New York, New York, hereinafter called the "Owner";
WHEREAS, the Owner has title to certain lands situate,
lying and being at Fishers Island, in the Town of Southold,
County of Suffolk and State of New York, said lands hereinafter
being more particularly described; and
WHEREAS, it is the Owner's intention
that the aforesaid

more than two residential lots;
NOW, THEREFORE, the following described lands shall be:
restricted as hereinafter set forth:

ALL that certain lot, piece or parcel of land situate,
lying and being in the Town of Southold, Suffolk County,
New York, being a part of that portion of Fishers Island
formerly belonging to Fishers Island Corporation which
portion is hereinafter called the "Park", lying easterly
of the following line, viz:

BEGINNING at the southeasterly corner of land owned by
the United States, known as the Fort H.G. Wright
Military Reservation, Mount Prospect Tract, on the
shore of Block Island Sound or the Atlantic Ocean and;

RUNNING THENCE northerly following the East Boundary of
the said land of the United States to the southerly line
of East End Road (sometimes called Oriental Avenue) and
~hich point is the northeasterly corner of land of the
United States;
THENCE crossing the East End Road and following ~~e same
course as the last to the shore of West Harbor or Fishers
Island Sound; Said lot or parcel of land being bounded and
described as follows:-
BEGINNING at a stone monument set on the South side of a
road 40 feet wide, said monument being 1577.88 feet south
of a point which is 1246.95 feet West of another monument
marking the U.S. Coast and Geodetic Survey Triangulation
Station "Nin" (which said "Nin" monument is located near
the Western end of a ridge overlooking the South Shore of
Fishers Island and on the highest point between Chocomount

and Mount Prospect and lies South 45 degrees 17 minutes
20 seconds East of North Dumpling Light in Fishers Island
Sound); and
RUNNING THENCE along the South side of said road, North
83 degrees 55 minutes 20 seconds East 117 feet to a stake
marking a point of curve to the right whose radius is
112.67 feet and the direction of whose radius at that
point is South 6 degrees 4 minutes 40 seconds East;
THENCE Eastwardly (following the arc of said curve)
94.12 feet to a stake;
THENCE south 48 degrees 13 minutes East 87.69 feet to a
stake;
THENCE South 48013' East 65 feet to the shore of Block
Island Sound; thence following the meanders of said shore
line on the following two courses: South 34030'23" West
209.65 feet and South 28041'06" West 265.43 feet; thence
North 60059'00" Nest 55 feet to a stake, thence North
60059' Nest 207.67 feet to a stake; thence North 82013'20"
West 151.90 feet to a monument set on the easterly side
of a road; running thence northerly, along the easterly
side of said road (and following the arc of a curve to
the right whose radius is 753.61 and the direction of
whose radius at that point is South 87013'54" East
240.90 feet to a stake; thence north easterly along the
southerly side of said road (following the arc of a curve
to the right whose radius is 753.61 feet and the direction
of whose radius at that point is South 68055' East) 13.01
feet to a stake; thence northeasterly still along the
southerly side of said road (and following the arc of a
curve to the right whose radius is 190.47 feet and the
direction of whose radius at that point is South 67055'40"
East 205.61 feet to a stake; thence still along the
southerly side of said road, North 83055'20" East 68.87
feet to a stake set at an intersection with the westerly
side of a road 29.64 feet wide; thence along the westerly
side of said last mentioned road, South 4042'10" Nest
170.69 feet to a monument; thence South 7707'40" East
29.94 feet to the easterly side of said last mentioned
road; thence North 4042'10" East 180.55 feet along said
last mentioned road to the point or place of beginning.
DECLARANT does hereby warrant, covenant and represent
that on approval of the aforesaid described lands as a minor sub
division by the Planning Board of the Town of Southold, no furth,r
application will be made to that Board or to any other Board in
the Town of Southold to further subdivide any of ~~e lots set
forth in said minor subdivision.

represent that the aforesaid described lands within the minor
subdivision cannot be subdivided into more than two lots and
that each lot shall comprise an area of not less than 50,000
square feet, with only one residential dwelling (not including
accessory building) per lot.
DECLARANT does hereby further warrant, covenant and
represent that the foregoing restrictions and agreements shall
bind the undersigned, her heirs, successors and assigns, and
any and all person or persons who shall succeed to the ownership
of any of the lots shown on said aforedescribed premises in said
minor subdivision by transfer or otherwise.

Dear Mr. Wickham:
The Suffolk County Planning Commission at its regular meeting on October 5,
1977, reviewed the proposed subdivision plat, entitled, Minor Subdivision-Alice S.
Sturges, referred to it pursuant to Section 1333 of the Suffolk County Charter.
After due study and deliberation it resolved to approve said map subject to the
following changes which are deemed necessary to protect the shoreline:
1. No sanitary disposal facilities being located within 100 feet of the top
of the bluff.
2. Stormwater runoff resulting from the development and improvement of the
lots shall not be discharged down over the face of the bluff in any manner.
3. No grading and no clearing shall be undertaken within the setback area
except for that clearing and cutting necessary for maintenance.
4. Access to the beach shall be limited to a single common access point and
then only by means of a suitable structure that will not cause undue disturbance to
the bluff and of a design acceptable to the Town.
5. There shall not be any further subdivision of this property without the re-
view and approval of the Town Planning Board.

York for many years.
Recently the County of Suffolk has raised the question as
to whether I have a license.
I have my biennial registration certificate 10/31/76 but do
not find one for the next biennium.
We sent you a check dated JUly I, 1976 for $40.00 for the
renewal and enclose herewith a copy of the cancelled check.
Possibly thru some oversight my name does not appear on the
current roster.
Please let me know about this so I can clear the matter up
with the County of Suffolk.

DECLARATION made this 22nd day of September, 1977,
by ALICE SCHUMACHER STURGES, residing at 164 East 72nd Street,
New York, New York, hereinafter called the "OWner";
WHEREAS, the Owner has title to certain lands situate,
lying and being at Fishers Island, in the Town of Southold,
County of Suffolk and State of New York, said lands hereinafter
being more particularly described; and
WHEREAS, it is the OWner's intention that the aforesaid
land be subdivided into a minor subdivision consisting of not
more than two residential lots;
NOW, THEREFORE, the following described lands shall be
restricted as hereinafter set forth:
ALL that certain lot, piece or parcel of land situate,
lying and being in the Town of Southold, Suffolk County,
New York, being a part of that portion of Fishers Island
formerly belonging to Fishers Island Corporation which
portion is hereinafter called the "Park", lying easterly

division by the Planning Board of the Town of Southold, no furth r
application will be made to that Board or to any other Board in
the Town of Southold to further subdivide any of the lots set
forth in said minor subdivision.

represent that the foregoing restrictions and agreements shall
bind the undersigned, her heirs, successors and assigns, and
any and all person or persons who shall succeed to the ownership
of any of the lots shown on said afore described premises in said

In any change of lot lines the original lot& block numbers
and original lot lines should be shown so that the new lots can be
properly identified.
Further; Any division of the existing lots containing a
width of 150 feet and 80,000 sq ft of area would be entitled to
two dwelling units - at 40,000 sq ft area each - you cannot leagaly
force a deed restriction in excess of the ordinance minimum reqm-
irements. On 40,000+Sq.ft.lots an accessory building ( without
cooking facilities) can be built and used for temporary guest
quarters.
Please furnish me with a copy of the proposed division
indicating the original lot lines and the proposed lot lines.

I now enclose two copies of an Application for
Approval of Plat signed by me as Mrs. Sturges' attorney,
she being in Fishers Island and not available to sign the
application in time for t:he Planning Board meeting on July
18, 1977. Attached to the application are copies of the
two deeds to Mrs. Sturges by which she received title.
The surveyor, Chandler, Palmer & King, Norwich, Connecticut,
are sending eight copies of the survey directly to your
office. Please consider them as part of this application.
I also enclose our check to the order of the Planning Board
in the amount of $20.00 1:0 cover the processing fee.
The purpose of the application is to permit a
purchaser of the house and 2 plus acres to occupy the
residence and to enable Mrs. Sturges in due course to
apply for a building permit to construct a new summer
residence on the vacant parcel being retained by her.
That permit would, of course, be subject to the regulations
regarding any building permit. As the closing of title
depends upon the PlannineJ Board's action and is presently
scheduled for August, Mrs. Sturges would appreciate the
Board revievling the application at its next meeting. If
there is any additional information required, we will
attempt to supply the same. If necessary, perhaps favorable
action could be taken subject to applicant providing such
additional information.

SUBJECT to all applicable laws and regulations
of Federal, state and local governmental authorities;
RESERVING to the grantor herein from the grant
of the land and premises hereby conveyed easements and
rights of way within a strip of land approximately five
feet wide for the erection thereon of poles to support
wires for the transmission of electricity for light,
heat, telephone and other purposes, and for the con-
struction, operation and maintenance of pipe lines or
conduits under the surface of said reservation for any
lawful purpose whatsoever, but the grantor shall have the
right to release the premises above described from these
particular easements and rights of way;
PROVIDED, HOWEVER, that whenever the surface of
the ground shall be disturbed by the grantor, its
successors or assigns, for the purpose of constructing or
repairing any such pole line, pipe line or conduit, it
shall become the duty of the grantor, its successors or
assigns, forthwith, at its or their own expense, to
repair and restore the surface of the ground so disturbed
to substantially the same condition as shall have existed
before the time of such disturbance.
The grantor hereby grants and conveys to the
party of the second part, her heirs and assigns, an
easement for ingress to and egress from the premises
above described over and along such private roads as now
or may hereafter exist connecting the said premises with
the public highway. ThE! grantor reserves the right to
change the location, route or grade of said roads from
time to time, provided that such change shall not prevent
reasonably convenient and adequate access to the premises
herein conveyed nor unreasonably lengthen the distance to
be traveled to reach such public highway.
TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, her heirs and assigns
forever.
PROVIDED, HOWEVER, that this conveyance is made
subject to the following covenants and agreements which
are hereby entered into by the party of the second part
by the acceptance hereof, her heirs and assigns, as a
part of the consideration therefor:
That the aforesaid premises shall be occupied
and used by the grantee, her heirs and assigns, for
private residential purposes only, and not otherwise, and
there shall be erected thereon only a private residence
for the use of one family only, together with the
necessary outbuildings appurtenant thereto, PROVIDED
that if more than one homesite is hereby conveyed, only
one such residence shall be erected or maintained on each
of such homesites, which are hereinbefore respectively
designated as Homesites Nos.

That no building or other structure shall be
erected on the aforesaid premises, no alterations shall
be made in the exterior of any building or other
structure erected thereon, and nothing else shall be done
materially affecting the appearance of the aforesaid
premises except according to plans (includ ing exter ior
color scheme, grading plan, planting plan and location
plan) wh ich shall have been approved in wr it ing by the
grantor, its successors or assigns.
That no stable for live stock shall be erected
or maintained on the aforesaid premises by the grantee,
her heirs or assigns, and no live stock shall be kept on
any par t of the property hereby conveyed, wi thout the
written consent of the grantor, its successors or
assigns.
That the premises herein conveyed shall be kept
free from any nuisance, and from any object or condition
otherwise offensive to the neighborhood, or dangerous to
the health of trees or other vegetation in said neighbor-
hood.
That from and after the date hereof, the
grantee, her heirs, or assigns, by the acceptance of this
deed, covenants and agrees to pay to the grantor, its
successors or assigns, an annual maintenance charge, as
fixed by the gran tor, its successor s or ass igns, which
charge, except with the consent of the owners of a
majority of the acreage in the "Park," shall not exceed
in anyone year $25. per acre of the premises hereby
conveyed, such charge to be applied to the maintenance
and repair of roads, sidewalks, sewers, and gutters, and
to the collection and disposal of garbage and other
refuse, PROVIDED, HOWEVER, that the grantor, its succes-
sors or assigns, shall not be obligated to maintain or
repair roads, sidewalks, sewers (except main trunk line
sewers) and gutters on the premises herein conveyed,
PROVIDED, FURTHER, that: in no event shall the grantor be
liable for any performance hereunder in excess of the
amount collected by it pursuant to this paragraph.
And it is further covenanted and agreed that no
right to the land covered by the waters of any pond on
which said premises abut, or to the control thereof, or
to the control of the land covered by the waters of any
streams, or to the banks thereof, running through the
above described premises, or to any of said waters, or to
the use or control of any of said waters, shall pass by
this grant, that the party of the first part shall have
the right to raise or lower the waters of said ponds
and/or streams as may from time to time be found expe-
dient; and that the rights of the party of the second
part in and to the premises hereby conveyed, shall be
limited and bounded by the shore or margin of said ponds
and/or streams, as the same may vary from time to time or
be regulated by the party of the first part, and that the
use of said waters at all seasons, and of the land under
the same, shall be subj ect to the regulations of the
party of the first part; and the party of the first part
hereby reserves to itself and its assigns all the water
rights upon the premises hereby conveyed.

The grantee covenants and agrees to install
upon the premises hereby conveyed septic tanks or other
facilities for adequately disposing of all sewage origin-
ating on said premises and further to install at the
grantee's own expense, when so requested by the grantor,
a lateral sewer connection with a main trunk line sewer,
if there shall be one on said premises, or if such trunk
line sewer shall have been brought to the property line
of said premises. The grantee further covenants and
agrees at all times to maintain such septic tank,
facilities and/or lateral sewer connection in good repair
and proper operating condition. The plans and specifi-
cations for the construction and/or installation of such
septic tanks, facilities and/or lateral sewer connection
shall first be approved in writing by the grantor.
The grantee hereby covenants and agrees that he
will not knowingly permit the premises herein conveyed to
be so used that the water in any fresh water ponds and/or
streams contiguous or adjacent to said premises may be in
any way polluted or rendered unfit for potable purposes.
All the covenants and agreements herein ex-
pressed shall be binding upon the grantee, her heirs and
assigns, and shall be held to run with and bind the land
and premises hereby conveyed and all subsequent owners
and occupants thereof, until April 15th, 1985, and there-
after from term to term of twenty years upon the consent
of the owners of a majority in acreage of all land within
the "Park".
All rights and easements of access, implied or
expressed, to the property herein conveyed shall be
limi ted by and subj ect to such rules, regulat ions and
restrictions governing the manner of use thereof, or the
persons licensed or permitted to use the same, as shall
from time to time be adopted or prescribed by the
grantor, its successors or assigns.
The rights reserved herein to the grantor, or
to the grantor's successors or assigns, and the consent
or approval of the grantor, its successor s or ass igns
herein referred to, shall enure to, mean or require only
the right or act of the said Fishers Island Development
Corporation, or its corporate successor, and shall not
refer to or include a person or corporation holding only
as grantee of land from said corporation.
PROVIDED, HOWEVER, that any of the covenants
and agreements contained in this deed of conveyance may
be at any time and in any manner waived or changed with
the consent of the grantor, its successors or assigns,
and the owner or owners for the time being of the land
hereby conveyed, and the owners of a majority in acreage
of all the property within the "Park."

The provision last preceding shall apply to
cases where the change contemplated 1S to affect less
than all the land in the "Park" which has been conveyed
by the grantor to purchasers, but where such waiver or
change shall apply to and affect all the land within the
"Park" which has been conveyed by the grantor subject to
the covenants and agreements herein set forth, said
covenants and agreements may be waived or changed with
the consent of the grantor or its successors and the
consent of the owners (other than the grantor) of a
majority in acreage of all the land within the "Park".
PROVIDED, HOWEVER, that nothing in this deed
contained shall limit the right of the grantor, its
successors or assigns, to set apart such part of its
lands, si tua ted wi thin the aforesaid "Park," as it or
they may deem suitable for golf courses, club houses,
bathing beaches or other attractions, and necessary
buildings appurtenant thereto, and also the right to set
apart in the "Park" other premises deemed suitable for
the convenience of the residents of the "Park" to be used
or operated for store or business purposes; but the
setting apart of any such lands and their use shall not
operate to confer or vest in purchasers or property
owners any rights or interests in said lands.
No appurtenant or other interests in the real
property of the grantor not expressly set forth in this
instrument are hereby conveyed or transferred to the
grantee herein, and it is expressly covenanted by the
parties hereto that no rights, appurtenances, privileges
or personal advantages not herein expressed, run with or
are attached to the land conveyed.
IN WITNESS WHEREOF, the party of the first part
has caused its corporate seal to be hereunto affixed, and
these presents to be signed by its duly authorized
