The private roadway providing access to the lots on the realigned lot-line change map shall be 501 in width with a gravel surface of 16 ' in width. No Certificate of occupancy will be issued by the Southold Town Building Department until the access road is constructed to the lots . 2 . No new residential structure or sanitary disposal facility shall be constructed on any lot or otherwise located within 100 feet of the most landward limit of any freshwater wetland. 3 . A conservation buffer or easement having a minimum but not necessarily maximum width of 100 feet landward should be established over that portion of land adjacent to any freshwater wetlands . The area within the buffer or easement should remain in its natural state . However, dead, diseased, and storm damaged trees and vegetation may be removed for reasons of safety, to control the spread of the disease, or to control obnoxious plant growth, such as catbrier, that can be detrimental to existing vegetation. Such clearing, cutting and removal shall be subject to review by the Southold Town Planning Board to insure the maintenance and preservation of the natural buffer. 4 . All freshwater wetland areas shall be indicated on any map or survey of the property and shown as "reserved for Page 3 of 15 conservation purposes" . 5 . Domestic water to any dwelling erected on any of the lots shall be furnished by the Fishers Island Water Works . 6 . Erosion and sediment control measures shall be required during and after construction of any dwelling on any lot to insure storm water runoff will not carry eroded and other deleterious materials into the freshwater wetlands within the parcel and the tidal wetlands bordering the parcel . 7 . Clearing and grading within each lot shall be limited to that necessary for siting and constructing a house with the intent of preserving as much of the natural vegetation on the site as possible, and to minimize storm water runoff and erosion. No more than 15% of the site should be placed in fertilized vegetation and special care shall be taken to limit clearing and grading due to any severe slopes on the property. THESE Covenants and Restrictions can be modified only at the request of the Declarant with the approval of a majority plus one of the Planning Board of the Town of Southold after a public hearing. The Suffolk County Real Property Tax Service Agency has mapped the subject property in the Subscriber Map Album as one lot and not the 10 lots which are shown on the FIDCO MAP OF 1991. The 1991 Southold approved FlDCO map does have a County Clerk stamp on it, indicating that the FIDCO map was filed in the office of the County Clerk (Miscellaneous A-421 Filed Sept. 25, 1991 at 3:00 p.m. and bears the stamp of Edward P. Romaine, Clerk of Suffolk County). Other sections of the FIDCO map are in a similar state (for example, lots 44-7, 44-8, 44-9, 44-10 & 44-12 of the FIDCO map=SCTM No. 1000-10-05-12.9; Block 40 of the FIDCO map shows seventeen (17) lots, the SCTM shows only five (5) for the same block, etc.). This discrepancy shall be clarified prior to final approval of the map. 2. The correct tax map number shall be indicated on the "Proposed Lot Line Change"map. 3. The name of the proposed resubdivision map shall be distinct from any other map previously approved by the Town of Southold. 4. (b) The right-of-way of the private road should have a minimum width of 50 feet. (c) A private road or serving two or more lots shall be given a distinctive name and properly signed to facilitate the location of the properties served by the private road by police, fire equipment and other emergency services. (d) The proposed pavement width of a private road within a right-of-way should be a minimum of 18 feet. 5. The subject property contains "Class I" fresh water wetlands as mapped by the New York State Department of Environmental Conservation(wetland NL-I). A note shall be placed on the map as to the entity and date when the most landward limit of freshwater wetland vegetation was flagged. 6. This proposed subdivision is situated within the"Secondary Protection Zone"as defined in the "Fishers Island Watershed Protection Standards as promulgated by the Suffolk County Department of Health Services. The development of this parcel shall be subject to the following restrictions in accordance with Commission Policy and said watershed protection standards: • No new residential structure or sanitary disposal facility shall be constructed or otherwise located within 100 feet of the most landward limit of freshwater wetland. • A conservation buffer or easement having a minimum but not necessarily maximum width of 100 feet landward should be established over that portion of land adjacent to any freshwater wetlands. The area within the buffer or easement should remain in its natural state. However, dead, diseased, and storm damaged trees and vegetation may be removed for reasons of safety, to control the spread of the disease, or to control obnoxious plant growth, such as catbriar, that can be detrimental to existing vegetation. Such clearing, cutting and removal shall be subject to review by the Town or Village to insure the maintenance and preservation of the natural buffer. • All freshwater wetland areas should be indicated on the map of the proposed subdivision as "reserved for conservation purposes". These areas should be made subject to covenants and restrictions that will insure their preservation as a natural resource. • Any newly constructed private water system shall comply with "Suffolk County Department of Health Services Private Water Systems Standards. 7. No stormwater runoff resulting from the development and improvement of the subdivision or any of its lots shall be discharged into the freshwater wetlands within the parcel. 8. Erosion and sediment control measures shall be required during and immediately after construction on each lot to insure that stormwater runoff will not carry eroded and other deleterious materials into the freshwater wetlands within the parcel and the tidal wetlands bordering the parcel. Clearing and grading within each lot shall be limited to that necessary for siting and constructing a house with the intent of preserving as much of the natural vegetation on the site as possible, and to minimize stormwater runoff and erosion. Special care shall be taken to limit clearing and grading due to the severe slopes on the subject property. 10. No more than 15%of the site should be placed in fertilized vegetation. Yours t- "rs t COMMENTS RE: Proposed Lot Line Change SCTM# 1000-10-5-12.7 FIDCO lots #44 - (17-25) and #44-29 On September 9, 1991, the Southold Planning Board authorized its Chairman to endorse the Open Development Subdivision Plan for the Fishers Island Development Corporation (FIDCO) Showing East End Lots. This plat had been adopted by the Planning Board in January of 1988 and previously approved by the Suffolk County Department of Health Services' Board of Review on December 4, 1987. However, since the plat had not been filed with the County Clerk's Office in Riverhead, the Planning Board's 1991 endorsement allowed for the filing of the map in accordance with the provisions of New York State Town Law. FIDCO owns SCTM# 1000-10-12-7, which is shown on the above mentioned approved subdivision as 10 building lots. The request before the Planning Board is to change the layout of the 10 lots to better utilize the existing topography. Please find the Planning Board's comments listed below: 1. The front, rear and side yard setbacks must correspond to the street on which each lot fronts. Most setbacks are correct, however, please have your surveyor re-check each lot and indicate the designated front, rear and side yards for each lot. In particular, Lot #19 does not indicate a rear yard. 2. The Planning Board questions whether or not the interior road is necessary. Depending on the established front yard setbacks, it may be possible to design Lot 20 as a flag lot. 3. A 75' setback from the wetland is shown on the map. This area must be labeled as a wetland buffer within which there shall be no clearing or grading. 4. The ownership of the wetland lot (Lot 24) must be clarified. 0 0 5. The current FIDCO subdivision shows the parcel designated as SCTM# 1000-10-5-12.7 as containing 10 FIDCO lots. The sketch map which you presented to the Planning Board for review shows one FIDCO lot (#44-17) remaining the same, seven (7) FIDCO lots with revised boundaries and one area designated as a non-buildable wetland area. Assuming that all of the original FIDCO lots are a minimum of 40,000 square feet in area, and all of the revised lots are a minimum of 40,000 square feet in area, the Planning Board will process the proposal as multiple lot line changes. Since 7 lots are proposed to be revised, the Planning Board will process this as 7 lot line changes. The lot line change application fee is $250.00. A total application fee of $1750.00 is required for the proposed lot line changes. Since all of the lot line changes will be shown on one map, one file will be kept for the multiple changes. Therefore, one set of application materials will be required. In addition to the standard information required, the following information must be shown on the map: 1 . The boundaries of the wetland. 2. A seventy-five (75) foot wetland buffer. 3. Building envelopes for all lots. The subject parcel is located in the R-120 Zoning District. FIDCO would like to build first On I and eventually on 3 Of these lots. I am told by Dick Strauss of Chandler, Palmer, and King, our Fishers Island surveyor, that there are no Motes and bounds on ally of the Olmstead sub divisions in 10.12.7, It also appears that when these lots were laid out, it was Clone without a field check. Thus the present lots, as taker) off of the OLmstead map, don't make a lot of sense from a utilization standpoint. (e.g. the 'best Sites are often right on lot linns) FIDCO would like to survny 10.12.7 and re-layout the 10 lots with the goal Of better utilizing the topo-graphy. I have talked to Ken Edwards about this, and he points out that we are going to have to have rnetes and bounds before we can get a building permit.
