Gentlemen:
On November 28, 1983, I received a notice from the then
Chairman of the Southold Town Planning Board with
reference to the above property. I enclose a copy of
that letter and the attachments thereto.
Please be advised that the recommendations of the work
to be done prior to the release of the road bond, as
set forth in John W. Davis' report #332, dated
October 27, 1983, have been complied with. All the
work has been done after many efforts to have the same
done by the contractors. I have finally received a
bill for all the trimming and cutting of trees and
brush, all of which have been removed.
I would appreciate an inspection of the property and a
favorable report so that the bond at this time can be
released to Mrs. Hoey and Mrs. Daly.

with exception of the barrier guide rail, at the end of Hoey I~ane and
turning area, which has bee~ installed, the remaining final it~ns of work
in this subdivision are about the same as noted in my Report No. 246 dated
September 21, 1982.
The recharge basin ar~a on Daly Lane is still overgrown with brush and
small trees. The pavement break and washout at the C.B. where the outfalf --
line goes to the recharge basin has not been repaired. ·
The "Private Roads - Keep Out" signs are still in place at the entrance to
Hoey Lane and Daly ~ne.
I would waive the grading etc. between the R.O.W. and curbs in areas where
such work has not been done as the roads are private. These areas are
overgrown with brush,, small trees and a few medi~,n size trees. Some of this
growth overhangs the curbs and should be cut or trimmed. Also, scme road
sections have heavy weed growth at the curbs. The weed growth should be
r~cved. If not checked, it can cause pav~_nt breaks.

Clearing, grading and seeding has been done behind curbs on 4 lots in this subdivision.
One each, right end left at To~ Harbor Lane and Hoey Lane. One lot on.left nea~ etd
of Hoey Lane and one lot on right at To~n Harbc~ Lane and Daly Lane.
~here is no clearing or grading between curbs and the R.O.W. l~m4t (6.5 ft.~- ) on all_
other sections of the subdivision. Apparently some ef the gradirg excavation fc~ the
roads was lef% on the sides. In most areas the present existing ground is higher
than the curbs. T~ees in the ungraded sections are from 1" to 2" with a few at
4~e ~_ .. The recharge basin area on Daly Lane (30' xl25') is overgrc~n ~ith brush and
s~all trees. Also, there is a pavement break and washout (10' x 3' x 1') at ~be catch
basin where the outfall pipe goes into the recharge basin,
~ere is a rough graded berm at the end of Heey Lane and the turning area. It appears
that there may have been a washout here some ~me ago as there are pieces of broke~ ' ,;~
curb in the berm. Curb was probably placed here ~ben the subdivision was curbed through-
out. ~ere are a few lengths of metal guide rail on the ground nearby indicating that
a barrier ~ay have been planned fo~ the end ef Hoey Lan~ A barrier should be placed
here even if the roads are not be to dedicated to the Tc~n.
~here is a hydrant on the right side ef ~honae Street about 100 ft. from ~e intersectim
with Hoe~ ?~me. ~hie hydrant appears to have been recently re-installed.
~ere are signs at the entrance to Hoey Lane and Daly Lane reading "Private Roads -
Keep out ".
Reco~endations s
1. Clear and grub the recharge basin area.
2. Install a barrier guide rail at ~he end of Hoey Lane and the turning' area.

Gentlemen:
In accordance with your request of last year,
Mrs. Daly and Mrs. Hoey have had the trees and
plantings on either side of the private roads off
Town Harbor Lane cut back. In addition, the
barrier was placed at the spot designated so that
traffic would be stopped before the edge of the
bank overlooking Hippidrome Pond. Stop signs have
been placed at the appropriate intersections.
Since all required work has been done within the
last year, I request that full approval be given to
the roads and that the funds presently under deposit
be released to Mrs. Daly and Mrs. Hoey.

Dear Mr. Hoey:
The Southold Town Planning Board has not recommended to
the Southold Town Board that your passbook be released.
Inspection was made of the property and it was found that
the undergrowth was not cleared from each side of the road.
There were no street signs and no barrier at the end of Hoey
Lane. The recharge basin needs clearing.
I enclose for your information the section of the Highway
Specifications and Code of the Town of Southold that apply to
these matters.
Upon completion of the above, please contact this office
and I will arrange for another inspection of the property.

Ail the necessary roadwork has been completed at the property
of Mrs. Hoey and Mrs. Daly on Town Harbor Terrace Development at Town
Harbor Lane, Southoldo I cite the report of the Town Engineer, Mr
Davis. '
I have conferred with Superintendant of Highways, Raymond C.
Dean, who has reiterated the fact that it is not necessary to clear
7 feet on either side of the road until and unless the roads are
dedicated to the Town. This is not the intention of either Mrs. Hoey
or Mrs. Daly at this time or any time within the foreseeable future.
I have also requested that Mr. Dean communicate with your office re-
questing that the bond which has been placed with the Town Board be
released.
I therefore am now asking you to communicate with the Town
Board certifying that all the required work has been completed and
that the Town Board is authorized to release the bond to Mrs. Hoey
and Mrs. Daly.

The center section of the road is the problem area. Sams portions ars
composed ~ntirely of loam, others are composed of loam overlaid with lees
than six inches of bankrun.
The entire road base must contain at leas~ six inches of bankrun. Those
area that do not conform must be reworked~ this will entail replacement of the
loam with bsnk run. tt will not be satisfactory to merely add additional
bankrun, doing so would create a road bed with a too high final qrade.

On several occasions I have written to Latham Sand &
Gravel, attention Irving Latham, with copies to you and other
designated persons. Up to the present time we are still at
a standstill and in the same position as we have been for the
past couple of years.
! realize that any request to you may be an imposi-
tion on you, however, as the Superintendent of Highways and
as the person who would eventually have to pass upon and
approve whatever work is completed on behalf of Mrs. Daly and
Mrs. Roey, I request that you use your good services to call
a.conference of the people listed below in an effort to recon-
cile whatever difficulties presently exist in ~he completion
of these roads. This is a final effort to be made by Mrs.
Daly and Mrs. Hoey to get this matter reconciled.
Incidentally, both Mrs. Hoey and Mrs. Daly will be
in Southold for the next few months and available to~iscuss
whatever has to be discussed on this and to appe~u~rat any meeting.
They should be arriving no later than Wednesday, June 26. I have
made arrangements to be in Southold personally from Friday even-
ing, June 28 ~ntil July 8.
I trust that calling upon your good services would not
be too great a burden upon you if in the interest of facilitating
this you would see your way clear to have this matter c~arified
and completed.

The work on the roads in the above subdivision
has been started by Mr. Irving C. Latham. I examined the
cleared property last weekend and became rather apprehen-
sive about the fact that the plans call for 2400 feet of
curbing. It appears that if all the curbing were entered
that it would not be possible to enter upon any of the
existing properties which would front upon this new road-
way. In view of this, I request the approval for this road-
way be amended and that curbing be required only at the
intersections. In this way it will be possible for the
families presently living on this roadway to enter upon
their property without having to cross the curbing or to
have the curbing broken so that they could enter their
property. I would appreciate a favorable action upon this
request.
A copy of this letter is being sent to the Hon.
Raymond Dean, the Superintendent of Highways.
This letter is being sent to you with the approval

everything in our power to complete the roads before the ex-
tension date. In the last paragraph of your letter, however,
you indicate that because the sub-division is not on an approved
list in the Zoning Ordinance the lots are considered sub-standard
and will have to be increased to meet the new requirements of
the town and Health Department. As you will note in the letter
enclosed, the Health Department has approved this sub-division.

utility.
Co~muunity seweraEe system means a system utilized for the collection
and disposal of sewage, or other wastes of a liquid nature, including
the various devices for the treatment of such wastes serving more
than one lot, whether owned by a municipal corporation or private
utility.
II. Application for Approval
Applications for approval of water supply and sewerage facilities
to serve a realty subdivision or section thereof as conforming
%~th the standards prescribed herein shall be made on forms provided
by the department.
B. Applications for approval shall be accompanied by such maps, plans,
reports~ specifications, data and fees as the department may require.
III. Plan Submissions
All plans submitted for approval shall be in conformance with the
relevant provisions of bulletins and other requirements of the
department and other agencies having jurisdiction.
Plans other than those for community water and sewerage systems
shall indicate individual water and sewerage systems located on
each lot.
%%ere the developer proposes to obtain and furnish water suppIy
and/or sewerage facilities for a subdivision by connection to an
existing eommunitywater and/or sewerage system, the developer shall
supply the department %~th a certification in writing by the owner
of the utility that such facilities w~11 be furnished and kept
available and in ~oo~ ~e~a%in~ o<3r~hit~d, oll ~0~ %h~ ~B~vision.
The commissioner at his discretion may require the developer to
furnish a performance bond to the owner of such utility conditioned
upon the developer's making connection to the utility within a
specified period of time.
E. The proposals for realty subdivision development shall consider
all applicable comprehensive wmter supply and sewerage studies.
IV. Sewerage Facilities
A. A community sewerage system is required when:
1. The subdivision or section thereof is l~cated in an existing
sewer district or service areaS
The subdivisi.n *r section thereof is reasonably accessible
to an existing sewer district or service area. This requirement
shall apply in the absence of proof satisfactory to the depart-
ment that the developer cannot effect arrangements for the
instalf~ation and/or connection of the sewerage system to the
existing sewer district or service area facilities;
The subdivision is located in a marsh lowland area, where fill
is placed over subsoils containing mead~ mat, bog~ silts, clays
or other impervious materials which lie at or extend below the
ground water table, or in an area where the subsoils or ground
water conditions are not conducive to the proper functioning of
individual sewerage systems$ or
4. Any lot in the subdivision is less than 40,000 square feet in

5. Any lot in the subdivision is less than 20,000 square feet
in area.
B. Individual water supply systems may be approved by the dePartment
as the method of w~ter supply for the subdivision when:
1. All lots in the subdivision consist of an area of at least
40,000 square feet;
2. Items A-t., A-2, A-3, and A-4 above are not found to be
applicable by the department; and
3. The department's current standards for individual water
supply systems are fellowed.
All plans and specifications submitted for approval of com~uuity
water supply systems shall be in conformance with the relevant
provisions of bulletins and requirements of the department and
other agencies having jurisdiction.
VI. Variances
The commissioner may on written application grant a variance from a
specific provision of these standards in a particular case,
subject to appropriate conditions, where such variance is in harmony
%~th the general p~u~pose and intent ef the standards, and when such
application for a variance has been considered by a review board
appointed by the commissioner.
The co.m,~ssioner may impose more stringent requirements in a specific
case when necessary to assure an adequate and satisfactory water
supply and se~erage facility for the subdivision.
In accordance with Section 2 of Article VI of the Suffolk County
Sanitary Code, the foregoing are standards approved by the Suffolk C~unty
Commissioner of Health for the administration of these provisions of the
Suffolk County Sanitary C,de by the Suffolk County Department of Health.
They shall take effect the 1st day of Janl~y 1970.

HIGHWAY SPECIFICATIONS

HIGHWAY SPECIFICATIONS
TOWN OF SOUTHOLD
Any person or persons desirous of dedicating land for town highway purposes shall be re-
quired to file four (4) prints of the proposed layout of such highway ~vith the Planning Board of the
Town of Southold. The Planning Board shall examine such prints and prepare a written report
thereon, containing its recommendations concerning the proposed layout, and file the same with the
Southold Town Board and one copy to the Superintendent of Highways, together with one print of
the proposed layout. The Planning Board shall retain one print for its files and shall return one priut
to the applicant. Thereafter, the To~vn Board shM1 approve or disapprove such layout and so advise
the Planning Board and the applicant.
After such proposed layout has been approved by the Southold Toxvn Board, the following
specifications shall be complied ~vith: --
1. Any person or persons desiring to dedicate real estate to the Town of Southold for highway
purposes must execute and submit to the Town Board the following:-
a. A duly acknowledged dedication and release, together with the required County Clerk's
recording fees.
b. Proposed consent to the Toxvn Board.
c. Proposed order of the Superintendent.
d. A survey map of the property which shall show the actual location of the highway area
within the highxvay right-of-way.
e. An attorney's certificate of title and an abstract of title certified to the Toxvn Board by
an attorney or a 2,000. title policy issued in the name of the Town of Southold.
f. A bargain and sale deed ~vith covenant against grantor's acts in the proper form for re-
cording in the County Clerk's Office.
The foregoiug six documents shall be fastened together in one folder and the dedication and
release shall include the signatures of all fee owners, easement o~vners, mortgages and so forth, and
the attoruey's certificate shall certify to such.
2. All highways, accepted by the Town as Town Highways must be at least fifty (50) feet in
~'idth; such xvidth shall hereinafter be knowu as the bounds of the high~vay.
3. All proposed highways shall be properly surveyed, monumented with concrete monuments
on all points, curves and intersections. All roads shall be laid out in a "station mark" system showing
elevations, percentage of grade distances betxveen station marks, all drainage pipes, drainage struc-
tures, recharge basins, etc. to be clearly shown on both map and profile map of each road. All profile
maps to be on a large scale, clearly an(t legihly printed xvith not more than one (1) road on one page
or sheet. Name of highway, name of all adjacent owners, if any, drainage rights of way or leaching
areas, width and length of highway, scale of map shall not be more than 1" to 200'. ,An additional
survey map of the property other than the one in the folder shall also be submitted.
4. All highxvays terminating at tidewater shall have a width of not less than 100 feet back from
the mean high water mark. All highways on water front property must have the same access to the
water as above required. Each dead-end shall have a stop sign on a 10 foot steel U type sign post.
5. All dead-end highways ~nust have a xvidth of not less than 100 feet for a distance of 100 feet
back from the dead end to provide for a turn-around, all of ~vhich must be free of trees, bushes, and
stumps. A guard rail shall be installed along the entire dead-end line. Such guard rail shall be of gal-
vanized steel (flex-beam type) 18~ inches in width mounted on 6" x 6" x 4' posts dipped in creosote
to a depth of 30" and placed in the ground to a depth of 30". A standard stop sign shalI be placed
in the center of the dead-end in the rear of the guard rail.
6. The name of such highway may be proposed by the owner or owners of property dedicating
such high~vays but the name of such highway shall be subject to the approval of the Town Board.
7. A ~vidth of 36 feet shall be hereinafter known as the highway area from which all trees,
brush, rocks, stumps and other obstructions shall be thoroughly cleared and all such material shall be
removed from the bounds of the highway, the remaining distance from the curb line to the property
line, shall be raked and seeded.
8. The portion known as the high~vay area shall be plowed, disc-harrowed, roiled and graded
to a unifor~n sur[ace to the longitudinal grade as shown on the final map.
9. Six inches of Bank Run Base Material with a gravel content of 20% or more will be install-
ed below the finished grade of the road section if the existing material is not satisfactory, and shall
be free of all vegetable matter.
10. Where cuts and fills are necessary in order to bring the highway to the proper grade and
cross sections, the cut or fill shall meet the abutting surface with a 1 on 2 slope. Where the slope
r)r fill extends beyond the fifty feet, the necessar~ releases, easements or deeds must be obtained
irom the property owner or owners.
11. Concrete curbs, when deemed necessary by the Superintendent of Highways, storm sewers,
leaching basins, leaching areas and gutters, shall be installed in accordance with the requirements
under the supervision of the Superintendent of Highways. When leaching basins and gutters are re-
quired, the same shall he constructed as follows:
a. Leaching basins: Only inlet type hasins shall be used. All basins within fifty (50) feet of
each other .shah be connected to each other with eighteen (18) inch corrugated pipe, or 14 inch
asbestos cement pipe.
h. Concrete curhs: Curhs shall be installed on all streets within the subdivision or develop-
ment. All inte;sections shall have a curve xvith a radius of not less than twelve (12) feet. The distance
between curb faces on both sides of the highway shall be 36 feet. Curbs shall he 6 inches wide, 16
inches deep, 6 inches above road surfaces.
c. Full length concrete curb on both sides of all roads are required unless waived by the
Snperintendent of Highways and the Planning Board. Integral curb and gutter shall be installed at
all intersections for at least ten (10) feet each side of the curve and at least ten (10) feet each side
of a drainage inlet structure intake. Integral curb and gutter on both sides of any road having a
grade of 5% or more.
12. After the highway area has been properly graded, rolled, and shaped to the approval of the
Superintendent of Highways, the thirty-six (36) foot section in the center of the highway area (here-
inafter referred to as the "road section") shall he stabilized with an application of three (3) gallons
of MC-250 (bituminous cut-back) per square, yard ~nixed to a depth of (6) inches in two (2) separate
applications. Within two (2) months and not less than one (I) month after stabilization, the road
section sbalI be rolled and properly prepared and an application of one-half (1/'2) gallon of RC-250
(hituminous cut hack) per square yard shall be apl)lied with sufficient sand to absc~rb the excess oil.
In case of dry weatber, the sub-grade shall be wet-down before the application of oil. Before the
highway is accepted by the Town of Southold, the Superintendent of Higbways shalI examine the
same and thereafter a final application of .3 gallons of RC-250 (bitnminous cnt back) per square
yard, shall be applied and shall be covered with three eighths (3/8) inch blue stone, which shall be
rolled with a roller having a minimum weight of (5) tons. Where curbs are installed, the road section
sbaI] be deemed to be the entire area within the curbs.
13. On both sides of the oiled surface or road section of the highway area, there shall be a six
(6) foot shoulder wbicb shall be graded and free from all trees, brush, rocks, stmnps, and other ob-
strnctions, and raked and seeded.
14. Before any highway shall be accepted by the Town of Southold, as a town higMvay by
dedication, the assessed value of the buildings and structures on the Iand on both sides of such high-
way (as shown on the current tax roll of the Town of Southold) shall have an assessed value of not
less than forty thousand ($40,000.00) dollars per mile proportioned at that rate if more or less than
a mile.
15. Where it is necessary to have a drainage area located beyond the fifty (50) foot bounds
of the highway, fee title to such area shall be conveyed to the Town of Southold, together w/th the
uecessary land to connect such area to the boumls of the highway. Corrugated pipe having a mini-
lnum diameter of eighteen (18) inches extending from the drainage area to the bounds of the highway
shall be installed xvith clean out boxes at 150 foot intervals.
16. Side~valks shall be standard fonr foot in width, four inches thick, except in driveways
where they must be not less than six inches thick. All curbs and gutters to be built to standard lorries
as may be directed by the Superintedent of Highways. On existing Town Highxvays the Town will
furnish the necessary engineering, grading, fill and labor; the property owner or owners shall furnish
the necessary ready mixed concrete and shall deliver such concrete to the site as directed by the
Superintemtent of Highways. The amount of sidewalk construction throughout the Town shall be
determined by the To~vn Board.
17. Whenever in the opinion of the Superintendent of Highways he feels that for the best in-
terest of the Town, alterations or modifications should be made to the above specifications, rules and
regulations, such alterations or modifications may be made on the recommendation of the Super-
indent of Highways to and with the approval of the Toxvn Board.
18. These specifications shall be effective on and after November 7, 1968.

Tl~.2 AGREEMENT made this 16th day of December, 1964, by and
between the Village of Greenport, a municipal corporation in Suffolk County
havir~ its office and principal place of business at 18 South Street, Greenport,
New York, hereinafter referred to as the Village, and Kethryn D. Hoey, resid-
ing at 2121 Albemarle Terrace, Brooklyn, New York, 11226, and Genevieve T.
Daly, residing at 425 Highbrook Avenue, Pelham Manor, New York, herein-
after referred to as the owners,
WITNESSETH
The Village holds from the Town of Southold a franchise for the
distr~bution of water throughout the public roads in Southold0 New York, where
the owners are about to subdivide acreage. The owners wish to install a
public water supply in the area to be subdivided. The Village is willin~ that the
owners should comect with the existing villa~e water main on Town Harbor Lane
at points, respectively, about 2000 feet and 2300 feet south of the southerly line
of the Main Road, and will supply the development with potable water for normal
household and fire protection purposes.
Therefor, in consideration of the premises and the undertakings and
covenants herein, it is mutually agreed as follows:
1. The owner will ir~tall at his own cost and expense, a water main,
for supply and distribution of not less than six inch diameter and a fire hydrant
from the extstin~ main on Town Harbor Lane across the said public street and
through lands of the owner as shown on the attached map. The necessary engineer-
ing work, trenching, laying, joining, backfillin~, etc., is sometimes hereinafter
referred to as "the work".
2. So long as the diameter of the pipe does not exceed ten inches,
Johns Manville Transite pipe, or equal, may be used for the mains. Any pipe and
all Joints and parts of the system must be able to stand a pressure of not less
than 150 pounds per square inch.
3. The Village will suprl/f without charge to the owner sufficient
water to make essential tests and to leave the system on final approval completely
sanitary.
4. The work ts subject to inspection by the Village which hereby
delegates to its Superintendant of Utilities full power of inspectinn hereunder.
The owner will grant complete freedom of access to all parts of the premises
and the work for inspection. The Village will have an authorized inspector at the
work site at all proper times so as not to delay the work. No work not passed by
the inspector wall be accepted by the Village. No back~fllling shall be done until
the pipe and work in the trench has been approved by the inspector.
5. The o~vner will and by this agreement does, upon approval of
the completed work, which the Village will indicate to the owner in writing, dedicate
the mains and fire hydrants to the Village, and does hereby grant and convey to
the Village an easement and right of way for the purpose of laying, relaying, re-
pairing, operating and maintaining water mains, both supply and distribution,
and appurtenances, including domestic services and fire hydrants in the full length
and width of the new or hereafter existing public or private streets in the
development as shown on said a~tached map. The rights of way and easements
shall also extend five feet on either side of the =xain to be laid Imf suant to this
agreement, whether or not such distance shall be within any roadway. The mains
and appurtenances and the rights of way and easements shall be and forever
remain the property of the Village, its successors and assigns, provided, how-
ever, that nothing herein contained shall be construed to prevent the owner, or
subsequent owners of the property, from dedicating roads to the Town of Southold.
6. If the owners contract with third parties f~' the work, as the
parties contemplate will be the case, the Village will examine the proposed con-
tract, plans and specifications, and promptly furnish the owner and the third
party contractors with a written statement of what palg, If any, of the work
proposed in such contract should be revised to insure approval of the Village
inspector. The Village will not require any abnormal conditions, unless con-
ditions found at the site require them.
7. The easements herein granted, where the same are in now or
hereafter existing public ~r private streets or highways, are not exclusive and
easements in said streets may be granted to other persons or corporations n~ain-
raining public services throughout the development, provided that no other mains
are set within two feet laterally of the water main and nn poles are set into the
ground within two feet either side on a line on the surface directly above the
water main. If a gas° sewer, or other main or service necessarily crosses
the Village water mains, the Village is to be advised in writing of the exact
location of the intersection forthwith upon installation.
8. The premises described herein are situate at Southoldo in

24th, I have again conferred with Mr. Van Tuyl,
who will proceed as expeditiously as possible to
complete the work on the final map.
I have also conferred with Mr. Monsell
of the Water Company and made arrangements for
the securing of a contract for the supplying of
water with the company.
In addition thereto, I conferred with
Mr. Villa of the Department of Health in Riverhead,
who stated that it would not be necessary to have
test hole borings. He will confirm this by letter
to Mr. Van Tuyl.

Ny' wife, Kathr~n Daly Hoey and her
brother, Thomas F. Daly, Jr., own the property
on the east side of Town Harbor Lane, Town of
Southold, extending down towards the Bay. They
have sold three lots fronting on Town Harbor Lane.
It is their present intention to request
authorization from the Planning Board to create
two separate 50-ft. roads, which will give access
to the remainder of the property, which does not
actually front upon Town Harbor Lane. I have
conferred with Mr. Otto W. Van Tuyl's office at
Greenport, and they suggested that I request
authorization to have the roads opened as set
forth on a proposed map of the property, which
they have prepared.
I request permission to appear at the
next meeting of the Planning Board, to set forth
my position and to explain what Mr. Daly and my
wife have in mind. Please notify me as to the
next meeting of the Board, and I will appear with
my wife.
