NOTICE OF SIGNIFICANT EFFECT ON THE ENVIRONMENT
April 9, 1985
Pursuant to the provisions of Article 8 of the Environmental Conservation
Law; Part 617 of Title 6 of the New York State Codes, Rules and Regulations;
and Chapter 44 of the Southold Town Code, the Southold Town Board, as lead
agency, does hereby determine that the action described below is a Type I action
and is likely to have a significant effect on the environment.
DESCRIPTION OF ACTION
Application of Suffolk Cement Precast, Inc. for a Sand and Gravel Pit'
Permit on certain property located at the west side of Cox's Lane and south
side of Oregon Road, Cutchogue, New York.

WHEREAS, Suffolk Cement Precast, Inc. has heretofore applied to the
Southold Town Board for a Sand and Gravel Pit Permit on certain' prop-
erty located at the west side of Cox.s Lane and south side of Oregon
Road, Cutchogue, New York,
NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS:
1. That pursuant to the provisions of Article 8 of the Environmental
Conservation Law; Part 617 of Title 6 of the New York State Codes, Rules
and Regulations, and Chapter 44 of the Southold Town Code, the Southold
Town Board, as lead agency, does hereby determine that the action proposed
isa Type I action and is likely to have a significant effect on the environ-
ment.
2. That the Town Clerk shall file and circulate such determination as
requi red by the aforementioned law, rules and code.
3. That the Town Clerk immediately notify the applicant, Suffolk
Cement Precast, Inc., of this determination, and further request said'
applicant to prepare a draft environmental impact statement, all in accord-
ance with said' law, rules and code.

The first consideration to be addressed is, what benefit
or gain would such a condition be for Southold Town? Certain-
ly it is not to have another hole added to the community. The
Town has two abandoned sites in Laurel; one in Southold; another
in East Marion; and a fifth one in Orient. By the time the hole
becomes a reality; the Town will not be able to use it for a
disposal area expansion because it will outlaw such a disposal
procedure years before. Does the Town need a cement block plant
in the Town? I think not. The application asks Southold Town
to waver all its restrictions on the contention that they pro-
pose putting up a building or buildings in the future for some
unspecified operation. In the meantime the excavation will sal-
vage the operation in Calverton.
The survey of the area indicates the operation will come to
within ten feet above the water table. Is the Town willing to
gamble on side-leakage from the presently lined disposal area in-
to the water table? The Town is getting enough correspondence
from the environmental agency on water & gas conditions now in
this area. I fail to see any benefits the Town would derive from
such an operation.

8. Comnents:
The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article V and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Article XII. The Lead Agency is requested
to forward a copy of this form to the applicant with its findings.

MINING PLAN NARRATIVE
This is a surface unconsolidated type of mine. The screening
of the area is afforded due to a natural terrain of the property.
In addition, the applicants propose to further screen the property
from Oregon Road and neighbors on the West by constructing a berm
along both boundaries. Along the boundaries fronting on Oregon
Road and to a depth of approximately two hundred fifty (250') feet
off of Oregon Road Japanese Black Pines or an approved equivalent
would be planted. The mining site will eventually be lower than the
surrounding area. The area to the North bordering Oregon Road is
farmland. The area to the East is woodland currently and would be
graded over and part of it replaced by an industrial plant site.
The area to the West is farmland with the exception of a house
located at the Northwest corner of the project and the area to the
South is owned by the Town of Southold which uses it for a sanitary
landfill and current mining operation. The mining area will be on
slopes. The slopes will be one (1') foot vertical for a slope of
one (I') foot horizontal. The mining for the current term shall
proceed in a Westerly direction. Thereafter the applicants will
proceed in both a Westerly and Northerly direction in successive
permit terms. The property will be excavated by front end pay-
loaders and placed on dump trucks.
There are no noise or pollution problems presented.
RECLAMATION PLAN NARRATIVE
It is anticipated that when the site is fully mined that the
site will be an industrial plant site. In the event that it should
not prove economically feasible to do so, then, of course, the land
would be re-vegetated. The area will be covered with six (6")
inches of topsoil in accordance with the Town of Southold requirements.
Sufficient grasses would be planted to hold the topsoil in place.
The area is extremely suitable for an industrial plant site.
It is intended that Suffolk Cement Products, Inc., a cement
plant operation, having its main plant located at Calverton, New
York, will operate a plant at the Southeast corner of the area,
as this will be the first area to be mined and prepared for an
industrial plant site.
The berms and plantings referred to in the mining plan narrative
will operate to serve as an additional natural screening in addition
to the woods along the Easterly boundary of the property.

I have read the Suffolk Cement Precast, Inc. Reclamation Plan Narrative
on the Rider attached hereto. At the present time there is an application for
a permit for a sand and gravel permit before the Southold Town Board. How-
ever, a public hearing must be held on the application and a determination
made by the Board thereafter.

Impact On Land
1. Will there be an effect as a result of a physical change to
project site?
The detailed statement submitted with this application
describes the existing site conditions and method of
operation. In order to economically mine the sand and
gravel, the excavation will create slopes of 1:1. As
the property existing is relatively flat agricultural
land, this physical change is substantial. The impact
on the land will be mitigated by the implementation of
the proposed restoration plan. .
The restoration plan indicates that the property will be
regraded after the mining operation is completed to
create a fresh water pond surrounded by land which has
been attractively graded, ~opsoiled and seeded.
Impact On Visual Resource
10. Will the project affect views, vistas or the visual character
of the neighborhood or community?
The potentially large impact on the visual resource,
that is, the change from relatively flat agricultural
land to an open pit mine, will be mitigated by leaving
the majority of the existing woodlands at the north-
easterly side of the proposed mine, by creating an
earth berm on the northwesterly and southwesterly sides
and by establishing screen plantings, as shown on the
excavation plan. These factors will visually screen
the entire excavation on three (3) sides. The south-
easterly side is adjacent to Cutchogue Landfill.

You sent me a copy of the application and supporting documents in the
above matter and asked for my comments, which are as follows:
1. It appejlrs that the applicant is a contract vendee to purchase 15.7
acres of land on the west side of Cox Lane at Cutchogue from
Leander B. Glover, Jr. I t is apparently the intention of the
applicant to excavate sand and gravel from 9 acres of this land and
to establish an industrial park on the remaining 6 acres, including a
cement manufacturing plant.
2. The Code of the Town of Southold requires a minimum of 20 acres
for a sand and gravel excavation facility. The total land in question
is 15 acres
3. The Town Code provides that operations be setback at least 200 feet
from all streets and highways and 150 feet from all property lines.
The applicant requests a waiver of the street setback requirements
from 200 feet to 100 feet and the boundary line requirements from
100 feet to 50 feet.
4. The applicant indicates that a total in excess of 500,000 cu. yds. is
proposed to be excavated at a rate of approximately 100,000 cu.
yds. per yr.
5. The applicant intends to excavate to a depth of 5 feet above ground
water. It would appear that the excavation will be approximately 15
ft. deep.
In summary, it would appear that the proposed application is at variance
with most of the code requirements as to mimimum area requirements and
minimum setback requirements.

As to the SEQUA process, it would seem to me that extensive excavation
and industrial operations are intended to take place on the site which may
involve dust, noise and heavy equipment operations and that the extent
of sand and gravel excavation will change the character of the premises,
all of which, it seems to me to be likely to have an adverse affect upon
the environment and, therefore, require a draft environmental impact
statement. .

Conservation and they have advised me that in view of the fact that the

that it is not a Type 1 action and would not require an environmental
impact study.
There is enclosed herewith as well, three New York State Department
of Environmental Conservation Mining Permit Applications and Reclamation
Reports that requires a signature at item 27 of the Chief Administrative
Officer of the municipality having immediate jurisdiction over the proposed
mine site.
I carefully point out to you that this signature only states that
you have been given notice of the fact that we are filing an application
with the State of New York.
I would appreciate it if the three copies could be executed by
your Administrative Officer, dated and returned to our office so that
we may proceed to file our application simultaneously with the State of

3. Suffolk Cement Precast, Inc. intends to purchase a sixteen (16)
acre parcel, and utilize the area fronting on Cox's Lane as a small
industrial plant site. They intend to utilize the area nearest to
the highway to construct three (3) buildings to be located thereon.
The existing woods behind the industrial plant site would be
utilized as a natural boundary to the actual excavation site. A
thirty (30') foot roadway would be constructed off of Cox's Lane
into the interior of the premises.
The excavation would commence in the Southeasterly corner of the
premises. Once this area in the Southeast corner was substantially
mined, it would be leveled and Suffolk Cement Precast, Inc. intends
to enter into a lease with Suffolk Cement Products, Inc., a cement
manufacturing company, located at Calverton, New York, to operate a
similar plant site there.
The intention would be to thereafter mine the area proceeding in
a Westerly direction, and eventually to mine the entire proposed
excavation site as shown on the site plan presented herewith.
In order to screen this property from Oregon Road, and neighbors
on the West a berm would be constructed along both boundaries. Along
the boundaries fronting on Oregon Road and to a depth of approximately
two hundred fifty (250') feet off of Oregon Road, Japanese Black pines
or an approved equivalent would be planted.
At such time as the entire area is mined, the area would be graded
on an approximate slope of one on four. The entire area as part of the
reclamation project would have to be covered with six (6") inches of
topsoil in, accordance with the Rules and Regulations of the Town of
Southold. It is intended that the area be mined to approximately five
(5') feet above groundwater level. The reclaimed area would be
developed for additional industrial park sites. It would be unrealistic
to indicate that any part of the area would be rehabilitated prior to
December 31, 1985.
In order to file a New York State application, it is necessary
that the consent of the Town of Southold be approved. The applicants
have met with representatives of the New York State Department of
Environmental Conservation who have acutally had an on site inspection.
The current regulations of the Town of Southold indicate that the
proposed site must have a minimum of twenty (20) acres. The entire
parcel involved is only 15.7 acres. The entire area to be mined over
the length of the mining operation would be nine (9) acres, and, there-
fore, we must have a waiver of that part of the Town's requirement.
The regulations further provide that any proposed operations are to
be set back at least two hundred (200') feet from any road, street,
avenue or highway, and set back one hundred fifty (150') feet from any
property line. The New York State regulations require only a twenty-
five (25') foot set back. In view of the fact that if we were to be
required to adhere to these required setbacks, it would render the
usable area uneconomically feasible to mine. A waiver is sought reducing
the setbacks from the road to one hundred (100') feet, and along the
adjacent property owners to fifty (50') feet. The rear of this property
adjoins the Town of Southold Landfill operation. There is a hill and
existing woods to screen the easterly side. The construction of a berm
and the planting of trees along Oregon Road and along the easterly
boundary would serve to screen the operation from the public's view.
In addition, we are requesting that we be permitted to use that area
fronting on Cox's Lane for the future development of an industrial park
Qite, and that since the area would not be used for storage of materials
mined, or equipment from this use, that we be permitted to develop said
area.

14. METHOD OF REHABILITATION
Rehabilitation will be accomplished by regrading as shown on the
attached plans the restoration plan indicate' that the maximum
restored slope will be 1:2, indicates one acre pond and a area

After grading as shown on the restoration plan has been completed

APPLICATION FOR PERMIT FOR SAND AND GRAVEL
PIT OR OTHER EXCAVATION PURPOSES
3. Suffolk Cement Precast, Inc. intends to purchase a sixteen (16)
acre parcel, and utilize the area fronting on Cox's Lane as a small
industrial plant site. They intend to utilize the area nearest to
the highway to construct three (3) buildings to be located thereon.
The existing woods behind the industrial plant site would be
utilized as a natural boundary to the actual excavation site. A
thirty (30') foot roadway would be constructed off of Cox's Lane
into the interior of the premises.
The excavation would commence in the Southeasterly corner of the
premises. Once this area in the Southeast corner was substantially
mined, it would be leveled and Suffolk Cement Precast, Inc. intends
to enter into a lease with Suffolk Cement Products, Inc., a cement
manufacturing company, located at Calverton, New York, to operate a
similar plant site there.
The intention would be to thereafter mine the area proceeding in
a Westerly direction, and eventually to mine the entire proposed
excavation site as shown on the site plan presented herewith.
In order to screen this property from Oregon Road, and neighbors
on the West a berm would be constructed along both boundaries. Along
the boundaries fronting on Oregon Road and to a depth of approximately
two hundred fifty (250') feet off of Oregon Road, Japanese Black Pines
or an approved equivalent would be planted.
At such time as the entire area is mined, the area would be graded
on an approximate slope of one on four. The entire area as part of the
reclamation project would have to be covered with six (6") inches of
.topsoil in accordance with the Rules and Regulations of the Town of
Southold. It is intended that the area be mined to approximately five
(5') feet above groundwater level. The reclaimed area would be
developed for additional industrial park sites. It would be unrealistic
to indicate that any part of the area would be rehabilitated prior to
December 31, 1985.
In order to file a New York State application, it is necessary
that the consent of the Town of Southold be approved. The applicants
have met with representatives of the New York State Department of
Environmental Conservation who have acutally had an on site inspection.
The current regulations of the Town of Southold indicate that the
proposed site must have a minimum of twenty (20) acres. The entire
parcel involved is only 15.7 acres. The entire area to be mined over
the length of the mining operation would be nine (9) acres, and, there-
fore, we must have a waiver of that part of the Town's requirement.
The regulations further provide that any proposed operations are to
be set back at least two hundred (200') feet from any road, street,
avenue or highway, and set back one hundred fifty (150') feet from any
property line. The New York State regulations require only a twenty-
five (25') foot set back. In view of the fact that if we were to be
required to adhere to these required setbacks, it would render the
usable area uneconomically feasible to mine. A waiver is sought reducing
the setbacks from the road to one hundred (100') feet, and along the
adjacent property owners to fifty (50') feet. The rear of this property
adjoins the Town of Southold Landfill operation. There is a hill and
existing woods to screen the easterly side. The construction of a berm
and the planting of trees along Oregon Road and along the easterly
boundary would serve to screen the operation from the public's view.
In addition, we are requesting that we be permitted to use that area
fronting on Cox's Lane for the future development of an industrial park
site, and that since the area would not be used for storage of materials
mined, or equipment from this use, that we be permitted to develop said
area.

14. METHOD OF REHABILITATION
Rehabilitation will be accomplished by regrading as -shown on the
attached plans the restoration plan indicates that the maximum
restored slope will be 1:2, indicates one acre pond and a area
of moderate slopes "surrounding the pond.

After grading as shown on the restoration plan has been completed
the excavation site and disturbed areas will be covered with a
minimum of 6" of top soil obtained from the stockpiles and the
entire area seeded.

Impact On Land
1. Will there be an effect as a result of a physical change to
project site?
The detailed statement submitted with this application
describes the existing site conditions and method of
operation. In order to economically mine the sand and
gravel, the excavation will create slopes of 1:1. As
the property existing is relatively flat agricultural
land, this physical change is substantial. The impact
on the land will be mitigated by the implementation of
the proposed restoration plan. .
The restoration plan indicates that the property will be
regraded after the mining operation is completed to
create a fresh water pond surrounded by land which has
been attractively graded, ~opsoiled and seeded.

Impact On Visual Resource

of the neighborhood or community?
The potentially large impact on the visual resource,
that is, the change from relatively flat agricultural
land to an open pit mine, will be mitigated by leaving
the majority of the existing woodlands at the north-
easterly side of the propo'sed mine, by creating an
earth berm on the northwesterly and southwesterly sides
and by establishing screen plantings, as shown on the
excavation plan. These factors will visually screen
the entire excavation on three (3) sides. The south-
easterly side is adjacent to Cutchogue Landfill.

As to the SEQUA process, it would seem to me that extensive excavation
and industrial operations are intended to take place on the site which may
involve dust, noise and heavy equipment operations and that the extent
of sand and gravel excavation will change the character of the premises,
all of which, it seems to me to be likely to have an adverse affect upon
the environment and, therefore, require a draft environmental impact
statement.
