Harbor Committee
MINUTES
May 18,1994
4:30pm at the Utility Offices
Next meetinl! is set for Wednesday. June 8th at 4:30pm at the Utilitv Offices
Present:
Elbert BUlT, Tom Doherty, Tom Doyen, Chippy duPont, Cynthia
Estabrooks, Louisa Evans, Leslie Goss, Steve Malinowski, Bill
Ridgway, Scudder Sinclair and Bill Wall.
Absent
Frank Bohlen, Cindy Gillan, Harris Parsons, David Patterson and
David Wilmerding.
Goss welcomed BUlT and Wall as new members of the committee and thanked Doherty for
providing meeting space.
Goss stated that the objectives for the meeting were to 1) make sure that all duties and tasks relating
to the positions of Bay Constable and Hamor Master were being performed or provided for, 2)
assist Doherty and Wall with any policy guidance they need in order to have lhe harbors well
managed and running smootWy this summer in the absence of an HMP, and 3) detennine how to
proceed with developing an HMP as quickly as possible.
Evans stated that lhe Resolution establishing the Harbor Committee passed the Town Board and
that lhe hearing to amend the Town Code eliminating lhe position of Harl>or Master would be held
on May 31st. Goss plans to attend that hearing. Evans outlined the preliminary concerns of Board
members Hussie and Liszewski.
Doherty provided an update on the following duties and activities:
Moo~ Permit Applications: 97 applications were mailed, 4 were returned declining a mooring
this swnrner, 16 applicants have yet to respond. All applicants will be issued the same mooring
with the same number and will attach the same boat to said mooring as last summer. Application
fees collected and forwarded to the Town have totaled around $9K thus far. No mooring waited
list was presented form last summer, so Doherty began a new one this winter. The on-island
requests were for Ball, May and Hancock. The committee agreed to issue all these applicants
permits as moorings were available. Mooring #71 (formerly Kennedy's) was suggested to be
unsafe and will be removed. A waiting list will be maintained for off-island applicants.

[Special Note: Since the meeting, Gass was conlacted by Kevin Coleman about their mooring
adjacent to Robert Coleman property in West Harbor for 31 foot Bertram "Double Bogie". The
mooring hasn't been used in several years and the shifting bottom prevents the mooring from
accommodating the Bertranl in present location. Kevin asked for a permit application. and
permission to look for deeper water in sanle area and put the Bertram there this summer. Goss
said yes and to check with Doherty. Kevin understands this was an interim decision until an HMP
for West Harbor is developed.]
Channel Markers and Instructional Float Bids for almual work on markers were received from
Pirate's Cove and Paul Tombari. The Cove had the lowest bid and was awarded the contract. The
Cove has since submitted a long-term proposal to Evans and Doherty for replacement and
maintenance of this equipment.
Licensine of operators under 18 years of age: The Town Bay Constable may be able to send one
of his staff to Fishers once a month to administer the six hour course. NY SParks & Recreation
certifies individuals to administer a licensing course. If we cannot get Town assistance, it was
suggested that maybe the Yacht Club would consider identifying someone to be certified and
administer the course. It was suggested that parenlal consent be a requirement for taking the ,
. course. What is the minimum age for an operator?
Hav Harbor Rules and Regulations: Largely the Sallle as last summer. No overnight allchoring,
no jetskiing, no waterskiing without a permit/visit to the Bay Conslables first to outline waterski
rules. It was the sense of the committee that the Hay Harbor channel be unofficially marl;ed (rather
than place red and green channel buoys) and that a "no overnight anchoring" instructioual buoy be
placed at the harbor end of the channel to discourage use of the harbor other than us by residents or
the Hay Harbor Club. Recent unintentional advertising of Hay Harbor in slate documents and the
poor water quality in Hay Harbor led the committee to suggest such action. Doherty wi\l send
mooring applications to Crisp, Bonsai, Wilmerding, Rauch and Purnell for Hay Harbor moorings
this summer, he will also mention the unofficially marked channel. Doherty will also conlact Jack
Polo of Hay Harbor Club to see if they need any mooring applications.

West Harbor Rules and Regulations: Ridgway presented a copy of the Old Lyme Harbor
Management Ordinance (attached). It was decided that this would be a good starting point for the
Fishers Island HMP. In the meantime, the committee agreed to adopt the 1993 West Harbor Rules
and Regulations printed by Mr. Clavin with the following changes: eliminate the reference to the
Harl>ormaster in the first paragraph, add 'Rafted boats must be attended at all times", add Doherty
and Wall's phone nunlbers under the Harbor Police (challge to Bay Conslable) section and add
Hay Harbor rules. The committee agreed that no anchoring zones for West Harbor included the

entire mooring area (east and west sides of the channel to Pirate's Cove), Darby's Cove and
previously defmed area around the aquaculture site. Anchoring would continue to be pennitted
from the harbor flasher along the west side of the channel to the Yacht Club until instroctional
buoys at Dock Beach swim area.
Transient Accommodation: Pirate's Cove will place three additional rental moorings near two
existing rental moorings by the rocks on the east side of channel to Pirate's Cove. These moorings
will be available for $25 per night and will be administered by Pirate's Cove Marine employee
stationed at the Yacht Club, monitoring Channel 9. Doherty will notify mooring owners that
unless the Pirate's Cove Marine employee at the Yacht Club is notified that guests of the owner
plan to use the mooring, it should be empty when owners aren't using it. Goss will talk to Cook
about rumored mooring rental program Yacht Chili is planning.
During discussion of each of the above issues, many valuable suggestiollS and concerns were
raised. Goss attempted to delay consideration of such untillhe conunittee begins woik on an
HMP.
The next meet/nl! was set for Wednesday, .Tune 8th at 4:30pm at the Utilitv Offices.
The subject of the meeting will be how to proceed on an HMP. Enclosed you will find a copy of
the Old Lyme Plan and an outline this conunittee prepared during lhe sununer of' 92. Please
review both and give some thought to lhe interests of the constituency you represent on this
conunittee. As Elbe suggested, the best way to begin may be to define all the harbor uses and
examine where they conflict.
