The above referenced subdivision was granted Final Approval by the Southold Town Planning Board on May 13, 1971 — 39 years ago. At the time this above referenced subdivision was granted final approval by the Town of Southold, the New York State Environmental Quality Review Act, 6 NYCRR Part 617(SEQRA) did not exist. SEQRA was not enacted until 1976. A previous letter(see attached)from the Town of Southold Planning Department was sent to the applicant due to Suffolk County Department of Health Services (SCDHS) requests for SEQRA on the above referenced subdivision on September 17, 1996. As previously stated in the letter from the Southold Town Planning Department dated September 17, 1996, no SEQRA review was conducted by the Town of Southold at the time of approval for the above referenced subdivision as this subdivision was granted Final Approval by the Southold Town Planning Board in 1971, five (5) years prior to the existence and enactment of SEQRA. Latson Subdivision approved 5/13/71 SCTM# 1000-64-1-14.1 Dear Mrs. Latson: Please find the following in response to your letter of September 20, 1996: 1. The Planning Board granted approval to the five (5) lot subdivision on May 13, 1971. 2. The State Environmental Quality Review Act (SEQRA) did not exist in 1971. Therefore, the Planning Board was not required to do a SEQRA review for the proposed subdivision. 3. In 1971, the Planning Board classified the proposed 5 lot subdivision as a minor subdivision. At that time the Board did not require the filing of minor subdivisions in the office of the County Clerk. 4. On November 28, 1995, the Town adopted a Local Law in regard to Merger (Section 100-25). The law states that a nonconforming lot shall merge with an adjacent conforming or nonconforming lot which has been held in common ownership with the first lot at any time after July 1, 1983. Nonconforming lots shall merge until the total lot size conforms to the current bulk schedule requirements. The subject 'parcel is located in a R-40 zone. Therefore, all lots with less than 40,000 square feet in area are nonconforming lots. All of the lots within the subdivision have been in the same name since 1983. Therefore, as stated above, the nonconforming lots shall merge Latson September 24, 1996 Page 2 until the total lot size conforms to the current bulk schedule requirements. Based on the above mentioned law, the Planning Board is in favor of the merging of Lots 1 and 2 of the Latson subdivision to form one conforming lot, and the merging of Lots 3, 4 and 5 to form another parcel.
