Dear Mr. Tonyes:
The following took place at a meeting of the Southold Town Planning Board on Monday,
January 24, 2000.
The final public hearing was closed.
The following resolution was adopted:
WHEREAS, this proposed site plan, to be known as site plan for Southold Automotive Corp.
is to expand on existing building by 520 square feet to accommodate inspection equipment;
and
WHEREAS, Tonyes Realty Corp. is the owner of the property known and designated as
Southold Automotive, Main Road, Southold, SCTM # 1000-61-4-23; and
WHEREAS, a formal application for the approval of this site plan was submitted on
September 25, 1998; and
WHEREAS, the Southold Town Planning Board, acting under the State Environmental
Quality Review Act, (6NYCRR), Part 617, makes a determination that this project is a Type II
action and not subject to the provisions of the State Environmental Act, (SEQRA); and

WHEREAS, this site plan, last revised July 2, 1999 was certified by the Building Inspector on
January 24, 2000; and
WHEREAS, a setback variance was granted by the Board of Appeals on August 24, 1998;
and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public
Hearing, has received affidavits that the applicant has complied with the notification
provisions; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have
been met; be it therefore
BE IT RESOLVED, that the Southold Town Planning Board authorize the Chairman to
endorse the final survey dated July 2, 1999, with Suffolk County Department of Health
Services approval stamp, subject to a one year review from date of building permit.
Enclosed please find 2 copies of the approved site plan; one for your records and one to be
submitted to the Building Department when you apply for your building permit.

As discussed, a check was made in the Building Department files for an "as built' plan
showing the building without the two dormers. No such plan was found in the files of the
Building Department.
The Architectural Review Board had previously approved the elevation drawings that
you had provided showing the two dormers. In addition, it appears that the west elevation
differs from the elevation submitted to the ARC for review.
The ARC stated that the dormers should be built as shown on the original elevation
drawings.
The ARC will meet this week on Thursday July 26, 2001, at 4:30 pm. If you wish to
attend this meeting, or require more information, please contact this office.

FINDINGS OF FACT
PROPERTY FACT~/DE~RIPTION: The above-identified property is
located in the Hamlet Business {HB) Zone Oistrict and is a corner lot with
115+- ff. frontage along Hain Road (N.Y.S. Route 25) and 75+- feet along
Youngs Avenue, Seuthold. The property consists of a total size of 8,625
square feet. The present uso is public garage-repair and gasoline sales.
BASIS OF APPEAL: The NoUce of Disapproval issued by the Building
Inspector is dated August 13, 1997 and reads as follows:
"Under Artide XXIV, Section 100-243A, a non~forming building with a nonconforming use
·hall not be enlarged, ~ or .tnmtumlly altered unle~ the me of the building is
changed to a conforming use. 11re preexisting building is located in the IfamEet Business
District and is not a pennL**'~ use In this district. 11re side and rear yard setbacks do not
conform to the required 10 fL side and 25 ft. rear yard..."
VARIANCE RELIEF REQUESTED BY APPLZCANT: The request made by
applicant is to add a 505 sq. ff~ area to the existing building by adding a
bay at the west side and squaring off the rear to establish a uniform
sotback of 8 feet along the rear wall. The sothacks are proposed at a
minimum of 10 feet 4 Inches from the westerly (side) prnporty line and 8
feet from the southerly (rear) property line (maintaining the e=:-blished
rear setback).

REASONS FOR BOARD AC'I IONf DESCRIBED BELOW:
The subject promises has been operated since at least 1927 as a gasoline
station with a two-bay motor vehicle service facility. New York State
motor vehicle inspections have been performed at least since 1987~ when
applicant took over operation of the business, and probably for many
years before then. Until 1989, the property was zoned B-1 General
Business, a zone in which gasoline stations aro permitted by Special
Except. ion.
Pursuant to Federal clean air laws~ New York State has imposed a new
automotive emissions inspection system that is being phased in during
1998. Inspection stations aro required to install a fixed dynamometer on
which vehicles will be run at over 50 mph for testing~ a fixed camera~ and
other new equipment. Applicant has decided to continue to perform NY
State inspections~ which it has shown aro an economically important
element of its business. Consequently, applicant will ins;~ll the
dynamometer and other required new equipment. It seeks a variance to
enable the building of a third bay at the west side of its building, which
will hold the inspection equipment and will be enclosed for purposes of
safety and the control of noise and emissions. Applicant has testified that
if it cannot build the third bay~ the equipment would be installed in an
existing bay. Because the existing bay would continue to be used for
vehicle ropairs~ applicant has testified that the dynamometer would be
located in a spot such that cars being tested would protrude out of the
open bay door and onto the gasoline staUon apron. Applicant has testified
that such an arrangement would result in problems including uncontained
noise from the dynamometer~ uncontained emissions from tested vehides~
and safety hazards rolated beth to the protrusion of cars from the bay and
to the risk of unprotected 'runaways' on the dynamometer.
The Board concludes that applicant's proposal does not change nor
expand the existing use. Rather, he proposes to build a bay to shelter
Stete-mandated equipment necessary for it to continue in the business of
doing inspections. Applicant will inaiall the equipment and romain in the
inspection business even if not permitted to build the third bay, but in that
case the result, in the Board's view~ would be a significant detriment to
community safety and welfaro. The Board is also cognizant of the public
policy interest in accommodating emissions inspection operations as a
means to improve air quality.
The Board concludes that granting of the requested variance will not
produce an undesirable change in the character of neighborhood or a
detriment to nearby properUes because the established business will
conUnue to operate as it has in the past and the addiUon will be
consistent with the appearance of the neighborhood. The rear yard

setback of 8 feet, while substanUally less than the required 25 feet, is
unchanged from the exisUng rear setback, There is no other feasible way
· for the applicant to establish an enclosed inspection facility while also
maintaining the existing capacity of its business to perform repairs.
GranUng of the variance will not have an adverse effect on physical or
environmental condiUons in the neighborhood provided that the
inspection fadlity's air exhaust is directed to the greatest degree passible
toward Route 25, where there is substanUal vehicular traffic.
The Board finds that the grant of the requested variance, with the
condiUons set forth below, is the minimum necessary and adequate to
enable applicant to conUnue to perform NY State inspections, while at the
same Ume preserving and protecting the character of the neighborhood,
and the health, safety, welfare of the community.
RESOLUTION/ACTION: On motion by Member Collins, seconded by
Member Dinizio, it was
RESOLVED, to GRANT a variance permitting applicant to square off the
southwest comer of the existing building and to build a third bay, as
described in its application, with a minimum setback of 8 feet along the
entire rear wall and a minimum west side setback of 10 feet, subject to
the following CONDITZONS:
1. The third bay shall be used to house the equipment mandated by New
York State for the performance of motor vehicle Inspections, including a
dynamometer in a fixed installaUon.
2. The exhaust of air from such hay shall be arranged so as to direct
such exhaust to the greatest degree possible toward State Route 25.
3. Personal vehicles of the owners and employees shall not be parked
on the premises between 8 a.m. and 6 p.m. (business hours), and public
parking areas must be utilized.

The attached plan, *vhen duly signed by a representative of the department, constitutes a permit to
construct a water supply and/or a sewage disposal or collection system for the property as depicted. The
applicant sho,,ld take note of any conditions of approval, which may be indicated on the plan or encbsed
herein. Construction must conform with applicable standards includ/ng "Standards for Approval of
Plans and Construction for Sewage Disposal Systems for Other than Sin~e Family Residences."
Omissions or lack of detail on the plan do not release the applicant from the responsibility of having the
construction done m conformance with applicable standards. '
The permit (plan) expires three (3) years after the approval date. A_ny modification wkich may affect
the proposed sewage disposal or water supply systems requires submission ora revised plan and
additional fees (if applicable) for reapproval prior to consmction. No inspections w/il be performed
by the department on expired permits.
Permits may be renewed, extended, transferred, or revised in accordance with the procedures
described in Instructions to Renew, Extend, or Transfer an Existing Permit for Other than
Single Family Residences (Form WWM-01$).
It is the applicant's responsibility to call the department in advance to arrange inspections of the
sewage disposal and/or water supply facilities prior to bacld:illing. These include inspections of the
sewage collection and disposal systems, water supply system components and piping, and final
~dading as shown on the approved plans, in certain cases, inspections of the soil excavation may be
required to determine the acceptability of the soils for sewage disposal systems. The department
must be notified at least 48 hours in advance to schedule an inspection; and excrrvation inspections
must also be confirmed by calling 852-2100prior to 9:$Oam. the morning of the inspection.
Final approval issued by the Department is necessary, prior to the occupancy of new buildings,
additions to existing buildings, or for the use of sewage disposal or water supply systems.

Findings and Facts:
i. The applicant is proposh~g to coi~struc~ a 516 sf addition to an existing automobile sc?.'ice
s:ati,~n building on a 0.19 acre lot for the purpose of Fro ¢iGn~ necessary space for new required
vehiGc inspection equipment. To serve the sanitary needs of the facility, the applicant is
proposing to demolish the existing cesspool and reP[ace it with a septic tank/leaching pool
~ewag¢ disposal system.
2. Available space for constructing the building exte2sion and installing a new sanitary system is
ec. nst,'ainCd by the size of the property. The design [lan for the project, dated 2/10/99, shows the
proposed septic tank approximately 18 ft from the eaisting concrete support slab for underground
fuel storage ~anks and the proposed leaching pool approximately 9 ft from the same tanks. Also,
me mmre ':xpansion leaching pool is shown approximately 2 ft from the storage tanks.
3. A~ thc hearing, and in the "Explanation for Variance Request", dated March 26, 1999, the
applicant's engineer indicated the proposed leaching pool would be installed with the use of a
tempo:a~v caisson. The reported reason for this construction method would be to eliminate
cSsturbance to the surrounding soil and, thereby, prevent settlement, damage or undermining of
the existing underground fuel storage tanks.

4. The Department staff engineer indicated that there was an on-gc';ng fue.l spi~l
investigation/remediation at the site. A letter dated April 5, 1999 from the NYSDEC ;~r,d;.cated
that, with respect to the spill activities, they had no objecticv, tc the pco?)sed proj.:ct

6. Public water is available from the Suffolk County Water Authority.
7. There are no public water supply wellfields within one-half mile of the project that could be
impacted.
8. Depth to groundwater at the test hole location was 24 ft. below grade.

Determination:
It was a 3 to 0 determination of the Board to grant a variance to allow continued use of the
existing sewage disposal system. This approval does not significantly adversely affect
groundwater quality in the area. Moreover, the continued use of the existing system alleviates the
possible public health and safety concerns that would arise from the installation of a new sanitary
system close to the underground fuel storage tanks.

The drainage design for this project is adequate to handle the additional run-off
generated by the proposed addition. The only concern is the location of leaching basin #2.
This basin is located adjacent to the garage. If this location is intended for additional work
space, (ie.~oil changes, pressure washing of engines, etc.), the open grate of the leaching
basin immediately below the car indicated on the map would not be recommended.

The minutes of the meeting of September 1 were approved as submitted upon
a motion made by John Greene and seconded by Howard Meinke.
DZUGAS-SMITH WINERY (Formal Submission). The application is incomplete,
lacking items listed on the ARC checklist, i.e. eleva, fions and floor plans, type
and color of roofing, windows, doors and trim; type, color and design of signage
as well as promised photographs of a similar structure in Southampton.
As to the material submitted, it was moved by Robert Keith, seconded by
Herbert Ernst and approved by all that the building be sited 220 feet from the
road and that vines be planted also in front of the building. As an alternative to
the latter, the Committee will consider a landscape plan or planting schedule.
SOUTHOLD AUTOMOTIVE (Formal Submission). Moved by Garrett Strang
and seconded by Howard Meinke, it was resolved that the plan be approved as
submitted, provided that the new materials match those that are existing. The
motion carried without oppostion.
HAY HARBOR GOLF CLUBHOUSE (Formal Submission) The staff of the
Planning Board is asked to request the applicant to submit answers to the ARC
Checklist and to obtain photographs of the site. Once this is obtained the staff
is requested to submit this and the other application materials to the two ARC
members on Fishers Island, requesting a letter with their opinions of the
application.

At the conclusion of our meeting today the Committee discussed two
requests that will serve to expedite the consideration of applications in process.
We ask that representatives of the Committee be invited to meetings of
the Planning Board at whiCh decisions will be taken. This will afford the
opportunity to put forth the reasons behind our recommendations and for us to
amend them when additional facts arise. The matter arose in consideration of
the Dzucjas-Smith Winery and Raphael Vineyard applications.
It will speed things up if applicants are given the checklist of ARC
considerations when first discussing an application with the staff of the Planning
Board In particular, this will affect the Dzugas-Smith and Hay Harbor
applications.

cop8es of material from Sou thold Town Justice Court regarding
one Tonyes's legal actions in relation to town law. I was a
tenant of the Tonyes family at this property and also the com-
plainant. A few days ago I photogaphed two cars for sale on
this same property - a complaint was filed and the cars moved
back to the gas station of Tonyes.
i~hen a tenant I had to tolerate the intolerable as well as the
illegal including the fact that the Tonyes family rented three
apartments (no permits) one found illegal and the garage for use
by an auto mechanic.

The Tonyes family or some of them will twist every law and situation.
I could outline some of their actions at length and will if asked.
Personally, these are not people I would want making a living from
'rejected inspections' as they were quoted in a local paper.
Even without the expansion they have requested (and the Z B~ has
approved) they are extending onto and degrading other residential
areas - Building Department has or had a copy of my photo and
complaint. I have too many things I am involved in now so that in
all probability I will not be able to follow this project in the
Planning procedure. I can only repeat that I wish the Town had a
test for character, honor and financial responsibility.

in that:
On May 13, 1996 I accompanied Building Inspector John Boufis and owner Edwin Tonyes on an
inspection of premises located at 55465 Main Road, Southold, Suffolk County Tax Map #1000-62-1-
14, located in the General Business Zone. I observed a dwelling unit on the lowest level of the
structure which consisted of a kitchen area, a bathroom, a bedroom and a living room. The floor of
this unit is below grade level. The structure has two other dwelling units that had ZBA Special
Exception approval on Application #4317. A condition of the Special Exception was that this below
grade space be non-habitable.
Property owner Edwin Tonyes was issued the following violations:
AT #753 for violation 45~15C, use of structure without a Certificate of Occupancy for such use.
AT # 754 for violation 100-91B(1 ), Special Exception conditions for this use in General Business
Zone are not complied with. Habitation of below grade space prohibited as condition of Special
Exception #-4317.
AT #755 for violation of 45-2, failure to meet provisions of NYS Fire Prevention and Building Code
Sec. 711. l(b) does not meet the minimum requirements for habitable space below grade.

architectural intent of the addition is to match the white clapboard siding and asphalt
shingle roof of the existing station.
We will be working with the owners to organize the signage better and clean up the general
appearance of the overall building. Please submit these concept drawings to the

REASONS FOR BOARD ACTION, DESCRTBED BELOW:
The subject promises has been ope.rated since at I?..st 1927 as a gasoline
station with a two-b.ay motor vehicle service facility. .New York State
motor vehicle inspections have been performed at least since 1987, when
applicant took over ope~tion of the business, and probably for many
yea.rs before then. Unt. d 1989, .the pro.perty was zoned 6-1 General
Business, a zone in which gasoline stations are permitted by Special
Exception.
Pursuant to Federal cl.ean air laws, New York State has imposed a new
automoUve emissions inspection system that is being phased in during
199.8. InspecUon staUons aro required to install .a. fixed dynamometer on
which vehicles will be run at over 50 mph for testing, a fixed camera, and
other new equipment. Applicant has decided to conUnue to perform NY
State inspections, w.hich it has shown aro an economically, important
element of its business. ConsequenUy, applicant will install the
dynamometer.a.n.d other required new equipment. It seeks a .variance. to
enable the budding of a third bay at the west side of its building, which
will hold the inspection equipment and will be enclosed for purposes of
sa.f.ety and the ..c~.ntrol of noise and emiss!ons. Applicant ha.s testified that
if it cannot build the third bay, the equipment would be installed in an

located in a spot such that cars being tested would protrude out of the

noise from the dynamometer, uncontained emissions from tested vehicles,
and safety hazards related both to the protrusion of cars from the bay and
to the risk of unprotected "runaways" on the dynamometer.
The Board concludes that applicant's proposal do?. not change nor
g~vn~lld ~he existina use. Rather, he proposes to build a bay to.shelter
S'~a"~dated equipment necessary for it to c?nUnue in the bus. ln.e~..of
· 4,~Inn ;ncn~rtinn~. Aonlicant will install the equipment and rematn in me
;ncnb'finn huslneSS even if not permitted te build the third bay, but in that
~e th~--'~'~=s~ in the Board's view, would be a significant detriment to
community safety and welfare. The Board is also cognizant of the public
policy interest in accommodating emissions inspection operations as a
means to improve air quality.
The Board concludes that granUng of the requested variance will not
dPrnd.~ an undesirable change in the character of neighborhood or a
e'~e--n~'~o--n-earby prope~ because the established business will
continue to operate as it has in the past and the addition will be
consistent with the appearance of the neighborhood. The rear yard
setback of 8 feet, while substantially less than the required 25 feet, is
unchanged from the exisUng rear setback. There is no other feasible way
for the applicant to establish an enclosed inspection facility while also
maintaining the exisUng capacity of its business to perform repairs.
GranUng of the variance will not have an adverse effect on physical or
environmental condiUons in the neighborhood provided that the
inspection facility's air exhaust is directed to the greatest degree possible
toward Route 25, where there is substantial vehicular traffic.
The Board finds that the grant of the requested variance, with the
condiUons set food1 below, is the minimum necessary and adequate to
enable applicant to conUnue to perform NY State inspections, while at the
same Ume preserving and protecting the character of the neighborhood,
and the health, safety, welfare of the community.
RESOLUI~ONIACT~ON: On moUon by Member Collins, seconded by
Member Dinizio, it was
RESOLVED, to GRANT a variance permitting applicant to square off the
southwest corner of the existing building and to build a third bay, as
described in its applicaUon, with a minimum setback of 8 feet along the
enUre rear wall and a minimum west side setback of 10 feet, subject to
the following CONDITTONS:
1. The third bay shall be used to house the equipment mandated by New
York State for the performance of motor vehicle inspecUons, including a
dynamometer in a fixed inaLa;laUon.
2. The exhaust of air from such hay shall be arranged se as to direct
such exhaust to the greatest degree possible toward State Route 25.
3. Personal vehicles of the owners and employees shall not bo parked
on the premises between 8 a.m. and 6 p.m. (business hours), and public
parking areas must be utilized.

VARIANCE RELIEF REOUESTED BY APPLICANT: The request made by
applicant is to add a 505 sq. fl~ area to the existing building by adding a
bay at the west side and squaring off the rear to establish a uniform
sotback of 8 feet along the rear wall. The sotbacks are proposed at a
minimum of 10 feet 4 inches from the westerly (side) property line and 8
feet from the southerly (rear) property line (maintaining the established
rear sothack).

REASONS FOR BOARD ACT[ON~ DESCRZBED BELOW:
The subject premises has been operated since at least 1927 as a gasoline
station with a two-bay motor vehicle service facility. New York State
motor vehicle inspections have been performed at least since 1987, when
applicant took over operation of the business~ and probably for many
years before then. Until 1989, the property was zoned B-1 General
Business, a zone in which gasoline stations are permitted by Special
Excepf&on.
Pursuant to Federal clean air laws, New York State has imposed a new
automotive emissions inspection system that is being phased in during
1998. ~[nspection stations are required to install a fixed dynamometer on
which vehicles will be run at over 50 mph for testing, a fixed camera, and
other new equipment. Applicant has decided to continue to perform NY
State inspections~ which it has shown are an economically important
element of its business. Consequently, applicant will install the
dynamometer and other required new equipment, lit seeks a variance to
enable the building of a third bay at the west side of its building, which
will hold the inspection equipment and will be enclosed for purposes of
safety and the control of noise and emissions. Applicant has testified that
if it cannot build the third bay, the equipment would be installed in an
existing bay. Because the existing bay would continue to be used for
vehicle repairs~ applicant has testified that the dynamometer would be
located in a spot such that cars being tested would protrude out of the
open bay door and onto the gasoline station apron. Applicant has testified
that such an arrangement would result in problems including uncontained
noise from the dynamometer, uncontained emissions from tested vehicles,
and safety hazards related both to the protrusion of cars from the bay and
to the risk of unprotected "runaways" on the dynamometer.
The Board concludes that applicant's proposal does not change nor
expand the existing use. Rather, he proposes to build a bay to shelter
State-mandated equipment necessary for it to conUnue in the business of
doing inspections. Applicant will install the equipment and remain in the
inspection business even if not permitted to build the third bay, but in that
case the result, in the Board's view~ would be a significant detriment to
community safety and welfare. The Board is also cognizant of the public
policy interest in accommodating emissions inspection operations as a
means to improve air quality.
The Board concludes that granting of the requested variance will not
produce an undesirable change in the character of neighborhood or a
detriment to nearby properties because the established business will
continue to operate as it has in the past and the addition will be
consistent with the appearance of the neighborhood. The rear yard

setback of 8 feet, while substantially less than the required 25 feet, is
unchanged from the exisUng rear setback. There is no other feasible way
for the applicant to establish an enclosed inspection facility while also
maintaining the exisUng capacity of its business to perform repairs.
GranUng of the variance will not have an adverse effect on physical or
environmental cendiUons in the neighborhood provided that the
inspection facility's air exhaust is directed to the greatest degree possible
toward Route 25, where there is substanUal vehicular traffic.
The Board finds that the grant of the requested variance, with the
condiUons set forth below, is the minimum necessary and adequate to
enable applicant to conUnue to perform NY State inspections, while at the
same Ume preserving and protecting the character of the neighborhood,
and the health, safety, welfare of the community.
RE$OLUT~ON/ACI~ON: On moUon by Member Collins, seconded by
Member Dinizio, it was
RESOLVED, to GRANT a variance permitting applicant to square off the
southwest corner of the existing building and to build a third bay, as
described in its applicaUon, with a minimum setback of 8 feet along the
enUre rear wall and a minimum west side setback of 10 feet, subject to
the following CONDI'I/ONS:
1. The third bay shall be used to house the equipment mandated by New
York State for the performance of motor vehicle inspecUons, including a
dynamometer in a fixed installaUon.
2. The exhaust of air from such bay shall be arranged se as to direct
such exhaust to the greatest degree possible toward Stat~ Route 25.
3. Personal vehicles of the owners and employees shall not be parked
on the premises between 8 a.m. and 6 p.m. (business hours), and public
parking areas must be utilized.

We were recently informed by The Planning Board that we needed to inform you of
our future plans regarding the Mobil station renovations. We were informed to tell you
about future setbacks and plans.
The plans labeled A (enclosed) are our exsisting setbacks and figures. The plans
labeled B (enclosed) are our future setbacks and plans. When looking at the A plans, we
have on the South side 8' existing setbacks. On the West side there are 23'11" current
setbacks. B-plans, our intentions are to build out 13' West to the mar of the building, this
part will be built out to where the 8' exsisting setbacks are currently. The Southwest
comer w/Il be a 8' setback to the mar and to the West will be 10'11". The Northwest
comer (fi'ont) will be 10'4" as per figure B.
