The following action was taken by the Planning Board,
Monday, September 10, 1984.
RESOLVED that the Southold Town Planning Board approve
the subdivision of Southold Equities located at Southold
between the Main Road, and Traveler Street containing
2 lots. This subdivision received the approval of the Board
of Appeals for a variance on the insufficient area of the
lots. This approval is subiectto those conditions required
by the Board of Appeals to wit: No further front, side, and/
or rearyard setback reductions which do not comply with the
zoning code, bulk schedule requirements: and no further
division or set-off within either parcel (which would further
reduce the lot areas). This is also subiect to the review
of the Suffolk County Planning Commission.
Please foward six (6) copies of the survey (see the
enclosed list or requirements) in order that we may make
the necessary referral to the County and so the Chairman
can endorse the maps.

Dear Mr. Orlowski:
The Suffolk Co~ty Planning Commission at its regular meeting on December
4, 1985 reviewed the proposed subdivision plat, entitled, "Minor Subdivision -
Anne Hocking & William Schott", referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to
disapprove said map for the following reason:
Creation of a subdivision with substandard lots, that is, lots whose areas
are less than the minimum required by the zoning classification of the
property, constitutes an overintensification of land use in a groundwater
sensitive area in what is meant to be a low density area. Such action could
establish a precedence for future subdivision of this kind which would
essentially be a circumvention of the Town Board's action taken over the past
years to upzone these groundwater sensitive areas. The Commission feels that
the Town Planning Board should have the prerogative to review this type of
application rather than it being left to the sole discretion of the Zoning Board
of Appeals.

which contain existing buildings, the northerly lot having frontage
along Traveler Street, and the southerly lot having frontage along
Main Road, in the Hamlet of Southold; County Tax Map Parcel No.

The board made the following findings and determination:
By this appeal, applicant seeks a variance to the provisions of
Article VII, Section 100-71, Bulk Schedule of the Zoning Code, for
approval of the proposed lot area of each of two parcels in thts
division of land. The,most northerly parcel will contain an area
, , ,.of 24,495:t sq. ft. and is presently improved with a one-story frame
[lY4'l:building. The southerly parcel will contain an area of .356:t acreage
I ' ~and is presently improved with three buildings: (1) one-story stucco
_.building set back 6:t inches from the southerly property line; (2)
. 'a~accessory garage/sfdrage building located along a concrete retain-
ing wall on the west side; (3) a one-family, two-story frame house
to the north of the garage/storage building. The subject premises is
located in the "B-1 General BUsinesi" District, and it \5 noted for
the reco'rd that a' prior appl ication has been made and conditionally
approved as noted in Appeal No. 3145, decision rendered June 17, 1983
for a residential use of the most northerly building along Traveler
Street. .'
. 'The board members have visited the site in question and are
familiar with the surrounding parcels, which are similar in size o~
sma11er than that proposed by this application. Also, in consider-
ing this appeal, the board determines: (a) that the relief requested
is not substantial since the lots will conform with the character of
the neighborho~d;(b)that a substantial change will not be produced
that would detriment adjoining properties inasmuch as the buildings
have existed since the enactment of zoning; (c) that the difficulty
cannot be obviated by some method feasible for the applicant to pursue
other than a variance; (d) that no effect will be produced on
available governmental facilities of increased population; and (e)
