Cremers Kenneth L. Edwards George Ritchie Latham, Jr. Melissa Spiro, Planner Carol Kalin, Secretary Mr. Orlowski: Good evening. I'd like to call this meeting to order. The Board to set Monday, May 22nd, 2000, at 7:30 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board Meeting. Mr. Latham: So moved. Southold Town Plannin,q Board PaRe 2 May 1, 2000 Hearings Held Over From Previous Meetings: Mr. Orlowski: Summit Estates, Section 4 - Section 4 of this major subdivision is for one 4.3739 acre lot (Lot #33). The property is located off Shipyard Lane in East Marion. SCTM#1000-38-7-p/o 10 (a.k.a. SCTM#1000-35-8-5.3). Boy, this thing has been held open for a long, long time. Mr. Cremers: I'll offer the following: BE IT RESOLVED that the Planning Board hold the final hearing for Summit Estates, Section 4, open until such time that Conditions Number 3, 4, and 5 of the approval in regard to the public hearing in accordance with Condition Number 11 of the Declaration of Covenants and Restrictions are fulfilled to the satisfaction of the Planning Board. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND SET OFF APPLICATIONS: Setting of Final Hearings: Mr. Odowski: Elizabeth Husband and Gunther Strothe & Lucinda J. Herrick - This proposed lot line change is to subtract .68 of an acre from a 1.33 acre parcel SCTM#1000-9-11-7.9 and add it to a 3.66 acre parcel SCTM#1000-9-11- 6, and to subtract .65 of an acre from the same 3.91 acre parcel (SCTM#1000-9- 1 I-7.9) and add it to a 3.91 acre parcel SCTM#1000-9-11-7.8. The property is located on Ocean View Avenue and Heathulie Avenue on Fishers Island. Mr. Edwards: Mr. Chairman, I'd like to entertain the following motion: BE IT RESOLVED, that the Southold Town Planning Board set Monday, May 22, 2000, 7:35 p.m., for a final public hearing on the maps dated January 3, 2000. Mr. Edwards: Mr. Chairman, I have another resolution for you: BE iT RESOLVED that the Southold Town Planning Board, acting under the State Environmental Quality Review Act, do an uncoordinated review of this unlisted action. The Planning Board establishes itself as lead agency, and as lead agency makes a determination of non-significance, and grants a Negative Declaration. Mr. Cremers: I second the motion. Mr. Odowski: Peconic Development Corp. (a.k.a. Harvest Homes, Section 2) - This proposed major subdivision is for 13 lots on 14.9 acres located on Oaklawn Avenue and Wells Avenue in Southold. SCTM#1000-70-3-22. Mr. Cremers: Mr. Chairman, I'll offer the following: BE' IT RESOLVED that the Southold Town Planning Board adopt the Town Engineer's report, dated April 28, 2000, and the bond estimate, dated April 28, 2000, and recommend adoption of same by the Town Board. The bond estimate is in the amount of $188,525.00, with an administration fee in the amount of $11,311.50. Mr. Edwards: Second the motion. The property is located within a R-40 zoning district and is located on the east side of Horton's Lane, approximately 848' south of the intersection with CR 48. SCTM#1000-63-1-13. Mr. Caq.qiano: Mr. Chairman, I'd like to offer the following: WHEREAS, the proposed minor subdivision is for a cluster subdivision of 2 lots on 2.863 acres; and WHEREAS, the property is located within the R-40 zoning designation; and WHEREAS, the Planning Board has accepted the yield plan, dated November 5, 1999, which shows 2 lots in conformance with the R-40 zoning designation; and Southold Town Planning Board Pa,qe Five May 1,2000 WHEREAS, a Declaration of Covenants and Restrictions will be recorded for the subdivision stating that there shall be no further subdivision of either lot within the subdivision in perpetuity; be it therefore RESOLVED that the Southold Town Planning Board grant sketch approVal on the map dated February 17, 2000. MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES, SET OFF APPLICATIONS - STATE ENVIRONMENTAL QUALITY REVIEW ACT: Determinations: Mr. Orlowski: Orchard Acres (a.k.a. Keith Scott Morton) - This minor subdivision is for 4 lots on 17.59 acres located on the northwest corner of King Street and Old Farm Road and the south Side of Orchard Street in Orient. SCTM#1000-25.4.11.4. Southold Town Planning Board Pa_oe Six May 1,2000 Mr. Latham: Mr. Chairman, I'll offer this: WHEREAS, the Planning Board initiated the SEQRA lead agency coordination process on July 19, 1999; and WHEREAS, the process was put on hold at the applicant's request while the applicant negotiated with the County in regard to the purchase of development rights; and WHEREAS, in a letter dated April 6, 2000, Bruce Anderson, on behalf of the applicant, asked the Planning Board to complete the SEQRA review; now, therefore, be it RESOLVED that the Southold Town Planning Board, acting under the State Environmental Quality ReView Act, assumes lead agency, and as lead agency, makes a determination of non-significance and grants a Negative Declaration. SITE PLANS: Final Determinations: Mr. Orlowski: Periwinkle/Lori Feilen - This proposed site plan is to convert a residence to a commercial retail store located on the southwest corner of Main Road and Town Harbor Road, Southold. SCTM#1000-62-3-38. I'll make the resolution: WHEREAS, this proposed site plan, to be known as site plan for Lori Feilen/Periwinkle, is to convert a residence to a commercial retail store; and Southold Town Planning Board Pa.qe Seven May 1,2000 WHEREAS, Lori Feilen is the owner of the property known and designated as Lori Feilen/Periwinkle, Main Road Southold, SCTM#1000-62-3-38; and WHEREAS, a formal application for the approval of this site plan was submitted on March 28, 2000; and WHEREAS, this amended resolution replaces the resolution approved by the Planning Board on April 10, 2000; and WHEREAS, a single row of six foot high White Pines, planted fifteen feet (15') on center, will replace the single row of Canadian Hemlocks, previously approved by the Planning Board on April 10, 2000. These White Pines are to be planted this Spring in the west side transitional buffer as requested by the applicant; and WHEREAS, a single row of six foot high appropriate evergreens, planted six feet (6') on center, will replace the Canadian Hemlocks, previously approved by the Planning Board on April 10, 2000. These appropriate evergreens are to be planted in the south side transitional buffer as requested by the applicant. These evergreens will be planted in the Fall of 2000. This planting in the south side transitional buffer will be supplemented with a second row of broadleaf evergreen shrubs to be planted next spring, 2001; and WHEREAS, all merchandise for sale will be placed south of the edge of the display line shown on the plan last revised on April 18, 2000. The Planning Board approves leaving this merchandise overnight in the area between the front of the house and the edge of the display line. No for sale merchandise is to be placed in the area north of the edge of the display line and the Main Road; and WHEREAS, this site plan, dated March 28, 2000, was certified by the Building Inspector on April 7, 2000; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore Southold Town Planning Board Paae E .qht May 1,2000 RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final survey, dated April 18, 2000, subject to a one year review from date of building permit. SITE PLANS - STATE ENVIRONMENTAL QUALITY REVIEW ACT: Lead Agency Coordination: Mr. Orlowski: Martha Clara Vineyards - This proposed site plan is to convert an existing barn into a tasting room and the construction of a 17,652 square foot winery as Phase I of the project; and a winery extension building in Phase II. The project is located at 2595 Sound Avenue in Mattituck. SCTM#1000-120-2-3.1. Mr. Cremers: Mr. Chairman, I'll offer the following: BE IT RESOLVED that the Southold Town Planning Board start the lead agency coordination process on this unlisted action. Mr. Latham: Second. SCTM#1000-96-5-8. Mr. Edwards: Mr. Chairman, I offer the following: BE IT RESOLVED that the Southold Town Planning Board start the lead agency coordination process on this unlisted action. Determinations: Mr. Orlowski: Private Ferry Terminal/Robins Island - This proposed site plan is for a 1,800 square foot private ferry terminal for office and storage located on the northeast corner of First and Jackson Streets in New Suffolk. SCTM#1000-117-8-18 & 19. Mr. Orlowski: I will take this off the agenda as Mr. Kassner is not here. ! believe he might have added this prematurely. We'll put that on hold for the next meeting, if it's o.k. with everybody else. I have nothing left on my agenda. Are there any questions or comments from the audience?
