Dear Mr. Pell:
Pursuant to your request, I have inspected and do hereby
submit an appraisal of the above captioned property.
In making this appraisal, I have taken into consideration
location, accessibility, neighborhood and all ether factors neces-
sary to estimate its value.
Based on these findings, I judge the "Market Value" of
the Subject Property on January 24, 1980, to be $180,000.
The report outlining the basis upon which this opinion
rests is attached hereto and made a part hereof.

PURPOSE OF APPRAISAL
The purpose of this appraisal is to determine the Market Value
of Subject Property.
In my opinion the term "Market Value" means:
The highest price expressed in terms of money
the property would command if offered for sale
in the open market with a reasonable amount of
time allowed to complete the transaction and
with both seller and buyer being equally well
informed and acting willingly.
In making the estimate of "Market Value" of the Subject Property,
the appraiser has considered income, zoning, functional obsolescence
and marketability.
CERTIFICATION
I do hereby certify that I have made a personal inspection of
Subject Property and an analysis of those factors affecting its value:
That I have no present interest in the property: That neither the em-
ployment to make the appraisal nor the compensation I receive is con-
tingent upon the value of the property reported and to the best of my
knowledge and belief all statements and information in this report are
true and correct and no important facts have been withheld or over-
looked. This appraisal has been completed in accordance with the Code of
Ethics as established by the Eastern Suffolk Board of Realtors.

PROPERTY IDENTIFICATION
The Subject Property can be identified on the Suffolk County Tax
Map as follows:
District 1000, Section 83, Block 3, Lot 4
District 1000, Section 83, Block 3, Lot 4.1
These tax maps are the official maps used by Suffolk County, State
of New York. The property was found to be zoned C-l.
GENERAL INFORMATION
The parcel contains approximately 40 acres and is located North
of Oregon Road, East by Cox Lane, McBride, Heidtmann, Harris, Muratore
and ESC Co-op, South by Pietrewicz, West by the Town of Southold and
District 9 Cutchogue, Town of Southold, County of Suffolk, State of
New York.
The present use of the property is as a mining operation of
sand and gravel and potato farming.
The sand pit comprises about 7.2 acres of the over-all property.
The entire property was found to be zoned C-l, General In-
dustrial District.
The 1979 - 1980 Southold Town assessment was:
District 1000, Section 83, Block 3, Lot 4 - $1000. land
District 1000, Section 83, Block 3, Lot 4.1 - $9100. land
GENERAL INDUSTRIAL DISTRICT C-l
The following list are those locations within the Town of South-
old that are zoned C-l:
1. Mattituck, Naugles Drive area approximately 18 acres.
2. Cutchogue, Northeast corner of Depot Lane and the North
Road approximately 45 acres.
3. East Marion, 2 small pieces off Rocky Point Road
approximately 2 acres.
4. East Marion, East of Stars Road, North of the Main Road
and West of Dam Pond approximately 20 acres.
5. East Marion, South end of Shipyard Lane approximately 19 acres.
6. Southold, Young's Avenue Agway property approximately 5 acres.
7. Cutchogue. Cox Lane and Oregon Road including subject property
and surroundings approximately 77.5 acres.
These are approximately 187 acres within Southold Town with C-l
zoning, of which the subject property represents 21 percent of all
property within this C-l zoning designation.
The uses allowed with special exception by the Boaed of Appeals
and site plan approval are listed on pages 10040 through 10041 of the
Code of the Town of Southold. Some of those uses include Blast Fur-
nances, acid manufacturing, smelting and crematories. The minimum
lot size is 200,000 square feet.
The point here is to show there is very little C-l zoning ~n the
Township and that the subject parcel represents fully one-fifth of all

properties within the Township so zoned.
The purpose of this appraisal is to calculate the value of
the southerly 15 acres that abuts the Town of Southold property
and the jib that goes out to Cox Lane (see Exhibit I). This area
includes the permitted sand pit area and approximately 8 acres of
C-l zoned land not in the permitted sand pit area.
SAND PIT
Exhibit I-A shows the area of the present sand pit and the cal-
culated amount of cubic yards of sand left in the pit as of January
24, 1980.
Mr. Van Tuyl (licensed Surveyor) did the calculation based on a
one foot to one foot bank and a 40 foot depth. His calculations show
that there is approximately 370,000 cubic yards of sand in the pit
to be mined.
I went through all the records in the Southold Town Clerk's
office pertaining to the permit for the sand pit operation. The
original resolution was passed by the Southold Town Board on October
26, 1971 (Exhibit II). At that time, the Board authorized a pit of
3.014 acres (Exhibit II-A). A renewal of the permit was presented
to the Board each year thereafter and approved with no problems and
some modification in favor of Glover
On December 9, 1975, Glover requested an increase in area of
an additional 4 acres and some other modification to the original
application (see Exhibit II-B and II-C) which was passed without
objection.
Each year thereafter the permit came up for renewal and was
approved. See Exhibit III, which is the last approval by the Board
on February 26, 1980.
The conclusion I have drawn for the purpose of this appraisal

is that Glover has a viable operation, even though he has a yearly
permit. The Board has approved the application each year with no
objection and has, in one instance, increased the permissible size
of the operation. Therefore, a buyer of the property might reasonably
expect that the Board will continue to approve future application
under the same conditions and be willing to pay fair market value.
I spoke to Mr. Fred Abinet, who is the owner of AAAA Central
Sand & Gravel, Inc. in Islip, New York. Mr. Abinet's qualifications
range from purchasing sand and gravel pits in California, Arizona,
South America and three pits on Long Island.
Mr. Abinet's opinion is that based on a $1.50 to $2.00 per
cubic yard loaded at the pit, the market value for a pit would range
from $.20 to $.30 per estimated cubic yards in the pit, depending on
the quality of the run of sand and gravel.
I spoke to R. Jacobs of the Southold Highway Department, and
asked his opinion of the quality of sand in the subject pit and the
surrounding areas. Mr. Jacobs' opinion was that the run of sand was
very good.
Therefore, using Mr. Van Tuyl's figure of 370,000 cubic yards
of sand left to be excavated, and Mr. Jacobs' opinion of a good run
of sand, and Mr. Abinet's opinion of $.20 to $.30 per cubic yard of
sand left to be excavated, my opinion is that the value of the 7.2

acre sand pit on January 24, 1980, should be based on $.27 per cubic
yeard, or $99,900., say $100,000.
I've used the figure of $.27 because the run of sand is good
and not excellent, and also because of the minimum amount of sand
left in the pit to be excavated under the present permit.
VALUE OF 8 ACRES OF C-l ZONED PROPERTY
I've pointed out the scarcity of C-l zoned property in the
Town of Southold and there is relatively few comparables in Southold
Town to use for valuation purposes. The two comparables in the im-
mediate area of the Subject Property are as follows:

The Subject property has 195 feet of frontage on Cox Lane and
a portion of the 2 acres outlined on Exhibit I have been excavated
for sand. The northerly 6 acres is presently being used as a potato
farm.
Therefore, using the minimum amount of comparables, the
uniqueness of the C-l zoning, the minimum amount of road frontage
for the size parcel (15 acres), understanding that one acre of the
2 acre parcel has been partially excavated and the lack of heavy
buyer demand for C-l zoned property, my opinion of value is $10,000.
per acre, or $80,000.
SUMMARy
In summary, in my opinion a fair market value for the
Subject Property would be:
1. Sand pit on January 24, 1980
2. 8 acres @ $lO,OOO./acre
Total
$100,000.
$80,000.
$180,000.
The boundary lines on all the surveys in the Exhibit are
approximate and a new survey should be made, then a final cal-
culation of value should be done.

This appraisal is subject to the following limiting conditions:
The legal description furnished is assumed to be correct.
I assume no responsibility for matters legal in character, nor
do I render any opinion as to title, which is assumed to be marketable.
All existing liens and encumbrances have been disregarded and the
property is appraised as though free and clear under responsible
ownership and competent management.
The maps and sketches in this report are included to assist the
reader in visualizing the property. I hve made no survey of the
property and assume no responsibility in connection with such matters.
Unless otherwise noted herein, it is assumed that there are no
encroachments, zoning violations, or restrictions existing in the
Subject Property.
Information, estimates and opinions contained in this report are
obtained from sources considered reliable, however, no liability for
them can be assumed by the appraiser.
Possession of this report, or a copy thereof, does not carry with
it the right of publication, nor may it be used for any purpose by any
but the applicant without the previous written consent of the appraiser
or the applicant, and in any event only with proper qualification.
I am not required to give testimony or attendance in court by
reason of this appraisal, with reference to the property in question,

QUALIFICATIONS OF LEWIS L. EDSON

I have acted in many sales and purchases in the Town of Southold.
I have also bought and sold real property for my own account at
Southold and elsewhere in the Town of Southold. I am well acquainted
with real estate values in the Town of Southold.
Prior to opening First Towne Realty in June, 1976, I was with
McDonald's Corporation as Director in Charge of new site development.
During my nine year tenure, I either purchased or approved the purchase
of over 300 locations in the Northeastern section of the United States

Restoration of the slopes of sandpit of
Ieander Glover, Jr.,. Cox Lane, Southold
Gentlemen:
In the matter of the above, Paragraph #5 details the
restoration as follows: "After operations have been
completed, the excavated area, as well as all other areas
where prior excavation operations have been conducted on
the premises, shall be leveled, top soil to a depth of 3
inches shall be deposited thereon and said area shall be
seeded with grass."
We feel that the ~roper method of restoring the slopes
~ould be with peach grass 18" on center, interspersed with
small black pines, as three inches of topsoil would fail to
support 'grasses' during the summer months, due to the sand
gravel nature of the remaining soil. Beach grass, however,
will indeed tolerate the lack of moisture during the hot
months and secure the slopes from erosion, both wind and
water inspired. Within three years the slopes should be
completely stabilized. You will note the stability of the
ocean dunes with identical Slopes, though conditions are
indeed more severe.
While this is a more expensive method of restoration,
the owner and ourselves feel it will be more successful
than the directed restoration.
.The work, if approved by the Town Board, will be
completed in late March, before the beginning of April. It
will be done by Plantings by the Sea, Inc. supervised by
Peter Sterling and under Rambo's direction.

Dear Mr. Glover:
On April 7, 1981 the Southold Town Board renewed your
Excavation Permit for parcels I and II north of Middle Road
(CR 48), Cutchogue.
The aforementioned permit as granted subject to certain
conditions (copy attached) concerning rehabilitation of the
areas previously excavated within six months from the date of
the issuance of the permit, or supply the Town Board with a
surety bond in such amount as the Board shall determine,
conditioned upon the faithful and proper rehabilitation of
the excavated areas.
Please advise the Board at this time if rehabilitation

WHEREAS, Leander Glover, Jr., heretofore applied to this
Board for a permit to excavate sand, gravel, stone and other
materials from premises located on the north side of Middle Road
at Cutchogue, New York, and
WHEREAS, this Board by resolution duly adopted on the 26th
day of October, 1971, authorizing the Town Clerk to issue a
permit to the said Leander Glover, Jr. subject to the terms and
conditions set forth in said resolution; and
WHEREAS, one of the conditions to the issuance of said permit
was that the applicant enclose the premises with a wire fence
six (6) feet in height with four (4) strands of barbed wire at
the top thereof, and
WHEREAS, the applicant has requested this Board to waive the
requirement of the placing of four (4) strands of barbed wire at
the top of said fence for the reason that the same is not required
for the protection of the public for reason of the location of
said premises, and
WHEREAS, this Board has given due consideration to said
requested waiver and is of the opinion that due to the location
of the said premises the required barbed wire strands along the
top of said fence are not required for the public safety,
NOW, THEREFORE, BE IT RESOLVED, that the aforesaid resolution
of tpis Board adopted the 26th day of October 1971, be hereby
amended by deleting therefrom any reference to the placing of
four (4) strands of barbed wire at the top of the fence on the
premises of said Leander Glover, Jr., and
IT IS FURTHER RESOLVED, that the Town Clerk be and he hereby

WHEREAS. Leander Glover. Jr. has by written application applied to
this board for a permit to excavate sand. gravel, stone or other materials
from premises located north of Middle Road (Route 27), Cutchogue. New
York bounded generally northerly by lands of Glover; easterly by lands of
Glover and McBride; southerly by lands of Pietrewicz and the Town of
Southold; and westerly by lands of the Town of Southold, and
WHEREAS, a public hearing was held on said application on July 13,
1971 at which all interested persons were given all opportunity to be heard.
NOW, THEREFORE, BE IT RESOLVED that this Board does in
accordance with Section V of the Excavation Ordinance of the Town of
Southold, find that
(a) The proposed operations will not interfere with the surface
water drainage plan of the area nor endanger any street, road or highway.
(b) The circumstances of the location and terrain are reasonably
adapted to rehabilitation to the end that the premises wilt not become desert
or waste land following completion of operations.
(c) The circumstances of the location and the terrain are such
that conditions and safeguards may feasibly be imposed to assure that the
premises will not constitute an attractive nuisance or endanger the safety of
children.
(d) The use will not cause undue traffic hazards.
(e) The use will not cause undue noise or wind-blown dust or
sand.
(f) The use will not change the established character of the
neighborhood or depress the value of other lands in such neighborhood.
(g) The proposed operations are set back at least 300 feet from
any road, street, avenue or highway and that the excavation operations were
in existence at the effective date of the aforesaid excavation ordinance and

that such proposed operations will not be extended beyond the present front,
side or rear setback lines, and it is further
RESOL VED, that the Town Clerk be and he hereby is authorized and
directed to issue a permit to the said Leander Glover, Jr. for the excavation
of sand, gravel, stone, or other materials from the above described premisef
for a term of one year. subject, however, to the following terms and con-
ditions:
1. The removal of materials shall be confined to the area shown on
the map accompanying said application, a copy of which is to be signed by
the Supervisor and the applicant and filed with the Town Clerk.
2. The removal of materials from said area shall not extend below
twenty-five (25) feet above sea level.
3. All removal operations shall be setback at least 25 feet from all
property lines.
4. All slopes shall be maintained during and after operations at one
foot vertical on one foot horizontal.
5. After operations have been completed, the excavated area, as well
as all other areas where prior excavation operations have been conducted on
the premises, shall be leveled, top soil to a depth of 3 inches shall be
deposited thereon and said area shall be seeded with grass.
6. That all areas where excavation operations have been conducted in
the' past and all areas where actual excavation operations are to be conducted
in the future shall be enclosed with wire fencing of the type known as chain
link or cyclone fence or its equivalent to a height of 6 feet with four strands
of barbed wire at the top thereof which fencing shall contain no openings
except necessary gates for ingress and egress which gates shall be closed

WHEREAS Leander Glover Jr. has by written application applied to
this board for a permit to excavate sand, gravel, stone or other
materials from premises located north by Middle Road {Route 27),
Cutchogue, New York, bounded generally northerly by lands of
L. Glover; easterly by lands of J. Pratt and F. McBride; southerly
by land of Pietrewicz; and westerly by Town of Southold, and
WHEREAS a public hearing was held on said application on December
9, 1975, at which time all interested persons were given an

NOW, THEREFORE, BE IT RESOLVED that this Board does, in accordance
with Section 81-5 of the Southold Town Code, find that
(a) The proposed operations will not interfere with the
surface water drainage plan of the area nor endanger any street,
road or highway.
(b) The circumstances of the location and terrain are
reasonably adapted to rehabilitation to the end that the premises
will not become desert or waste land following completion of
operations.
(c) The circumstances of the location and the terrain are
such that conditions and safeguards may feasibly be imposed to -2~
assure that the premises will not constitute an attractive nuisanc
or endanger the safety of children.
(d) The use will not cause undue traffic hazards.
(e) The use will not cause undue noise or wind-blown dust

RESOLVED that the Town Clerk be and she hereby is authorized and
directed to issue a permit to said Leander Glover Jr. for the
excavation of sand,

to the following terms and conditions:
1. The removal of materials shall be confined to the area
shown on the map accompanying said application, a copy of which is
to be signed by the Supervisor and the applicant and filed with
the Town Clerk.
2. The removal of materials from said area shall not extend
below twenty-five (25) feet above sea level.
3. All removal operations shall be set back at least 25 feet
from all property lines.
4. All slopes shall be maintained during and after operation
at one foot vertical on one foot horizontal.
5. After operations have been completed, the excavated area,
as well as all other areas where prior excavation operations have
been conducted on the premises, shall be leveled, top soil to a
depth of three inches shall be deposited thereon and said area
shall be seeded with grass.
6. That all areas where excavation operations have been
conducted in the past and all areas where actual excavation
operations are to be conducted in the future shall be enclosed
with wire fencing of the type known as chain link or cyclone

fence or its equivalent to a height of 6 feet with four strands
of barbed wire at the top thereof which fencing shall contain no
openings except necessary gates for ingress and egress, which gate

shall be closed and locked at all hours that operations are not
being conducted on the premises.

until such fencing has been erected.

plan of the area proposed for excavation or for removal of
top soil which shall show condition of the plot or premises
before operations and the proposed condition of the same
after operations are completed, such plan to be prepared by
a duly licensed engineer or land surveyor and drawn to scale
showing all adjoining streets, location and dimensions of
premises, the location, size and use of any existing buildings.
B. A topographic survey of the premises prepared by a duly
licensed engineer or land surveyor showing contours at 10
foot intervals, using Coast and Geodetic Survey datum.
C. Duly acknowledged consents of the owner of the premises and
mortgagees, if any.

before operations and the proposed condition of the same
after operations are completed, such plan to be prepared by

RENEWAL EXCAVATION PERMIT
RENEWAL PERMIT is hereby issued to Leander Glover, Jr.,
residing at Cutchogue, New York, for the excavation of sand,
gravel, stone or other materials from premises located north
of Middle Road (Route 27, Cutchogue, New York, general described
as follows, to wit:
Northerly by lands of Glover; easterly by
lands of Glover and McBride; southerly by lands
of Pietrewicz and the Town of Southold; and
westerly by lands of the Town of Southold.
This permit is. issued pursuant and subject to the provisions
of the Southold Town Excavation Ordinance and subject to the
terms and conditions of res~lutions of the Southold Town Board

Board. If applicant requests a waiver of any of the following items, applicant
should insert at the end of application subdivisions for which a waiver is
requested.
A. Detailed statement of the proposed operation together with a
plan of the area proposed for excavation or for removal of
top soil which shall show condition of the plot or premises
before operations and the proposed condition of the same
after operations are completed, such plan to be prepared by
a duly licensed engineer or land surveyor and drawn to scale
showing all adjoining streets, location and dimensions of
premises, the location, size and use of any existing buildings.
B. A topographic survey of the premises prepared by a duly
licensed engineer or land surveyor showing contours at 10
foot intervals, using Coast and Geodetic Survey datum.
C. Duly acknowledged consents of the owner of the premises and
mortgagees, if any.

D. Receipted tax bills or photostatic copies thereof or other
proof showing payment of all taxes and assessments against
premises for which an application is requested.
E. A proposed comprehensive plan for the rehabilitation of the
premises together with a schedule of progress therefor. Such
plan to set forth the ultimate contour and grade of the area
upon completion of work, describing the area to be refilled,
top soiled and seeded and specifying the amount and extent
thereof to be performed before December 31st of the year for
which permit is being applied for.
F. Estimate prepared by a duly licensed engineer or land surveyor
of the total number of cubic yards of material to be removed
from the property during the permit period.
6. Applicant hereby requests a waiver of the requirements of paragraph 5, sub-

PERMIT is hereby issued to Leander Glover, Jr., residing
at Cutchogue, New York, for the excavation of sand, gravel,
stone or other materials from premises located north of Middle
Road (Route 27), Cutchogue, New York, generally described as
follows, to wit:
Northerly by lands of Glover; easterly by
lands of Glover and McBride; southerly by lands
of Pietrewicz and the Town of Southold; and
westerly by lands of the Town of Southold.
This permit is issued pursuant and subject to the provisions
of the Southold Town Excavation Ordinance and subject to the
terms and conditions of resolutions of the Southold Town Board
adopted October 26, 1971, and August 8, 1972, copies of which

WHEREAS Leander Glover, Jr. has, by written application, applied

to this board for a renewal of his permit to excavate sand, gravel~
stone or other materials from premises located on the north side
of Middle Road at Cutchogue, New York, and
WHEREAS a public hearing was held on the original application on
July 13, 1971, and the Town Clerk issued a permit as authorized
by resolutions dated October 26, 1971 and August 8, 1972, subject
to the terms and conditions set fcrth in said resolutions,
NNW, THEREFORE, BE IT RESOLVED that the Town Clerk be and he
hereby is authorized and directed to issue a renewal permit to
said Leander Glover, Jr. for the excavation of sand, gravel, stone
or other materials from the above described premises for a term
of one year, subject to the same terms and conditions set forth
in said resolutions of October 26, 1971 and August 8, 1972, and
further subject to the condition that the following fees be paid
before the permit is issued:
$310.00 for the excavation of 15,500 cu. yds. of fill under
permit authorized by the Southold Town Board by resolutions
adopted October 26, 1971 and August 8, 1972, and
$310.00 for the estimated excavation of 15,500 cu. yds. of

fill under renewal permit granted by resolution of the Southold
Town Board on September 11, 1973.

WHEREAS, Leander Glover, Jr., heretofore applied to this
Board for a permit to excavate sand, gravel, stone and other
materials from premises located on the north side of Middle Road
at Cutchogue, New York, and
WHEREAS, this Board by resolution duly adopted on the 26th
day of October, 1971, authorizing the Town Clerk to issue a
permit to the said Leander Glover, Jr. subject to the terms and
conditions set forth in said resolution; and
WHEREAS, one of the conditions to the issuance of said permit
was that the applicant enclose the premises with a wire fence
six (6) feet in height with four (4) strands of barbed wire at
the top thereof, and
WHEREAS, the applicant has requested this Board to waive the
requirement of the placing of four (4) strands of barbed wire at
the top of said fence for the reason that the same is not required
for the protection of the public for reason of the location of
said premises, and
WHEREAS, this Board has given due consideration to said
requested waiver and is of the opinion that due to the location
of the said premises the required barbed wire strands along the
top of said fence are not required for the public safety,
NOW, THEREFORE, BE IT RESOLVED, that the aforesaid resolution
of tpis Board adopted the 26th day of October 1971, be hereby
amended by deleting therefrom any reference to the placing of
four (4) strands of barbed wire at the top of the fence on the
premises of said Leander Glover, Jr., and
IT IS FURTHER RESOLVED, that the Town Clerk be and he hereby
is authorized and directed to issue a permit to the said Leander
Glover, Jr. subject to the terms and conditions of the aforesaid
resolution adopted by this Board on the 26th day of October, 1971,

I that such proposed operations will not be extended beyond the present front,
i side or rear setback lines, and it is further
RESOL VED, that the Town Clerk be and he hereby is authorized and
directed to issue a permit to the said Leander Glover. Jr. for the excavation
of sand, gravel, stone, or other nlaterials from the above described premise
for a term of one year, subject, however, to the following terms and con-
ditions:
1. The removal of materials shall be confined to the area shown on
the map accompanying said application, a copy of which is to be signed by
the Supervisor and the applicant and filed with the Town Clerk.
2. The removal of materials from said area shall not extend below
twenty-five (25) feet above sea level.
3. All removal operations shall be setback at least 25 feet from all
property lines.
4. All slopes shall be maintained during and after operations at one
foot vertical on one foot horizontal.
5. After operations have been completed, the excavated area, as well
as all other areas where prior excavation operations have been conducted on
the premises, shall be leveled, top soil to a depth of 3 inches shall be
deposited thereon and :,aid area shall be seeded with grass.
6. That all areas where excavation operations have been conducted in
the' past and all areas where actual excavation operations are to be conducted
in the future shall be enclosed with wire fencing of the type known as chain
link or cyclone fence or its equivalent to a height of 6 feet with four strands
of barbed wire at the top thereof which fencing shall contain no openings
except necessary gates for ingress and egress which gates shall be closed
and locked at all hours that operations are not being conducted on the
premises. That the permit authorized to be issued by this resolution shall
not be issued by the Town Clerk until such fencing has been erected.

Board. If applicant requests a waiver of any of the following items, applicant
should insert at the ena of application subdivisions for which a waiver is
requested,
A. Detailed statement of the proposed operation together with a
plan of the area proposed for excavation or for removal of
top soil which shall show condition of the plot or premises
before operations and the proposed condition of the same
after operations are completed, such plan to be prepared by
a duly licensed engineer or land surveyor and drawn to scale
showing all adjoining streets, location and dimensions of
premises, the location, size and use of any existing buildings.
B. A topographic survey of the premises prepared by a duly
licensed engineer or land surveyor showing contours at 10
foot intervals, using Coast and Geodetic Survey datum.
C. Duly acknowledged consents of the owner of the premises and
mortgagees, if any.

proof showing payment of all taxes and assessments against
premises for which an spplication is requested.
E. A proposed comprehensive plan for the rehabilitation of the

upon completion of work, describing the area to be refilled,
top soiled and seeded and specifying the amount and extent
thereof to be performed before December 31st of the year for
which permit is being applied for.
F. Estimate prepared by a duly licensed engineer or land surveyor
of the total number of cubic yards of material to be removed
from the property during the permit period.

PERMIT is hereby issued to Leander Glover, Jr., residing
at Cutchogue, New York, for the excavation of sand, gravel,
stone or other materials from premises located north of Middle
Road (Route 27), Cutchogue, New York, generally described as
follows, to wit:
Northerly by lands of Glover; easterly by
lands of Glover and McBride; southerly by lands
of Pietrewicz and the Town of Southold; and
westerly by lands of the Town of Southold.
This permit is issued pursuant and subject to the provisions
of the Southold Town Excavation Ordinance and subject to the
terms and conditions of resolutions of the Southold Town Board
adopted October 26, 1971, and August 8, 1972, copies of which
are annexed hereto.

at Cutchogue, New York, and
WHEREAS, this Board by resolution duly adopted on the 26th
day of October, 1971, authorizing the Town Clerk to issue a
permit to the said Leander Glover, Jr. subject to the terms and
conditions set forth in said resolution; and
ffilliREAS, one of the conditions to the issuance of said permit
was that the applicant enclose the premises with a wire fence
six (6) feet in height with four (4) strands of barbed wire at
the top thereof, and
WHEREAS, the applicant has requested this Board to waive the
requirement of the placing of four (4) strands of barbed wire at
the top of said fence for the reason that the same is not required
for the protection of the public for reason of the location of
said premises, and
WHEREAS, this Board has given due consideration to said
requested waiver and is of the opinion that due to the location
of the said premises the required barbed wire strands along the
top of said fence are not required for the public safety,

amended by deleting therefrom any reference to the placing of

WHEREAS, a public hearing was held on said application on July 13,
1971 at which all interested persons were given an opportunity to be heard,
NOW, THEREFORE, BE IT RESOLVED that this Board does in
accordance with Section V of the Excavation Ordinance of the Town of
Southold, find that
(a) The proposed operations will not interfere with the surface
water drainage plan of the area nor endanger any street, road or highway.
(b) The circumstances of the location and terrain are reasonably
adapted to rehabilitation to the end that the premises will not become desert
or waste land following completion of operations.
(c) The circumstances of the location and the terrain are such
that conditions and safeguards may feasibly be imposed to assure that the
premises will not constitute an attractive nuisance or endanger the safety of

(d) The use will not cause undue traffic hazards.
(e) The use will not cause undue noise or wind-blown dust or
sand.
(f) The use will not change the established character of the
neighborhood or depress the value of other lands in such neighborhood.
(g) The proposed operations are set back at least 300 feet from
any road, street, avenue or highway and that the excavation operations were
in existence at the effective date of the aforesaid excavation ordinance and

that such proposed operations will not be extended beyond the present front,
side or rear setback lines, and it is further
RESOL VED, that the Town Clerk be and he hereby is authorized and
directed to issue a permit to the said Leander Glover. Jr. for the excavation
of sand, gravel, stone, or other materials from the above described premiseE
for a term of one year, subject. however, to the following terms and con-
ditions:
1. The removal of materials shall be confined to the area shown on
the map accompanying said application, a copy of which is to be signed by
thc Supervisor and the applicant and filed with the Town Clerk.
2. The removal of materials from said area shall not extend below
twenty-five (25) feet above sea level.
3. All removal operations shall be setback at least 25 feet from all
property lines.
4. All slopes shall be maintained during and after operations at one
foot vertical on one foot horizontal.
5. After operations have been completed, the excavated area, as well
as all othcr areas where prior excavation operations have been conducted on
the premises, shall be leveled, top soil to a depth of 3 inches shall be
deposited thereon and said area shall be seeded with grass.

6. That all areas where excavation operations have been conducted in
the' past and all areas where actual excavation operations are to be conducted
in the future shall be enclosed with wire fencing of the type known as chain
link or cyclone fence or its equivalent to a height of 6 feet with four strands
of barbed wire at the top thereof which fencing shall contain no openings
except necessary gates for ingress and egress which gates shall be closed
and locked at all hours that operations are not being conducted on the
premises. That the permit authorized to be issued by this resolution shall
not be issued by the Town Clerk until such fencing has been erected.

LEANDER GLOVER. JR., applicant herein, residing at
Cutchogue, New York, does hereby furnish the following informa-
tion, and annex the documents hereinafter stated, in support of
his application for a permit under Section VI of the Excavation
Ordinance of the Town of Southo1d.
(a & b) Applicant for many years has excavated bank run
sand from premises owned at Cutchogue, New York, adjoining lands
of the Town of Southo1d. The operations in the past, as well as
in the present, have been conducted in an area delineated on a
survey of the premises prepared by Van Tuyl & Son dated May 20,
1971, annexed hereto and made a part hereof. The operations con-
ducted to date have been in and about the area designated on the
survey as the southeasterly portion of the premises. It is an-
ticipated that when the area has been excavated to a depth of
approximately 25 feet the operations shall continue in a north-

westerly direction encompassing the area delineated as "area to
be excavated - 25 foot depth". The topographic survey showing
contours at 10 foot intervals, hereto annexed, indicates the pres-
ent condition of the premises, and the proposed condition after
the work is completed.
(c) Annexed hereto is a duly acknowledged consent of
the owner as required.
(d) Annexed hereto are copies of receipted tax bills of
the Town of Southo1d for the taxable year 70/71.

(f) If, as and when the work comtemplated in connectio
with the subject premises is completed, the applicant shall de-
posit in the area of excavation three inches of topsoil and duly
seed same. It is anticipated that operations in the subject area
would be completed any time within a period of five years. The
survey of Van Tuyl & Son, dated May 20, 1971, annexed hereto, in
the upper right hand corner thereof, sets forth the contour and
grade of the proposed excavation of the premises, if, as and when
the work is fully completed. It is not anticipated that any re-
habilitation program shall be commenced prior to December 31, 197
(g) The survey of Van Tuyl & Son, annexed hereto, sets
forth the total cubic yards to be excavated from the subject
premises at 112,500 plus or minus, based upon a depth of 25 feet.
It is approximated that 35,000 cubic yards have already been ex-
cavated from the premises, leaving approximately 77,500 cubic
yards to be yet removed.
(h) Annexed hereto is the check of the applicant in
the sum of $50.00, payable to the Southold Town Clerk, as require

tien, and annex the documents hereinafter stated, in support of
hIs application for a permit under Section VI of the Excavation
Ordinance of the Town o.E Southold.

The operat1.ons In the paat, a8 well as
in the present, have been conducted l.n an area deUn.ated on a
survey of the premises prepared by Van Tuy1 &. Son dated May 20,
1971, annexed hereto and made a part hereof. The operations con-
ducted to date have been in and about the area designated on the
survey a. the southeasterly portion of the premiaea. It is an-
ticipated that when the area has been excavated to a depth of
approximately 2,~ feet the operations shall continue tn a north-
weater1y direction encOlllpa88ing the area dell.neated aa "area to
be excavated - 25 foot depth". The topographic survey showing
contours at 10 foot intervals, hereto annexed, indicates the pres-
ent condltlon of the prem18es. and the proposed condition after
the work Is completed.
(c) Annexed hereto is a duly acknowledged consent of
the owner 8. required.
(d) Annexed herato are copies of receipted tax bills of
the Town of Southo1d for the taxable year 70/71.

within which operations regulated by this Ordinance are proposed
to be performed, are a II follows:

Greenport, New York;

3. P'. M. Kelr ide, Cutchogue, New York;
4. Leander Glov.r, Jr., Cutcbogue, New York.
(f) If, as and when the work comtemplated in connectton
with the subject premisea Is completed, the applicant shall de-
posit in the area cf excavation three inchea of topsoil and duly
seed same. It is anticipated that cperaticns in the aubject area
would be completed 01 time within a period of five years. The
survey ef Van Tuyl & Sen. dated Hay 20. 1971, annexed hereto, in
the upper right hand corner thereof, sets forth the contour and
grade ef the proposed excavation of the premi.e., if, a. and wben
the work Is fulg completed. It is not a.,Udpated that any re-
habilitation program shall be commenced prior tc December 31, 1971.
(g) The survey of Van Tuyl & Son, annexed hereto, lets
forth tho total cubic yarde to be excavated from the subject
premises at 112,500 plus or minus, based upon a depth of 25 feet.
It is approximated tbat 35,000 cubic yards have already been ex-
cavated from the ,rem!.sel, leavlng approximately 77, SOD cubic
yard. to be yet removed.
