Fishers Island Harbor Committee
MINUTES
Friday, September 8, 1995
at 12:30pm at the Utility Offices

Valerie and Steve Riddler provided an overview of the Town's Local Waterfront
Revitalization Plan (LWRP) development The purpose of the plan is to give the Town
leverage over state and federal activities (ie have more of a say in the Navy's dumping 400k
cubic yards of toxic sediments in our waters) that occur at the shoreline.
Ruth has been leading over a decade of effort to develop the plan and hopes to have the
process completed by the end of 1995. Valerie stated that the Town commissioned two
studies because basic data was missing for her to be able to put together the LWRP. The
State gave the Town two grants for $25,000 each to conduct a shoreline erosion study and
develop a model harbor management plan (HMP). In this case, 'the model was built on
Mattituck Harbor. Valerie stated that from the Mattituck HMP, she will try to develop
contingencies/provisions that cover Town-wide HMP considerations.
The Fishers Island Harbor Committee was congratulated for its efforts in putting together a
Fishers Island HMP. Steve Riddler said that the LWRP will have several components: the
model HMP, the erosion study, a resources inventory, a land use section and some other
parts. He stated that the committee's HMP is very good for the nitty gritty of HMP plan
development He said the committee is way ahead pf the Town on this component.
The LWRP will be structured by "reach", there being 10 reaches for Southold, Fishers Island
being the furthest area northeast. Steve Riddler has much information on island resources,
zoning, etc... and will put together the section on the Fishers Island reach as it goes into the
LWRP. Be will ask the committee to review this section after he writes it. The Fishers
Island rew:h section will include the work of the committee.
Both Valerie and Steve Riddler will be developing a series of coastal zone policies (whittled
down from 44 state coastal policies) for Southold. Valerie will ask for the committee's
assistance in determining how the policies can include Fishers Island and where the policies

mav be refined to be more soeciflc to Fishers Island.if necessary.
Louisa asked if the committee should ask the Town to act on the Fishers Island HMP as a
separate document rather than wait to incorporate it into the Southold LWRP. Steve Riddler
advised against doing so.

Steve Riddler also advised that the committee might want to redraft the Fishers Island HMP ( ;c-
as a olanning document rather than a ocooosed legislative document as it is now. Then the .
committee could rely on the Town to enact laws that follow the committee's
recommendations, in the planning document Doing this would avoid conflicts with or
duplication of Town Code that exist in the Fishers Island HMP as it is drafted now. This
process would essentially mean going through the Fishers Island HMP and writing a
reason/justification/demonstration for each of the sections describing what the need for that
section is, so the Town will act on it.
Steve Riddler also suggested outting together a oamohlet called "Southold laws as thev
oertain to harbor use at Fishers Island" as a way to communicate to the local and visiting
public what the rules are, rather than handing out copies of our existing HMP or a redraft.
The committee and guests went through the document discussing concerns over various
sections. Major points include:
* The Fishers Island Harbor Commit~e as it is established now is somewhat illegal, and
therefore the proposed committee in the HMP wouldn't work legally either. The two choices
are to become a legal arm of the Town with very specific authority (mooring/anchorage
placement and location) with the Town appointing individuals (no way to ensure that different
groups are represented from year to year) OR, become an administrative/advisory arm of the
Town with no real authority but an ability to comment on a wide-range of issues (no
guarantee the Town will listen to us) and a way' to ensure all groups represented all the time.
Bill Sharp suggested drafting committee structure, terms and meeting procedures from the
Town Code section on the Planning Board.
* General Municipal Law Section 6 does not allow for establishing a separate Fishers
Island Harbor Management Fund in the Town's accounts. Ruth suggested submitting an
annual budget showing past revenues/expenses and projected expenses and getting it to the
Town so the cOlI!mittee goes on record in the Town budget process.
* There is confusion about the jurisdiction of Trustees over FI waters and moorings that
are not inside West Harbor.

1he committee will not be able to have any direction over the Bay Constables. )(

* The grievance process (appeals made to the committee when complaints are lodged
against the Bay Constable who is only carrying out committee policy) is not adequate.
