Fishers Island Utility Company
Present:
Chippy duPont, Louisa Evans, Leslie Goss, Steve Malinowski and
Scudder Sinclair.
Absent:
Frank Bohlen, E1by Burr, Tom Doyen, Cynthia Estabrooks, Cindy
Gillan. Harris Parsons, David Patterson, Bill Ridgway, David

SUBJECT: Discuss and draft text for overarchin!! harbor oolices and develoD committee
structure. membershio and o~ratin!! orocedure.
Louisa Evans mentioned thai the Town attorney would need more information to investigate a NYS
rioarian rie:hts case than was mentioned in an article provided by E1by Burr. Her feeling was that
the case was decided some time ago and may have been overtumed or moved to a higher court
since.
Tom DOherty will be in contact with Chief Bay Constable Don Dzenkowski to reauest an instructor
for the underage operator's course to be conducted on Fishers Island once in July and once in
August.
Leslie Goss summarized the mana!!ement orooosal put forward by Bill Ridgway at the November
18th committee meeting. The group assembled agreed that monitoring the placement of new
moorings should by undertaken by the Bay Constables. It was suggested that the Bay Constables
place a marker buoy at the proposed location for a new moorin!! in order to facilitate correct
placement by contractors other than Pirate's Cove Marine. The group agreed that administration of
the transient moorin!!s should be undertaken by the entity managing the docks and manning the
radio and telephone at the HDCO/Yacht Club premises. The group thought it would be too
confusing to separate transient mooring management and maintaining a list of guests on permitted
moorings from the other management duties associated with the HDCO/Yacht Club premises. The
group agreed that the availability of transient moorings should be noted in the Fishers Island
Harbor Management Plan. The group decided that Island mooring holders would be permitted to
have a !!uest use their mooring when the mooring was empty as long as the Island mooring holder

notified the central management entity to aid the Bay Constables on their harbor patrols. The group
decided against an explicit mention of guest mooring use in the Fishers Island Harbor Management
Plan. Louisa Evans expressed concern about fairness in not mentioning this particular use
specifically.
Leslie Goss agreed to contact the Yacht Club about two moorings it maintains. There was concern
that these moorings may be used for rental purposes and that one of the moorings near the docks
should be used for storage, not live aboard use.
Steve Malinowski noted that the committee had yet to discuss an overarching policv on Dlacement
of moorin!!s in the West Harbor mooring field. It was agreed that the east side of the field (east of
Pirate's Cove channel) would be for mooring all live aboard and off island vessels, and transient
moorings. The field to the west of Pirate's Cove channel would be used for storage only (need to
address location of the Thompson and Bohlen mooring~).
The group decided that there should be no issuance of new off island moorin!! Dermits. This was
suggested in anticipation of increased Island demand for moorings. No committee member knew
of any other harbors where mooring permits were issued to nonresidents or nonlocal renters. Such
a policy would conform with Town Code descriptions of resident and lessee for mooring
applications. There was a discussion about how to provide for family members of mooring
holders who might wish to maintain mooring permits.
The committee discussed the pros (possible reopening of outer harbor shellfish beds) and cons (no
pump out and retrofitting vessels) of establishing Fishers Island waters as a no dischar!!e zone.
Chippy duPont's primary objection was that there are no pump out facilities available. Leslie Goss
suggested that in the future, a mobile facility might be available from the mainland. Chippy duPont
was also concerned about the implications of retrofitting Island vessels with the appropriate Marine
Sanitation Devices.
