SCTM # 1000-9-2-8.1 (Formerly 1000-9-2.6 &2.8) Zone: R-40 Dear Ms. Moore: The following resolution was adopted by the Southold Town Planning Board at a meeting held on Monday, July 14, 2003: The final public hearing was closed. The following resolution was adopted: WHEREAS, this proposed site plan, to be known and designated as site plan for the Island Health Project, Inc., is to change the parking configuration, change the access and egress onto the site, and modify the layout of the existing structure to improve handicap access; and WHEREAS, the Island Health Project, Inc. is the owner of the property known and described as the Island Health Project, Inc., Fishers Island, SCTM #1000-9-2- 8.1(formerly 1000-9 —2-6 & 2 .8, which have are now merged as determined by the Building Department); and WHEREAS, a formal application for approval of this site plan was submitted on March 25, 2003; and WHEREAS, the Southold Town Planning Board makes a determination that the proposed is a Type II Action and is not subject to review pursuant to 6 NYCRR Part 617.5; and • Island Health Project Site Plan — Page Two — 7/15/03 WHEREAS, a final public hearing was closed on said application at Town Hall, Southold, New York on July 14, 2003; and WHEREAS, this site plan, dated February 21, 2003, and last revised March 27, 2003, was certified by the Building Inspector on July 7, 2003; and WHEREAS, the Town Engineer has reviewed the drainage calculations and the Planning Board has accepted his recommendation for approval; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold have been met; be it therefore RESOLVED that the Southold Town Planning Board grant final approval on the surveys, dated February 21, 2003 and last revised on March 27, 2003, and authorize the Chairman to endorse the final surveys subject to a one year review from the date of the building permit. Enclosed please find two copies of the approved site plan, one for your records, and one to be submitted to the Building Department when you apply for your Building Permit. As you may recall, this office represents Windham Resources, LLC, and members of the Anthoine Family, owners of the property immediately adjacent to the IIP property. My clients and I have serious concerns and reservations with regard to this project, which we wish to have finally addressed and resolved as this matter has been before your for some two and a half years. In the first place, my office has previously communicated with you regarding the so- called "subdivision" of the still legally undivided SCTM lot# 1000-9-2-6. 1 have provided your Board with several letters, dated July 16, 2001 and September 10, 2001, copies of which are enclosed herewith. Once again, for the record, we do not believe that the lots identified as 6.1 and 6.2 enjoy legal status as separate lots. I am frankly not certain that any"self-help"merger of the lots is valid, absent some sort of official division of the original lot. As of the date hereof, we are aware of no such official determination of any agency of the Town of Southold recognizing the validity of any such subdivision. Of even greater concern is the fact that no one seems at all willing to acknowledge the fact that the IHP Project is a change in the underlying use of this property, and constitutes an illegal use of the property. The IHP property has in the past always existed as a Doctor's home with a"home professional office" use therein. However, as of January 24, 2002 or thereabouts, (as brought to the Town's attention in my Notice of Claim of February 8, 2002) there has been no residential use of the property, thus the proposal before you no longer even maintains the Page Two Mr. Bennett Ozlewski and Southold Planning Board 14 April 2003 fiction of any residential use of the property, which is the "sine qua non", or the basis, for the home professional office use. The change of use absent a trip to either the Zoning Board for a use variance or to the Town Board for a zone change, constitutes an illegal change of use. The instant attempt to legitimize the expansion of the illegal change of use amounts to no more than"bootstrapping", based on an illegal action. As it is said in numerous cases, an illegal permit vests no rights in contravention of the zoning ordinance. (Reichanbach v. Windward at Southampton, Parkview Assoc. v. City of New York) Given all of the foregoing, I respectfully submit to the Board that it cannot and should not take any action with regard to this matter until such time as the underlying use is clarified. Application for Lot Line Modification Dear Board Members: This office represents Windham Resources,LLC, as owner of property located on Athol Crescent, Fishers Island,New York(SCTM# 1000-9-2-7 and 1000-9-2-p/o 6), and Nina W. Leth, Robert and Edith Anthoine, and Nelson Anthoine, as principals of Windham Resources. This letter is submitted in opposition to the application of Island Health Project, Inc., for a lot line modification which would have the effect of merging Fishers Island lots identified as 1000-9-2-8 and 1000-9-2-6.2 on the Suffolk County Tax Map. Please include the letter in the record of public hearing on the application. As you may know, Island Health Project, a New York not-for-profit corporation, plans to construct, own and manage a so-called"medical clinic"on the subject lots. This application appears to be precedent to a revival of an application to the Zoning Board of Appeals to legalize the proposed use. Initially, I must register my objection to your opening of this hearing and respectfully submit that you have no jurisdiction to hold it. The reason for this is very simple—not all of the owners of one of the lots have joined in the application, and without these necessary parties, you have no legal authority to consider it. My clients, who have not and will not join in the application, are part owners of the lot putatively identified as 1000-9-2-6.2 on the Suffolk County Tax Map. Despite the notation, this lot does not legally exist. As shown below, the land given this tax map number is in fact part of undivided lot No. 1000-9-2-6. The notice of public hearing on this application, a copy of which is attached hereto as Exhibit A, fails to list my clients as owners of one of the subject lots. A bit of history is in order. Prior to 1978, Fishers Island Utility Company, Inc. owned property fronting on Oriental Avenue and adjacent to two lots, one owned by a predecessor in interest of Windham Resources and the other by Fishers Island Civic Association("FICA"). This property, of approximately .64 acre, was identified as No. 1000-9-2-6 on the Suffolk County Tax Map. During 1978, the utility proposed to sell to each of the two adjacent property owners that portion of its lot that abutted their respective properties. Both agreed to the proposal. Subsequently, the utility transferred, for nominal consideration and without benefit of prior subdivision, the respective portions of its lot to Windham Resources' predecessor in title and Island Health Project, which was mistakenly thought to be the owner of the property in fact owned by FICA. The transfers are reflected in deeds recorded with the Suffolk County Clerk during 1978, copies of which are attached hereto as Exhibit B. You will note that the tax map number referred to on the left side of both deeds is 1000-9-2-6, but the legal descriptions of the property transferred differ. For reasons unknown to me,the Suffolk County Tax Map, at some point subsequent to the transfers, began to carry the property as two discrete lots with different tax map numbers, i.e. 1000-9-2-6.1 and 1000-9-2-6.2. However, because the utility did not subdivide the property prior to selling it,the legally correct notation continues to be 1000-9-2-6. One can only surmise the reason the utility failed to subdivide, but it is clear that a subdivision would have necessitated a variance in that the lot, even prior to subdivision, did not meet the minimum requirements for lot size in a residential district in effect at the time of transfer. No such variance has ever been granted and the property remains undivided. Thus, it is currently owned by my clients and Island Health Project as tenants in common. In Fullam v. Kronman. 31 A.D. 2d 947, 298 N.Y.S.2d 865 (1969),an Appellate Division, Second Department case, the court was asked to consider whether a subdivision sponsor was required to join in a petition to the Village of Lattingtown Planning Board to partition a lot that was physically separated from a larger area of land owned by the subdivider. The application was submitted solely by the contract vendee of a portion of the lot proposed to be partitioned. In holding that the sponsor, who also owned the lot that was the subject of the application, was an indispensable party to the application, the court said: The owner and subdivider did not join in the petition or appear at the public hearing; nor was any authority from the owner alleged or proved by petitioner; hence, no jurisdiction could be exercised over it by the Planning Board. The regulations of the Planning Board ... provide that `no person, firm or corporation, proposing to make or have made a subdivision ... shall proceed with any development ... until he or she has obtained from the Planning Board ...approval of the proposed subdivision or development pursuant to the procedure outlined in the regulations. (citation omitted). Moreover, the regulations provided that the application for approval of a subdivision shall be made by the owner or his authorized agent. (Emphasis supplied). 298 N.Y.S.2d 865, 866-867. The Zoning Code of the Town of Southold, which, together with the Town Law of the State of New York, regulates subdivisions and authorizes the Planning Board of the Town of Southold to promulgate rules and regulations for subdivisions, defines "Application for Development" in Section 100-13 as follows: The application form and all accompanying documents and exhibits required of an applicant by an approving authority for development and/or site plan review purposes. (Emphasis supplied). Section 100-13 goes onto define "Applicant"thus: The landowner or agent, optionee, contract purchaser or other person authorized in writing to act for the landowner in submitting an application under this chapter. (Emphasis supplied). As noted above, my clients, as co-owners of lot No. 1000-9-2-6, have not joined in the instant application, have authorized no one to act for them in pursuing the application, and appear at this hearing for the limited purpose of objecting to the application on procedural and, alternatively, substantive, grounds. Accordingly, because not all the owners have joined in the application and the Southold Zoning Code requires "the landowner"to be the applicant, under the authority of F. ul]ant the Planning Board lacks jurisdiction to consider the application. Beyond the jurisdictional defect in the application, my clients object to Island Health Project's plans for the property. The lots, even if combined, are too small for the intended "medical clinic," which is a prohibited use in the zone. Although, for the reason outlined above, they believe the proposal should get no further than this evening's hearing,they will contest vigorously any revival of Island Health Project's Zoning Board of Appeals application to legalize the proposed use, should the project get that far. Moreover, Island Health Project is not authorized to conduct a medical clinic. It does not and cannot have the necessary approvals from the State Department of Health, cannot meet the requirements of the Public Health Council and the Certificate of Need process to operate such a facility, and, perhaps most importantly, is specifically prohibited from providing hospital or health related services(as defined in Article 28 of the Public Health Law) in the Department of Health's endorsement annexed to its certificate of incorporation (A copy of such certificate, with DOH endorsement, is attached hereto as Exhibit B.) My clients have pointed this out in a complaint filed on or about May 1, 2001, with the Charities Bureau of the New York State Attorney General's Office. In the complaint, my clients have also charged that FICA's recent transfer of lot# 1000-9-2-8 to Island Health Project to facilitate the proposed lot line modification is void as a matter of law. It appears that Section 100-24 controls whether Lots 6.1 and 6.2 are single and separate parcels. Subsections (A) (2), (3), and (4) are irrelevant here since, to the best of my knowledge, there has been no prior Town Board, Planning Board or Zoning Board of Appeals action concerning Lot 6. If the Board were to approve this application, it would be according legal rights to an illegal subdivision. The precedential value of such an action might very well have wide and negative implications for the town as a whole by encouraging owners of other illegal subdivisions to submit similar applications! Because of the foregoing and Section 100-II(B) of the Town Code, which addresses conflicts between the code and any rules and regulations promulgated thereunder, Ms. Moore's discussion of the Planning Board rules and regulations, current and historic, is irrelevant. My clients and I have serious concerns and reservations with regard to this project, which we wish to have finally addressed and resolved as this matter has been before your for some two and a half years. In the first place, my office has previously communicated with you regarding the so- called "subdivision"of the still legally undivided SCTM lot# 1000-9-2-6. 1 have provided your Board with several letters, dated July 16, 2001 and September 10, 2001, copies of which are enclosed herewith. Once again,for the record, we do not believe that the lots identified as 6.1 and 6.2 enjoy legal status as separate lots. I am frankly not certain that any"self-help" merger of the lots is valid, absent some sort of official division of the original lot. Prior to 1978,Fishers Island Utility Company, Inc. owned property fronting on Oriental Avenue and adjacent to two lots,one owned by a predecessor in interest of Windham Resources and the other by Fishers Island Civic Association("FICA"). This property, of approximately .64 acre, was identified as No. 1000-9-2.6 on the Suffolk County Teat Map. During 1978,the utility proposed to sell to each of the two adjacent property owners that portion of its lot that abutted their respective properties. Both agreed to the proposal. Subsequently, the utility transferred for nominal consideration and without benefit of prior subdivision, the respective portions of its lot to 'Windham Resources'predecessor in title and Island Health Project, which was mistakenly thought to be the owner of the property in fact owned by FICA. The transfers are reflected in deeds recorded with the Suffolk County Clerk during 1978, copies of which are attached hereto as Exhibit B. You will note that the tax map number re&Tred to on the left side of both deeds is 1000-9-2-6,but the legal descriptions of the property transferred differ. For reasons unknown to roe, the Suffolk County Tax Map, at some point subsequent to the transfers, began to carry the property as two discrete lots with different tax map numbers, i.e. 1000-9-2-6.1 and I000-9-2-6.2. However, because the utility did not subdivide the property prior to selling it,the legally correct notation continues to be 1000-9-2-6. One can only surmise the reason the utility failed to subdivide, but it is clear that a subdivision would have necessitated a variance in that the lot, even prior to subdivision, did not meet the minimum requirements for lot size in a residential district in effect at the time of transfer.No such variance has ever been granted and the property remains undivided. Thus, it is currently owned by my clients and Island Health Project as tenants in common- In Fullam v Kronman. 31 A.D. 2d 947, 298 N.Y.S.2d 865 (1969),an Appellate Division, Second Department case, the court was asked to consider whether a subdivision sponsor was required to join in a petition to the Village of Lattingtown Planning Board to partition a lot that was physically separated from a larger area of land owned by the subdivider. The application was submitted solely by the contract vendee of a portion of the lot proposed to be partitioned. In holding that the sponsor, who also owned the lot that was the subject of the application, was an indispensable party to the application,the court said: The owner and subdivider did not join in the petition or appear at the public bearing; nor was any authority from the owner alleged or proved by petitioner; hence, no jurisdiction could be exercised over it by the Planning Board. By virtue of Section 100-24(B), I respectfully submit you are enjoined from considering the instant lot line modification application. At minimum prior to your considering this application, another application would have to be filed with you to have Lot 6 recognized as two separate parcels as provided in the 1978 deeds. However, Windham Resources would be a necessary party to that application, and I advise you it will not participate. Beyond the law is a policy issue that I believe the Board must seriously consider. If the Board were to approve this application, it would be according legal rights to an illegal subdivision. The precedential value of such an action might very well have wide and negative implications for the town as a whole by encouraging owners of other illegal subdivisions to submit similar applicationsl Because of the foregoing and Section 100-11(B) of the Town Code, which addresses conflicts between the code and any rules and regulations promulgated thereunder, Ms. Moore's discussion of the Planning Board rules and regulations, current and historic, is irrelevant. Moreover, my office has been advised by the Southold Town Attorney that the so-called rules and regulations were never committed to writing and that the Zoning Code now controls all issues that prior Planning Board practice may have covered. The drainage calculations meet the minimum requirements of Town Code. 2. The Plan indicates that the existing sidewalk on Crescent Avenue will not be replaced. This sidewalk has been worked on in recent years and is considered reasonably stable. However, due to the amount of construction and the potential for damage, it should be noted that this project should include new curbing and sidewalks. I have reviewed this item with the Highway Superintendent and he has agreed that new sidewalk should be required beginning at the new entry steps and extending to the intersection of Oriental Avenue. 3. The Highway Superintendent has also requested New Sidewalk and Curbing along the southwesterly side of the site. Due to the proximity of the Post Office, it has been determined that the extension of the sidewalk around the corner and along the property line would be a public benefit.
