. Edwards, it was
Mullen Motors - The Board reviewed this site plan for a parking
lot located at Cottage Place, Southold.It was noted that
the Board of Appeals had granted a special exception for the
proposaland it had received certification from the Building
Department. Ms.Scopaz stated that the plan exists almost
entirely in the residential zone and there are three residences
across the street. She that the plan indicates that the unpaved
area of the parking lot be seeded and in deference to the
existing, established residential character of the neighborhood
she requested that the Board give consideration to requesting
that a row of evergreen bushes to block the cars from the
existing residences. Ms. Scopaz also recommended to the Board
that the lights be in keeping with the residential character
so the existing residences don't have a flood light beaming
down in their yard. Mr. Orlowski stated that the flood lights
were requested in the parking area and Mr. Lessard enforces
the code with regard to the lights being shielded and not
offensive to the neighbors. Mr. Lessard stated that the lights
would have to be shielded to the property. Mr. Orlowski stated
that the trees in front to screen the parking lot would be
a good idea. Mr. Mullen stated that trees may obstruct the
line of visions going out of the parking lot. Mr. Mullen
noted that it is a busy area and he suggested low shrubs,
3 or 4 feet. He was in favor of the buffering but also concerned
about the safety factor. Mr. Lessard suggested that the Board,
if they want shrubbery, that the shrubs be no higher than
30" as on a corner lot so the vision is not blocked. (1000-61-3-19) ~

only located at Cottage Place, Southold, site plan survey
dated as amended April 7, 1987, subject to:

Application of CARMINE AND DONNA DiSPIRITO for a Special Exception
to the Zoning Ordinance, Article III, Section 100-30(B)[lJ for permis-
sion to establish and construct two-family dwelling at 6030 Youngs
Avenue, Southold, NY; Minor Subdivision Map 378, Lot 4; County Tax
Map District 1000, Section 55, Block 2, Lot 1.4.
WHEREAS, a public hearing was held and concluded on April 2,
1987 in the Matter of the Application of CARMINE AND DONNA DiSPIRITO
under File No. 3615; and
WHEREAS, at said hearing all those who desired to be heard were
heard and their testimony recorded; and
WHEREAS, the board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surroundi ng areas; and
WHEREAS, the board made the following findings of fact:
1. By this application, applicants request a Special Exception
as regulated under the Provisions of Article III, Section 100-30(B),
subsection [lJ, of the Zoning Code for permission to establish
two-family dwelling use in a proposed principal dwelling on this
vacant parcel.
2. The property in question is located in the "A-80" Residen-
tial and Agricultura.l Zonin.~ District, having frontage along the
east side of Youngs Avenue (a/k/a Railroad Avenue), and a total
acreage of 4.102 acres as more particularly shown by survey amended
February 25,1987, prepared by Roderick VanTuyl, P.C.
3. The subject premises is more particularly referred to as
Lot No.4, Subdivision Map No. 378 approved by the Southold Town
Planning Board, and is identified on the Suffolk County Tax Maps
as District 1000, Section 55, Block 2, Lot 1.4.

Decision Rendered April 23, 1987
4. Column "A-180" of the Bulk and Parking Schedule of the
Zoning Code, and Article III, Section 100-30(B)[1] permit a
two-family dwelling by Special Exception, subject to site plan
approval by the Planning Board, a minimum lot area of 180,000
sq. ft., minimum lot width of 270 feet, and minimum lot depth
of 250 feet. Each dwelling unit is required and is proposed
to .have a minimum liveable area of 850 sq. ft., at a maximum
height of 35 feet. The total lot width and depth of the
premises is shown to be 316.93 feet and 668.07 feet, respectively.
5. It is noted for the record that Certificate of Occu-
pancy No. Z14118 dated December 26, 1985 has been issued to
Randazzo Building Co., Inc. (predecessors in title) concerning
this property.
6. The survey plan amended February 25, 1987 depicts
the proposed location of the two-family dwelling which is
shown: (a) to be set back 125 feet from the west front
property line, and building envelope outlining the minimum
setback requirements of 30 feet from the north side line,
20 feet from the south side line, and 75 feet from the rear
(east) property line; (b) a minimum lot area of 160,000 sq.
ft. for thi s two-fami 1y use.
7. In making this determination, it shall be understood
that this project shall not violate any building or zoning
code regulations and accordingly must be established in _
accordance with all rules and regulations for a two-family
dwelling structure and use.
In considering this application, the board also finds and
determines that: (a) the use requested will not prevent the
orderly and reasonable use of adjacent properties or of properties
in adjacent use districts; (b) the use will not adversely affect
the safety, welfare, comfort, convenience or order of the town;
(c) the use is in harmony with and promote the general purposes
and intent of zoning. The board has also considered subsections
[a] through [1] of Article XII, Section 100-121(C)[2] of the
Zoning Code in making this determination.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Sawicki, it was
RESOLVED, that a Special Exception BE AND HEREBY IS APPROVED
in accordance with Article III, Section 100-301UBT[1] of the Zoning
Code in the Matter of the Application of CARMINE AND DONNA DiSPIRITO
for the establishment of a two-family dwelling use, SUBJECT TO
THE FOLLOWING CONDITIONS:
1. Each dwelling unit/apartment shall have a minimum
livable floor area of 850 sq. ft. pursuant to the requirements
of the Bulk Schedule of the Zoning Code;
2. The second dwelling unit's exterior entranceway shall
not be at the front (road) side;'
3. Subject premises shall remain a minimum area of 160,000
sq. ft. as applied for this two-family dwelling use.
