Dear Mr. Gambone:
The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday, April 30, 1990.
WHEREAS, Jerry Gambone and Kes Zapkus are the owners of the
property known and designated as SCTM# 1000-61-1-12, located at
55415 Main Road, at Southold; and
WHEREAS, a formal application for the approval of this site
plan was submitted on January 16, 1990; and
WHEREAS, on January 9, 1990, the Zoning Board of Appeals
granted a Special Exception for permission to have a rental
apartment over an office; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
March 26, 1990; and
WHEREAS, all the requirements of the Site Plan Regulations
of the Town of Southold have been met; and

RESOLVED, that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final survey prepared by
Victoria Weile and received by the Planning Board on February
13, 1990.

to the Zoning Ordinance, Article IX, Section 100-91, for
permission to have Office/Retail business on first floor and
residential rental apartment on second floor. Property
Location: 55415 Main Road, Southold, County Tax map No. 1000,

WqtEREAS, a public hearing was held and concluded on
December 19, 1989 in the matter of the Application of JERRY
GAMBONE AND KES ZAPKUS under Appeal No. 3896; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WqtEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning,, and
the surrounding area; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Main Road, Route 25, Hamlet of Southold, and is
identified on the Suffolk County Tax Maps as District 1000,
Section 62, Block 1, Lot 12.
2. This is an application for Special Exception from the
Zoning Code Article IX, Section 100-91, for permission to have
Office/Retail business on first floor and residential rental
apartment on second floor.

3. Article IX, Section 100-91, in the HB District, no
building or premises shall be used and no building or part of a
building shall be erected or altered which is arranged, intended
or designed to be used, in whole or in part, for any uses.
4. In considering this application, the Board finds and
determines;
(a) that there is no other method for appellants to
pursue; and changes or alterations on the premises will require
a Special Exception.
(b) that the Special Exception will not in turn cause a
substantial effect on the safety, health, welfare, comfort,
convenience, and/or order of the Town;
(c) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the Special Exception, as applied conditionally noted
below.
Accordingly on motion by Mr. Dinizio, Seconded by Mr.
Goehringer, it was
RESOLVED, to GRANT a Special Exception in the matter of
the application of JERRY GAMBONE AND KES ZAPKUS under Appeal No.
3896, SUBJECT TO THE FOLLOWING CONDITIONS:
That there only be cooking facilities for one
apartment.

Dear Mr. Kassner:
Enclosed is our completed Site Plan application. Our initial Site
Plan proposal was originally submitted on June 20, 1989. Based on
the discussions with you in August and October, we have modified
our plans and incorporated your recommendations. We are applying
for Site Plan approval in order to:
1) Change the usage of our buildings' first floor, which was
formerly residential, to professional office space or
a retail store, while maintaining the current usage of the second
floor as a residential apartment.
2) Improve the existing Garage structure to use it as storaqe
space, accessory to the principal activity of the first floor.
3) Create a parking area in the rear yard and bring the site into
compliance with Town requirements.
Re: Item ~1, we have been granted a Special Exception by the ZBA
(Application ~3896, hearing date 12/19/89, approved on 1/12/90)
to have office space or a retail store on the first floor and a
residential rental apartment on the second floor in the HB
District
(Under the amended Zoning Ordinance Article IX, Section 100 -

to the Zoning Ordinance, Article IX, Section 100-91, for
permission to have Office/Retail business on first floor and

WHEREAS, a public hearing was held and concluded on
December 19, 1989 in the matter of the Application of JERRY
GAMBONE AND KES ZAPKUS under Appeal No. 3896; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning,'and
the surrounding area; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of Main Road, Route 25, Hamlet of Southold, and is
identified on the Suffolk County Tax Maps as District 1000,
Section 62, Block 1, Lot 12.
2. This is an application for Special Exception from the
Zoning Code Article IX, Section 100-91, for permission to have
Office/Retail business on first floor and residential rental
apartment on second floor.

3. Article IX, Section 100-91, in the HB District, no
building or premises shall be used and no building or part of a
building shall be erected or altered which is arranged, intended
or designed to be used, in whole or in part, for any uses.
4. In considering this application, the Board finds and
determines;
(a) that there is no other method for appellants to
pursue; and changes or alterations on the premises will require
a Special Exception.
(b) that the Special Exception will not in turn cause a
substantial effect on the safety, health, welfare, comfort,
convenience, and/or order of the Town;
(c) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the Special Exception, as applied conditionally noted
below.
Accordingly on motion by Mr. Dinizio, Seconded by Mr.
Goehringer, it was
RESOLVED, to GRANT a Special Exception in the matter of
the application of JERRY GAMBONE AND KES ZAPKUS under Appeal No.
3896, SUBJECT TO THE FOLLOWING CONDITIONS:
That there only be cooking facilities for one
apartment.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,

We are applying for a Site Plan approval in order to:
1) Change the usage of a first floor formerly residential
space to Professional Offices. This is the ground floor of a
two story frame house which has a remodeled residential
Apartment in current use on its second floor.
2) Improve the existing Garage Structure and enlarge it to
the dimensions of its pre-existing block foundation.
The structure would be used for Storage or Accessory Office
Space.
3) Create a parking area in the rear yard and bring the site
into compliance with the Town requirements.
Note:
Our original interest in purchasing this property, in 1985,
had to do with its unique architectural and historical value
located in the heart of Southold. Our intention was to
preserve and restore this beautiful structure, after
witnessing the unfortunate demolition of another Southold
monument, the Hartranft House. Our building was once a part
of the old Southold Hotel. It is an excellent example of
Greek Revival Architecture (Greek Temple style) circa 1830.
According to the inventory entry of the SPLIA: "the building
is a rarity on the North Fork which adds greatly to the
interest of Southold's historic streetscape".
Our conversion plans are modest and do not substantially
alter the impact on the neighborhood. We hope our effort to
preserve the character of the building, yet also make it
economically viable, will be considered in your evaluation
and approval of our proposed plans.
Prior to purchasing this property, we had extensive
discussions with Mr. Ed Hinderman and later with Mr. Victor
Lessard, both of the Building Department, concerning what
would constitute ideal usage for the structures and site,
and what the Code would permit in terms of improvement and
conversion. From these discussions and our reading of the
Zoning Code it is our understanding that:
Re: Item ~1, the Code allows for mixed usage (residential
and commercial) in the same building in the HB District and
since the residential unit is pre-existing this situation
involves only site plan approval for the change of usage on
the first floor and will not require a Special Exception nor
ZBA action.
Re: Item ~2, because it is an existing condition, the block
foundation adjacent to the garage, which had supported a
greenhouse attached to the garage, allows for our proposed
extension for the full width of the foundation and full
depth of the garage structure.
Re: Item ~3, please refer to the enclosed floor plans for
the Principal Building and the Accessory Structure
(Converted Garage) for the square footage of floor area
devoted per type of use. The required number of parking
spaces has been calculated as follows:

I am in receipt of your memo dated August 4. 1989 in relation to
apartments over retail stores. I agree with your interpretation that same
are not allowed over business, professional and governmental offices.

(3) A permit issued by the Building Inspector shall be
required for each shopping center directory sign erected
or maintained pursuant to this subsection. The applica-
tion for said permit must contain an architect's drawing
of said directory sign as well as a survey indicating the
dimensions of said sign, its location and_se~. The
Building Inspector shall reT~i: said ap~ draw-
ing(s), survey(s) an~ other supporting papers to the
D. Interior signs. An interior sign or combination of signs shall
not cover more than ten percent (10%) of the total glass area
upon which, or in which, it is affixed, displayed or painted.
E. Wall signs.
(1)Wall signs shall not project more than twelve (12) inches
from the wall to which they are affixed.
(2) Within any business district, such signs shall not exceed
a height of three (3) feet and shall not extend higher than
the top of the parapet in case of one-story buildings. In
the case of buildings taller than one (1) story, such signs
shall not extend above the bottom of the sill of the
windows of the second story nor extend or be placed more
than fifteen (15) feet above the outside grade. No wall
sign or combination of signs, including interior signs, on
any wall facing any street or public way in a business
district shall exceed an area in square feet equivalent to
one (1) times the length in feet of the structure on each
frontage, up to a maximum of sixty (60) square feel
(3) Within an industrial district, one (1) wall sign not
exceeding thirty (30) square feet is permitted for each
street frontage from which access is provided to the lot.
(4) In any districts where wall signs are permitted, no such
sign shall cover, wholly or partly, any wall opening,
including doors, fire escapes and windows nor project
beyond the ends of the wall to which it is attached. All
such signs must be safely and adequately attached to said

§ 100-205. Specific regulations.
A. Illuminated signs.
(1) A sign illuminated by electricity from outside or within
or equipped in any way with electric devices or appli-
ances shall conform with respect to wiring and appliances
to the regulations of the New York State Board of Fire
Underwriters and shall bear the stamp of said Board. All
wi.ring shall be self-enclosed in metal raceways.
B. Freestanding and ground signs. Except for required caution-
ary or traffic control signs, one (1) freestanding sign shall be
permitted for each frontage of a property on a public street or
way where a building is setback at least twenty-five (25) feet
from the street line. Such signs are limited to either pole signs
with no guy wires or signs permanently affixed to a fence or
other wall separate from the principal building. All ground
signs shall be located within and not overhang the property
line. The location and design of such signs shall be chosen so as
not to present a hazard to pedestrian or vehicular traffic and
shall be twenty-five (25) feet from each side line and fifteen
(15) feet from the front and/or rear property line. The
maximum height of such signs shall be fifteen (15) feet.
