This is to confirm your meeting with the Planning Board on
October 16, 1991.
The Planning Board will waive the requirement that the Bank
obtain site plan approval for the following improvements which
will be made to the parking area this fall:
1. Drainage and curbing along Traveler Street will be
installed as shown on the enclosed sketch subject to
the Town Engineering Inspector James Richter's
supervision during construction.
2. There shall be six feet for landscaping between the
curbing along Traveler Street and the new sidewalk.
Two street trees are to be planted within this area.

October 31, 1991
On October 30, 1991, James Richter, Engineering Inspector,
gave a verbal status report on the installation of the curbing
and street trees at this site. He indicated that he had
authorized the placement of three trees, instead of four, along
Young's Avenue due to the presence of a thick concrete block
where the fourth tree was to be placed. This tree was
subsequently placed along Traveler Street, so that each
landscaping strip has three trees each.
This was brought to the Planning Board's attention later
that day. They concurred with his decision.

This is in response to your letter dated September 25,
1991, in which you indicated the improvements the North Fork
Bank & Trust Company is willing to make to the parking area. The
Board finds these improvements acceptable with the following
changes:
1. The landscaped area between the sidewalk and the curb
along Traveler Street shall be increased to six (6)
feet in width.
2. Oak or honey locust trees should be substituted
for the pear trees.
3. Similar landscaping, also six (6) feet wide, shall be
placed parallel to Youngs Avenue, inside the existing
sidewalk. Railroad ties or concrete car stops can be
used to protect the landscaping from the cars.

above-mentioned changes so that the Planning Board can proceed

with reference to our phone call this morning, please
be advised of the following work the Bank is prepared to do
at the above-referenced site in order to beautify the
property and improve pedestrian and traffic safety:
1) install curbing to continue from the existing
curbing on Traveler Street in front of the Prince
property
2) install a 4' x 4" concrete sidewalk to join the
sidewalk on the existing Prince property
3) install an entrance/exit apron
4) leave an area of approximately 4' between the
curbing and the proposed sidewalk which will be
planted with 6 flowering pear trees and mulched
All other interior landscaping, including the Youngs
Avenue side, would not be done for several years due to the
fact that the Bank is uncertain as to the use of this
property going forward.

Dear Mr. Butkovich:
This is in response to your letter dated August 14, 1991,
in which you indicate that the North Fork Bank & Trust Company
is willing to stripe the parking stalls, and to install curbing,
sidewalk, and several street trees along Traveler Street.
However, you questioned the request to do the same along Young's
Avenue because this is Town property.
In answering your question, I, first, must clarify what the
Board meant in its July 11th letter. The Bank is being asked to
install the landscaping on its own property; not the Town's
property. Second, the reason we do not want the Bank to plant
street trees between the sidewalk and the curbing on Young's
Avenue is that when they mature, they will interfere with the
utility lines overhead. Last week's hurricane was a reminder of
the enormous amount of damage that can be caused by tree
branches falling on utility lines. We have taken a different
approach to the strip along Traveler Street because there are no
utility poles on that stretch of road. Finally, there should be
a landscaped strip between the parking area and the sidewalk for
the safety of pedestrians. Whatever the Bank's long term plans
for the development of the lot, it is likely that there will be
landscaping between the sidewalk and any proposed building.
In closing, please know that the Board is delighted that
Traveler Street at this corner of the business district will be

landscaped. I hope the Bank reconsiders the landscaping along
Young's Avenue, because it would be an asset to the whole
business district as well as the Bank.
As stated in our previous letters, if you have any
questions or need more information, please contact Bob Kassner
of my staff. In the meantime, please send us a copy of your
landscape drawings before you proceed.

In addition to the front landscaped area and buffer area
requirements, parking areas shall comply with the following
minimum standards:
A. All uses required to provide twenty (20) or more off-street
parking spaces shall have at least ten (10) square feet of
interior landscaping within the paved portion of the parking
area for each parking space and at least one (1) tree with a
two-inch caliper for every ten (10) parking spaces or fraction
thereof. Each separate landscaped area shall contain a
minimum of one hundred (100) square feet, shall have a
minimum dimension of at least eight (8) feet, shall be planted
with grass or shrubs and shall include at least one (1) tree of
not less than two-inch caliper.
B. A landscaped area shall be provided along the perimeter of
any parking area except that portion of the parking area
which provides access to a street or parking facility on an
adjacent lot. Accessways to adjacent lots shall not exceed
twenty-four (24) feet in width and shall not exceed two (2) in
number for each purpose. The landscaped area shall have a
minimum dimension of four (4Lieet, shall be planted with

Dear Mr. Butkovich:
This letter is in reference to my letter to you of March
20, 1991, (copy enclosed), in which I indicated that if a site
plan application was not submitted by May 15, 1991, this matter
would have to be referred to the Ordinance Inspector for further
action.
To date, we have not received an application. Accordingly,
I regret informing you that this matter will be turned over to
the Town Attorney and the Ordinance Inspector for enforcement.
As stated in our previous letters, if assistance in
preparing the site plan application is needed, please contact
Bob Kassner of my staff.

Department that the demolition on the above referenced property
is now complete, and that a site plan is required for the
parking lot. f

Clearly defined curb cuts at c~refully chosen locations
would improve traffic safety at this poorly defined
intersection. And, proper landscaping and lighting would
enhance the overall appearance of the property.

Dear Mr. Orlowski:
Please be advised that I met with Bob Kassner last July
at the above-referenced site to go over the requirements
and questions relative to a site plan. At that time I went
over what the bank had already done at the site as far as
demolition, paving, adequate drainage retention pools and
lighting to the sum of approximately $45,000. Mr. Kassner
indicated a need for additional sidewalks, islands with
shrubbery and trees and I do not feel that these
improvements would enhance the ability to park cars.
Furthermore, a budgetary figure of $40,000 to $50,000 would
be needed.
I will be happy to further discuss this matter with you
and can be reached at 298-3240. I look forward to hearing
from you.

I understand that new owner of the above-referenced

E. Where the existing topography and/or landscaping provides
adequate screening, the Planning Board may accept the
existing planting and/or buffer area as the required planting.
~ 100-214. Landscaped parking a,'ea.
In addition to the front landscaped area and buffer area
requirements, parking areas shall comply with the following
minimum standards:
A. All uses required to provide twenty (20) or more off-street
parking spaces shall have at least ten (10) square feet of
interior landscaping within the paved portion of the parking
area for each parking space and at least one (1) tree with a
two-inch caliper for every ten (10) parking spaces or fraction
thereof. Each separate landscaped area shall contain a
minimum of one hundred (100) square feet, shall have a
minimum dimension of at least eight (8) feet. shall be planted
with grass or shrubs and shall include at least one (1) tree of
not less than two-inch caliper.
B. A landscaped area shall be provided along the perimeter of
any parking area except that portion of the parking area
which provides access to a street or parking facility on an
adjacent lot. Accessways to adjacent lots shall not exceed
twenty-four (24) feet in width and shall not exceed two (2) in
number for each purpose. The landscaped area shall have a
minimum dimension of four (4ljeet. shall be planted with
grass or shrubs and shall include- at feast one (1) tree of not less
than two-inch caliper for every forty (40) feet along the
perimeter of the parking area. In cases where the parki~
area adjoins a public sidewalk, the required landscaped are.t'

Supplementary Regulations

S 100-230. Exceptions and modifications.
A. Established front yard setback. Where property in the vicinity
is improved with principal buildings with front yards of less
than that required by the provisions of this chapter, the front
yard setback shall be the average setback of the existing
buildings within three hundred (300) feet of the proposed
building on the same side of the street within the same use
district.
B. Exceptions to lot depth requirements. The minimum lot depth
at any point may be decreased to seventy-five percent (75%) of
the minimum requirement if the average depth conforms to
the minimum requirement.
C. Exceptions to yard requirements.
(1) Permitted obstructions. Cornices or cantilevered roofs
may project not more than two (2) feet into a required
yard. Belt courses, windowsills and other ornamental
