Dear Mr. Lark:
The following resolution was adopted by the Southold Town Planning Board at a meeting held
on March 12, 2001:
WHEREAS, Fishers Island Development Corporation (FIDCO) is the owner of the property
known and designated as SCTM# 1000-10-5-12.8 & (12.10-12.12), located on the northeast
comer of Peninsula Road and East End Road on Fishers Island; and
WHEREAS, the applicant desired to change the original lot layout approved by the Planning
Board on September 9, 1991, because of wetlands located on the southwestern portion of the
property; and
WHEREAS, the proposal reduces the number of buildable lots from ten to eight; and
WHEREAS, conditional final approval was granted on January 26, 1998, and all of the
conditions have been met; be it therefore
RESOLVED, that the Southold Town Planning Board endorse the final surveys dated December
26, 2000.
Enclosed please find a copy of the plan which was endorsed by the Chairman.

The Planning Board approved multiple lot-fine changes on these properties on March 12,
2001. As a condition of approval, the applicant filed Covenants and Restrictions stating
that they would be required to upgrade an existing dirt road to a 16'-wide gravel road
before obtaining C.O.'s on the houses. The Planning Board member from Fishers Island,
Kenneth Edwards, was to notify the Board when the road was completed. He has
reported that the work has not yet been started. I am aware that there have been a few
building permits filed for these properties. The Planning Board asks that you refrain
from granting C.O.'s until the necessary work has been completed.

DECLARATION OF
COVENANTS AND RESTRICTIONS
THIS DECLARATION made the 5th day of January, 2001, by
FISHERS ISLAND DEVELOPMENT CORPORATION, a New York corporation
having its principal place of business at (no #) Equestrian
Drive, P . 0. Drawer E, Fishers Island, New York 06390,
hereinafter referred to as the Declarant .
WHEREAS, the Declarant has title to certain lots lying and
being at Fishers Island, Town of Southold, County of Suffolk
and State of New York, as shown on the "Plan Made for
Fishers Island Development Corp. Showing East End Lots" dated
August 1981 prepared by Chandler, Palmer & King which was
approved by the Planning Board of the Town of Southold on
September 9, 1991 and filed in the Office of the Clerk of the
County of Suffolk on September 25, 1991 as Miscellaneous Map
#A-421, which said lots are shown on said map as follows :

WHEREAS, the Declarant due to the freshwater wetlands on
the property and in order to preserve the scenic beauty and
natural vegetation, desires to realign the lot lines of the
aforementioned lots; and
WHEREAS, the Declarant has applied to the Southold Town
Pianning Board for said realignment and a lot-line change of the
aforementioned lots as shown on the "Survey Map, Property of
Fishers Island Development Corporation" entitled "CLUB LOTS"
prepared by Chandler, Palmer & King dated October 20 , 1997 which
is attached hereto as Schedule A; and

WHEREAS, the Planning Board of the Town of Southold on
January 26, 1998 approved the realignment and lot-line change as
applied for subject to certain covenants and restrictions being
placed on the lots .
NOW, THEREFORE, the revised lots as described in Schedule B
shall be subject to the following covenants and restrictions :
1 . The private roadway providing access to the lots on the
realigned lot-line change map shall be 501 in width with a gravel
surface of 16 ' in width. No Certificate of occupancy will be
issued by the Southold Town Building Department until the access
road is constructed to the lots .
2 . No new residential structure or sanitary disposal
facility shall be constructed on any lot or otherwise located
within 100 feet of the most landward limit of any freshwater
wetland.
3 . A conservation buffer or easement having a minimum but
not necessarily maximum width of 100 feet landward should be
established over that portion of land adjacent to any freshwater
wetlands . The area within the buffer or easement should remain
in its natural state . However, dead, diseased, and storm damaged
trees and vegetation may be removed for reasons of safety, to
control the spread of the disease, or to control obnoxious plant
growth, such as catbrier, that can be detrimental to existing
vegetation. Such clearing, cutting and removal shall be subject
to review by the Southold Town Planning Board to insure the
maintenance and preservation of the natural buffer.
4 . All freshwater wetland areas shall be indicated on any
map or survey of the property and shown as "reserved for

conservation purposes" .
5 . Domestic water to any dwelling erected on any of the
lots shall be furnished by the Fishers Island Water Works .
6 . Erosion and sediment control measures shall be required
during and after construction of any dwelling on any lot to
insure storm water runoff will not carry eroded and other
deleterious materials into the freshwater wetlands within the
parcel and the tidal wetlands bordering the parcel .
7 . Clearing and grading within each lot shall be limited to
that necessary for siting and constructing a house with the
intent of preserving as much of the natural vegetation on the
site as possible, and to minimize storm water runoff and erosion.
No more than 15% of the site should be placed in fertilized
vegetation and special care shall be taken to limit clearing and
grading due to any severe slopes on the property.
THESE Covenants and Restrictions can be modified only at the
request of the Declarant with the approval of a majority plus one
of the Planning Board of the Town of Southold after a public
hearing.
THE DECLARANT, does hereby further warrant, covenant and
represent that the foregoing restrictions and agreements shall
bind the undersigned, its heirs, successors and assigns, and any
and all person or persons who shall succeed to the ownership of
said premises or any part thereof by transfer or otherwise .

Dear Mr. Lark,
I have examined the revised maps dated 11/27/00 for the FIDCO Club Lots lot line
changes. These maps meet all of the requirements set by the Planning Board. However,
there are two minor corrections that should be made:
I. Spelling error. The wording in the wetlands area says"reserved for conversation
purposes" instead of"reserved for conservation purposes".
2. Building envelope for Lot #17. A rear yard must be shown— choose a location
that would be reasonable for the placement of accessory structures. Also, the
front setback should be 60' to comply With the Town Code.
Everything else is in order. Please submit the revised Covenants and Restrictions when
you have them ready.

THIS DECLARATION made the day of November, 2000, by
FISHERS ISLAND DEVELOPMENT CORPORATION, a New York corporation
having its principal place of business at (no #) Equestrian Drive,
P. 0. Drawer E, Fishers Island, New York 06390, hereinafter
referred to as the Declarant .
WHEREAS, the Declarant has title to certain lots lying and
being at Fishers Island, Town of Southold, County of Suffolk
and State of New York, as shown on the "Plan Made for
Fishers Island Development Corp. Showing East End Lots" dated
August 1981 prepared by Chandler, Palmer & King which was approved
by the Planning Board of the Town of Southold on September 9, 1991
and filed in the Office of the Clerk of the County of Suffolk on
September 25, 1991 as Miscellaneous Map #A-421, which said lots
are shown on said map as 44-17, 44-18 , 44-19, 44-20, 44-21, 44-22 ,
44-23 , 44-24 , 44-25 and 44-29 (SCTM #1000-010 . 00-05 . 00-012 . 010,
012 . 011 and 012 . 012) ; and
WHEREAS, the Declarant due to the freshwater wetlands on the
property and in order to preserve the scenic beauty and natural
vegetation, desires to realign the lot lines of the aforementioned
lots ., and
WHEREAS, the Declarant has applied to the Southold Town
Planning Board for said realignment and a lot-line change of the
aforementioned lots as shown on the Map of Chandler, .Palmer King
dated October 20, 1997 which is attached hereto as Schedule A; and
�, - WHEREAS, the Planning Board of the Town of Southold on

January 26 , 1998 approved the realignment and lot-line change as
applied for subject to certain covenants and restrictions being
placed on the lots .
NOW, THEREFORE, the revised lots as described in Schedule B
shall be subject to the following covenants and restrictions :
1 . The private roadway providing access to the lots on the
realigned lot-line change shall be 161 in width with
gravel surface.
2 . No new residential structure or sanitary disposal
facility shall be constructed or otherwise located within 100 feet
of the most landward limit of any freshwater wetland.
3 . A conservation buffer or easement having a minimum but
not necessarily maximum width of 100 feet landward should be
established over that portion of land adjacent to any freshwater
wetlands . The area within the buffer or easement should remain in
its natural state . However, dead, diseased, and storm damaged
trees and vegetation may be removed for reasons of safety, to
control the spread of the disease, or to control obnoxious plant
growth, such as catbrier, that can be detrimental to existing
vegetation. Such clearing, cutting and removal shall be subject
to review by the Southold Town Planning Board to insure the
maintenance and preservation of the natural buffer.
4 . All freshwater wetland areas shall be indicated on any
map or survey of the property and shown as "reserved for
conservation purposes" .
5 . Domestic water to any dwelling erected on any of the lots
shall be furnished by the Fishers Island Water Works .
6 . Erosion and sediment control measures shall be required
during and after construction of any dwelling on any lot to insure
storm water runoff will not carry eroded and other deleterious
materials into the freshwater wetlands within the parcel and the
tidal wetlands bordering the parcel .
7 . Clearing and grading within each lot shall be limited to
that necessary for siting and constructing a house with the intent
of preserving as much of the natural vegetation on the site as
possible, and to minimize storm water runoff and erosion. Special
care shall be taken to limit clearing and grading due to any
severe slopes on the property.
8 . No more than 150- of the site should be placed in
fertilized vegetation.
THESE Covenants and Restrictions can be modified only at the
request of the Declarant with the approval of a majority plus one
of the Planning Board of the Town of Southold after a public
hearing.
THE DECLARANT, does hereby further warrant, covenant and
represent that the foregoing restrictions and agreements shall
bind the undersigned, its heirs, successors and assigns, and any
and all person or persons who shall succeed to the ownership of
said premises or any part thereof by transfer or otherwise .

The following took place at a meeting of the Southold Town Planning Board on
Monday, January 26, 1998:
BE IT RESOLVED to adopt the January 7, 1998, Suffolk County Planning
Commission report with the following amendments (numbers correspond to the
numbers in the report):
1. The Planning Board will require, as a condition of final approval, that
deeds be recorded in the County Clerk's office for each revised parcel.
20. As written.
4. The Planning Board is requiring that the road shown as "Road
(Unimproved)," which is perpendicular to East End Road, must be
improved to the Town's 16' wide road specifications, as shown in Drawing
No. 15-4 of the Highway Specifications.
5-10. As written.
Numbers 6, 7, 8, 9 and 10 must be presented in a Declaration of Covenants and
Restrictions in proper legal form.

The final public hearing, which was held at 7:30 P.M., was closed.
The following resolution was adopted:
WHEREAS, Fishers Island Development Corporation (FIDCO) is the owner of
the property known and designated as SCTM# 1000-10-5-12.7, located on the
northeast corner of Peninsula Road and East End Road on Fishers Island; and
WHEREAS, SCTM# 1000-10-5-12.7 is shown as 10 building lots (FIDCO Lots
#44- (17-25) and Lot #44-29), on a subdivision map which was endorsed by the
Planning Board in 1991; and
WHEREAS, this proposal, which is being treated by the Planning Board as 7 Lot
Line Changes, is to change the layout of the 10 existing lots which will result in a
reduction in the number of lots to 8 buildable lots and I non-buildable wetland
area; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on January 5, 1998; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on January 26, 1998; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Soythold Town Planning Board grant conditional final
approval on the surveys dated November 19, 1997. All conditions must be met
within six (6) months of the date of this resolution:
1. A Declaration of Covenants and Restrictions must be submitted
containing all of the information noted above in regard to the Suffolk

County Planning Commission report. A copy of the draft Declaration
must be submitted for review by the Planning Board. Once approved, the

3. Revised deeds for each lot must be recorded in the County Clerk's office.

Dear Mr. Ward:
Pursuant to the requirements of Sections A 14-14 to 2') of the Suffolk County Administr-ative
Code, the Suffolk County Planning Commission on January 7, 1998 reviewed the above captioned
application and after due study and deliberation Resolved to approve it subject to the following
conditions:
I. The Suffolk County Real Property Tax Service Agency has mapped the subject property
in the Subscriber Map Album as one lot and not the 10 lots which are shown on the
FEDCO MAP OF 1991. The 1991 Southold approved FIDCO map does have a County
Clerk stamp on it, indicating that the FIDCO map was filed in the office of the County
Clerk QvEscellaneous A-421 Filed Sept. 25, 1991 at 3:00 p.m. and bears the stamp of
Edward P. Romaine, Clerk of Suffolk County). Other sections of the FIDC0 map are in
a similar state (for example, lots 44-7, 44-8, 44-9, 44-10 & 44-12 of the FIDCO
map=SCTTN4 No. 1000-10-05-12.9; Block 40 of the FIDCO map shows seventeen (17)
lots, the SCTM shows only five (5) for the same block, etc.).
This discrepancy shall be clarified prior to final approval of the map.
1 The correct tax map number shall be indicated on the "Proposed Lot Line Change" map.
3. The name of the proposed resubdivision map shall be distinct from any other map
previously approved by the Town of Southold.
4� Where access to a subdivision is provided by an existing private road the following should
be required to insure accessibility by residents. visitors, and emergency and service
equipment to the properties served by the private road.

(a) The private r6dd should be brought up to town or village standards and
specifications.
(b) The right-of-way of the private road should have a minimum width of 50 feet.
(c) A private road or serving two or more lots shall be given a distinctive name and
properly signed to facilitate the location of the properties served by the private road
by police, fire equipment and other emergency services.
(d) The proposed pavement width of a private road within a right-of-way should be a
minimum of 18 feet.
5. The subject property contains "Class I" fresh water wetlands as mapped by the New
York State Department of Environmental Conservation(�vetland NL-1). A note shall be
placed on the map as to the entity and date when the most landward limit of freshwater
wetland vegetation was flagged.
6. This proposed subdivision is situated within the"Secondary Protection Zone" as defined
in the "Fishers Island Watershed Protection Standards as promulgated by the Suffolk
County Department of Health Services. The development of this parcel shall be subject
to the following restrictions in accordance writh Commission Policy and said watershed
protection standards:
• No new residential structure or sanitary disposal facility shall be constructed or
otherwise located within 100 feet of the most landward limit of freshwater wetland.
• A conservation buffer or easement havinQ a minimum but not necessarily maximum
width of 100 feet landward should be established over that portion of land adjacent
to any freshwater wetlands. The area within the buffer or easement should remain
in its natural state. However, dead, diseased. and storm damaged trees and
vegetation may be removed for reasons of safety, to control the spread of the
disease, or to control obnoxious plant growth, such as catbriar, that can be
detrimental to existing vegetation. Such clearing, cutting and removal shall be

subdivision as "reserved for conservation purposes". These areas should be made
subject to covenants and restrictions that will insure their preservation as a natural
resource.
• Any newly constructed private water system shall comply with "Suffolk County
Department of Health Services Private Water Systems Standards.
7- No stormwater runoff resulting from the development and improvement of the
subdivision or any of its lots shall be discharged into the freshwater wetlands within the
parcel.
S. Erosion and sediment control measures shall be required during and immediately after
construction on each lot to insure that stormwarer runoff wail not carry eroded and other
deleterious materials into the freshwater wetlands within the parcel and the tidal wetlands
bordering the parcel.

Dear Mr. Ward:
Pursuant to the requirements of Sections A 14-14 to 23 of the Suffolk County Administrative
Code,the Suffolk County Planning Commission on January 7, 1998 reviewed the above captioned
application and after due study and deliberation Resolved to approve it subject to the following
conditions:
I. The Suffolk County Real Property Tax Service Agency has mapped the subject property
in the Subscriber Map Album as one lot and not the 10 lots which are shown on the
FIDCO MAP OF 1991. The 1991 Southold approved FlDCO map does have a County
Clerk stamp on it, indicating that the FIDCO map was filed in the office of the County
Clerk (Miscellaneous A-421 Filed Sept. 25, 1991 at 3:00 p.m. and bears the stamp of
Edward P. Romaine, Clerk of Suffolk County). Other sections of the FIDCO map are in
a similar state (for example, lots 44-7, 44-8, 44-9, 44-10 & 44-12 of the FIDCO
map=SCTM No. 1000-10-05-12.9; Block 40 of the FIDCO map shows seventeen (17)
lots, the SCTM shows only five (5) for the same block, etc.).
This discrepancy shall be clarified prior to final approval of the map.
2. The correct tax map number shall be indicated on the "Proposed Lot Line Change"map.
3. The name of the proposed resubdivision map shall be distinct from any other map
previously approved by the Town of Southold.
4. Where access to a subdivision is provided by an existing private road the following should
be required to insure accessibility by residents, visitors, and emergency and service
equipment to the properties served by the private road.

(a) The private road should be brought up to town or village standards and
specifications.
(b) The right-of-way of the private road should have a minimum width of 50 feet.
(c) A private road or serving two or more lots shall be given a distinctive name and
properly signed to facilitate the location of the properties served by the private road
by police, fire equipment and other emergency services.
(d) The proposed pavement width of a private road within a right-of-way should be a
minimum of 18 feet.
5. The subject property contains "Class I" fresh water wetlands as mapped by the New
York State Department of Environmental Conservation(wetland NL-I). A note shall be
placed on the map as to the entity and date when the most landward limit of freshwater
wetland vegetation was flagged.
6. This proposed subdivision is situated within the"Secondary Protection Zone"as defined
in the "Fishers Island Watershed Protection Standards as promulgated by the Suffolk
County Department of Health Services. The development of this parcel shall be subject
to the following restrictions in accordance with Commission Policy and said watershed
protection standards:
• No new residential structure or sanitary disposal facility shall be constructed or
otherwise located within 100 feet of the most landward limit of freshwater wetland.
• A conservation buffer or easement having a minimum but not necessarily maximum
width of 100 feet landward should be established over that portion of land adjacent
to any freshwater wetlands. The area within the buffer or easement should remain
in its natural state. However, dead, diseased, and storm damaged trees and
vegetation may be removed for reasons of safety, to control the spread of the
disease, or to control obnoxious plant growth, such as catbriar, that can be
detrimental to existing vegetation. Such clearing, cutting and removal shall be
subject to review by the Town or Village to insure the maintenance and preservation
of the natural buffer.
• All freshwater wetland areas should be indicated on the map of the proposed
subdivision as "reserved for conservation purposes". These areas should be made
subject to covenants and restrictions that will insure their preservation as a natural
resource.
• Any newly constructed private water system shall comply with "Suffolk County
Department of Health Services Private Water Systems Standards.
7. No stormwater runoff resulting from the development and improvement of the
subdivision or any of its lots shall be discharged into the freshwater wetlands within the
parcel.
8. Erosion and sediment control measures shall be required during and immediately after
construction on each lot to insure that stormwater runoff will not carry eroded and other
deleterious materials into the freshwater wetlands within the parcel and the tidal wetlands
bordering the parcel.

9. Clearing and grading within each lot shall be limited to that necessary for siting and
constructing a house with the intent of preserving as much of the natural vegetation on
the site as possible, and to minimize stormwater runoff and erosion. Special care shall
be taken to limit clearing and grading due to the severe slopes on the subject property.
10. No more than 15%of the site should be placed in fertilized vegetation.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
This project is for a reduction in the number of existing lots from 10 lots to 8
buildable lots and 1 non-buildable wetland lot.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required

FIDCO lots #44 - (17-25) and #44-29
On September 9, 1991, the Southold Planning Board authorized its
Chairman to endorse the Open Development Subdivision Plan for the
Fishers Island Development Corporation (FIDCO) Showing East End Lots.
This plat had been adopted by the Planning Board in January of 1988 and
previously approved by the Suffolk County Department of Health Services'
Board of Review on December 4, 1987. However, since the plat had not
been filed with the County Clerk's Office in Riverhead, the Planning
Board's 1991 endorsement allowed for the filing of the map in accordance
with the provisions of New York State Town Law.
FIDCO owns SCTM# 1000-10-12-7, which is shown on the above mentioned
approved subdivision as 10 building lots. The request before the Planning
Board is to change the layout of the 10 lots to better utilize the
existing topography. The result will be a reduction from 10 lots to 9
lots, one of which has been designed as a non-buildable wetland lot to be
retained by FIDCO.

Dear Mr Doherty:
The Planning Board reviewed the above mentioned application at the
November 3, 1997 work session. Please find the Planning Board's
comments listed below:
1. The front, rear and side yard setbacks must correspond to the
street on which each lot fronts. Most setbacks are correct, however,
please have your surveyor re-check each lot and indicate the
designated front, rear and side yards for each lot. In particular,
Lot #19 does not indicate a rear yard.
2. The Planning Board questions whether or not the interior road is
necessary. Depending on the established front yard setbacks, it may
be possible to design Lot 20 as a flag lot.
3. A 75' setback from the wetland is shown on the map. This area must
be labeled as a wetland buffer within which there shall be no
clearing or grading.
4. The ownership of the wetland lot (Lot 24) must be clarified.

5. The longer road, which is shown as unimproved, must be improved
to the Town's 16' stone blend specifications. Road and drainage
plans will be required.
The Planning Board will proceed with its review upon submission of the
above mentioned information.

Your inquiry in regard to changing the lot lines for the above mentioned
FIDCO lots was reviewed at the July 21, 1997 work session.
The current FIDCO subdivision shows the parcel designated as
SCTM# 1000-10-5-12.7 as containing 10 FIDCO lots. The sketch map which
you presented to the Planning Board for review shows one FIDCO lot
(#44-17) remaining the same, seven (7) FIDCO lots with revised
boundaries and one area designated as a non-buildable wetland area.
Assuming that all of the original FIDCO lots are a minimum of 40,000
square feet in area, and all of the revised lots are a minimum of 40,000
square feet in area, the Planning Board will process the proposal as
multiple lot line changes. Since 7 lots are proposed to be revised, the
Planning Board will process this as 7 lot line changes. The lot line
change application fee is $250.00. A total application fee of $1750.00 is
required for the proposed lot line changes. Since all of the lot line
changes will be shown on one map, one file will be kept for the multiple
changes. Therefore, one set of application materials will be required.
In addition to the standard information required, the following
information must be shown on the map:
1 . The boundaries of the wetland.
2. A seventy-five (75) foot wetland buffer.
3. Building envelopes for all lots. The subject parcel is located in the
R-120 Zoning District. Therefore, the lots are non-conforming. The
building envelopes must conform to the minimum standards for
non-conforming lots (Section 100-244 (B)) .
4. Metes and bounds for each lot.
5 . The area of each lot. If the lot contains wetlands, the upland area
and the wetland area must be indicated.

Valerie-
FIDCO owns lot 10-12.7 on Fishers Island which is shown in the Olmstead
Plan as being divided into 10 building lots. FIDCO would like to build first
On I and eventually on 3 Of these lots. I am told by Dick Strauss of
Chandler, Palmer, and King, our Fishers Island surveyor, that there are no
Motes and bounds on ally of the Olmstead sub divisions in 10.12.7,
It also appears that when these lots were laid out, it was Clone without a
field check. Thus the present lots, as taker) off of the OLmstead map, don't
make a lot of sense from a utilization standpoint. (e.g. the 'best Sites are
often right on lot linns)
FIDCO would like to survny 10.12.7 and re-layout the 10 lots with the goal
Of better utilizing the topo-graphy. We would Plan to keep the number of
lots at 10, although it is ��oncelvable that we might propose to reduce the
final number of buildable lots it It doesn't make sense to retain �10.
I have talked to Ken Edwards about this, and he points out that we are
going to have to have rnetes and bounds before we can get a building
permit. He suggested that I talk to you about resurveying the area and
rearranging the lot lines.
Can we do this? AssUnling that we can, what process should we follow to
make it all legitimate?
I'm at 860,434.8975, and this is the reason I called this morning.
