Dear Mr. Orlowski: The Suffolk County Planning Commission at its regular meeting on August 1, 1984, reviewed the proposed subdivision plat entitled, "Minor Subdivision - Mary Grigonis", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to approve said map sub- ject to the following condition deemed necessary to help preserve the ground- water supply and residential zoning. 1. The subdivision shall file in the County Clerk's office on or prior to the granting of approval to this subdivision a covenant and restriction prohibiting the future subdivision of either or both lots. This covenant and restriction can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Town Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required. The Commission also offers the following comments on the map for your use and consideration: , I . ,,\ I I . -, \ ", 1. Creation of a subdivision with substandard lots, that is, lots whose areas are considered less than the minimum required by the zoning classification of the property, constitutes an overintensification of land use in a groundwater sensitive area in what is meant to be a low density area. Such action could establish a precedence for future subdivision of this kind which would essentially be a circumvention of the Town Board's action taken over the past years to upzone these groundwater sensitive areas. N.Y. 11971 TELEPHONE 15161 765.1809 ACTION OF THE ZONING BOARD OF APPEALS Appeal No. 3211 Application Dated January 24, 1984 TO: Mrs. Mary Grigonis 550 Wells Avenue Southold, NY 11971 [Appellant (s)] At a Meeting of the Zoning Board of Appeals held on April 5, 1984 the above appeal was considered, and the action indicated below was taken on your Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a Request for Special Exception under the Zoning Ordinance Article , Section [X] Request for Variance to the Zoning Ordinance Article III, Section 100-31 [] Request for The public hearing on this application was held on April 5, 1984. Application for MARY GRIGONIS, 550 Wells Avenue, Southold, NY for a Variance to the Zoning Ordinance, Article III, Section 100-31 for approval of insufficient area of two proposed parcels located at the west side of Wells Avenue, Southold, NY; County Tax Map Parcel No. .1 000-061-03-08. '. The board made the following findings and determination: By this appeal, applicant seeks approval of a parcel of land to be set-off from the existing dwelling which would contain 56,120 sq. ft. with 282 feet of frontage along Wells Avenue. The existing dwell- ing will be retained on the 50,327 sq. ft. lot with 242.56 feet of frontage. Existing on the northerly parcel to be set-off is a very large barn, approximately 1.5 feet from Wells Avenue and which is structurally in good, sound condition. In personally visiting the site and neighborhood in question, the board finds as follows: (a) the premises to the north and the premises on the east side of Wells Road opposite this property are zoned B-1 Business and which require a minimum of 30,000 sq. ft.; (b) the parcels south of this property and east of Wells Road contain an area of less than 40,000 sq. ft. The courts have in the past held that the denial of such an area variance is improper where there were numerous lots in the neighborhood which were as small or smaller than the subject lot (Krueger v. Zoning Board of Appeals, 368 NYS2d 63 (1975, AD). In considering this appeal, the board determines: (a) that the relief requested is not substantial; (b) that the circumstances are unique; (c) that by allowing the variance, no substantial detriment to adjoining properties would be created; (d) that no adverse effects will be produced on available governmental facilities of any increased population; (e) that there are numerous lots in the neighborhood which are smaller than that proposed; (f) that the relief requested will be in harmony with and promote the general purposes of the zoning code; (f) that the interests of justice will be served by allowing the variance, as indicated below.
