Dear Mr. Wickham:
I am in receipt of a copy of your letter to Mr. Palmer
concerning the .linen maps for filing in the county clerk's
office. Mr. Palmer has completed these maps and they
are now with Mr. Fred Grebe who has kindly volunteered
to deliver them to the town office.
On Friday, February 23rd, Mr. Gada, with two machines
and operators tried manfully to comply with the requirement
for demolil..i.on of the sidewalk and the .foundation. The work
was actually begun the day before and continued until 4 P. M.
Friday. They found that the frost was over a foot into the
ground and that the machines could not budge the concrete
imbedded there. They were successful in removing the concrete
floor but the surrounding wall was immovable. I assure you that
as soon as the weather breaks and the frost leaves the earth, I
will continue with this work and comply with the requirement set
up by ,your commission. It is my estimate that in addition to the
$200. 00 already spent, there will be an additional $300 . 00 for the
completion of the work. Would you like me to send you a check
in this amount for ,you to hold in escrow and then deliver to
Mr. Gada �v'ien Fred Grebe assures you it is compieted? I wish
to assure you that I am a man of my word and will comply with
your requirements.

capacity as an employee of the Fishers Island Water Works
Corporation and the Fishers Island Estates, Inc. , I must
come to the island to oversee these operations at, least once

Dear Mr. Wickham:
Following the instructions in your letter of January 16th, I am
forwarding my application for a minor subdivision. I also
enclose my check for $50. 00 which I am told is the required fee.
Mr. Palmer, the surveyor, advises that he has completed the
revised surveys with the turn-around at the easterly end of the
property and in the form of a square. He is forwarding two prints
of this to Mr. Fred Grebe for presentation at your meeting. He
also is sending on prints of Reservoir Road to the point where it
connects with Winthrop Drive. I never wanted this property but
was forced to take it from the Race Point Corporation. They
assure me it is the required 50 feet in width throughout its length.
I spoke to Mr. Gada on Friday, January 26th, and he is prepared
to go ahead with any work which is necessary and financially
feasible as soon as the weather breaks.
From your letters I somehow get the feeling that you think I am
trying to damage Fishers Island. Nothing could be farther from
the truth. My one regret is that we have not had the opportunity to
meet personally. From such an encounter you would see that I am
relatively young (45 years) am not of inherited wealth; in fact, my
people were Canadian farmers who despaired of trying to scratch
a living from the frigid soil of Ontario and emigrated to New York
when they entered the Real Estate business and set about selling
other peoples farms and real property. We live in a modest house

in Irvington, New York where I am a member of church vestry,
the P. T. A. and even president of the local property owners
association. I would unquestionably be a member of the Planning
Board were it not for my conflicting interests as a Real Estate
Broker. The point is, I am a tax paying, hard working, middle
class American who takes on the dirty jobs, fights the wars and
tries to make it on his own without government handouts and without
asking anybody to carry his load.
This is the philosophy am bringing to Fishers Island. As you know,
I have worked many years for the wealthy families on the East End
as manager of the Fishers Island Estates and of the Fishers Island
Water Works Corporation. Additionally, I have plied my trade as
Real Estate Broker and appraiser on the Island in conjunction with
Polly Edmonds. When a tract of land became available in the old
Fort Wright property at a reasonable price, I dug deeply into my
savings and bought it. I am seeking to prove that there is a place on
Fishers Island for working people of moderate income who wish a
quiet retreat to rear small children. I would like to divide my
property into five parcels, as limited by my deed, and ask others
of similar circumstances to come in with me; thereby apportioning
the cost of the taxes and reducing my own capital investment. At
this writing, Mr. George Conant of St. Louis is the only one who
shares my dream and wants to buy in with me. He has agreed to pay
a portion of the cost of maintaining our road and anyone else who
comes in will have to do likewise on a per acreage basis. Neither
I nor anyone in my group will cost your Township anything, you can
be sure of it. In fact, five houses, paying taxes and requiring no
services, not even schools, should be a credit to your community.
We only want to live quietly three months a year on Fishers Island.
For this reason we do not want vastly improved highways bordering
our properties. Mr. Conant has five young children and I have one.
The last thing we desire is the rich boys from the East End coming
down to drag race in front of our homes on roads we have paid to
improve.

York corporation, having an office at 1 Chase
Manhattan Plaza, City, County and State of
New York (hereinafter called the Seller) , and
WILLIAM B . MAY, JR. and JEANNE A. MAY, his
wife, residing at 123 Main Street, Irvington,
New York (hereinafter collectively called the
Purchaser) ,

Seller agrees to sell and .convey , and Purchaser
agrees to purchase, for the price and subject to the terms
and conditions herein set forth, all that certain plot, piece
or parcel of land, with the building and improvements thereon
erected, situate , lying and being at Fishers Island, Town of
Southold, Suffolk County, State of New York, and being more
fully described on Schedule A. attached 'hereto and made a part
hereof, and on the Survey, dated April 22, 1964 , revised May

parties to use , maintain, repair and replace (as the

ation of the above—mentioned 30—day period or
( 2) the date Purchaser receives notice from Seller
that it does not elect to purchase the Premises or
portion thereof to be sold.
( 2) The provisions of paragraph (g) ( 1) shall
apply to any transfer by Purchaser without considera—
tion, except that the purchase price at which Seller

may exercise its option shall be an amount equal
to the then fair market value of the Premises or
portion thereof.
(3) Within 30 days after Purchaser has received
notice that Seller has exercised any of the fore-
going options , Purchaser shall deliver or cause to
be delivered to Seller a Bargain and Sale Deed, in
recordable form and in all respects satisfactory to
Seller. Upon the delivery of such Deed, Purchaser
shall vacate and surrender possession of the Premises
or portion thereof to Seller.
( 4) Any transfer or conveyance of the Premises
or portion thereof by Purchaser in violation of the
foregoing provisions shall be void. .
( 5) The foregoing covenants and agreements
shall run with the land, shall bind the heirs ,
distributees, personal representatives and assigns
of Purchaser, and shall inure to the benefit of the
successors and assigns of Seller. Seller shall have
the same options to purchase the Premises or any
portion thereof against all subsequent owners of the
Premises, it being understood that the word "Purchaser"
when used in this paragraph ( g) shall include the
heirs, distributees , personal representatives and

assigns of Purchaser.
The purchase price is Fifteen thousand and 00/100
Dollars ( $15 , 000 .00) , 10% of which or $1,500 has been
received and is hereby acknowledged as received by Seller.
The balance of said purchase price shall be payable in cash
or by certified or official bank check on the delivery or
tender of delivery of the deed by Seller as hereinafter pro-
vided.
Real property taxes assessed or levied against the
Premises shall be adjusted as of the closing date.
Seller shall convey and Purchaser shall accept a
title such as Chicago Title Insurance Company will approve
and insure .
The form of deed shall be a Bargain and Sale Deed;
said deed shall contain the several conditions, restrictions
and covenants hereinabove set forth and shall be delivered
upon receipt of the balance of the purchase price at the
office of Seller, on or about June 1, 1967 .
Purchaser represents that Purchaser has inspected
the Premises, and is purchasing the same "as is" .
This Agreement constitutes the entire contract
between the parties , and Seller shall not be liable or bound
In any manner by express or implied warranties , guarantees,
promises , statements, representations or information made or
furnished by Seller, or any other person, pertaining to the

physical condition or value of the Premises , unless such
warranties, guarantees , promises , statements, representa—
tions or information are expressly and specifically set
forth herein.
The provisions of this Agreement shall bind and
inure to the benefit of the heirs, executors , administrators
and successors of the parties hereto and assigns • of the Pur—
chaser provided that prior written consent to any assignment
by Purchaser is obtained from Seller.

Dear Mr. May:
In response to your letter of November 16, 19670 it appears
to the Planning board that if you sell part of the shore front
Property to the Conant*, and reserve part for yourself, there
will be some six acres left over. Itis the experience of the
Planning Board on Fishers Island that in a very short period of
time this six acres of land will be offered to somebody else, and
the Rules and Regulations for the Subdivision of Land will be
avoided, and this is not good planning.
The Planning Board will insist that you file a minor subdivision
before selling any land. Also the Planning Board has found that
every experience there has been the reluctance of the Fishers Island
people to face the abominable conditions of their highways, and the
Planning Board has no intention of letting this go any further. The
roads in this subdivision will have to be fifty feet wide and built
to Southold Town Highway Specifications, a copy of which you will
find enclosed.

Dear Mr. Albertson:
Following up on our earlier conversations, I am enclosing a copy
of the latest subdivision plan made up by Mr. Palmer of Norwich,
Connecticut. As you can see, we have provided a 50 foot right-of-
way to include land on either side of the existing 22 foot paved road.
I also include a circular turn around with a diameter of 100 feet.
From this road and from this turn around, each lot will have well
over 100 feet of frontage. Mr. Palmer can supply linens of this when
required.
I has been suggested that I engage Mr. Gada to move in with a bull-
dozer and clear the brush and debris out of this right-of-way. I am
quite willing to do this if you consider it necessary but in our last
conversation, you suggested I not do anything without talking to you
so I await your advice.
Once again, I assure you that my wife and I and Mr. and Mrs. Conant
who are the only ones interested in this project at the moment will do
nothing to in any way downgrade the property. If you would like me to
go out to the meeting, I will be most happy to do so. Additionally, I
would be pleased to meet with you in Southold prior to the meeting if
you consider this advantageous. In fact, I wish to cooperate with you
and the Planning Board in every way I can to create something which
will result in a positive improvement for the Town and for Fishers
Island.

Dear Sirs:
This refers to the 9. 32 acre parcel of land at Fishers Island
which my wife and I have recently acquired from Race Point
Corporation. Said parcel is shown on sketch of said parcel
made by Chandler & Palmer, a copy of which said surveyors
have forwarded to Mr. Grebe.
We also own Reservoir Road which provides access for said
parcel through Winthrop Drive.
We have no intention at this time of offering any part of the

subdivision map of said 9. 32 acre parcel.
The contract for the acquisition of such property was made on
May 6, 1967. Shortly thereafter, we received an offer from
George K. Conant, Jr. and Ellen R. Conant, his wife, for
approximately 2. 50 acres, which is also shown on said sketch
and which we would like to sell to the Conants. Access for
the 2. 50 acre parcel would be through the right-of-way on
the 9. 32 acre parcel, shown on the sketch, which right-of-way
connects with Reservoir Road. The conveyance to the Conants
would be by a metes and bounds description, without references
to any map or survey.
The Conants are ready to improve the property.

We purchased the property for a homesite for ourselves and intend
to construct a dwelling thereon, perhaps next year. We do not need
the entire 9. 32 acres and as above mentioned would like to sell a
portion thereof.
We have been informed that new subdivision regulations have been
adopted and that the Planning Board will consider this a minor
subdivision under the regulations and will advise us whether the
proposed sale can be made under all existing conditions.
While we cannot understand how our sale to the Conants would be
subject to the new regulations, nevertheless, we would like your
Board, without prejudice to any of our rights, to consider the pro-
posed sale and to advise us of their requirements in connection there-
with.
We wish to reserve the right to have the parcel or the remaining
portion thereof declared an open area development under section 280A
of the Town Law.

Dear Mr. Nay:
In response to your letter of November 16, 1967, it appears
to the Planning Board that if you mall part of the shore front
Property to the Conants, and reserve part for yourself, there
will be some six acres left over. Itis the experience of the
Planning Board on Fishers Island that in a very short period of
time this six acres of land will be offered to somebody else, and
the Rules and Regulations for the Subdivision of Land will be
avoided, and this is not good planning.
The Planning Board will insist that you file a minor subdivision
before selling any land. Also the Planning Board has found that
every experience there has been the reluctance of the Fishers Island
people to face the abominable conditions of their highways, and the
Planning Board has no intention of letting this go any further. The
roads in this subdivision will have to be fifty feet wide and built
to Southold Town Highway Specifications, a copy of which you will
find enclosed.

Dear Fred,
I have talked at length with Fred Carver, my lawyer and the
lawyer for Fishers Island Estates, and he advises me to
forget the subdivision for the time being. The complications
are too many and the possible expenses too great for a person
of limited means like myself.
Instead, I plan to sell only one tract to Mr. George K. Conant, Jr.
of St. Louis, Missouri. Mr. Conant has been in this from before
the time I purchased the property. In fact, it was based upon
his offer to take and pay for part of it that I went through with
the purchase of the whole nine acres. I will hold the balance for
myself for the indefinite future.
Mr. Palmer is sending you a new survey showing the breakdown.
Kindly submit it that way to the Planning Board in their meeting
on Tuesday, November 21st. I hope I will not have to spend any
more money on this. After all, I am not going into a real estate
speculation; merely receiving assistance from one outside party
to make possible my initial purchase. I hope that your colleagues
on the Planning Board will be able to see it in this light.

While I strongly believe in controlled development through the
means of a strong planning board, I would caution you against
long delays and the imposition of stringent regulations on what
is essentially a community of 4, 000 summer people trying to
enjoy second homes. If the delays are too long, there will be
no transactions - busy people do not have time to take on more
battles. If the regulations are too stringent and expensive, you
will destroy the "middle income" people who are beginning to
appear on Fishers Island. They cannot afford extensive land
improvements so they will abandon the whole idea and spend
their vacations at resort hotels or cruises or the many other
opportunities made possible through better travel facilities
and availability of credit. Result: the rich people will acquire
more land (the taxes are deductible from their income taxes),
there will be less building, the stores and service people will
have less trade and the middle aged, middle income, work-for-
a-living people who are the real strength of any society will
simply not come to Fishers Island. It is something to think
about
