Board at a regular meeting held January 26, 1976.
RESOLVED to waive the 35 foot setback requirement on the
minor subdivision of Doebler located at Town Creek, Southold.

Gentlemen:
We have been asked to render s~u engineer's opinion
relative to tidal action in Town Creek, Southold, where said
creek is bounded by property of one Errol Doebler. The purpose
of this opinion, as you know, is to aid in determining if a
building set-back line should be established on said property,
which has been subdivided into three parcels and possible con-
struction of two more dwellings.
Our records of surveys in this particular location
start in 1919, at which time the land was surveyed for Helen
Joost, ~rior owner to Mr. Doebler. During our more recent
survey (1975), we of course again located the position of
ordinary high water mark and made a comparison of the two.
From the evidence of these two, we find no appreciable diff-
erence in high water lines~less than five feet at any point.
The comparatively similar locations do not really surprise us,
since the waters of Town Creek at this point are nearly one-
half mile from the open water of Southold Bay, and thus not
too v~nerable to tidal action.
In view of the above, we would professionally suggest
that a building set-back line, if any, be not too restrictive
on the property concerned. With rear-yard set-back lines now
established at 50feet, the proposed 35-foot set-back from the
top of the rather low bank does not seem necessary to us, and
possibly too confining for the type of house we assume would be
constructed in this area.
