The Southold Town Planning Board and Rensselaer G.
Terry, Esq., discussed the agreement between Mrs. Ollie
Overton and the Southold Town Park District. Mr. Howard
Terry said the Board of Appeals had approved, but the
approval would not be in the mail until next week. The
Chairman s~aa~d that the Planning Boar~ would not be
approving any more minor subdivisions of five lots.
Mr. R.G. Terry agreed to delete the papragraph from the
agreement which refers to Lot ~6 of the proposed sub-
division. He said this was for identification purposes
only-and the metes and bounds description is correct.
Mr. WiCkham said this subdivision has been under discussion
since January 26, 1971, and has been presented to the
Board several times and the applicant has met all the
conditions and requirements of this Board and our
information is that it meets the approval of the Board
of Appeals. This time has bean spent in trying to solve
the problems of the Southold Park District and the property
owner in accordance with the established policy of this
Board to convey to any public facility the fact that
adjacent property is petitioning for subdivision and ask
if they wish to take any action and the time spent on this
has been in response to their positive answer.
On motion of Mr. Moisa, seconded by Mr.. Raynor, it was
RESOLVED that the proposed minor subdivision of Ollie M.
Overton at Southold New York, be approved.
Vote of the Board: Ayes: Messrs. - Wickham, Moisa,
Raynor.
The Planning Board,~Rensselaer G. Terry, Esq., and
Mr. Cha~es Gagen discussed proPerty owned by Mr. Gagen
located on the southsside of ClearView A~enue, Southold.
The property fronts on Goose Creek. Mr. R.G. Terry
stated that there are four lots all having 100 'foot frontage
except for one with 97 feet. Mr. Gagen would like to have
a minor subdivision approved. Mr. Gagen said the property
was filled and was n~t ~iked. Mr. Moisa asked Mr. Gagen if
he had Considered a thr~e lot subdivision instead of four.
The requirements are now 135 foot frontage and 40,000
square feet per lot. Even three lots would be only about
35,000 sq. feet. The Board is trying to hold to t~at policy.

Dear Mr. Terry:
At the last meeting of the Planning Board two agents
presented proposals to meet this Board's requirements for
a Minor Subdivision on the property of Mrs. Jonathan
Overton adjacent to Founders Landing.
The proposedf~rst refusal on the sixth lot is simply
not acceptable,. This Board stated clearly that they would
accept no more than five lots. As you know this is in
conformity with state and county regulations and your client
could have met this condition long ago, but did not choose
to do so.
At this late date the Board reiterates its earlier
stand. Enter into a contract for sale with the Pakk District
or meet the full requirements for a Minor Subdivision. I
might point out that by this we mean existing requirements
which are not more than five lots of 40,000 square feet and
about 135 feet of frontage per lot.
This Board feels that we have been very patient and
understanding with your client. We have been told that she
expected to sell the western most lot to the Park District.
We have also been notified that the Park District would like
to purchase it. In our position of seeking the best interests
of the people of the Town, it would seem apparent that this
problem could be easily and speedily solved by entering into
contract with the District.

I am enclosing a copy of' the f'irst draf't of' " letter sent to
Mrs. Ollie Overton regarding her property at Founders Landing in
Southold. The letter that was mailed said the same thing but Frank
Lekich tells me that he typed it better. He had no carbon paper.
'1Ie pould like to purchase as much of' that land as we could get
the taxpayers to go along with. Our prime concern is the approximately
160 f'eet that we have been renting 1'or many years. We 1'eel Mrs.
Overton is asving too much f'or this land considering that it is
next door to a public beach and across f'rom a rather congested
area. Considering that she wants :B30,000.00 f'or a 100 1'oot lot it
is di1'ficult f'or me to comprehend the person who would pay this
amount in that particular neighborhood.
We have approached many people and groups to

At the last public meeting o~ the Southold Park
District, we told the people present of your intention
to sell your land at Founder's Landing. In an open
discussion it was unsnimous that we, the commissioners,
should make every effort to purchase as much of the
land as we can.
We are primarily interested in the portion of the
land that we have been renting. We Understand,that ;)lou
O,ln 660 feet more or less 3nd if' you are dividl~mg this
into 100 foot parcels/we would like to buy the 160 feet
from our line easterly to~ards Town Harbor Lane.
We have approached individual taxpayers and groups
to get ideas of a fair offer and frankly we hsve a price
gap. We do feel, however, that we must make an offer of
$200.00 per :l"oot to you. If this is acceptable, you
reillize th8t we do he.ve to go through the legalities
of public meeti~gs and voting on the necessary bond

Mr. Bill Albertson has informed the corillllissioners

We can only hope that by the time you sell the
