I represent the Charley Horse Cafe and Ulura Sadolo'ski who
intend to occupy the building formerly known as shelly's ])lace.
Your board properly granted site plan waiver to Shelly's
place, however the adjacent neighbor initiated litigation ()ver the
iSSUe and the litigation agoainat the Town is still pendJ.nq. In
order to make "moot' the litigation, 1 have advised my clients to
reopen the waiver and obtain site plan approval. The neiqhl~rs can
expresA their concerns which we anticipate can be addresEled with
some site plan review.
The new owners intend to properly screen the rear of the
property. The owners will also provide constant monitoJ:'inq and
management ot the property.

at their expense. So I don't have to look at a dumpster.
empty boxes and delivery drop offs. and employees hanging
out back on break. They both seem to feel that there may
not be much to be done. This I feel is very unfair! But
they are trying to see how to solve the problem-my
suggestions a fence and parking signs. I've been told this
can take a very long time for anything to be done. This is
not what we need to hear especially since we live here and
have to view this problem daily.
"I" and other neighbors will not give up! There's no
reason why we shouldn't have our peace and quiet back.
Especially since the owners of the pub go home to peaceful Orient.
They need to understand" how we feel." Yes. we have talked
to them and they are just regarding everything they said to
us. Such as agreeing that cars should not park in front of
our homes since they have Rt. 25.
Shelly's place said they would put a fence around back area
and understood our situation. But now a different tune is
being sung.
Hopefully you can find the time to stop by our street and home
to see the need for these changes.

I am writing to you in a desperate attempt to request your help from your department with
regard to a situation that has arisen in the past two weeks. My once quiet residential
neighborhood is now upset and in disarray because of it.
The new "pub", "Shelly's Place" at the comer of our one-way street, Hobart Road, in Southold.
"Shelly's Place" has been constructed inside of a house. There is very little parking yet
hundreds of vehicles are arriving both day and night. The cars are also driving the wrong
way on a one way street as they are probably not familiar with this area. The patrons have
been loud, appear intoxicated, and "rowdy" in general from what we have witnessed so far.
Weekends mean noise until 3 or 4 a.m. for us. I should also mention that I have a two year
old son. Not only is the noise disruptive to his sleep but I am now in constant fear for his
safety with the amount of traffic at all hours. Myself and the other neighbors are also upset at
the way these cars are now parking all over our front lawns.
I am asking that you please conduct a police survey so that the highway department is able to
construct and install the signs that we now need to help make this situation tolerable.
My own home borders the "Shelly's Place" property. I cry when I watch my property values
decline. I put my heart and soul not to mention all of our money (we didn't have much) to
renovate this old house so that we could remain out here in this community and so our son
could grow up here as well. I don't know how the building department ever allowed the
permits for something like this when every week it seems standards are stricter and stricter
for everyone else.
Both myself and my husband have tried to be good neighbors to these new owners and in
return, they completely disregarded us. Other neighbors have now hired attorneys and now

RESTAURANT, FORMULA FOOD - A restaurant
business required by contractual or other arrangements
to offer standardized menus, ingredients, food
preparation, decor, external facade or uniforms. [Added

RESTAURANT, TAKE-OUT - Any establishment other
than a formula food restaurant, whose principal business
is the sale of foods, frozen desserts or beverages to the
customer in a ready-to-consume state, usually served in
paper, plastic or other disposal containers, for
consumption within the restaurant building, elsewhere
on the premises or for carryout for consumption off the

Funds for Fort and Village

CUTCHOGUE-State funds are on
the way to assist the town in its goal of
protecting the open land near the site of
a long-gone Native American fort here,
and Greenport Village will get addi-
tional support in its drive to make its
much-prized carousel the star attraction
of a new harborfront park.
The two municipalities will share in
the $8.55 million in Environmental Pro-
tection Fund matching grants released
by the state parks department. Southold
will receive $200,000 toward the preser-
vation of the Fort Corchaug property,
with the village getting $100,000 to
build a pavilion for the carousel donated
by the Northrop Grumman Corp. They
are among the 128 projects funded in
this round of grants.
The town has long sought to place the
full 105-acre property near the fort site
under public ownership, but that goal
seemed unattainable after Suffolk Coun-
ty withdrew the $2 million it pledged to-
ward a joint $3 million purchase. Since
then, the town reached a tentative agree-
ment with WiJliam Baxter, whose family
owns the land, to permit a 13-lot subdi-
vision with the town paying nearly
$900,000 for title to the 37 wooded acres
where the fort once stood. With the help
of the Peconic Land Trust, new con-
struction on the remaining 37 acres
would be limited to no more than three
homes.
With the subdivision plan winding its
way through the Planning Board's re-
view process, town officials have
searched .for outside funding to revive
the full preservation plan. While the
$200,000 grant is much welcomed, offi-
cials said more will be needed to buy the
entire property.
"The search continues," said Supervi-
sor Jean Cochran.
The latest grants give the Village of
Greenport about $850,000 in state fund-
ing toward converting the former
~ rooD' SPIBITS ~
Mitchell property on Front Street into a
harborfront park, said Mayor David
Kapel!. "I'm delighted," he said. "This is
another indication of strong statewide
support for what's happening in Green-
port."
The Town of Riverhead also has re-
ceived a $100,000 state grant for the re-
construction of bulkheading in Gran-
gebel Park along the shore of the Pecon-
ic River.

GREENPORT -For the record:
Costello Marine Contracting is not be-
ing investigated by the district attor-
ney's office. So said business owner and
Trustee John Costello in the latest
wrangle over Greenport officials doing
business with the village.
The trustee's remarks' were spurred
by quotes from Mayor Dave Kapell in
recent newspaper stories saying the
DA's office is investigating a possible
conllict of interest in Mr. Costello's
bidding on recent Greenport govern-
ment contracts. When contacted by The
Suffolk Times, the district attorney's
office could not confirm any investiga-
tion into the matter.
"The mayor's making detrimental
comments, which are affecting my
business. about conflict of interest," Mr.
Costello said at the regular meeting of
the Board of Trustees Dec. 19. "The
DA's office is not doing any investiga-
tion of my business."
The conflict issue has lent a bitter
edge to already contentious relations be-
tween some of the trustees and Mr.
Kapell since the mayor first callcd on
Mr. Costello and all board members to
cease bidding on municipal projects.
Mr. Costello refused, saying that such
bidding is legal and that many elected
officials have business dealings with the
village. The trustee brought an over-
sized prop to the meeting .to prove his
point.
Producing a copy of a check blown
up to the size of a Monopoly board, Mr.
Costello stood before a cable television
camera recording the evening meeting.
The check, he said, was issued by the
Greenport Housing Authority for a
tenant of a rent-subsidized apartment in
Dri ftwood Cove. The apartment is
owned by Mr. Kapell who also heads up
the Greenport Housing Authority, sug-
gesting another conflict of interest, Mr.
Costello said.
Mr. Kapell retorted that his position
with the Housing Authority does not
conflict with his being a landlord. "I
rent that apartment to [a tenant] who is a
quiet elderly lady," Mr. Kapell said.
"This is completely legitimate, and I
invite anyone to investigate it."
. East End Supply Snafu
The exchange set the tone for the rest
of the evening, which saw debate on
various financial matters including em-
ployee raises and budget allocations.
Starting off those discussions was a
motion by Trustee Jamie Mills to get an
appraisal for the East End Supply build-
ing, a Front Street parcel the village ac-
quired when it purchased the Mitchell!
Mohring property last summer.
Mr. Mills said the proposed demoli-
tion of the building as part of the water-
front park project would be a waste of a
valuable building. Annual taxes on the
structure are over $12,000, Mr. Mills
said, and that money will be lost if the
building is converted into parkland.
"I remain committed to tax issues,"
he said. "It should go back on ,the tax
rolls, it should not be torn down. I ask
that we go ahead and get appraisals [for

Again the mayor disagreed. Mr.
Kapell said the property tax assessment
was based on an inflated value of the
property, which will be readjusted if the
land is sold off. The village bought the
whole Mitchell/Mohring parcel for $1.2
million, which is just over one-quarter
what Richard Mohring bought it for in
1989.
"The [present] taxable value does not
jibe or square with current market
value," Mr. Kapell said. "Vou sell that
property and that tax figure is going to
drop by 60 percent."
Trustees Costello and Barbara
Heaney sided with Mr. Mills and voted
to seek appraisals for the property.
Since the board agreed to purchase the
property the three trustees have argued
adamantly that some part of the land be
returned to the tax rolls. The East End
Supply building, all three said at the
meeting, should be considered for
commercial sale and use.
"Any vote I ever participated in was
under the condition that the majority of
the property be returned to the tax
rolls," said Trustee Costello.
. Raises Shelved
Dissension dominated -discussions
and postponed proposed raises for cer-
tain village employees. The increases
were contingent on approval from the
federal Department of Civil Service and
until that approval comes, Mayor KapeJl
said, the raises should be withheld.
"I have no qualms about giving the
raises to these men, but I think we've
got the cart before the horse," Mr.
KapeH said. "Every raise we've given
has been on the assumption of greater
responsibility... I think we should get
[Civil Service] approval then give them
the raises."
Trustee Costello said that's not been
past practice. "That's a problem," he
said. "Some of the raises we've given
over the past few years Civil Service
knew nothing about."
"I take personal exception to thal,"
said Village Clerk Lorna Callis. "I've
been working to keep personnel
[records] up to some kind of standard."
The upshot: The raises were held for
further discussion.
. Rebate Shelved, Too
A motion by Trustee Costello to give
taxpayers a rebate was months late and
$100,000 short. The trustee proposed a
motion to return to taxpayers $100,000
originally allocated but not used for
low-income housing to taxpayers, but
Ms. Catus said the money's heen spent
elsewhere.
Specifically, Ms. Catus said. money
expected from municipal property sales
never materialized, and the village had
to exhaust the $100,000 fund to make
ends meet. That did not deter Mr.
Costello,. who suggested that $28,000
from another property sale be directed
toward a rebate, with the balance com-
ing from $100,000 set aside this year for
the purchase of the Mitchell/Mohring
property.
"It's taxptly:ers' money and 1 believe
it belongs in taxpayers' hands," Mf.
Costello said. The board agreed to dis-
cuss the matter further at a later date.

Man Found
Dead in Bay
An Orange County man was found
dead in his car in the bay off East
Marion Christmas morning, apparently
the victim of an accident, officials said
this week. William Hailer, 79, of
Roscoe, was found dead at 10:50 a.m. at
the wheel of his 1989 Dodge about 25
feet from shore in Orient Harbor at the

end of Bay Avenue, police said.
Mr. Hailer was headed south on Bay
Avenue when he left the roadway and
headed into the water, police said. The
accident report said Mr. Hailer died in
the mishap, and the County Medical
Examiner's office was called in to con-
duct an autopsy.
"Basically, we found a guy in the wa-
ter in his car," said Lt. Ty Cochran. "We
don't know exactly what happened,
other than that he ended up in the wa-
ter."
A County Medical Examiner's office
investigation into the cause of death
concluded that it was accidental. Next
ofkin had been notified, police said.
There was a little too much ehristmas
cheer on the streets over the holidays.
Police reported making several arrests
for driving while intoxicated.
Carlos Gonzalez, 27, of Southold was
charged with OWl after his car hit a tree
on Route 25 in Peconic Sunday, police
said, Mr. Gonzalez was heading east
abuut 150 feet east of Wells Road at
8:26 a.m. when he fell asleep at the
wheel of his 1987 Mercury, striking a
tree and a mailbox before the vehicle
overturned, police said. Mr. Gonzalez
was taken to Eastern Long Island
Hospital, where he was treated and
released to police. who took him to
headquarters for arraignment.
A Greenport man was charged with
OWl and resisting arrest after he fought
with police attempting to bring him into
headquarters last Saturday, according to
reports. William Cosby, 38, was
charged after he drove his car over traf-
t~c lines several times and struck a curb
D.l Route 25 in Greenport al 10: 18 p.m.,
police said. When police allempted to
br,ng Mr. Cosby into headquarters, he
had to be forcibly restrained, resulting
in the second charge, police said.
Another Greenport man was charged
with OWl after police pulled him over
for defective lights Dec. 18, police said.
Richard Lakowitz, 37, was arrested after
he was found to be intoxicated when he
was pulled over at 12:52 a.m., police
said.
No Agreement Yet
On Police Lawsuit
The second in a series of negotiating
sessions between Southold Town and
Greenport Village officials on Dec. 23
failed to bring an end to the village's
claim that the town is providing less
than adequate police protection.
The two boards are scheduled to talk
again at noon on Jan. 16 in Town Hall.
The village filed suit against the town
last year, claiming that the Southold
Police purposely provided thin coverage
within GreenporCs one square mile.
Through two administrations, the town
has responded that Ihe opposite is true.

Mayor Dave Kapell said that when he
learned of the matter from the litigents,
he referred it to the District Attorney's
office. Officials there would not con-
firm any investigation into the matter,
but the mayor said he felt the authorities
should be notified.

MATIlTUCK-With the change of
seasons, there are substantial changes
- both realized and planned - at the
North Forl< Early Learning Center.
The not-for-profit child care facility
has a new director, a new board presi-
dent and a new list of goals, including
expanding services and ultimately fmd-
ing a new location.
The center provides day care for
about 30 children ages 3 to 5 in space
rented from the VFW on Wickham Av-
enue here. It employs seven teachers in
a mix of full- and part-time employees.
The center hopes to develop a vaca-
tion and summer elementary school age
care program and is looking for a loca-
tion somewhere in Southold, said Dr.
Karen Malcolmson, who stepped into
the board chairman's post on July 1.
She outlined the organization's goals
during a "green eggs and ham" legisla-
tive breakfast at the facility last Thurs-
day morning. Among those attending

Supervisor Jean
Cochran.
"It all boils
down to there are
a lot more worl<-
ing couples out
there," said Dr.
Malcolmson, who
is supervisor of
the North Fork Karon Malcolmson
Counseling Program in Mattituck.
''There is a big problem with working
parents needing quality child care
during the summer months. There isn't
much out there and what is out there is
very expensive."
The center's new director, Dione
ekas, came on board as a teacher last
ember. The Hampton Bays residents
holds a master's degree in education
from SUNYlBinghampton. She replaces
Glenn Moller, who founded the center
in the early 1980s. During the summer,
he moved to New Yorl< City, where he
serves as director of The Maple School
in Brooklyn, Dr. Malcolmson said.
Also on the wish list is the addition of
a toddler care program for 2-year-olds
and instslling a kitchen with a commer-
cial stove at its current location. Lack-
ing a stove of its own, the center buys
lunches from the Mattituck-Cutchogue
school district
Dr. Malcolmson also sees a growing
need for a scholarship program to assist
parents unable to cover the current tu-
ition fee. The center now charges $550
a month per child for full-time care.
"Our mission is to serve across the
socio.economic scale," she said. "It's
very hard to make a living on the North
Fork, and if you need to pay child care
it's hard to come UP with that money."
Anticipating no additional public
funding, the center plans to conduct its
own fund-raising effort as it turns to the
private sector for help. "As public assis-
tance comes to an end we'd like to be
there to help single parents go back to
work," Dr. Malcolmson said.

The attached two letters of complaint regarding Shelly's Place are being
sent to you for enforcement. As you know, the Planning Board had
granted a waiver of site plan requirements based on a letter agreement
with Wayside Market for parking.
Mr. Talbot is well aware of all the issues involved and had brought a
court action regarding this matter some time ago which he did not win.

Dear Mr. Orlowski,
I am a resident at 150 Hobart Road, Southold, adjacent to
Shelly's Place, Inc. This establishment has been open for
about one year now, and has caused many problems and distur-
bances for myself and its other neighbors. Among them are
parking problems, vehicles being left in front of my house
overnight, increased traffic until 3:00 A.M. at times, noise
from traffic, patrons going in and out, Loud live music,
kitchen noise from their back door, oven exhaust fan, etc.
This establishment was issued a site plan waiver by the plan-
ning Board based on (1) they operate as a restaurant, and
(2) they are provided with off street parking for overflow
from a local merchant.
The Planning Board gave this waiver on the belief that the
previous establishment was closed for less than two years,
possibly taking into account an open building permit.
The facts in this matter are the previous establishment has
been closed for (4) four years, and a building permit that
was issued was expired for almost two (2) years. Also, the
previous establishment operated only as a bar in its closing
years.
The current establishment does not even meet with the minimum
parking spaces as per code. It also does not provide any handi-
cap parking or access accommodations. The overflow parking
provided by Wayside Market is, one, nonconforming and inade-
quate, and two, also serves for parking by JoAnthony's patrons.
Lastly, I do not believe the Planning Board envisioned the
type of restaurant that Shelly's Place is actually operating
as: live music with a drinking type crowd and hours until
3:00 A.M. on weekends. The police department receives the
same complaints now, as when this establishment was in operation
as a bar by the previous business, the Quiet Man Inn.

I am writing this letter to ask the Planning Board to do a
one year review of the waiver which is based on misinformation
and let this establishment go through a proper permit process
for its situation which should include Zoning Board of Appeals
approval to operate as even a restaurant since it is a noncon-
forming lot and building.
All of the facts can be found in the building department files
and in the Planning Board files. I can supply copies, if needed.
I hope this matter can be attended to for the sake of all
Shelly's Place Inc.'s neighbors, and if Shelly's Place Inc.
receives the proper approvals and permits through the proper
process I wish the establishment the best of luck.

I am enclosing herewith affidavit signed by Scott Oliver which should, by itself, resolve
the questions posed in your letter referred to above.
However, absent that permission, it is our position that my client's patrons
have ample parking along side the roadway, where pemritted, in the immediate vicinity
of the restaurant plus her parking lot to accommodate her patrons on a regular basis.

L I am one of the owners of Wayside Market located at Main Road, Southold,
New York, 11971 and that I am presently a tenant of the premises leasing same together with
all of the parking facilities surrounding it from one Lenore Adamson.
2. I am a aware that on or about September 13, 1996, that I signed an affidavit
revoking my permission to allow patrons of Shelly's Place Inc. to park their vehicles on my
prenuses.
3. Since that date I have reconsidered that decision and it is my present position
to permit those patrons park in the designated parking area of my premises.
4. There is nothing in my lease with Lenore Adamson which prevents me from
giving this permission.
5. I am making this affidavit knowing that the Southold Town Planning Board and
Shelly's Place Inc. will rely upon same.

so that a fence could be put around back of the "Pub" area
at their expense. So I don't have to look at a dumpster,
empty boxes and delivery drop offs, and employees hanging
out back on break. They both seem to feel that there may
not be much to be done. This I feel is very unfair! But
they are trying to see how to solve the problem-my
suggestions a fence and parking signs. I've been told this
can take a very long time for anything to be done. This is
not what we need to hear especially since we live here and
have to view this problem daily,
"I" and other neighbors will not give up! There's no
reason why we shouldn't have our peace and quiet back.
Especially since the owners of the pub go home to peaceful Orient.
They need to understand" how we feel." Yes, we have talked
to them and they are just regarding everything they said to
us. Such as agreeing that cars should not park in front of
our homes since they have Rt. 25.
Shelly's place said they would put a fence around back area
and understood our situation. But now a different tune is
being sung.
Hopefully you can find the time to stop by our street and home
to see the need for these changes.

I am writing to you in a desperate attempt to request your help from your department with
regard to a situation that has arisen in the past two weeks. My once quiet residential
neighborhood is now upset and in disarray because of it.
The new "pub", "Shelly's Place" at the corner of our one-way street, Hobart Road, in Southold.
"Shelly's Place" has been constructed inside of a house. There is very little parking yet
hundreds of vehicles are arriving both day and night. The cars are also driving the wrong
way on a one way street as they are probably not familiar with this area. The patrons have
been loud, appear intoxicated, and "rowdy" in general from what we have witnessed so far.
Weekends mean noise until 3 or 4 a.m. for us. I should also mention that I have a two year
old son. Not only is the noise disruptive to his sleep but I am now in constant fear for his
safety with the amount of traffic at all hours. Myself and the other neighbors are also upset at
the way these cars are now parking all over our front lawns.
I am asking that you please conduct a police survey so that the highway department is able to
construct and install the signs that we now need to help make this situation tolerable.
My own home borders the "Shelly's Place" property. I cry when I watch my property values
decline. I put my heart and soul not to mention all of our money (we didn't have much) to
renovate this old house so that we could remain out here in this community and so our son
could grow up here as well. I don't know how the building department ever allowed the
permits for something like this when every week it seems standards are stricter and stricter
for everyone else.
Both myself and my husband have tried to be good neighbors to these new owners and in
return, they completely disregarded us. Other neighbors have now hired attorneys and now
we also may be forced into the same position.
I deeply appreciate any help or advice that you will be able to provide me and I look forward
to hearing back from you.

I met briefly with William Moore, Esq., who is representing the owners
of The Quiet Man Inn on the southeast corner of East Main Road and Hobart Ave.
I
1he owners wish to expand the existing seating area to provide more space for
the existing number of tables and chairs. They have been told by the Planning
Board that five additional spaces will be needed for parking. There is no
space available on site for this parking. The Wayside Market's owner has
written that he has no objection to the use of six of his parking spaces for
the Inn's use. However, this has been deemed unacceptable by the Planning
Board.
The Board of Appeals has indicated informally that it will not look upon
a variance to reduce the parking requirements favorably because of the Planning
Board's position.
I suggested to Mr. Moore that he explore the adjacent property (the
liquor store)and try to find out if that space could be obtained for parking
purposes. Mr. Moore says that his clients are willing to place a covenant on
their property restricting the number of tables and chairs to the existing
number--as a guarantee against the future intensification of the use.

Application of THE QUIET MAN INN for a Variance to the Zoning
Ordinance, Article XI, Section 100-112 (and Article III, Section
100-31) for approval of insufficient number of parking spaces of
this preexisting business use. Location of Property: Corner of
Main Road and Hobart Avenue, Southold, NY; County Tax Map Parcel
No. 1000-62-3-7.'
WHEREAS, public hearings were held on September 10, 1987 and
October 8, 1987, in the Matter of the Application of QUIET MAN INN
under Appl. No. 3659; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application, and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located in the B-1 General
Business Zoning District more particularly identified on the
Suffolk County Tax Maps as District 1000, Section 62, Block 3,
Lot 7, containing a total area of 4,008 sq. ft.
2. The subject premises is a corner lot as defined by
Section 100-13 of the Zoning Code with frontage of 63.50
feet along the south side of the Main Road and 97.99 feet
along the east side of Hobart Avenue.
3. The subject premises is improved with one two-story
framed building as shown by survey mapped February 13, 1987
by Roderick VanTuyl, P.C. with setbacks: (a) from the front
property line along the Main Road at 1.2 feet; (b) from the
west (front) property line at 24I feet; (c) from the south
[rear] property line at 21I feet; (d) from the east [side]
property line at 2.3 feet, all at the closest points.

4. By this application, appellant requests a Variance
from the Provisions of Article XI, Section 100-112 of the
Zoning Code for approval of the existing number of insuffi-
cient parking spaces with the proposal to extend the existing
building 10 feet towards Hobart Avenue, 57.5~ feet in length,
and then extending at an angle parallel with the westerly
property line 10 feet wide and 12 feet in length [see Sketch
A-3 prepared by V. Regi Weile, Architect, submitted under
this application].
5. For the record it is noted that under separate
application, a front yard setback reduction variance was
denied (same date hereof) under Appl. No. 3593.
6. The addition is proposed to extend the kitchen floor
area and seating floor area as more particularly shown on Sketch
A-7 prepared by V. Regi Weile Architect, for the placement of
six two-seat tables.
7. Several parking plans have been submitted and con-
sidered for the total four parking spaces proposed herein.
8. The total seating capacity claimed by the appellant
is 26 at tables and 12 at the bar. Section 100-112(A) of the
Zoning Code provides at least 1 for each 5 seats in an eating-
and-drinking establishment. The Southold Town Planning Board
has determined that a total of nine parking spaces are required
to satisfy the Site-Plan requirements under Article XIII. The
premises as exists without the addition provides for five
parking spaces, for this established business and second-story
single-family apartment use.
9. The present square footage of the first-floor area
is shown to be 1292 sq. ft. of which approximately 750 sq. ft.
has been utilized for the bar and table seating. The remaining
square footage has been utilized as kitchen area, lavatories
and stair wells [see Sketch A-6].
10. Also noted for the record are the following documents:
(a) Certificate of Occupancy of Nonconforming Premises #Z16245
issued October 2, 1987, (b) copy of letter dated September 25,
1987 from Roderick VanTuyl, P.C., Surveyor, concluding that
no more than two vehicles could be accommodated in any arrange-
ment of diagonal parking allowing the normal 10' by 20' for
each space; (c) 1 etter dated July 21, 1987 from the Bui 1 di ng
Inspector indicating the occupancy load at 57 persons (both
standing and seating).
11. It is the opinion of this Board as follows:
(a) the amount of relief requested is substantial in
relation to the requirement, that request being five out of
the nine spaces required, and being more than 45% of a
variance;
(b) the difficulties created have been existing for
many years and the owners/operators purchased the existing
business and premises during the period of time these
zoning requirements have been in effect;
(c) an extension of the subject building would add to
an existing dangerous intersection and would create serious traffic
hazards with the reduction of on-site parking spaces and backing
out onto Hobart Avenue;

RESOLVED, to DENY WITHOUT PREJUDICE the relief as applied
under Appl. No. 3659 in the Matter of QUIET MAN INN for a
Variance to reduce the number of the required parking spaces
to a total of four.

In response to your request, the Planning Board submits the following
information in support of its position, which is that the
parking requirements should not be waived.
The requests before the Zoning Board of Appeals are for a
variance to reduce the front yard setback for an addition
to an existing building which has a non-conforming setback;
and for a varaince to waive the required parking for the site.
The current building is an eating and drinking establishment
with a fire-rated occupancy capacity of 49 people. The seating
capacity is 38 people. There is also an accessory apartment
on the second floor.
The proposed enlargement of the building will enable the construction
of a new kitchen and more interior seating area for the comfort
of the patrons; however, the number of seats will not be increased.
And according to the Building Department, the fire capacity
of 49 will not be increased either.
The current site does not meet its parking needs now. At
present, there are 4 or 5 spaces available on site for customer
use. A 38 seat establishment requires at least 8 spaces.
The accessory apartment requires at least 1 space as well.
If the Town were to use the fire code occupancy rate of 49
people, which it does not at this time, 10 parking spaces
would be in order.
The lot is a non-conforming lot. The B-1
property lies requires 30,000 square fee

The subject lot is only 4,008 square feet - less than one-sixth
the required area. The applicant has enjoyed and can continue
to enjoy the current use on an undersized lot with insufficient
parking. In so doing, the applicant has relied on the goodwill
of two neighboring business owners (Wayside Market and Thompson's
Emporium) each of who have indicated a willingness to let
clients of the Quiet Man Inn park in their parking lots.
The Planning Board is not in favor of encouraging the use
of the Wayside Market's parking area because of its location
next to the intersection, its poor design and the fact that
the intersection is known for the high number of fender-bender
type accidents that tend to occur there. The owner of Thompson's
Emporium has declined to go so far as to grant a lease to
the applicant for the long term use of this parking lot; which
is understandable given his recently approved expansion plans
for a new building and parking area. Thus, many clients must
park on either Main Street, Boisseau Avenue or Hobart Avenue.
This intersection of these three streets is a busy and dangerous
one. Expansion of the Quiet Man Inn will eliminate its 4
to 5 parking spaces, thus forcing those cars to be parked
on these streets.
The addition of these cars to the street parking may increase
the already existing traffic congestion at this intersection.
Finally and most importantly, the granting of this variance
and waiver will set a clear precedent of allowing the expansion
of non-conforming sites without provision of adequate parking.
Such a precedent would be unfair to those business owners
who develop new sites and are required to provide for their
parking needs on site.
Furthermore, it might encourage the over intensification of
business uses on individual non-conforming lots in a manner
that has a negative impact on public safety and welfare.

Schedule, for permission to construct one-story addition to
the existing building in line with the northerly (front)
property line, extending 10 feet wide into the westerly
(front) yard area, extending 57.5i feet in length the full
10-ft. width, and thence extending 12 feet in length along
an angle parallel with the westerly property line [see
Sketch A-3 prepared by V. Regi Weile, Architect, submitted
under this application].
5. Article VII, Section 100-71, Bulk Schedule, of the
Zoning Code requires a minimum: (a) front yard setback at
35 feet; (b) sideyard at 25 feet; (c) rearyard at 35
feet.
6. The setback requested under this variance is a reduction
from 14ti feet at the southwest corner to 4ti feet from its clos-
est point from the westerly front property line [see Sketch A-3
prepared by V. Regi Wei 1 e, Archi tect].
7. The addition is proposed to extend the kitchen floor

Re: The Quiet Man Inn site plan
Dear Mr. Orlowski and Members of the Board:
A site plan has been presented by the owners of the Quiet Man Inn
to permit the alteration of the existing building to enlarge the
seating and kitchen area.
The Board has advised the applicants that they must comply with
the off-street parking requirements of the Town Code and provide
five (5) spaces in addition to the four existing off-street
spaces because the proposed addition requires site plan approval.
The proposed addition will not expand the seating capacity of
this preexisting use. The applicants are prepared to execute a
covenant agreeing to limit the seating to the existing 38 seats.
The Board has the authority to determine reasonable and
appropriate off-street parking regulations. In light of the
applicant's willingness to limit seating to its present capacity,
the Board should accept the existing parking and seating and
approve the proposed addition.
Moreover, the applicants have made a diligent effort to obtain
the additional off-street parking. The owners of the Wayside
Market granted permission to use their parking facilities as did
the owner of Thompson's Emporium. The spaces at Wayside were not
deemed acceptable to the Board because parking at that location
is not delineated clearly. The owner of Thompson's Emporium has
agreed to allow the use of his parking area for patrons of the
Quiet Man. In fact, he advised the owners'of the Quiet Man that
they could put a sign on their property advising patrons of the
additiOnal parking at Thompson's Emporium. He does not, however,
wish to enter into a formal written agreement with respect to the
parking.
Section 100-112(G) of the Town Code permits the Planning Board to
combine space requirements for two or more uses. The Board can
reduce the total parking spaces required for a particular use
when it can be conclusively demonstrated that the use will be
generating a demand for parking spaces primarily during periods

Re: The Quiet Man Inn
when the other use is not in operation. Thompson's Emporium
closes for the day by 6:30 p.m. The Quiet Man operates primarily
at the end of the business day when the Emporium is closed.
Therefore, the Planning Board may, in its discretion, reduce the
parking requirements of the Quiet Man in light of the agreement
by the owner of the Emporium to permit parking for the Quiet
Man's patrons.
The parking facilities at the Emporium together with the
applicant's willingness to covenant that the existing seating
capacity will not be expanded should be sufficient to satisfy the
parking demands of this preexisting business use and enable the
Board to approve the proposed site plan.

MEMORANDUM IN SUPPORT
OF APPLICATION FOR VARIANCE BY
THE QUIET MAN INN
Introduction
This memorandum is offered in support of the application for
a variance from section 100-31 of the Southold Town Code by The
Quiet Man Inn. Specifically, the Quiet Man Inn is located on the
southeast corner formed by the intersection of Main Road and
Hobart Avenue in Southold.
As a corner lot, the property is
deemed to have two front yards.
An area variance is necessary
because the proposed addition to the existing building does not
provide the necessary front yard setback.
Variances
Where there are practical
difficulties or unnecessary
hardships in the way of carrying out the strict letter of the
zoning regulations, the Board of Appeals has the power to vary or
modify the application of such regulations so that the spirit of
the chapter shall be observed, pUblic safety and welfare secured
and substantial justice done. Town Code sect. 100-12l(B)

Practical Difficulties Exist
For the Applicant
VARIANCES ARE NECESSARY FOR MANY OF THE
ESTABLISHED BUSINESSES IN THE TOWN BECAUSE
THE BUSINESSES PRE-DATE THE ENACTMENT OF THE
ZONING ORDINANCE
Many, if not most, of the business establishments in the
town predate the enactment of the zoning ordinance. The building
in which the Quiet Man Inn is located is no exception. These
existing businesses are located on small lots in the established
business districts in the Town which creates a regular need for
variances from the zoning ordinance.
For example, the Mattituck business district has many
establishments that have required all manner of area variances to
cope with the requirements of the code and the practical
realities of the small sized business zoned lots.
In an application on behalf of Metro Rental in Mattituck
the Zoning Board was provided a list of some of the variances
obtained by the businesses located in the Mattituck business
district because the businesses could not comply with the
ordinance when renovations and alterations were being made to the
existing buildings.
A similar list could be prepared for every
other hamlet area with business property in the Town of Southold.
If variance applications become computerized in the records of
the Town these trends could readily be established for the
Board's information.

VARIANCE WILL NOT AFFECT THE PUBLIC SAFETY OR
WELFARE AND WILL NOT ADVERSELY AFFECT THE
SURROUNDING PROPERTIES IN THE DISTRICT
The variance will not affect traffic safety in the area.
Corner lots are deemed to have two front yards from a concern
that traffic safety will be jeopardized if motorists are unable
to see around buildings not set back from the corner.
Traffic
safety will not be affected if the variance is granted because
Hobart Avenue is a one-way street with no traffic northbound
toward Main Road.
All traffic travelling from Main Road goes
south on Hobart Avenue and the presence of the building would not
impact the
ability of
traffic to
safely negotiate this
intersection.
VARIANCE WILL ENABLE APPLICANTS TO IMPROVE
THE PROPERTY INTO A VIABLE BUSINESS
Applicants want to alter the character of the existing
business. Drinking establishments that do not or are unable to
offer food in addition to alcoholic beverages are becoming
extinct. Liability insurance for such places has increased in
price dramatically and increased public awareness over the
dangers of drinking and driving has altered the public's social
habits. In addition, organizations of bar owners have encouraged
and attempted to teach and persuade members to incorporate food
availability into their operations as part of good and safe
business practice.
The existing kitchen facility in the Quiet Man Inn lacks any
fire safety system and unusable as a commercial establishment in
its condition. (See attached letter from Henry M. Haan Brokerage)

The applicants would like to offer a light menu in a pub setting
not presently available in the Town. 1
The proposed addition
would enable the applicant's to expand and improve the kitchen
facility to bring it into compliance with applicable safety
codes.
The owners are young, energetic businessmen and women who
are committed to hours of hard work to make the business a
success.
They want to upgrade the facility to make it an
attractive establishment that anyone would enjoy
and feel
comfortable in.
To alleviate concerns that have been raised with the
Planning Board with respect to off-street parking, the applicants
are ready and willing to condition the variance on a covenant
that would limit seating capacity to its present 38 seats. In
other words there would be no additional seating capacity
provided by the proposed addition.
The existing seats would
simply be spread out to relieve congestion. It is important to
note that the proposed addition does not reduce the number of
parking spaces already provided on the property.
CONCLUSION
petitioners respectfully request that the Board grant the
front yard variance.
At present, additional off-street parking
is being discussed with the Planning Board and the applicants
would ask that the Zoning Board's decision be made conditional

1. It was noted that there is a parking deficiency which

Dear Chairman Gerard Goehringer,
As per your letter of 15 December 1986 relating to the above Appeal, I respect-
fully submit the following clarifications:
1. Addi tional Seating: There is no addi tional seating.
As per attached Drawings A-6-Existing Plan with Furnishings and A-7-Pro-
posed Plan with Furnishings please notethat no tables are being added to
the premises.
Due to the insufficient space between the bar and the first row of tables
AND the insufficient space between the two rows of tables service is
di fficul t and can be hazardous when hot foods and drinks are served. The
proposed extension will allow half the tables to be relocated, thereby
allowing ample space for the staff to move about in the service of cust-
omers who are seated at the tables without interfering with Patron space
at the Bar Area.
As per enclosed photographs please note that at peak business evenings the
first row of tables has to be removed to allow ample space for Patron Ser-
vice. This reduction of tahles is detrimental to the Quiet Man Inns' bus-
iness and investment and is a definite hardship.
2. Parking: Since there is no increase in tables,additional Parking is not
required.
With the addition of the extension please note that the namber of exist-
ing Parking spaces re~ains the same. As per Drawing A-1 and A-3 Spaces
NO.1 and 2 remain, No.3 becomesparallel '.J the street and No.4 moves
to the rear of the buildinq.
3. Sidewalks: There is no sidewalk on the Hobart Avenue side of this property.
A<;per'Drawings A-I and A-3 please note that there is no side'dalk or curb
on the Hobart Avenue side of this property. Sidewalk at Main Street has
been indicated.
New Survey will be forthcomming and under separate cover as per your re-
aves t.
