The following action was taken by the Southold Town
Planning Board at a regular meeting hold October 30, �^
1978.
RESOLVED to approve the sketch map of the minor
subdivision of Briscoe Smith subject to receipt of maps
showing lots with' a minimum of 40,000 square feet each,
15 foot setback from lot line of existing buildings,
statement that remainder of the property will be presented
as a formal subdivision if it is subdivided in the future.
Please submit six maps indicating "Minor Subdivision
of", $20 application fee and legal description of
property to be included in the minor subdivision. The
Suffolk County Dept. of Planning will require a statement
from you regarding grading of the property and drainage.

Gentlemen:
I represent Briscoe R. Smith, Mary R. Crimmins
and Theodore H. Smith, III (the "Sellers") who are the
owners of a parcel of land situated on the southerly side
of Equestrian Avenue, where the same intersects with
Heathulie Avenue, on Fisher' s Island, New York , containing
approximately one acre and being designated on the Official
Tax Map of Suffolk County as Item No. 85052 (Suffolk County
Tax Map No. 10009 6 1) (the "Premises") .
The Sellers desire to sell the Premises to the
Reverend William J. Hilliard of West Hartford, Connecticut.
Rev. Hilliard desires to use the Premises as a summer home.
However, he wants to use the existing dwelling and garage
as a guest house and to build a new primary dwelling as a
permanent summer residence. Obviously, Rev. Hilliard cannot
construct a new dwelling, retain the existing buildings and
comply with minimum zoning and set-back restrictions, given
the size of the parcel comprising the Premises . Accordingly,
he has asked that the Sellers convey the Premises plus
sufficient additional property to enable him to comply with
the zoning and building codes . Annexed hereto as Exhibit 1
is a Survey dated May, 1978, which Rev. Hilliard has had
prepared by Chandler, Palmer & King of Norwich, Connecticut
(the "Survey" ) showing the total area of the property which
he proposes be conveyed to him (the "Contract Parcel") .
The Sellers own an undivided 50% interest in
property adjacent to the Premises containing approximately
10 . 5 acres (the "Adjacent Land" ) and have an agreement in
principle with the owners of the other undivided 50% interest,
Norman D. Carter and Mary Blanchard (the "Joint Tenants") to
purchase from them their 50% interest in so much of the
Adjacent Land as is necessary to enable the Sellers to convey
the Contract Parcel to Rev. Hilliard.

As the Survey shows , the Contract Parcel fronts
on a public street. Before Rev. Hilliard can construct any
additional improvements thereon, he must comply with exist-
ing zoning and building codes in order to comply with set
back requirements and to insure adequate water, sewer, elec-
trical and drainage facilities , all of which must be approved
by the building inspector before a building permit or
certificate of occupancy can be issued. The Adjacent Land
is vacant and has access to public streets.
Since the Sellers own an undivided 50% interest
in the Adjacent Land and the Joint Tenants are distant
relatives of the Sellers, it is unclear whether the proposed
transaction technically constitutes a "subdivision" . Certainly,
no streets or highways are being laid out nor is there any
division of land into lots except to the extent necessary to
add sufficient acreage to the Premises in order to convey the
Contract Parcel to Rev. Hilliard.
Since no physical improvements are being made or
are contemplated to be made to any part of the Adjacent Land
as part of the proposed transaction and since the existing
zoning and building codes adequately protect the Town of
Southold in respect of any improvements to the Premises or
the Contract Parcel which may be contemplated by Rev. Hilliard,
technical compliance with the subdivision regulations , under
the circumstances of this case, would appear to raise extra-
ordinary and unnecessary hardships. Accordingly, I respect-
fully request the Planning Board to waive, pursuant to SA106-50
of the Code of the Town of Southold, strict compliance with the
subdivision regulations to the extent feasible.

I received a telephone inquiry today from a gentleman
named Frank Reed of the firm Milbank, Tweed, Hadley and
McCloy of 1 Chase ManhattanPlaza, New York 10005.
This property was formerly owned by Winifred Clark and
others. It is now owned according to the assessors' records
by B. R. Smith and others and comprises 11.3 acres. I have
enclosed a map showing where I think the property is. He
has made "casual" sales over the years and now the Smith
outfit is contemplating selling 1,9 acres off on the road.
I didn't know what to tell the man so thought I would
send you off a map and put it on the agenda for discussion
at the meeting of the 15th.
