Government Surplus Real Property at Fishers Island to be acquired by the Town of Southold Dear Henry: Several months ago, the General Services Administration of the U.S. Government offered for sale several parcels of surplus property located at Fishers Island. The property consists of two tracts of land. One tract (waterfront tract) containing approximately 4.52 acres, consists of 3 parcels near the Fishers Island Ferry District Ferry Terminal. The second tract (housing tract) contains approvimately 1.463 acres, on the nprth side of Whistler Avenue at its intersection with Equestrian Avenue, This tract has erected thereon a one family brick house and a four family brick house. -- ...... Under the terms of the sale, G.S.A. will accept only offers to purchase both tracts. The Fishers Island Ferry District is interested only in the waterfront tract and the one family dwelling on Whistler Avenue. However, to acquire the property in which it is interested, all property must be purchased. On September 6, 1983, the Town Board authorized the purchase of both tracts, and on September 14, 1983, the Town submitted an offer to G.S.A. to purchase both tracts at the following prices: Waterfront tract Housing tract Total $465,000.00 230,000.00 $695,000.00 The Commissioners of the Ferry District have received pledges from property owners on Fishers Island to donate sufficient funds to pay for the cost of the waterfront tract. However, the sale has been approved by the appropriate Congressional Committee, and the approval by G.S.A. appears reasonably certain. If this purchase is consummated, it is contemplated that the acquisition of the two tracts by the Town and the sale of the four family dwelling parcel will take place simultaneously {the proceed of the sale of the four family dwelling will be applied towards the purchase of the two tracts). Enclosed herewith is a map of the housing tract divided into Parcel A and Parcel B. Parcel A containing 22,029 sq. ft. will be retained by the Town for the use of the Fishers Island Ferry District to house its personnel. Parcel 13 containing 39,106 scI. ft. will be sold. Although both the Town and the Ferry District are governmental agencies, and, therefore, are not subject to zoning regulations, the parcel being sold to a private individual would, in my opinion, be subiect to the zoning regulations. Therefore, it would appear that the division of the housing parcel will require approval of the Planning Board as a set off. It would a]so appear that a variance may be required since the parcels are undersized. On behalf of the Town of Southold, I am hereby applying to the Planning Board for its approval of the set off as shown on the enclosed map. Upon application for PAUL D. The board made the following findings and determination: By this application, appellant proposes a division of approxi- mately 1.4 acres of land located on the north side of whistler Avenue at Fishers Island. The division is a set-off of a parcel of land containing an area of .897 of an acre, or 39,106 sq. ft. with frontage along Whistler Avenue of approximately 312 feet, which is depicted as Parcel "B" on survey prepared June 14, 1983 by Chandler, Palmer and King. The tract shown as Parcel "A" will contain an area of .506 of an acre, or 22,029 sq. ft. with 110' frontage along Whistler Avenue and will be retained by the Town of Southold for use by the Fishers Island Ferry District. Parcel "A" is not subject to the Town's Zoning Code. Existing on proposed Parcel "B" are a 25' by 25' accessory build- ing and a brick six-family dwelling, which has continuously been used as such prior to the enactment of the Zoning Code. Existing on Parcel "A" are a 20' by 25' accessory building and a brick one-family dwelling. The premises are served by communal sewer and water systems. The board members have personally visited the site in question and are familiar with the surrounding neighborhood. The entire premises in question are and have been owned since World War I by the United States Government and formed a part of former Fort H. G. Wright. The premises on the westerly side are zoned "M" Multiple Residence and are owned by the Fishers Island Union Free School District. The premises to the south of Whistler Avenue is zoned "B-i" Business and consists of the Fishers Island Airfield. In considering this appeal, the board determines: (a) that in granting the relief requested, no adverse effects will be produced on available governmental facilities of any increased population since the uses are not to be greater in number than exists; (b) that the abutting premises are also being used for multiple-dwelling purposes and therefore the relief requested will not produce a ohange in the character of the neighborhood or produce a substantial detriment to adjoining properties; (c) that the difficulty cannot be obviated by some method which might be feasible to appellant other than by the grant of this application; (d) the lot area of Parcel "A" will have 55.07% of the requirements of the Bulk Schedule applicable to the "M" Light District and 81.48% of the required width; the lot area of Parcel "B" will have 97.78% of the required 40,000 sq. ft. applicable to the "M" Light Multiple-Residence District, therefore the relief requested is not substantial, especially when compared with those parcels in the immediate neighborhood; (e) that the circumstances are unique; (f) that the relief requested will be in harmony with and promote the general purposes of zoning; and (g) that the inter- ests of justice will be served by granting the relief requested. it is NOW, THEREFORE, on motion by Mr. Doyen, seconded by Mr. Goehringer, RESOLVED, that the application for PAUL D.
