It may surprise some of you that the Southold Town Zoning Board of Appeals In about 1987 set conditions In relation to the facility at 1040 Hortons. It was to be closed Sundays. It was to operate only starting at 8 am with a definite closing time. The two front buildings were to allow only quiet nonpolluting businesses despite the light industrial zoning and most new businesses were to appear before the ZBA for acceptance or denial. There are also dbher limitations. Recently (two years go) this facility ss taken over by an Ohio company. They introduced various things, committed some serious errors and decided to install several new buildings. This application triggered the discovery of failings including not putting in agreed to fire wells and an almost total disregard to the ZBA restrictions. Obvdously certain failings in Town government gave also been displayed. At the mnent the nww buildings are not going to be built. The facility b converting two of the four front 'offices• to more storage units. Southold) applied for a permit to build new buildings it was discovered that fire wells demanded or part of the original building/planning process had nt been installed. The Planning Board at your Board's behest insisted that those wells and/or a hydrant be installed - apparently the latter at great cost. my It is V belief that the auto repair .shop Magnum is operating in violation of ZBA restrictions and is quiteobviously a fire hazard. Additionally. Liberty is presently converting several of its front 8bays' to additional storage units - without apparent Town input. What category the work falls under is unclear. Work is going on and is inf&ct converting at least part of the building (s) into storage units as opposed to other types of businesses. If permits or ZBA approval is needed action should be taken sntttxnr before the matter is done. Under ZBA conditions, most changes would require their approval . . . conditions to date unenforced. Possibly they are going to create storage in the rear and another rental business in front whichmay also need permits and/or approvals.. To wit: the site Plan approval existent for this site was granted to a prior owner of the property under the name of Pudge Corp. I have not been able to determine if the site plan approval that was granted to Pudge Corp included approval for a specific type or size of sign. When the property changed ownership or management,the sign was changed. As best as I understand it, the FOIL application seeks to know if the Building Department issued a permit for the previous and, presumably, the existing sign(s). The FOIL request indicates that more than one sign is in question. The current owner/manager has sought an amended site plan approval of the original site plan in order to construct two additional storage buildings on the site. This proposed amendment to the site plan has NOT received approval due to a number of unresolved issues and violations on the site. Please note for the record that since September ZA 15, 1999 (or so) Liberty Self-Stor has been trying to evict me and , therefore, consider my possible bias in this matter. On reviewing the file for the application of Liberty to expand I came across a copy of special conditions imposed in about 1986 on Pudge in relation to permission to build a self storage facility. Other problems I don't understand included ' lack of access ' to the site, special permission to build two other buildings closer to Horton' s (apparently the four 'office ' facilities which proviced access to the self storage and about which I have earlier written you and which was referred to Mr. Forrester. The conditions seem to clearly delineate the followings The facility will be closed on Sundays. The facility will not open until 8 am and (I think) will close at 5 Monday thru Saturday. There are other questionable elements - I am waiting for actual copies. It is my belief that prior to permitting an enlargement of the facility consideration of these conditions and their meaning and whether the violation is significant should be discussed and written formal decisions made . To function as it is now, Liberty should appear before the ZBA to have the conditions changed or rescinded. If Pudge is going to continue its conduct also shoyld be considered prior to any approvals. . . 2. Let it be noted that once again I am astonished by the failure of inter agency communication in relation to matters such as these . Mr. Kastner has been studying this problem, apparently Mr. Forrester automatically issued the new company (owner) a CO without considering the conditions and whether they had been or would be met. Possibly, conditions should be in acomputer and able to be pulled up in regard to any application and perhaps some effort should be made to see if the conditions are met. As I noted at a pulic hearing on Gray's new proposal - or as some things were stated on the record - there have been a mariety of uses of the existing storage facility sone f which violate the conditions . It is and has been open Sunday, it is and has been copen from 7 am to 7 pm. The new owners have had outside storage (boats and afew other things) which seem forbidden by the conditions . . and there is probably more. Further, Mr. Gray allowed and encouraged certain things and the new owners express varying permish6ons and attitudes. My problem once again involves 'rights' and protections which are to say the least unclear. In order to stay warm (heat) I am in Maine making drop ins difficult. If there is to be a hearing on January 10 I want to attend but if there is not I will need to know. I am developing a FAX number and offer my phone number. Forrester, Mr. Goeringer and Mr. Kassner (and the assessors) in relation to the origins, restrictions and current situation at 1040 Horton Lane, Southold in relation to the legality of its operations, its effect on the health and safety of the neighborhood and town and to try to determine who will determine what to do and when to do it. In doing this research various communication and visibility and enforcement problems have surfaosdo probably your computer expert should consult with these departments and develop ways of flagging problems rather than allowing them to remain obscured. Further, consideration of some epro_aotivee action to check on and ensure compliance should be considered (as in rental consideration). Even in instances when Justice Court has upheld positions the court and/or the Town have not insisted on inspection in terms of compliance (see Toryes). The Toryes situation also could reflect on fire and other rental hazards. While I am not totally clear on several things I am going to try and outline some sequences and what I see as present problems that require action (positive or negative). In my opinion (and Mr. Forresterts) the ZBA Board with or without the presence of a town attorney or its own attorney needs to discuss the foregoing and the specific problems raised by Southold/Liberty Self Stor. The clearest violations are in regard to operation hours. Conditions were placed on both the front buildings, South anyway, and self storage unitz. Cne exaeption was granted regarding the storage of trucks publicly in 1991 (a condition being that the area used be blocked from view of Horton•s Lane by either plantings or a vinyl fence. At present, Liberty has one trok whichit rents out itself (not exempted, not formally permitted use) which advertises its company and is visible ...there is no protective fencing as required by the 1991 exception. MY understanding is that in regard to the South building only verfy specific named businesses were allowed without ZBA approval. Cne of the things I would like to know is WHAT IS THE FORMAT FOR SUCH APPROVAL. Perhaps that should be clearly developed. Mr. G of ZBA said Forrester should do everything but, to me, if a person is supposed to appear before the LBA he should be forced to appear before the ZBA. And I believe the Planning Board should be more aware of Zoning condition violations then they presently seem to be. As I have previously stated and will swear to; in violation of the conditions of the ZBA as I understand them (one) the business operates seven days a week from 7 am to 7 pm. It is supposed to operate 8 am to 5 pm and be closed Sundays (I believe this is unrealistic but that is a condition). With the exception of the 91 exemption - which needs clarifying - there 1s not to be outside storage, (that would include anything but the exempted trucks). The storage units are not to be used to house automobiles and related things - but have been. Again, the reasons for prohibition and perhaps determining an area for safe storage of such sight be considered. Mr. G. of ZBA was aware that the Automotive use (Magnum) is a possible fire 3• threat making it worthy of considerable commhnityconsideration - and the question of considering additional safe guards if that use is permitted. Interestingly, I have not found restrictions on the Building in the front to the north but they may be the same. The first two exceptions were nonpolluting. An office space next to Magnum was used for storing Deer park water (nonpolluting). Where Magnum is I believe was first used for a while for a crating and moving business and then was in legal infinity for several years. Grattan's Grinding is in the N rth building n without any specific approval and until recently something to do with boats was next to it. Both Grattan and the boat company make quite a bit of noise. The automotive company as brought in some hot rodders (and police officers) and been the reason for some highly polluting actions. I believe that the work being done at Magnum should not be done at that location. If it is, certain safeguards including a closer study of what is done, fence and planting protection btween the storage facility and Magnum and possibly the fire protection. Laws regarding noise pollution should again be considered. Grattan's reminds of us the fact that Southold has not considered banning the hellish machines to blow snow and leaiPes. Generally, other than noise it Beams a useful and used business. I am not sure that was true of the Boat business. People have said that touch use is permitted within the sone" which if ture, Ignores the carefully written special exceptions indicating that that property was special and required special consideration as did its neighbors. In its search to expand, the operating company has caused the Town to take note of at least the lack of fire protection (noting once again a Cobhran conflict). It should have flagged a total review of other conditions which I am now providing. Note that there is a letter somewhere from the Department of Health in re odors possibly toxic which can be emitted from heated asphalt/tar areas. Since the town has preserved seven acres accovss from 1040 liortones consideration 4. to not expanding that business, to studying its past uses, the town' s needs in relation to the conditions and the health and welfare not only of residents but also those who for whatever reason are using the storage facility. I have more information on the foregoing if asked. In its application Liberty states that the facility is not for sale. Np,netheless, it has apermanent sign FOR SALE OR RENT in front and I have its photo. That sign has been up since Liberty took over. I will note also that, as usual, the failure of the Town of Southold to provide coherent oversight of its agencies and its conditions has contributed to a conflict I am having with Liberty Self-Stor. There are also legal and moral questions regarding the technical way it is being operated which somebody other than me should consider. For instance, they have established a two tier charge. The first (during a rent increase) is for tenants already in the facility, the second is for new tenants. Tois is unusual and seems to me a problem Due, perhaps, in part, to the failure of Mr. Forrester to note the special conditions when I first complained about Ramrod and related things I have been in more conflict then I should have been with the company operating 1040 Horton and, in fact, they are terminating my contract, locking me out and possibly ridding e the world of my tilongings or disposing of them. THIS RAISES ANOTHSR vERY IMPORTANT ISSUE legal moral political and environmental ... laws and procedures surrounding the disposal of 'abandoned' property in Southold and elsewhere. This requires marWpages in and of itself. It obviously can be a financial bananas to harrass or intefere with persons and their property andultimately get to keep or dispose of it. Protecrive laws do not seem to exist. For quite a while Liberty handled these things very poorly and ran the facility disgustingly. I believe this should be looked into. I end by attaching a related Newsday article. I urge that all these issues be studied and if possible be put on for a broad spectrums public hearing (users including local business people). I would like to provide certain general information and perhaps suggest additions to your pending request for changes in their plans. Adjacent to the self storage units and seeming part of the parcel are four 'stores' in two buildings which in some way are also separate from the storage facility, At present three are in uses a lawn mower repair and sales shop, a machine shop related to boat engines and a very recent auto repair shop (Magnum). These are in light industry zoning and legal under that zoning. What is not legal in my opinion Is the lack of polution control and the toxins, odors and so on being emitted in the direction of the storage units. I have referred this matter to the department of health's air quality unit and will also contact the DMV regarding auto emissions and the use of unknown chemicals and controlling their release. Several monthsago at 6: 00 pm a car was run outside Magnum emitting dark exhaust smoke in sufficient quantity to fill the huge self storage open space - it was so dense you could not see thru It . . .
