Planning Board, Monday, March 24, 1986.
RESOLVED that the Southold Town Planning Board approve
the set-off of Academy Printing located at Horton's Lane
and Traveler Street, Southold for two lots on 39,270 square
feet in zone "B-l"; subject to:
1. Approval from the Suffolk County Department of
Health Services, pursuant to Article Six.
Upon receipt of the above approval, the Chairman can endorse
the surveys, dated August 14, 1984.

Dear Mr. Orlowski:
On September 11, 1984 the Southold Town Planning Board denied the
proposed set-off of a 19~595 sq. ft. lot from Academy Printing Services
on Traveler Street, Southold, New York. A copy of the decision is
enclosed.
That decision was appealed to the Southold Town Board of Appeals, which
on November 20, 1984 approved the set-off of the parcel. A copy of
that decision is enclosed.
Then on December 5, 1984 the Planning Board~ in direct contradiction
to the ZBA decision, again denied this set-off.
It is my opinion that this "re-denying" after a decision by the higher
Board of Review in the township is uncalled for and illegal. I under-
stand that similar actions taken by the Planning Board after the ZBA
approval have been overturned and I hereby demand that the Planning
Board likewiserescind its December 5, 1984 decision, comply with the
Board of Appeals decision which granted a variance for unsufficient
lot size, and approve the set-off for Academy Printin§ Services~ Inc.
My clients may suffer serious and irreperable financial harm if this
step is not taken.

Upon application of ACADEMY PRINTING SERVICES, Horton's Lane,

Articl9 VII, Section 100-71, for approval of insufficient area and
width of parcels in this proposed division of land located at the
South Side of Traveler Street, Southold, NY;. ~ounty Tax Map Parcel
No. 1000-61-01-002.
The board made the following findings and determination:
By this appeal, applicant seeks a variance to the Zoning Ordinance,
Article VII, Section lO0-71, Bulk Schedule: (a) for approval of
insufficient area of two parcel~, ]9,675 sq. ft. and 19,595 sq. ft.
and (b) for approval of insufficient lot width along Traveler
Street of 156.88 feet and 160.35 feet, Parcels 1 and 2, respectively.
The premises in question is located in the "B-I" General Business
District.
Article VII, Section lO0-71, Bulk Schedule of the Zoning Code
requires a minimum lot areaiof 30,000 sq. ft. Each of the parcels
will meet the minimum lot width requirement of 150 feet alongJTraveler
Street. Parcel "l" is improved with a 1½-story frame building used
as a printing services establishment. Parcel ,,2,, is shown t~J be
vacant. Adjoining Parcel "2" on the east is a paper right-o~-way
of the Town of Southold and further east the proposed new location
of the Southold Post Office. Adjoining Parcel "l" on the south
are premises of Sisu Development, Inc. All of the parcels on this
block are in the "B-l" Business District.
Each of the board members is familiar with the site in question,
and in viewing the character of this district, the board finds a
majority of the existing parcels to be similar in size to that
2~p~ed by this application. The board agrees with the reasoning
applicant.
In considering this appeal, it is the opinion of the board
(1) that the relief requested is not substantial, being approximately
two-thirds of that required under the bulk schedule; (2) ~hat by

with and promote the general purposes of zoning; (5) the cir-
cumstances are unique; (6) that no adverse effects will be produced
on available governmental facilities of any increased population;
(7) that the interests of justice will be served by allowing the
variance, as indicated below.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.
Grigonis, it was
RESOLVED, that the relief requested under Appeal No. 3273, in

HEREBY IS APPROVED, as applied.
