The following is in response to your request of December 7, 1989
for comments on application number 3872 Compass Transports.
The Site Plan application was denied because of insufficient
parking for the proposed use. Enclosed please find a copy of the
Planning Board's resolution of denial and its reasons for so
doing.

Dear Mr. Markakis:
The following action was taken by the Southold Town
Planning Board on Monday, May 15, 1989.
WHEREAS, the Planning Board has reviewed the Engineer's report
dated May 5, 1989. The report states that the maximum allowable
parking which could be provided is limited to three spaces (the
diagonal parking stalls *1, 2, and 3). The report also states
that these three spaces could be used by a majority of vehicles
if caution is exercised entering and exiting; and
WHEREAS, the required number of parking spaces for a restaurant,
as described in Article XIX of the Town Code, is 1 space per 3
seats or 1 space per 100 square feet of floor space, whichever
is greater. The building area for the proposec site pl~~ is
1,547 sq. ft., thus requiring 15 parking spaces. The proposed
plan is for 15 seats, thus requiring 5 parking spaces. As per
the code, 15 spaces are required; and
WHEREAS, a restaurant is a use which creates a large volume of
vehicular and pedestrian traffic. With this particular use it is
not possible to design the site so as to ensure that individuals
will use the site with caution while exiting, entering, and
driVing around the site. It is also not possible to restrict
cars which are larger than the majority of cars, from using the
parking area; and

WHEREAS, based on the Planning Board's review and the Engineer's
report on the number of parking spaces for the site, the Board
feels that there is insufficient parking for the proposed use;
and be it therefore,
RESOLVED that the Planning Board deny the application.

Dear Mr. Orlowski:
We have made a field inspection of the above referenced site where
vehicles were utilized to demonstrate the feasibility of the parking
lot 1 ayout.
It appears that the diagonal parking stalls (#1, 2 and 3) could be
used by a major ity of veh icles if caut ion is exerc ised enter ing and
exiting. The other two stalls, (#4 and 5) if occupied by full size
passenger veh icles, would restr ict movement on the site to such a
degree that a hazardous condition could exist.
Due to this observation, we feel that the maximum allowable
parking which could be provided is 1 imited to three spaces. This does
not meet the code specifications which were previously fT'entioned, so
some waiver of normal requirements would be necessary.
If we may be of further assistance, please let us know.

Dear Mr. Markakis,
In response to your letter of February 22, 1989, the
Planning Board has reviewed the Zoning Code and finds that the
proposed fast food restaurant use is not a permitted use in the
Hamlet Business District as per Article IX, Section 100-91.A.
(7). Therefore, this Board cannot proceed with either an
amendment to your site plan or a new site plan.
If you wish to pursue the matter, you should apply for a
change of zone from the Town Board. However, for the record,
the Planning Board would not be in favor of a zone change
application for the property in question.

Gentlemen:
We acknowledge with thanks receipt of your letter dated February 24,
1989, in response to our letter of 22 February 1989.
In this connection plaese note that we had incorrectly described the
proposed use as a "Fast Food Establishment". It is obvious that we do not
have the physical set-up, the equipment, accessories, and rather extensive
parking facility required for a "Fast Food Establishment".
The proposed use of this bu~lliing is a small, cozy, specialty of eth-
nic nature (Greek) family type and country style Restaurant for which we
have had relative conference with the Town Attorney's office, and have been
advised that as such is of permissible use.
We respectfully submit our request for the Board's consideration.

We acknowledge with thanks receipt of your letter dated February 24,
1989, in response to our letter of 22 February 1989.
In this connection plaese note that we had incorrectly described the
proposed use as a "Fast Food Establishment". It is obvious that we do not
have the physical set-up, the equipment, accessories, and rather extensive
parking facility required for a "Fast Food Establishment".
The proposed use of this bu~lHing is a small, cozy, specialty of eth-
nic nature (Greek) family type and country style Restaurant for which we
have had relative conference with the Town Attorney's office, and have been
advised that as such is of permissible use.
We respectfully submit our request for the Board's consideration.

Gentlemen:
The undersigned, Andreas E. Markakis of Southold, is proposing to
use the captioned premises for a Fast Food Establishment- Fried Chicken-
both EAT-IN and TAKE-OUT.
In this connection, ~d for the required procedure of determining
whether an amended site plan is necessary or not, please note the follow-
ing:
1. NO CHANGES are proposed or needed to be made to the site plan or
the building itself.
2. FLOOR PLAN showing the equipment and fixtures outlay in the exist-
ing floor area is submitted herewith
3. We understand that the latest requirements for par ~ng facility
call for 3 sheats to each one parking space available. Accordingly,
we have provided for 6 tables accommodating 2 persons each plus 3
stools - a total of 15 sheats.
4. We also enclose herewith 3 copies of the existing on site parking
arrangement,as previously approved, for your handy reference.
5. All necessary requirements of the Health Department, as shown in
the approved Survey, have been met. Although a sheat capacity of
25 seats is allowed- as per sanitary design calculations approved-
we have provided only for 15 sheats.
6. We have also complied with the Building Department's requirements
of covering the entire kitchen walls and ceiling with new 5/8"
Fire Code Sheet Rock. Additionally, and only for "cosmetic" impro-
vement reasons we have replaced the old shingles store front with
l"x6" T.G.CEDAR, and also replaced the front windows with new pic-
ture windows.
We respectfully submit the above information and existing documents
for your review. As the site is in compliance we anticipate that a
waiver will be granted in the circumstances.
We would greatly appreciate receiving the Board's decision in due ti-
me so that we may proceed with the project.

Dear Mr. Lessard:
At our regular meeting July 11, 1983 our Board discussed
certification of the above captioned site plan by George H.
Fisher, BUilding Inspector. Prior to this meeting the Board
inspected the area and stated no objections to the number of
parking spaces on the site. Mr. Andreas Markakis was present
to discuss drainage for the area and the access width as noted
in Mr. Fishers report. Our Board requested that Mr. Markakis
supply our office with a survey designating the widths of ac-
cess and a letter with regard to the drainage on the property
for referral to your office.
Please advise as Planning Board approval has not been
given to date.

Dear Sirs:
In regards to Building Inspector's observations as stated in the
meeting of the Planning Board on 7-11-83, please note the following:
1. DRAINAGE: This building has been in that certain location for the
last 40 years or so, we understand, and apparently it has not had any
drainage problem due to the fact that the grounds around it are com-
prised of about 10 feet deep of SAND.
2. SURFACING: On top of the completed and graded grounds around the
building a total of 150,000 lbs of Blue stone has been installed pro-
viding for a cover of about 6 inches deep.
3. As for the various dimentions around the building, those are indi-
cated in the Surveyor's Plan originally submitted, but for handy re-
ference a photocopy in triplicate is attached hereto in addition show-
ing the concrete Aprons of the Parking entrance and exit with their
dimentions.
Please allow us at this time to mention some of the works
performed thus far:
= NEW RIDOF over the entire building.
= The rear of the property grounds entirely cleared of all soil,debris
bush~ etc., and graded to the level of the main building.
= The metal SHED on the property line was demolished.
= NEW retaining concrete wall was errected in the rear and side of the
property: 12 inches wide x 5 feet high with an additional 3 feet deep
footing; the side walls pitching down to curb height followed by
CURBING ( N.Y.S. Design A) 60 feet long on each side of the property.
= Entire property grounds around the building graded to the level of
the main building after the blue stone was provided.
= FRONT STEPS: BId steps demolished and new concrete steps constructed
with new custom made railings.
= A NEW 200 amps Electric service line installed.

cation process of this building.

length of the property, including 3' Foundation and 4' wall.
Reinforcing Rods (lz" bars) one foot each- apart installed.

Dear Sirs:
In regards to Building Inspector's observations as stated in the
meeting of the Planning Board on 7-11-83, please note the following:
1. DRAINAGE: This building has been in that certain location for the
last 40 years or so, we understand, and apparently it has not had any
drainage problem due to the fact that the grounds around it are com-
prised of about 10 feet deep of SAND.
2. SURFACING: On top of the completed and graded grounds around the
building a total of 150,000 lbs of Blue stone has been installed pro-
viding for a cover of about 6 inches deep.
3. As for the various dimentions around the building, those are indi-
cated in the Surveyor's Plan originally submitted, but for handy re-
ference a photocopy in triplicate is attached hereto in addition show-
ing the concrete Aprons of the Parking entrance and exit with their
dimentions.
Please allow us at this time to mention some of the works
performed thus far:
= NEW R@OF over the entire building.
= The rear of the property grounds entirely cleared of all soil,debris
bush~ etc., and graded to the level of the main building.
= The metal SHED on the property line was demolished.
= NEW retaining concrete wall was errected in the rear and side of the
property: 12 inches wide x 5 feet high with an additional 3 feet deep
footing; the side walls pitching down to curb height followed by
CURBING ( N.Y.S. Design A) 60 feet long on each side of the property.
= Entire property grounds around the building graded to the level of
the main building after the blue stone was provided.
,
= FRONT STEPS: BId steps demolished and new concrete steps constructed
with new custom made railings.
= A NEW 200 amps Electric service line installed.
