DESCRIPTION OF ACTICN The minor subdivision of Fishers Island Utility Company located on Fishers Island, New York: The project has keen determined not tc have a significant effect on the environment fcl the following reasons: An environmental assessment has been submitted which indicated that Dc significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because theze has keen nc ~esponse in the allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. Applicant should be aware that a permit may be required because of the proximity to the wetlands. The Suffolk County Department of Health Services has indicated its agreement with the lead agency designation. It has reviewed the project and finds that there may be a problem with getting potable water due to nitrate con- tamination in the area. Dear Mr. Raynor: The Suffolk County Planning Commission at its regular meeting on August 5, 1981, reviewed the proposed subdivision plat entitled, "Minor Subdivision - Fisher's Island Utility Co., Inc.", referred to it pursuant to Section 1333 of the Suffolk County Charter. After due study and deliberation it resolved to approve said map subject to eight conditions that are deemed necessary for the following two reasons: 1. To help preserve the natural and aesthetic attributes of West Harbor and also the nearby pond to the west of the proposed subdivision. 2e To alert prospective owners of lots within the subdivision that they are in close proximity to Elizabeth Field Airport and may be subjected to noise resulting from airport activities and aircraft movements and also to help avoid pressures from these future residents to close the airport or to curtail its activities because of noise emanating from the facility. Conditions: Lot 1, Section 2, which is indicated on the map as proposed for conveyance to Fisher's Island Electric Corp., when transferred to the adjoining owner as proposed shall be incorporated into the adjoining owner's parcel so that it will not exist as a separate parcel. 2. S/ly side of Madeline Avenue 223'± w/of Central Avenue, Fishers Island, N.Y. Dear Mr. Raynor: The staff has examined the current referral of the proposed subdivison known as "Minor Subdivision - Fishers Island Utility Co., Inc.", and is of the opinion that the referral is incomplete. When the Commission considered the proposed subdivision at its last regular meeting, May 6, 1981, it raised the question of the tract's zoning. Although the map indicates that the tract is located in two zoning districts it is not clear what those districts are and their extent. The Commission requires specific infor- mation as to the zoning of the tract rather than notes that state: "Residential District" and "Commercial District". These statements are not specific as to which residential and which commercial district the tract is located in. The staff has also noticed that Lot 1 and Lot 2 are now indicated as part of Section 1. There is no lot number or lot area for the parcel that is labeled Section 2. The staff does not see the rationale of cutting up what is a minor sub- division and is sure the Commission will raise questions about this aspect of the proposed subdivision. It is suggested that the applicant have his surveyor provide a new map clari- fying the zoning boundaries, lot numbers, and lot area. If the map is to be created in sections then this should be clarified also. Very truly yours, Lee E. Koppelman Director of Planning File No. 1333-D-81-18 CGL:jk Charles G.
